willful, deliberate, intentional and purposeful. >> early voting is already under way in dozens of states and more than 20 million votes have already been cast. voters head to the polls in just 10 days. stay with "eyewitness news" for complete coverage as we count down to election day. now the supreme court will consider what some are calling a landmark case for transgender rights. it involves a virginia high school student who was born female but identifies as male. cbs correspondent marlie hall reports. >> reporter: graph vin grim is the transgender high school student at the center of what is now a supreme court case. the high court will decide whether the female born 17-year-old can use the boy's restroom despite ob objections from the gloucester public school district in virginia. >> it's hugely significant. >> reporter: cbs news chief legal correspondent jan crawford says the court's

ruling could be used to resolve similar disputes across the country. >> for north carolina to texas, this decision could really set the law for how schools must treat transgender students. >> reporter: the obama administration says transgender students should be allowed to use restrooms and locker rooms consistent with their gender identities but more than a dozen states have issued ahold on that directive sparking protests and lawsuits. for the past two years, grim has been extremely vocal in the fight against his school. >> to me this is one way that -- that the school is saying we don't believe that who you are is legitimate. >> reporter: if if the ninth seat on the court isn't filled how will this affect the case. >> if they divide four to four then the lower court ruling would stand and that would mean that the student would win but it wouldn't set a nationwide precedent. >> reporter: the supreme court is expected to hear

argues in the case this winter. the ruling is expected until june. until then gavin grim will not be able to use the boy's bathroom. marlie hall for cbs3 "eyewitness news." >> three astronauts meantime are almost back home after 115 days aboard the interception nah in space station. the spacecraft is expected to come back to earth in about 20 minutes or so, a little more than three hours after undocking from the iss. the crews should just be beginning their descent back to the. 's atmosphere with a scheduled landing in kazakhstan at 11:59. thousands of rowers are on the schuylkill river this weekend. they're all part of the teams battling the out in one of the largest regattas in the nation. >> reporter: thousands gathered in philadelphia on a chilly saturday morning for the head of the schuylkill regatta an annual event held since 1971. >> i love the schuylkill, one of the best of the year, definitely the premiere rowing event in there fall. >> reporter: the regatta is one of the largest in the country with more than 8,500 competitors from more than two dozen states. >> i think it's exciting to have so many crews from like so many places, there's a florida crew here, i saw virginia. >> reporter: add dee had your witnesses joined penn state's crew team last year and said there's a lot of training involved. >> get up by 5:30 and leave by 6:00 and spend time on the morning every morning before classes even start. >> reporter: it's a different kind of sport and that's what drew chris smith of franklin and marshall in. >> just the team camaraderie of it. it's a sport where no one person can be the star. it's the team is the star. >> reporter: and that's something ryan gotberg of duke is learning. >> played soccer in high

the stone house and grounds that served as confederate general robert e lee's headquarters. the 4-acre property had been privately owned. there was a motel restaurant and shop but history buffs fought to bring it back to its original look. one that is honoring those who died in the civil war's bloodiest battle. >> totally different. i did make a visit here a couple months ago when they were remodeling it. and they had pretty much stripped it down to everything. this was a turning point in the civil war. from here our country got brought back together. >> well, plans called for the site to be turned over to the national park service. and two very brave individuals will come face to fang with the legend of track half the winners of a contest will get to spend halloween night inside the transylvania castle. teri okita went to romania to find out what tricks and treats are in store.

so, what a turn around from morning to afternoon and temperatures right now, though, we are not going to see that big cooldown tonight and into tomorrow morning. 63 in philly, 58 degrees one of our cool are spots in allentown, 64 in wildwood and 60 degrees in mount pocono. and all across the region temperatures are still very mild at this late hour. the coldest air bottled up in far northeastern new england. 70 in state college and same case 68 degrees right now in pittsburgh. overnight you can probably leave those windows opened, falling back to 59 degrees patchy clouds around. tomorrow some sunshine clouding up for the afternoon and temperatures soaring 75 degrees with some late day showers and even a few thunderstorms as a cold front moves across the delaware valley. storm scan3 showing us pretty quiet conditions precipitation-wise. mostly cloudy conditions will take us throughout the overnight period. by tomorrow we'll see those scattered showers develop but we'll be dry during the

daytime hours. you need to take the dog out, daytime is going to be good for that. as we head into the late afternoon and evening, city timing for showers to forms five to 9 p.m. we need this rainfallly our rainfall deficit over four and a half inches in philly. we start off with dry conditions tomorrow morning. there are the clouding up of the skies especially west of i-95 into the afternoon. showers start to break out into the lehigh valley and poconos and then move their way eastbound as a cold front traverses across the region. could see some heavier pockets of rain and then as we head into the evening hours that rain spreading east into south jersey. down the shore into the second half of the week some showers, some rumbles lingering along the coastline 9, 10 o'clock and then by midnight that rain clearing out of here and then as we head into the rest of the overnight tomorrow skies clearing out completely setting us up for a dry commute on monday morning and a dry halloween as well so yes, don't have to worry about

any foggy costumes. sunshine takes us throughout the day, clear skies into the 7 o'clock hour. although much cooler 58 degrees for the 3 o'clock hour, falling back to near 50 degrees by 7 o'clock and letting you prepare now it's going to be brutal but yes, daylight saving time is upon us, next sunday november 6th and our sunset time will be 4:52. yes, fall back so plan on that. enjoy these temperatures around the 6 o'clock hour because that's about to change and then for tomorrow enjoy the warmth, 73 degrees, sun and clouds down the shore, evening showers an few rumbles. showers kind of on and off through the day especially in the afternoon in the poconos but a mild day at 59 degrees and halloween is much cooler. 59 degrees but a beautiful fall day, nice and crisp, bootiful. tuesday 63 degrees to kick off the month of november. we're back in the 70's by wednesday and thursday. and then eventually cooling down once again as we head into the end of next week,
