allentown congressman charlie dent, a republican, was the strong opponent of the health care bill. his office told us in the statement quote, congressman dent's position would have remained the same, he would have voted no, congressman dent had said repeatedly this should not be the subject of artificial timelines or politically motivated deadlines. it should be done right. congressman frank lobiondo in new jersey was another republican hold out who said in a statement quote i planned to vote no today on this specific obama carry placement bill, it is not a declaration that obama should stay. it shouldn't. obama care has failed on a host of key metrics, promised to south jersey residents and i remain committed to repeal. pennsylvania congressman brian fitzpatrick, a local republican, also said he would have voted no, democrats in the tri-state area, they were in uni son they would have been no votes, house speaker ryan didn't give a time line for another possible go at health care, president trump says he wants to focus on tax reform. reporting live, david spunt

>> reporter: nicole, quiet here in maple shade at this apartment complex, police left the scene a little while ago but neighbor tell us they are still shocked, stunned, rocked to the core by the gruesome murder of a mom and her young son. >> the burlington county prosecutor's office, and police in maple shade, are investigating a gruesome double homicide at fox meadow apartments in south jersey. authorities say that a husband came home to the apartment on hamilton road, and inside, found his wife and their six year-old son, each stabbed multiple times. an autopsy still need to be done to confirm how mother and son died, but while that is in the works investigators spent more than 16 hours collecting evidence, fingerprinting the apartment, hoping to find out who committed this double homicide. >> it is a horrible tragedy and we as a community will do what we need to do to find the perpetrator and step up what we do as a community to help

one another because that is what it is all about. >> reporter: coming up at 6:00 r neighbor who saw the father, moments after he found his wife and son's dead body. also hear why this case is getting international attention. for now live from south jersey alycia nieves for cbs-3 "eyewitness news". police continue to investigate a homicide that occurred in clayton, new jersey early this morning, three three-year old kenneth bernard mostly of fair hilltown ship cumberland county was found dead after a shooting at 31 downs street. police say victim was sitting in the chair in the living room of his girl friend's home and was shot through the sliding glass door. >> my wife and i we woke up to what we thought was gunfire, we had three shots, came downstairs to make sure everything was okay, nothing was wrong with our house, before we could call police or do anything like that police started showing upstairs and cordoning off the house next door to us. >> reporter: police say mostly knew shooter saying crime was

quote planned and personal, two other adults and children were home at the time, in other injuries were reported. a judge has cleared way for prosecutors to retry monsignor william lynn to day judge denied a request by lynn 's defense team to block a retrial. "eyewitness news" was there as lynn left court, defense is expected to appeal today's ruling. monsignor lynn served three years of the three to six year sentence, when the pennsylvania supreme court overturned his conviction over trial errors. that was the second time, lynn 's 2012 convictions for child endangerment had been thrown out. former penn state assistant coach jerry sandusky was back in court seeking a new trial. he is appealing his 2012 convictions for sexually abusing 10 boys and "eyewitness news" reporter greg argos has more from certainty county. >> reporter: former assistant penn state football coach and convicted child sex offender jerry sandusky back inside of a center county courthouse this afternoon, facing a new judge in the late's peel to

get a new trial. a quick joke and seven three-year old jerry sandusky escorted inside center county courtroom in front of the new powe relief conviction act hearing. in november the pennsylvania supreme court, appointed judge john, from jefferson county to oversee pcra hearing after jack mccleveland and p.c. ra case from the start reaccused himself. >> he seemed attentive to what we have. >> reporter: current defense attorney lindsey and andrew salem called four witnesses to the stand including a psychologist and two state police investigators. they claim that the three suggestively questioned sandusky's accusers. >> suggestive questions i go when important lease officers say this is what everybody is saying. more or less why don't you go along. in this type of the case that type of questioning is shall we say raises credibility issue. >> reporter: prosecutors argue that the accusers were not

coached but investigators had to ask specific questions, to get sandusky's accusers to feel comfortable and open up. joe amendola sandusky's trial attorney also testified. he provided ineffective council. he countered he just did not have time. >> it was very frustrating. we were having boxes delivered to us, right up until trial and not having had the time to go through those boxes. >> reporter: now this hearing will continue on two days, may 11th and 26th, after then, this new judge could then deciding whether or not jerry sandusky could face a new trial. reporting here from center county i'm greg argos for cbs-3 "eyewitness news". just a short time ago former penn state president graham spanier was found guilty of one count of child endangerment over his handling of the jerry sandusky sex abuse scandal. spanier did not take the stand in his trial and his lawyer rested his case, without calling a single witness to the stand.

a dramatic defeat for the republican plan to repeal and replace the affordable care act, how speaker paul ryan pulls the bill, president trump says that he is moving on. we will continue to follow breaking news at 5:30 i'm nicole brewer, ukee washington is off. i'm jessica dean. president trump says republicans were close but just could not get enough votes for the bill. a short time ago speaker paul ryan explained why he pulled the bill, and leadership could not convince conservative republicans to get on board, they wanted a complete repeal of the affordable care act, president trump and democratic leaders also weighed in. >> i think we have to ileto bam a care go its way for a little while and we will see how things do well. i would like to see it do well , but it can't. it is not a question of i hope it does well, would i love it to do well, i want great health care for the people of this nation but it can't do

they worked very closely on this bill, basically the president, picking up sales job of the bill that was designed by paul ryan and republicans in the house. that was notable because the president, attacked paul ryan numerous times during the campaign. they work well together but they were unsuccessful. a lot of the presidential is have been attacking paul ryan in the press. so does that continue. reason that is important if is there a bad relationship between two of them it is harder to get these more complicated things done in the future. >> president started out with a lot of political capitol in the sense they have house, senate, the executive branch of government. you would spend a lot of political capitol to try to get something like this done. so now as the dust starts to settle, how much capitol has he spent as you mentioned when you go to start the next big thing do you have enough to dot next big thing. >> well, he has expended some capitol the question is, what has he learned in terms of how

to go forward into the next approach. there are approach that he is donald trump could take to a number of different issues that would grab a lot of democratic votes. he could pass a prescription drug plan where he basically is very much in step with number of democrats including bernie sanders. he could really move over to kind of some old fashion deal making with the other side, that is true on infrastructure expenditures and also true on immigration. but he would have to abandon big chunks of his own party. he could put together a coalition. there are possibilities. but that would require, some risk taking and require him to basically rewire his presidency what he has chosen to do, so far is run purely as appealing to his base and the republican party, the strategy that they chose for this affordable care act replacement was 100 percent republican strategy. same one democrats tried with obama care and for which republicans attacked them, quite a lot over last eight
