"eyewitness news" reporter joe holden joins us live in norristown with the judge's ruling, joe, good afternoon. >> rahel, good afternoon, breaking news here that july ruling over the last half hour hour. >> now, cosby's defense team seeking change of venue, where the entire trial would have been relocated to another pennsylvania county. but now the 12 men and women effectively bill cosby will come from another county in the state. supreme court will decide which county. bill cosby of course in court for the arguments this morning, accused every drugging and sexually assaulting andrea constand, a

woman he knew from his role at temple university. his lawyers wanted to change in venue, they allege the media has bill philadelphia international airport cosby, they call the coverage. they said he wouldn't be able to get a fair trial anywhere in the country. the judge essentially responded he couldn't help them with that. cosby's lawyers also argued the media has destroyed cosby's reputation, prosecutors shot back that cosby's attorneys were now blaming reporters and the press for cosby's own alleged actions. like i mention, now the supreme court will decide which out of county jury will seek here in june to hear this trial. interesting twist, though, cosby's lawyers tried to ask the judge to put a foot note in all of this, that the jury possibly come from either allegany county which would be pittsburgh, or philadelphia, that is an unprecedented move of course. we're exploring the ramifications of that. starting on "eyewitness news" at 5:00. >> reporting live in norristown, outside the montgomery county courthouse,

joe holden, cbs-3, "eyewitness news." >> thank you, joe. meanwhile this noon fundraising effort is underway to repair and restore hundreds of headstones damaged by vandals at jewish cemetery over the weekend. also $13,000 reward for information on the vandals, who struck after dark saturday at the mount carmel cemetery in wissinoming. chopper three over the cemetery at frankford and cheltenham avenue this morning, officials are upset and heart broken over the vandalism. >> toppled so many headstones, clearly, a concerted effort. >> i'm heart broken. discusting, frightening, bridges back memories of what was done in europe to our people. >> now, friends that every all fate gathered help right the tombstones yesterday, the vandalism comes about two weeks after vandalism at a bridesburg cemetery, and just a week after vandalism at jewish cemetery in st. louis. >> and police are hoping surveillance video leads them to alleged arsonist, video, from january 27th, along with

700 block of north fifth street, northern liberties. this is about 5:45 a.m. you can see the suspect appears to let fire in a trash can it, spreads to beer my car, there were no injuries, but if you recognize the suspect philadelphia police want to hear from you. >> there will be vigil tonight in delaware for the two law enforcement officers killed in a off duty accident this weekend. twenty-three year old robert will pant and 23 year old james watts of the dover police department died yesterday after single vehicle crash in dover. authorities say lafonte lost crawl crawl every his jeep, overturned and ejected watts who was not wearing a seatbelt. they say several fatal accidents have occurred there. police have not determined the cause of the crash. >> a philadelphia city councilman meets in less than an hour at city hall with potential federal and state budget cut on the agenda, hearing scheduled after president trump announced plans to pull funding from sanctuary cities including philadelphia. jim kenney insists he'll not change the city's immigration policy, congressman, brendon

boyle; set to explain the implications surrounding the loss of the affordable care act and other federal programs, along with the cost of the crash-down on immigrants. we'll have the latest on the hearing today on "eyewitness news" starting at 5:00. >> president trump has revealed some of the top fix he will focus on in his speech to joint session of congress tomorrow. the president shared some of his plans while addressing the national governor association meeting at the white house this morning, told the group, rebuilding the military, and repealing the affordable care act, are priorities of his administration. he said he will ' also outline plans for boosting infrastructure spending. >> pair of trump signs were moved from the shuttered taj mahal casino in atlantic city prompts legal battle over ownership. now, philadelphia recycling company has filed lawsuit claiming it purchased the signs to sell them on ebay. the company says ebay canceled the augusts when the taj claimed the signs were stone. lawsuit asks the judge to determine rightful ownership.

interesting. well, the national weather service confirms tornado was in fact what left behind this destruction in northeastern pennsylvania. >> the saturday twister tore the roof off of several homes, classified as etches f2 with winds speeds get this 120 miles an hour. press by tear yan church in the area was not immune to the damage. long standing bell fell from its spot on the tower. >> the good thing is the bell didn't crash through the flooring. it came off the mount. been there since 1900. it took a storm of this magnitude to topple it. >> the national weather service says straight line winds up to 95 miles an hour, damaged mostly farm buildings in lancaster county. there are no reports of injuries. well, there is a chance of more thunderstorms later this week. >> katie is in the cbs-3 weather center. >> guys, he can racketly right. in fact we do have slight risk posted for parts of our area by wednesday. and it will take a look, very quickly here, at where that will be outlined. at least from now. marginal risk, going into the

>> welcome back, more bad news for 6ers fans, just announced joel embiid is out indefinately, skipped the morning shoot around due to swelling in his left knee. he'll have mri to determine the cause that far swelling. well, today hollywood is mourning the sudden loss of actor bill paxton, he died this past weekend at the age of 61 following surgery complications. paxton was currently starring as a rogue cop in the cbs series training day, james paxton was set to guest star on upcoming episode. paxton's movie credits titanic, aliens, terminator and apollo 13. last night the film white helmets won academy award, but the sounder -- founder was unable to attend the is her moan. >> i terry the fighting in syria was too intense for him to leave. >> and the oscar goes to: the white helmet.

>> back on "eyewitness news" now with a car that flew offer the seventh story of a houston parking garage. it landed on the roof after hardware store and believe it or not the teenage driver walks away with just minor injuries. investigators say it appears the teenager hit the gas instead of the brakes. no one in the store was injured but the staff says there is considerable damage inside the store, it is not clear if the teenage letter face any charges. imagine going home to your parents and saying i kind of got into an accident with a car? >> well, that's one of those stories where you tell them, look at the car, but look at me, i'm good. >> i'm okay, my gosh. >> exactly. >> that's how you get out that far one. >> what a mess. >> thankfully he's okay. my goodness. we have quite a mess after forecast here, pretty much everything, we will be back in the 50's, the 60s and the 70s, then drop back off again forehands full of days, as well. so definitely lot of ups and

downs in this forecast, more than anything at all, one large storm system, which is going to send us on an uphill climb, then knock us back down again, by the weekend we ends up before the break with much more quiet weather, but, looks as though march may very likely come in like a lion, this time around, and also, very mild lion. let's take a look, outside, you know, we've been spec to go see with warmfront lifting in more clouds cover, definately the case go out to pleasant valley middle and high school, more clouds than anything at the moment. but we switch gears, and take you out to cape may courthouse, completely bright, blue sky here, so depend where you are, the cloud cover situation at the moment. but dow expect a dry afternoon. meanwhile you can already see some signs of life off to the south and west, this is our warmfront beginning to lift in. but again, just clouds expected out of it. well off to the south, you see, a lot of heavy rain, across alabama, mississippi. we will eventually see some scattered showers build in specially into tomorrow. but, that's the warmfront that's going to be lifting in to bring that to us. so look ahead to the beginning

of march, on wednesday, it will be a mild start. warmth coming in from the southerly surge, yet stream lifts to the north to allow that to happen. twenty to 25 degrees again above the seasonable average come wednesday, looks like the warmest day of the upcoming week here, so let's jump you to wednesday, talk about the clash that gets set up, what it may mean, again, we will be in a slight risk for severe weather come wednesday. you can see some very heavy thunderstorms projected to be coming through ohio for example, even before the sun comes up. will lick lie see some showers move through maybe even as early as noontime. but, i really think it is generally toward the evening rush, this particular model run bridges it in little later than it did earlier in the day, but regardless, p.m. time frame is when the squawl line likely to set up and usher in not just heavy rain very likely very gusty winds. yes, looking nasty. coming at 10:00 at night you'll have logs heating of the day, may not be at bad. come earlier expecting high of 73, you'll get heads banking together here, and bringing

with it some good clash in the atmosphere, in short, leaving very nasty thunderstorms, then out of here come thursday morning. last 24 hours have gun to warm up already. were at least a little closer to average yesterday, even shy of it by a degree, now 12 above where we were this same time yesterday. for stuck in the mid 50's by daytime high here, 51 the current temperature, so on our way. modest breeze, will pick up with time here, warmfronts, but we expect the daytime high officially to hit about 56 degrees, with the clouds continue to build even if you have bright blue sky like you do down in cape may for example. mainly cloudy tonight, not quite as cold dropping down to about a pair of four's, with blanket of cloud cover will testifily help thing out. meanwhile we have the wednesday, us women's national team will be in chester, looks right now things pan out the currently looks like it will i expect delays. you have uj germany at 7:00 then france and england at 4:00. both of those matches may end up having to deal with some stormy wet earl so, it will be
