4:32 am
of hours, sun officially rises just before that happens, typically when we'll finds the worse of the fog. so it is bad timing because it comes right in line with typical morning rush, as well. but you are under a mile in lancaster, already down to one and a half mile visibility in trenton. currently though at 63 degrees, really mild. to start things offer here at the airport, 58 mount pocono, isn't bad either. as the day progresses check it out. 84 degrees the expected high in philly, well above the seasonable average, obviously, and with the full sunshine across the board here today. might as well be summer. i know meisha you've been battling whether to put the shorts away, put them away. i hope you kept them out. >> they're all in my room, the shorts, the sweat pants, the jackets. but i won't complain, katie. outside, we switch gears, waking up, good morning, happy tuesday. up at the desk moments ago talking about over night fatal crash tractor-trailer and

4:34 am
speak with homicide detectives, likely recounting how previous fight with another group of men may have led to this man cornering their friend, opening fire, and leaving him for dead on that kensington street. let's get you now video from that scene there overnight. twenty-four district officers got several calls of shooting close to 11:30 last night. the scene, the 700 block of east allegheny avenue, that's where they found a man police say age 30, lying on the ground, with two gunshots, one to the upper back, one to the back of his head. he was unconscious. so police got him, themselves, to temple university hospital. he did die there a short time later on what should have been a day of celebration. >> what makes this case even more tragic is this 30 year old victim today was his 30th birthday. so this individual got shot and killed on his 30th birthday. >> we also do know surveillance cameras in the
4:35 am
area caught the entire crime in progress, detective have seen it, and could release portions of that video. we also know police are looking for a shooter, a man wearing no shirt, last seen wearing blue cut off short. live here outside the round house, justin finch, cbs-3, "eyewitness news", brooke, jim, into you. >> thanks, justin. >> developing now, crime scene tape surroundings burned out car in west philadelphia. police and firefighters rushed to the 5400 block of media street, just before 2:00 this morning. while there is no official cause yet, the fire marshall believes it may have started in the engine. >> that fire is getting a extra hard look by police because they are still searching for a suspect in a string of car arsons, not far away in overbrook. surveillance video caused -- caught someone starting a fire at 56th and mascher. flames were so fierce, it damaged a maserati park nearby. here's the owner of the car telling "eyewitness news" how he found out about what happened. >> i was asleep. and somebody was banking on my

4:37 am
pennsylvania, and to grow income. but, again, the senator is the only person in the united state of america who has not leveled with his constituent on the simple question: are you voting for donald trump. but what i think is objectionable, is that senator toomey has refused to answer this question. won't tell the voters that he's still, why he is still standing with donald trump. now, we will hear the senator say he has disagreements with donald trump. >> i've been very public about my many disagreements with donald trump. i have been willing to criticize him, because i think he is a badly flawed candidate. on the other handy also know if he were president woe probably sign legislation that would be constructive, like repealing of obama care and restoring sanctions on iran. what i can't believe is katie mcginty can't criticize anything about hillary clinton including all her lies. >> toomey said at some point before the election he will probably reveal whether he will vote for trump. mcginty and toomey both bee nouns trump claims the

4:40 am
deploy more agent in foreign countries. the fbi says in the end, no favors exchanged hands, and the classification level stayed as is. >> when you have an fbi themselves say that he was in a quid pro quo discussion with the under secretary of management at the state department, that should scare everybody. >> really assertion that this was somehow tid for tat, quid pro quo, in that manner, insulting. >> fbi document included an interview with a diplomatic security agent at the state department. he said clinton, quote, frequently and blatently disregarded security protocols, start contract from her predecessor condoleezza rice. >> nominees will face-off one more time before voters head to the polls, the final presidential debate is tomorrow night starts at 9:00 right here on cbs-3. and much more to cover this morning on cbs-3 "eyewitness news". so, what does this look like
