>> ♪ >> live from the cbs broadcast center in philadelphia, this is cbs3 "eyewitness news". >> well, rail riders could be in for a nightmare. no resolution between septa and its unionized workers. i'm natasha brown. thanks for joining us. commuters are concerned about a he potential strike by septa bus and trolley workers. alexandria hoff is live in center city tonight. she's got the very latest on where things stand right now.

alex. >> reporter: natasha, september and union heads have been in talks all afternoon here at the sheraton but with no resolution that now puts the possibility of a strike one day closer. septa and the transport workers union local 234 have until midnight monday to settle on a contract. if not, the union has agreed to strike. and picket signs for 5700 workers have been prepared. >> we move the city. we move the city. >> reporter: it's a strike -- if a strike does occur regional rail train service will be only option to get in and around philadelphia a harsh blow to tens of thousands of customers. >> i use septa every single day. >> i use it traveling to see my grandchildren. >> i use buses trolleys: in >> it would have to be uber lyft get a ride.

campaign 2016 and the presidential candidates are back out there on the campaign trail and both are now talking about the new fbi probe into newly uncovered e-mails related to hillary clinton. cbs news correspondent brook silva-braga has the latest tonight from both candidates. >> ♪ >> reporter: hillary clinton's campaign called fbi director james comey's letter to congress long on innuendo and short on facts. comey wrote that new e-mails have been foundry late to do clinton's use of a private e-mail server but couldn't say if they were significant. >> it's pretty strange to put something like that out with such little information right before an election. >> we've called on director comey to explain everything right away, put it all out on the table. >> reporter: cbs news has learned more than a thousand e-mails, some work related were found in a laptop belonging to huma abedin in her estranged husband anthony weiner while he was being

investigated for allegedly sending sexually explicit messages to a minor. sources tell cbs news attorney general loretta lynch disagreed with comey's decision to notify congress about the e-mails so close to election day. >> that's because the department of justice is trying their hardest to protect the criminal activity of hillary clinton. >> reporter: an associated press poll taken before the fbi's announcement found most likely voters think clinton broke the law with her use of a private server. >> you're an undecided voter from colorado. >> yes. >> reporter: does this affect how you lean at all? >> a little bit. i think i'm leaning towards trump. >> at this point there's nothing they could do to turn off the people that support them which is crazy if you think about it. >> reporter: early voting is already under way in dozens of states and more than 20 million votes have already been cast. brook silva-braga for cbs news new york. >> authorities investigating a police involved shooting in haddon township new jersey

that happened at route 130 and route 168 this morning. investigator say a township police officer struggled with the driver of a car after they say he sped away from a traffic stop. the officer shot the driver in the lower body during the struggle. he was not seriously wounded and the officer was not injured. and authorities in bucks county charge three teens in the shooting death of a former penn ridge high school football player. investigators say isaiah louis was gunned down during a robbery at colt memorial park in perkasie. the shooting happened about 12:30 this morning. louis was a 2015 penn ridge graduate. opening week for the 76ers has been overshadowed by a national anthem controversy. "eyewitness news" reporter trang do was at today's game in south philadelphia where she talked to fans. >> reporter: rumors of an anthem protest by philadelphia 76ers players proved to be unfounded. the national anthem during saturday afternoon's game

against the atlanta hawks went off without a hitch. >> ♪ >> reporter: sixers management faced an anthem controversy earlier this week during wednesday's season opener against the oklahoma thunder. r and b recording artist sevyn streeter took to social media to explain that the team pulled her performance at the last minute. >> i'm at the 76ers game to sing the national anthem and the organization is telling me that i can't because i'm wearing a he we matters jersey. >> reporter: the organization at first issued a vague statement in response but after speaking with players apologized to the singer in a statement friday. it reads in part "we believe that the wrong decision was made and sevyn should have been welcome to sing. we apologize to her and in an effort to move the conversation forward, we have reached out to offer her an opportunity return and perform at a game of her choice ." most fans we spoke to at the hawks game say streeter should have been allowed to perform. >> freedom of speech. you goat say what you want to say and you shouldn't be punished for having an opinion on something regardless of

what it is. >> i'm wearing a 76ers jersey because i'm supporting my team. she was kind of supporting herself and her people and all of us. >> reporter: season ticket holder robert tyson said he agreed with her message but it was the wrong venue. >> it does draw a distraction to the game itself but i think the message behind it is important. i think it just should be told a different way. >> reporter: streeter has not yet responded to their sixers or made any comments on social media about the offer to come back. from the wells fargo center i'm trang do, cbs3 "eyewitness news". >> today we learn miami marlins pitcher josé fernandez had cocaine in his system before his deadly boat crash last month. that is coming from the miami dade county medical examiners who also say that fernandez was legally drunk at the time of the accident. the star pitcher and two of his friends were killed after their private boat hit a jetty near miami beach. also, investigators say engine pieces from the american airlines plane that

caught fire friday at chicago's o'hare airport have been found thousands of feet away. a piece of the engine was found nearly 3,000 feet away and another was found about 1500 feet. investigators determine the fire on the runway was caused by engine failure. no word yet on what caused the engine to actually fail. meantime the investigation continues into a fed ex plane that caught fire while landing at a florida airport yesterday. fedex says the plane's only crew members were both pilots who escaped unharmed the pilots told authorities they believe the left landing gear collapsed on the runway. there were 46,000 pieces of mail on board but fed ex says none of it was actually damaged. date marks the fourth anniversary of superstorm sandy crashing into the jersey shore. on october 29th, 2012, the storm made landfall near atlantic city and it he slowly moved inland. sandy claimed 182 lives including 10 in new jersey and

two in pennsylvania. it also caused more than $71 billion in damage. thes devastated coastal communities. local residents are stepping in to help haitian victims still dealing with the devastating effects of hurricane matthew. tricks throughout the concert. everybody getting into the spirit. i think i saw superman and santa. >> i like the dinosaur. i only listen to music exclusively played by dine he no, sirs. >> nice day today. >> nice day, temperatures are still mild. this the last weekend of october and we're going to be even warmer as we head into the day so many and yes, a rarity in late october to have temperatures this late at night still in the 60's. 63 degrees right now. bit of a breeze out of the southwest up around 12 miles per hour. good looking scene as we get a live look at center city philadelphia. all is quiet but it was a chilly start to the day. seasonably appropriate down to 29 degrees in mount pocono. subfreezing in the lehigh valley. we awoke to 40 degrees in philadelphia but then as we went into the afternoon hours temperatures just soared. we eventually topped at 60 in mount pocono, up are 60's in

the lehigh valley, from 70's in berks county and close to 70 degrees in philadelphia. after that chilly start to the day definitely needed the layers today. and temperatures right now, though, not cooling too quickly. 58 degrees in allentown. we're still at 64 in reading. 65 degrees currently in ac and 63 in philadelphia and overnight tonight, temperatures very statement only falling back to 59 degrees. some patchy clouds around and then for the day tomorrow temperatures surpassing average by far. our average high temperature 62. we'll be at 75. some sunshine but then kind of clouding up for the second half of the day with a chance of late day showers and maybe a few thunderstorms for this moist air mass in place and we do welcome the rainfall at this point. the latest drought monitor issued showing parts of new jersey a moderate to even severe drought and parts of philadelphia county under moderate drought. he we are well below average for rainfall especially on the year. storm scan3 showing us quiet conditions precipitation-wise. do have some clouds in place especially along the i-95

corridor rolling their way eastbound. tomorrow the rain starts to move in. city timing i'm thinking five, 6, 7 o'clock, continuing into about 9 o'clock. isolated thunder possible. we do need that rainfall, o ever a half and a half inches in the deficit in philadelphia since the start of the year. future weather showing dry conditions, dry through midday and then showers and a few rumbles starting to break out poconos berks county lehigh valley as we head into the afternoon hours stretching its way east to the i-95 corridor so in the early evening hours. then stretching east into south jersey and eventually down the shore as we head into the second half of the evening. some showers and a few thunderstorms still lingering 9, 10 o'clock along the coast and then as we head into midnight rain diminishing for most of us across the delaware valley. as we head into monday morning dry conditions, clear conditions giving us a nice start to the work week and a nice halloween. don't have to worry about your costumes getting wet. sunshine all throughout the

day, clear skies as we head into the 7 o'clock hour al he bee it it will be a much cooler day, 58 degrees for the 3 o'clock hour. falling back to near 50 degrees by 7 o'clock. tomorrow 73 degrees with evening showers and storms developing on and off showers likely throughout the day in the poconos, a high temperature near 60 degrees and in your seven-day forecast, notice that big cooldown behind the cold front that generates those showers tomorrow. 59 on monday for our halloween. a very nice crisp but beautiful fall-like day with sunshine. tuesday marks the start of november and we're at 63 degrees. another little mini warmup in store wednesday and thursday, back up to near 70 degrees. and then eventually we cool down once again more seasonable by week's end. >> not very bad. >> yeah. >> i saw the boo-tiful. i like that play on words. >> it's not for the faint of heart. would you spend the night in dracula's creepy castle. >> no.

"eyewitness news" reporter alexandria hoff is live in center city with the very latest. alex. >> despite being in talks all afternoon long here at the sheraton no resolution puts us one day closer to a possible strike and you can see here these workers have already prepared their picketing signs. now if a deal is not reached by midnight monday night 57 workers have agreed to walk out. their dispute is over modified contract terms they believe hey will negatively impact employees wages pension and holiday work as well as down time between shifts. in the event of a strike regional rail will be the only option to get in and around the city. a harsh blow to tens of thousands of customers. but there is another national concern. this week city council asked that a possible strike be delayed until after the election and some riders fear what this could mean for voters trying to get to the

philadelphia international airport 64 degrees. temperature change over the last 24 hours pretty dramatic by these standards on the order of 15, 20, 25, even 28 degrees warmer than this time yesterday and forecast highs tomorrow are really going to cruise. 77 degrees the high temperature in atlantic city, getting near 80 in dover. we'll top out at 75 degrees in philadelphia and some upper 70's in wilmington so with these warm temperatures might be a good time to check out some of that fall foliage. lehigh valley berks county now at peek. in and around philadelphia, the i-95 corridor in south jersey those leaves just starting to turn over. parts of the pocono though past peak right now with that fall foliage but we'll return to more seasonable temperatures as we led into halloween and i'll have your trick-or-treat forecast coming up in just a couple minutes. natasha. >> all right lauren. just over a week until election day and the fbi's latest investigation of hillary clinton's e-mails is dominating the presidential campaign right now. the democratic nominee rallied supporters in daytona beach
