this is cbs-3 "eyewitness news" this morning. well breaking news overnight, man is in very critical condition and a woman hospitalized, as well, after hit-and-run in philadelphia. we'll tell you how a witness played a big role in helping police find the car. restrictions in effect around the art museum, preparations for the nfl draft continues, streets you'll have to avoid starting today. >> nominee neil gorsuch becomes the supreme court justice today. we'll tell you about the special relationship he has with another justice on the court it, as first of the nation's highest court. well today is monday april 10, 2017. good morning, i'm jim donovan. >> i'm rahel solomon, plus a great week for fd east in one philadelphia neighborhood. first out the door, with a check on weather and traffic with katie and meisha. >> good morning, here we are

kelly drive one lane blocked, by the museum. no fun, going to get busy, heads up, tweeting out this information, as well, walking you through it as the days and week progresses on any other further changes that we do get. also, going out to a live camera shot, construction out there, route one northbound, oxford valley, fail to exit, oxford valley, re-enter, the construction we were talking about little bit of time ago, couple of weeks ago, now back out there talking about that again coming up in ten minutes, rahel, jim, back to you. >> we do want to turn to breaking news, man fighting for his life this morning after a violent hit-and-run in hunting park sent him and another victim to the hospital. >> in this news report, trang do live at the accident investigation, trang, how are the victims right now? >> well, good morning, jim, rahel, paramedics transported both victims to temple hospital. we're told the nan very critical condition. and the woman is in stable condition with a broken leg. fortunately, though, police have some very strong leads to go off of. but take a look at video of the scene overnight in hunting

park. this accident happened around 10:30 last night, near the intersection of sixth street and erie avenue. and a man and woman were at the intersection when they were hit by dark green nissan maxima that kept going. fortunately a witness spotted that car, and followed it to torresdale avenue and fraley streets in wissinoming, then called police. investigators found the car had fresh damage to its windshield, as well as broken side mirror that was hanging off. they also found blood from the victims on the car and missing piece of the car at the accident scene, that nissan maxima is now in police custody. now, at this point, police have not made any arrests. they were told that they do believe they know who was driving that vehicle. they have spoken to the owner of the car. right now they do have a person of interest in custody that they're questioning. but, so far, no charges have been filed. right now, live outside the accident investigation district in brewerytown, trang do, cbs-3, "eyewitness news," jim, rahel, back to you. >> meanwhile in other news one

man dead another critically injured following a shoe out in the strawberry mansion section, police responded to the gunfire 2500 block of north mars den street after 9:30 last night, both victims suffered multiple gunshot wounds, were returned to the hospital. one died a short time later. >> investigators say numerous shots were fired, from two separate guns. >> we found numerous spent shell casings on the street. we also found a semiautomatic handgun, that was next to one of the victims that police scooped up. >> now, police say they also found a motorcycle laying on its side at the scene. they believe one of the victims may have been riding it when he was shot. so far no word on a mother disbelief investigators trying to pinpoint what started a fire that gut adel wear county apartment building. the call came in around 11:30, sunday morning at the waylynn manor apartment, garrett road, upper dare, trapped about 40 people in a stairwell. emergency responders were able to get them out safely. >> i seen lady running

screaming there is a fire. so came out, and not my neighbors a ten shown, running down the steps, and like the smoke was so thick, the fire people had to help us come down the steps, you know? it was devastating. >> and upper darby police officer was treated for smoke inhalation, the fire damaged at least 30 apartments, the red cross is helping resident. >> and authorities in manayunk are still trying to figure out what sparked a fire that left a firefighter injured. that blaze broke out in a vacant building at the intersection every main street and levington, about had yesterday afternoon. former location of carmella restaurant which closed back in 2004. that firefighter was evaluated for minor injuries. >> man assault wad cell phone in west deposition forwards, in urge new jersey, now police asking for the public ' help. this surveillance video taken friday there is happened at the wells wood court apartments on tatum street. police say the suspect asked to leave the property after he was caught throwing sticks at windows. he hit the maintenance worker

his phone, then thread in this silver car. >> happening today, in delaware, the three girls accused every killing their 16 year old classmate during fight inside a bathroom returned to court. the trial in the death of amy joyner francis continues in wilmington. the fight happened last april at howard high school of technology. the girls are being tried at juveniles, one charged with criminally neglect homicide while the other two teens are charged with conspiracy. prosecutors say they helped plan the fight. >> debate continues on how to deal with pennsylvania massive budget deficit. pennsylvania senate is said to take up budget proposal put together by house republicans, state house passed the proposal last week, and state house republicans wrote it in response to governor tom wolf's proposal which they oppose. pennsylvania facing projected $600 million budget deficit. >> and, following a grueling confirmation process, judge neil gorsuch will be sworn in as the nation's new supreme court justice today. gorsuch will take the oath in
