lawsuit now alleged is a racketeering entries, headed by labor leader john dougherty, and tonight he is talking only to cbs-3. good evening, i'm ukee washington. i'm nicole brewer. jessica dean is off tonight. man who filed the lawsuit got in the altercation with dougherty in january, and punches were thrown. >> he talked exclusively with our joe holden who joins us now outside the federal building in center city, joe, good evening. >> reporter: good evening to you, guys. in this federal lawsuit it is alleged john dougherty engaged in a pattern of racketeering allegedly intimidating and threatening, harassing non-union workers. the man who filed the lawsuit, says he was interviewed by fbi immediately, after philadelphia d.a. seth williams declined to prosecute the case instead referring it to the pennsylvania attorney general. >> dougherty was who bleep are you i'm here working. >> reporter: joshua keyscy takes us back to january when he got in the violent tank

with the labor leader john dougherty. parts of the exchanged were captured on video. details are contained in his federal racketeering lawsuit begins dougherty, ibew local 98 and three union employees. suit claims that dougherty and others intimidated, harassed and assaulted non-union workers. >> he was like who do you think you are. you want to fight or something. >> reporter: he is a non-union electrician and says january 21st threats escalated. he claims dougherty showed up at third and reid where he was working and started hurling racial remarks. >> he is hike this is my neighborhood and i don't want you working in it. >> reporter: dougherty then threw two punches breaking his nose. >> two clean really shots, after that, we were in brawl mode. he had wing tipped shoes on so i knew where he was. he was hain pit bull in the fight. >> reporter: his attorney cliff haines. >> is what john dougherty doing on the street, messing with a non-union electrician.

>> reporter: i sat down with haines today, he told me that philadelphia police had a strong case of aggravated assault against dougherty but decision to prosecute rested with philadelphia d.a. seth williams who instead, sent the case to the attorney general. >> i don't know why seth williams booted this to the attorney general, it is a city street crime. >> reporter: in an interview with ukee washing on just last month john dougherty says he is complete opposite of what is alleged in this lawsuit. >> i don't believe i'm a bully. i am effective. >> now a spokesmen for john dougherty and ibew says they have not seen a lawsuit and added that all you have to need to know about this is that the press saw it first, he also added just an hour ago they still had not yet been served. now within the last 15 minutes, we received a statement from d.a. seth williams. he said that the case was referred because of a long standing professional relationship between himself and john dougherty, and he also added that john dougherty

contributed to his campaign. meanwhile pennsylvania attorney general's office has convened a grand jury looking into that january street fight and interview in our story tells us he has already testified before that grand jury. in center city, joe holden for cbs-3 "eyewitness news". thanks, joe. in other news a philadelphia police officer has died in the line of duty. authority say 41 year-old douglass bamburger suffered an apparent heart attack working at the criminal justice sent they're morning. the police commissioner and mayor rushed to the officer's side at hand hand hospital where he later died. officer bamburger was a 16 year veteran of the force and survived by a wife and two children. well, last week someone vandalized a camden field used by a youth football team. tonight police say they have a suspect in custody. "eyewitness news" reporter alexandria hoff is in camden with how police caught up with alleged vandal, alex. >> reporter: ukee, this crew behind me they know a thing about stats but they were not ready for hit they took last

week. they had to redue their field, repaint their field house and now an arrest has been made. the camden raiders are coming off of a pretty successful weekend of match ups, games that had to be played, away, when their field is not yet safe enough to play on. >> the way they played this weekend, we had a couple losses but they played with more heart then i have seen him play before. >> reporter: rob kelly is head coach of the raiders, first year football program includes 80 kid who struggled to understand why two sundays ago someone would purposely ruin their field by tearing it up with their trucks before painting a swastika on their field house. that someone is now behind bars. >> he has a excess i have permanent history, so working on impulse we are not sure at this time but he said he didn't know why he did it. >> reporter: surveillance video media coverage and tips lid police to 28 year-old alexander peters of the gloucester city. he was in county prison after being sentenced friday for three years fun earlier

temperature right now, still well above normal. 79 degrees right now in philadelphia. seventy-nine in allentown. seventy-seven in wilmington. we fell 1 degree shy of breaking a record in the city today. our high was 84. record was 85. record have been broken in allentown, trenton, wilmington. record of 85 was tied in reading. the those are two warm spots. allentown and reading, late october, 85 degrees, that is almost unheard of 20 full degrees above average and we have a few more record for the next few days. tomorrow's record is 80. thursday's record is also 80. tomorrow has a better shot of breaking it, thursday we will fall short but it will be close. we have got still warm air in place for thursday but tomorrow we are looking at mid 80's, we will easily, break that record but all things must come to an end, for us, a front sweeps through friday, heading in the weekend. you can see cool breeze from the north and west. the highs only in the 50's and 60's with lows in the the 30's and 40's. with the wind it may not feel much better then 40's
