i'm jessica dean. we have been in contact with senator toomey's office requesting that he set aside time for an interview. today senator toomey answered the call live on facebook. >> this is what democracy looks like. >> reporter: protest outside senator pat toomey's office in philadelphia began one week after the presidential election. tuesday's with toomey have been a weekly ritual demonstrators jamming sidewalks calling on the senator to meet with them and talk. >> when will you hoe a real town hall with enough note that is real pennsylvanians can plan their schedule and engage and what i think they are getting at is real, it was about a face-to-face meeting in philadelphia, when do you plan to do that. >> i don't have a date set. i'm sure we will do one at some point. i have done more town hall in, person town hall meetings then any other elected pennsylvania official that i necessity of. >> reporter: senator toomey told us during a facebook conversation with our viewers that he has reached out to his constituents in other ways. >> i think i have done 48 tell

even if town halls, which is actually a terrific venue. we have had over 20,000 people , either on the phone or listening through the audio stream. >> reporter: while senator toomey does not have a date in mind he says his office will probably hoe a town hall in philadelphia in the future. we also discussed education, and the president's pick for education secretary. senator toomey still backs his vote for betsy devos. >> the reason i'm enthusiastic supporter of betsy devos is i think we need to create more options, especially for lower income families. >> reporter: as republican, spent this week, people should not be worried about coverage. >> if we vote tomorrow on the repeal, the actual effective date will be two or three years down the road. we will not pull the rug out from anyone, all right. someone hoist complying with the law that require them to go out and buy insurance and because of the way law was crafted it is unaffordable and they had to get subsidy we will not bring a end to that

>> reporter: the gathering was peaceful. >> somebody has got to break ranks and talk the vast majority of the people which we are. >> reporter: people like maryann schiller from fairmount and terry of lansdowne want to see senator toomey face-to-face. >> we would like him to agree to a town hall meeting, in person, not the electronic. >> reporter: this comes as wave of elected official as cross the country are criticized for not engaging with voters in person. >> i also believe that we need access to our elected officials. >> reporter: philadelphia police had 30 officers at the ready, many in this group had been at odd with the senator and idea of town hall meetings , for months. they stage a weekly meeting at his center city office known as tuesday's with toomey. >> we want to have a constructive conversation with our senator and to have him meet, our eyes, and basically, understand that why we're coming out every week. >> reporter: now tuesday's with toomey will resume tomorrow at senator toomey's

new office in philadelphia, that is now moved from center city to olde city. reporting live from the spring garden section of philadelphia , i'm joe holden for cbs-3 "eyewitness news". >> joe, thanks very much. today president trump signed a reworked version of his controversial travel ban, president privately signed the new order in the oval office. ate police to sit sense from six majority muslim countries, iraq has been removed from the list. the new executive order comes amid president's claim that president obama illegally ordered a wiretap on his, phone at trump tower. delaware senator chris coons spoke out about that. >> donald trump dedicated years of his life to running around our country claiming president that obama wasn't born in the you had, without a shred of evidence and immediately after his election , claims that millions of people voted illegally and demanded an investigation which even, in this investigation, from republican congress, they have not taken him up on it because there is no evidence of that either. >> we will have more on the

travel ban and the president's wiretapping claims on "eyewitness news" coming up at 5:30. pennsylvania senator democrats say they are in contact with the fbi and state attorney general's office after a ransom wear cyber attack shut down their computer systems. on friday we told you about the attack that left lawmakers and staff in the caucus unable to access their computer network or data. citing the investigation democrats are not saying if any, ransom was demanded. a northeast philadelphia community is rocked by a four alarm fire that damaged a fitness and physical therapy center and sent two people to the hospital. it happened just after 11:00 on grant avenue and forwardham road. "eyewitness news" reporter alycia nieves joins us live where, crews are working to pinpoint what cause that had huge fire, alycia. >> reporter: well, nicole this community has been certainly rock by this morning's fire, several streets around here of been closed all day and people living in the area have been asked to shelter in place.

partly because as you can tell behind me crews are still working to put out hot spots in the building, but also because of officials have been worried about air quality. with the amount of smoke that was in the air. around 11:00 from the air in northeast philadelphia, smoke could be seen for miles, on the ground near grant avenue and fordham road well over 150 emergency responders, many of them battling into the early afternoon to get this four alarm blaze, under control. >> you see the black smoke coming out of it already and then you have this old ladies who are doing therapy in the water, that were, you know, trying to get them out. >> reporter: this is one of the handful of patients inside gutted aquatic and fitness center. he was getting physical therapy on his knee. >> i was walking in the water for about a half an hour. >> reporter: when smoke detectors went off he thanked these women and other employees who got him out of the aquatic center's pool, out

of the burning building and to safety. >> they were the won that happened so quick. >> it wasn't a drill, got people out as fast as we could >> reporter: two employees from the aquatic and fitness center were taken to the hospital with minor injuries after manager to go get everyone else out. >> still so sad, i love that place, i love working there, i love my patients. >> it wasn't just a small little fire but it progressed, within five minutes the whole room was just in flames. >> our fire marshals and partners will be here for days , continuing to process this scene until we ultimately have a cause. >> reporter: we do know that work was being done on the roof of this aquatic and fitness center and that are where people saw the fire, initially, still no word though if anyhow that is connected to the cause of the fire. it is some positive news owner of the facility said that they have insurance, they plan to rebuild and they assured all of their employees that they will still have a job. in northeast philadelphia,

lisa nieves for cbs-3 "eyewitness news". a man is behind bars tonight after crashing into the side of the house in delaware county. authorities say that a 27 year-old man pulled into on coming traffic on township line road in drexel hill, before losing control of his vehicle and crashing in the side of the home. the man, then ran away before he was apprehended by officers home owner was not home but says that the car crashed, where she regularly parked her car. >> it is quiet but these cars do fly down this street real fast and they do get into a lot of accidents. they do. they are coming off of township line and they fly off the streets. >> authorities located marijuana in the vehicle, the driver faces drug violation charges and traffic offences. police are investigating a double shooting in southwest philadelphia that killed a 19 year-old man and left his 15 year-old brother fighting for his life. teens were shot on sunday afternoon while sitting in a koran eighty-first abe lions. they were able to drive a block and a half before

crashing in the utility pole. davis died at the hospital. his younger brother is at children's hospital with the gunshot wound to the face. his neighbors were horrified by broad daylight violence. >> these children have absolutely nothing to do in the community. if you look around there is no community center for them. these children need vocational training. they need an outlet. >> police don't have any suspects or motive for that shooting. nurses and technical staff at delaware county memorial hospital are on the second of a two day workers strike but walk out may last longer then they anticipated. chopper three over the hospital, at drexel hill this afternoon. that group walked off the job yesterday over what they say is a staffing problem. hospital leaders say that the staff is, paid at national average, and that nurses are paid fairly. striking workers could be off the job for as long as five days. hospital says it is minimum work time required by staffing agencies for the temporary

replacements. winter returned over weekend with a cold blast, but now it is warming up again. meteorologist kate bilo live on the cbs-3 sky deck to tell us what we can expect from the latest warming trend, kate. >> it feels so much better out here right now then it did over the weekend. it was a frigid saturday, frigid sunday and cold start to this monday as well. feeling nice outside right now but a few cloud rolling in, warmer air on the way but witt the chance for some wet weather. lets look at storm scan three you can see we have a warm front that is producing showers off in western pennsylvania, into the ohio valley, and the cold front is what you see all the way back across northern plains up around minnesota, that will come through about late tomorrow night or wednesday morning but in the meantime as we head in the warm sector of this low we will see patchy fog, some drizzle overnight tonight, and some light showers, not a ton of rain with this but it will help temperatures, ramp right backup. right now it is a comfortable 50 degrees, not bad on the sky deck, 50 in allentown, 45 in

a delicate rescue from the side of a mountain today in phoenix, arizona. the phoenix, technical rescue team walk a five two-year old woman down a mountain after she got stuck at the park. officials say hiker thought she was on the trail but that is when she got stuck. there is no word if the woman was injured. nasa scientists are breathing a big sigh of relief of avoiding a major disaster.

the spacecraft is orbiting mars to study upper atmosphere but teams recently discovered it was on track to slam into one of the mars moons. scientists gave it a boost with this rocket to speed it up, a touch by just 1 mile an hour and that was enough to steer the spacecraft away from the moon. >> intelligent folks, indeed. special pair of glasses has opened up a colorful new world for annie was boy with the vision impairment. >> 150 year-old casen earlback is color blind. thinks home video showing the moment that everything changed when he put on his special glasses. >> it is so amazing. so colorful. it is weird because i didn't, i never seen those colors before but i knew what they were. i don't know, it is just awesome. >> just to be able to, realize that, you know, a whole new world opened for him and very emotional. we didn't realize marshmallows in his lucky charms had color in them. >> little things, right. >> caseon saw his first

rainbow and his first sunrise. these glasses are made by the california based inchromea company, the company says results from their glasses, vary depending on a person's color vision deficiency. >> so interesting he said he had an idea what they were. >> so cool. >> kate's joining us now and it is not too bad out there it is definitely better then it was this weekend was pretty unbearable. it looked nice. >> it was sunny. >> sun was out. my kid were like let's play baseball in the backyard. i said, guys, five minutes, we have to get inside. we are warming backup but that doesn't mean the cold is done with us. we have another threat for cold air by end of the week and even the chance to see a little bit of snow. lets start with the near term first. it features a significant warm up. we will start to feel that today. live look down the shore, ocean city boardwalk, someone riding their bike on the board , the cloud are in, relatively mild, temperature near 50-degree mark.

so right about on target temperature wise for where we should be in the first week of march and not too bad looking outside, dry for now but that may change overnight, storm scan three, it shows a warm front invading pennsylvania, it doesn't have a ton of moisture but we can see scattered showers from central pennsylvania back toward pittsburgh area and these are coming in overnight tonight for us and then possibly some drizzle on and off anytime throughout the day tomorrow. it is part and parcel of the larger system. here's warm front. cold front produce something showers and thunderstorms from minneapolis on down toward omaha. that will come through for us late tomorrow night and late wednesday morning and will eventually usual inner a cold pattern as we head toward end of the week. in the meantime we have a live look outside. i was just on it side on the sky deck. it doesn't feel too bad. not compared to the weekend where we needed to be out with the hat, gloves, scarves, the whole nine. outside you need a coat, but just nothing more than that. 50 degrees. feel close to what the thermometer indicates. march has been a roller

coaster. we started moth 26 degrees above average. second day of the month well above average as well. then this weekend double digits, below average, today, temperatures got to the lower 50's. we are 2 degrees above normal and we will be above average for next two days as well. then we will go back to the blue as we head in the weekend and another round of cold air moves in that fight is on between winter, and spring. here's what it looks like overnight light rain, drizzle, possibly freezing rain in the poconos. it is not much. much of the night will be dry. north and west of the city better chance to see light rain and drizzle tomorrow morning for morning commute. that lifts to the north. dry midday and another chance for showers tomorrow night as cold front comes through tomorrow night into wednesday morning and could be rumble of thunder and that clears out and wednesday will be a mostly sunny and relatively pleasant day. tomorrow that warm front arrives, it is getting in overnight, 10 to 15 degrees above average but areas of fog , drizzle and some scattered light showers around for your tuesday. our overnight low is 42

list. the white house released a photo of president trump signing a new executive order, posting a 90 day ban on visas for citizens from six muslim majority countries, traveling to the u.s. >> we cannot risk prospect of man level length actors using our immigration system to take american lives. >> reporter: updated order does not apply to current visa holders and removes iraq from the list of banned countries after iraq agrees to increase vetting of its citizens. >> iraqis an important alley in the fight to defeat isis. >> reporter: original ban sparked nationwide protest and lawsuits in january with travelers detained and official scrambling to implement it. hoping for a smoother transition, the new order will not take effect until march 16th, the administration , also expects that this version to withstand court challenges. but critics, including khan of the muslim organization care says he plans to fight it just as vigorously as the last one.

effort continue on crease screening rates for colon rectal capser. "eyewitness news" at cooper in camden today, that organization is joining with the american cancer society, and elected officials, and community leaders, to announce their commitment to the 80 percent by 2018 campaign. that is about the national increase to increase colon rectal screening rates by 80 percent in 2018. new study is adding to the discussion about soy and breast cancer. new evidence shows that the soy may be good for some patients. cbs news reporter danielle nottingham has more.

>> how are you feeling. >> reporter: three two-year old maryann lewis battling aggressive breast cancer. she has always had a health a approach but question soy products. >> whenever the whole soy, you know, thing started to happening, before we were like you should not eat it, it is bad for you, i started to avoid it. i haven't eaten soy. >> reporter: over the years breast cancer concerns have caused many women to avoid soy but now new research that suggests soy is safe for breast cancer patients and may even be beneficial. >> soy has been an area of concerns, and controversy through the years because of the potential estrogen-like effects of the components of soy and potential for stimulating estrogen receptor positive breast cancer cells. >> reporter: researchers found woman who consumed highest amount of the compound in soy had a 21 percent lower risk of dying. patients have the most benefit if their breast cancers are

not driven by estrogen. doctor heather mcarthur says it is promising for patient was harmone related cancer. >> that the consumption of the soy, it is safe, and does not appear to impact survival is really encouraging, particularly for those women taking harmone therapy for breast cancer. >> reporter: study only looked at soy found in food, not in supplements, and doctors say that as with most things, moderation is usually best. danielle nottingham for cbs-3 "eyewitness news". the american congress of the opposite tryingses and gynecologists is urging medical professionals to not cut a new born's umbilical cord until 30 to 602nd after birth. traditionally in the u.s. the cord is cut immediately. that cord carries important nutrients from blood from mom to baby and growing agreement that a delay could be beneficial especially when it comes to premature babies. tossing coins in the fountain turned out to be bad

an eye on friday and sunday but still lots of uncertainty regarding this time frame. lets start off with what is happening right now. we will look what is going on weather-wise looking at parkway central library camera not a lot of sun visible as sunsets, or a few minutes from sunset right now but cloud have really won out. more sunshine this morning. cloud started to drift in midday and then now cloud are winning as system approaches from the west and that will be bringing us, some rain possible overnight into tomorrow. it doesn't look like a lot. these daylight times are getting later and later. lets talk about our sunset times. it is at 5:59 but by 12th that sunday our sunset 7:04 by april 1st our sun does not set until 7:25 p.m. lots of light, will be visible longer into the evening, once we set those clocks back, gaining two and a half minutes of daylight each day and set these clocks ahead. we will spring, forward this weekend so set those clocks ahead before you go to bed saturday night.

passage late tomorrow night and wednesday morning. not a lot of moisture with this. it looks like bulk will pass just off to the north of philadelphia, so if you are in the lehigh valley or poconos better chance to see some showers tomorrow morning. actual cold front is still way back here over northern plains , and that again does not come through until later tomorrow evening, into wednesday morning. so, it is milder with some showers for your tuesday, is there warm front lifting through and then we will get a break in the action, best chance for dry weather, will be from noon until 6:00 tomorrow evening, and temperatures in the meantime surge in the 60's as this low approaches but we will have patchy drizzle and fog and showers at night as that cold front comes through. we are up and down, big surge by end of the week colder air starts to move in thursday night into friday, low will track right along that boundary and that could bring us a chance for rain and snow friday morning. we will tap into more cold friday, saturday and into the weekend and that cold i have to the north and we will get a few shots in here heading in to next week.

"eyewitness news" reporter greg argos is live at the scene of one attack at broad and morris at surveillance video police want to you see, greg. and jessica you will see that video in just a second, it is very intense, surveillance video but police tell me tonight that the group appears to be watching more victims. especially as those victims leave the subway they will follow them for a block or two and then that group will make its move. >> the attack happened quickly >> reporter: group of teens follow their victims and then strike. >> they came up, behind us, a person, and assaulted them, and knocked them to the ground and kicked them and stole money. >> reporter: police in the third district are investigating three separate although similar incidents. the first this beating on the 1200 block of south broad street near ellsworth federal station on january 10th. >> as far as my knowledge goes , nobody has seen any tips that they identified these offenders. >> reporter: there has been an arrest and two other crimes. the first, f
