the driver of a car after they say he sped away from a traffic stop. the officer shot the driver in the lower body during the struggle. he was not seriously wounded and the officer was not injured. and authorities in bucks county charge three teens in the shooting death of a former penn ridge high school football player. investigators say isaiah louis was gunned down during a robbery at colt memorial park in perkasie. the shooting happened about 12:30 this morning. louis was a 2015 penn ridge graduate. opening week for the 76ers has been overshadowed by a national anthem controversy. "eyewitness news" reporter trang do was at today's game in south philadelphia where she talked to fans. >> reporter: rumors of an anthem protest by philadelphia 76ers players proved to be unfounded. the national anthem during saturday afternoon's game against the atlanta hawks went off without a hitch. >> ♪ >> reporter: sixers

management faced an anthem controversy earlier this week during wednesday's season opener against the oklahoma thunder. r and b recording artist sevyn streeter took to social media to explain that the team pulled her performance at the last minute. >> i'm at the 76ers game to sing the national anthem and the organization is telling me that i can't because i'm wearing a he we matters jersey. >> reporter: the organization at first issued a vague statement in response but after speaking with players apologized to the singer in a statement friday. it reads in part "we believe that the wrong decision was made and sevyn should have been welcome to sing. we apologize to her and in an effort to move the conversation forward, we have reached out to offer her an opportunity return and perform at a game of her choice ." most fans we spoke to at the hawks game say streeter should have been allowed to perform. >> freedom of speech. you goat say what you want to say and you shouldn't be punished for having an opinion on something regardless of what it is. >> i'm wearing a 76ers jersey because i'm supporting my team. she was kind of supporting herself and her people and all

of us. >> reporter: season ticket holder robert tyson said he agreed with her message but it was the wrong venue. >> it does draw a distraction to the game itself but i think the message behind it is important. i think it just should be told a different way. >> reporter: streeter has not yet responded to their sixers or made any comments on social media about the offer to come back. from the wells fargo center i'm trang do, cbs3 "eyewitness news". >> today we learn miami marlins pitcher josé fernandez had cocaine in his system before his deadly boat crash last month. that is coming from the miami dade county medical examiners who also say that fernandez was legally drunk at the time of the accident. the star pitcher and two of his friends were killed after their private boat hit a jetty near miami beach. also, investigators say engine pieces from the american airlines plane that caught fire friday at chicago's o'hare airport have been found thousands of feet away. a piece of the engine was found nearly 3,000 feet away

and another was found about 1500 feet. investigators determine the fire on the runway was caused by engine failure. no word yet on what caused the engine to actually fail. meantime the investigation continues into a fed ex plane that caught fire while landing at a florida airport yesterday. fedex says the plane's only crew members were both pilots who escaped unharmed the pilots told authorities they believe the left landing gear collapsed on the runway. there were 46,000 pieces of mail on board but fed ex says none of it was actually damaged. date marks the fourth anniversary of superstorm sandy crashing into the jersey shore. on october 29th, 2012, the storm made landfall near atlantic city and it he slowly moved inland. sandy claimed 182 lives including 10 in new jersey and two in pennsylvania. it also caused more than $71 billion in damage. thes devastated coastal

communities. local residents are stepping in to help haitian victims still dealing with the devastating effects of hurricane matthew. though, not cooling too quickly. 58 degrees in allentown. we're still at 64 in reading. 65 degrees currently in ac and 63 in philadelphia and overnight tonight, temperatures very statement only falling back to 59 degrees. some patchy clouds around and then for the day tomorrow temperatures surpassing average by far. our average high temperature 62. we'll be at 75. some sunshine but then kind of clouding up for the second half of the day with a chance of late day showers and maybe a few thunderstorms for this moist air mass in place and we do welcome the rainfall at this point. the latest drought monitor issued showing parts of new jersey a moderate to even severe drought and parts of philadelphia county under moderate drought. he we are well below average for rainfall especially on the year. storm scan3 showing us quiet conditions precipitation-wise. do have some clouds in place especially along the i-95 corridor rolling their way eastbound. tomorrow the rain starts to move in. city timing i'm thinking five,

weekend as october winds down. meteorologist lauren casey is here now to tell us a little bit more about what we can expect when we wake up in the morning. hey, lauren. >> hey, natasha, yeah, it was a chilly start to our saturday but then temperatures rebounded incredibly into the afternoon hours. as we head into tonight we're not going to feel that chilly air. temperature still very mild at this late hour. in fact many of our current temperatures above our daily average high temperature for today. 64 degrees right now in reading, dover air force base falling in the low 60's and philadelphia international airport 64 degrees. temperature change over the last 24 hours pretty dramatic by these standards on the order of 15, 20, 25, even 28 degrees warmer than this time yesterday and forecast highs tomorrow are really going to cruise. 77 degrees the high temperature in atlantic city, getting near 80 in dover. we'll top out at 75 degrees in philadelphia and some upper 70's in wilmington so with these warm temperatures might be a good time to check out some of that fall foliage. lehigh valley berks county now

school student who was born female but identifies as male. cbs correspondent marlie hall reports. >> reporter: graph vin grim is the transgender high school student at the center of what is now a supreme court case. the high court will decide whether the female born 17-year-old can use the boy's restroom despite ob objections from the gloucester public school district in virginia. >> it's hugely significant. >> reporter: cbs news chief legal correspondent jan crawford says the court's ruling could be used to resolve similar disputes across the country. >> for north carolina to texas, this decision could really set the law for how schools must treat transgender students. >> reporter: the obama administration says transgender students should be allowed to use restrooms and locker rooms consistent with their gender identities but more than a dozen states have issued ahold on that directive sparking protests and lawsuits. for the past two years, grim has been extremely vocal in
