back to our developing story. a septa strike is looming and we are less than an hour from the midnight deadline. i'm yukee washington. >> i'm nicole brewer. greg argos is live in center city where talks are ongoing but time is running out. >> reporter: that's exactly right, nicole. negotiations are still happening like you mentioned. both sides at the table. in fact the assistant chairman for septa updated us just 15 minutes ago and he calls the talks, quote, very positive. right now there is no resolution. so that means that potentially in one hour the city's trolley system, the city's bus system, the city's subway system could come to a screeching halt. the strike is set for midnight. that is 59 minutes from now and septa officials say if that happens, like i mentioned all cities, buses trolleys and trains will return to their depots. talks are going well and sources say the union president could

suspend the clock and keep the system running if there continues to be forward motion in these negotiations. even so septa officials are urging riders to watch for an update about service interruption. we're posting them on our website. a spokesperson for the union says there are three major issues negotiators are trying to work out. >> i do hope that there is a fair agreement. but they do need to consider all the people that rely on their service. >> it's upsetting that now i'm faced with the option of getting fired from work, walking two and a half hours or spending $40 on an uber. it's rld. >> and that was greg argos reporting. just to recap, if septa workers decide to strike the following will stop operating. city bus routes, the market

frank furt line, city trolleys. some septa service will continue running that includes regional rail, the norristown high speed lines, lucy and cct connect. we will bring you any developments that may happen between now and then and of course get the very latest before you head out the door tomorrow starting at 4:30 a.m. >> the midnight hour is also being watched by commuters in the garden state. this is a live picture from the wawa convenience store. folks are beginning to line up and fill their tanks up because in less than an hour gas there will go up $0.23 a gallon. that's the amount of the new gas tax. and once again we saw plenty of people filling up their tanks tonight. the extra moinl will go towards the transportation trust fund aimed at fixing crumbling roads and bridges. prosecutors now say a man accused of fathering two children with a 14-year-old girl gifted to him by her parents

also sexually assaulted five other girls in that family. new charges today were filed. he's accused of assaulting a total of six victims all sisters over the course of eight years. in june investigators discovered 11 young children living in the basement of kaplan's house. >> mr. kaplan has represented himself to these girls as a cult-like figure, as a prophet from god. but now it is time for mr. kaplan to be held accountable under the laws of mankind. >> kaplan as well as the parents of the girls are each being held on $1 million bail. entertainer bill cosby is expected to appear back in court too many. the judge will hear arguments over what evidence should be allowed in the upcoming trial. prosecutors want to have 13 accusers testify to show a pattern of quote, prior bad acts. cosby's lawyers want those women to take competency and memory

tests and some allegations date back to the 1960s. >> tonight new information on the deadly nightclub shooting in orlando. we're now hearing audio from a series of 911 calls by the shooter who pledge support for isis. >> that was omar matin who opened fire at the pulse nightclub in june. the shooting left 49 people dead. police eventually breached a wall in the club and killed him in a shoot-out. >> we are now just eight days from election day and tonight the clinton campaign sent an aggressive vice presidential message to philadelphia to help

united states senate. i'm katie mcginty and i approve this message. here's an update now on the looming septa strike. the very latest they continue to negotiate. the strike deadline is midnight, almost just over 45 minutes from now. we're told there are three sticking points. pension benefits, health care cost and meal and break time.

sources close to the talks say if the pension issue can be fixed, the strike will not happen. if a strike does happen, it will affect septa buses, trolleys and trains. the regional rails will not be affected. a union spokesman says if there is a strike, we will hear from the union at 12:05 a.m. a medical mystery is being investigated in montgomery county. it's a lung infection that has been linked to water. >> the illness is rare but the number of patients is growing. >> reporter: the unlikely victims are white, thin, post menopausal women who live in affluent neighborhoods around the main line. it's a lung infection similar to tuberculosis that's caused by a bacteria found all over, in soil, the air, and mainly in water. >> this is in all of our water. we're all exposed to it every day when we take a shower.

>> reporter: pulmonologist does not want to cause hysteria. she treats about 100 patients a year. symptoms include a cough and fatigue. >> all of this white area, that's all infection and inflammation. >> reporter: a study from the american thoracic society and nih in 2012 identified 7 significant clusters of ntm around the country, one being the greater philadelphia metropolitan area with significant clusters found in montgomery county. >> the end of the day you're thinking have you hurt yourself by drinking water. >> reporter: terry was diagnosed with mtm in may. >> now you have to live on antibiotics? >> uh-huh. until next september or october. >> reporter: she's instald a special water filter careful to avoid reexposure. she struggles with fatigue and

respiratory issues but makes sure to stay in shape. >> were you shocked when you found out that being healthy and fit put you at risk for this? >> oh, absolutely. >> reporter: the nih report also noted that most mtm patients had higher education and income levels with the infection being difficult to identify. >> the diagnosis is tricky. it often is delayed. while others that have been undiagnosed for several years. >> reporter: the doctor says the bacteria can be especially dangerous when it's aerosolized. >> i didn't know what it was. i didn't know how to pronounce it. >> reporter: he learned fast after his wife was diagnosed. they lived in another mtm hot spot, florida. the lung infection eventually killeded her. >> she was such an amazing person. but she's in my heart, she's with our children. >> reporter: not everyone is at

risk. doctors say african and americans and people who are overweight tend not to get mtm. but this bacteria that kaus it is everywhere. so the question is why do oent certain people get the infection. >> we don't know. a lot of people are trying to figure that out right now but that's not really understood. >> reporter: aqua, pennsylvania which supplies water to the area says it does not test for the bacteria because it's not a regulated contaminant and there is no epa-approved method to measure it. switching to bottled water isn't necessarily the answer because the bacteria is everywhere. but it only causes problems for an unfortunate few. staff any stall, cbs3, eyewitness news. >> one man's mistake teaches us al a very important lesson. don't poke a sleeping panda. take a look at this video. the man somehow got into the enclosure of the 265-pound male panda during a tour. he walks up to the animal, touches it. the bear wakes up and then lungs

not quite enough, we've got more of it on the way. here's a look on this halloween night. hopefully all the trick-or-treaters are nestled and snug in their beds. let's take a look outside. no problems, everything is quiet. just a few clouds drifting through this evening and that's kind of part and parcel of a storm that's going to be impacting us later this week. so what we have is actually a warm front that's drifting through the area right now. you can see the system right up this way and the cold front extended beyond that. that cold front is what will pass through our area as we get into thursday and that's our next chance for a shower or thunderstorm. temperatures on the live neighborhood network you can see are in the 50s in atlantic city and cape may. we drop to 48 degrees at the airport, and temps in some colder spots in the suburbs are in the 30s already. a chilly night and a chilly start to your tuesday morning. what a difference a day makes.

yesterday we were just 2 degrees from a record. we got to 79. today was 22 degrees colder. the high just 57 degrees. big drop in the mercury after that strong front that came through last night. highs today 55 in the city, 55 in allentown. but what happens when we zoom to the south and west temps got to the mid and upper 80s. the jet stream lifts back to the north and temperatures head upward especially wednesday and thursday. tomorrow is a seasonable day with a mix of clouds and sunshine. a lot of sun here but watch what happens thursday. that front gathers some strength and by thursday evening we'll get another line of showers and storms very similar to the one that came through last night. overnight mainly clear, chilly, down to 40 degrees. a seasonable day 62 to start the month of november. and now it's time to fall back on sunday we've got to set those
