campaign 2016, fbi is reviewing its investigation into hillary clinton's use of the private e-mail server while she was secretary of state. democratic nominee was in iowa at this hour. today fbi director announced the agency's found e-mails in the separate investigation into disgraced congressman anthony weiner that may be related to the clinton investigation. weiner was married to but separated from top clinton aid huma aberdeen. clinton has denied any wrongdoing. donald trump is praising the fbi's move. republican nominee rallied supporters in maine this afternoon. >> i have great respect for the fbi for righting this wrong. the american people, fully understand her corruption and we hope, all, all adjust advertise will finally be served. >> trump and many republicans have been calling for the fbi to take another look at clinton's handling of the classified materials after the fbi announced this

with the hump back whale was found in rope and the animal is about 20 to 25 feet long and believed to be a young whale. experts aren't sure if the whale swam and died when it we came tangled or struck by a large ship and then push in the the port. the state of of new jersey is facing a civil rights lawsuit from a native american tribe. group is fighting for tribal recognition and will soon have their day to argue the matter. "eyewitness news" reporter cleve bryan has that story. >> i didn't know how easy, it was for them to shut us down. >> reporter: lenape indian chief mark gold says light of justice is peeking through clouds of bias. for last few years his people have been fighting new jersey's attorney general's office for allegedly stripping them of recognition that the tribe gained in 1982. he said it cost his people federal grants, college scholarships and devalued their art. >> we were moving for, moving for, moving forward. we have had quite a few

people. then all of a sudden because of the issue of the casino they turned against us. >> reporter: lenape are suing state saying officials took way tribe recognition because of the racist notion that native americans want to build casino. a federal judge said the case has merit. in a 42 page decision she denied state's motion to dismiss discrimination lawsuit saying simply put as alleged by plaintiff one day they were a state recognized tribe and have been for decade and next day with the swipe of the pen and absence of due process they were not. >> you took my recognition away. you humled people that shouldn't be anymore. they have worked hard to be where they are at. >> reporter: while lenape can enjoy this judge's decision they say legal battle will is far from over. they won't stop their quest for state recognition until all have of their rights are restored. >> my prayer here was to be hurt and now it is up to us to preserve our case. >> reporter: for their part

attorney general's office says they are reviewing the judge's decision this week, they don't give a reason for no longer recognizing the tribe other than saying they don't have to. trial could begin in the next few months. in bridgeton cleve bryan, cbs-3 "eyewitness news". last week a good samaritan was shot multiple times when he stepped into stop a robbery in center city's rittenhouse square. tonight in an "eyewitness news" exclusive that good samaritan is talking with me about that night. rittenhouse square is a special community, for a man selling water and snacks. he says when he saw a group of young men including a man with the gun approaching people on october 18th he knew he had to act. at that moment you are like not me. >> no, not anyone out here. i can't imagine my self letting them, who you are not built for this at all. why would i let you take everyone out here which is 30 to 50 people and turning face forward and get through our pockets and do as you will. >> tonight "eyewitness news"
