>> ♪ >> live from the cbs broadcast center in philadelphia, this is cbs3 "eyewitness news". >> now at noon a delaware judge decides the fate of three girls that took part in a fight that led to the death of a classmate. good afternoon, i'm rahel solomon. >> i'm jim donovan. jan carabeo was in the courtroom this morning in wilmington for the judge's ruling. >> reporter: three teenaged girls face their fate thursday morning charged in the death of their 16-year-old classmate amy joyner-francis. it took family court judge robert coon nan about that 20

minutes to read his verdict. the teen facing the most serious charge found delinquent or guilty. she's seen that this cell phone video beating joyner francis. the judge ruled the teen caused joyner francis death and should have known the attack posed that risk. the prosecution now hopes the verdict finally will allow the community to heal. >> that sense of normalcy i hope will soon return to that school. >> reporter: it's one year to the month since joyner-francis' death. the victim's family sat sile limit in the courtroom but said they're thankful for the guilty verdict. >> at the end of the day you cannot brutalize someone pummel someone in the bathroom and lead to their death and there's no consequence for that action. >> reporter: during the trial, the defense argued joyner francis what you a willing participant in this fight and that her death was unforeseeable. an autopsy showed the teen had an extremely rare undiagnosed heart condition but the judge ruled the teen deserved the right to live another day. as for the teen found responsible.

>> from the very moment that this occurred there's been a great deal of confusion as to how this could have testify possible happened. >> i told her she's going to be fine. she has a family who loves her. she is a good child. this was the first fight that she's ever got 19. >> reporter: a second teen charged with conspiracy was also found guilty. the judge described how she helped plan and carry out the attack. third teen charged with conspiracy was cleared. all three were tried as juveniles. it's possible neither will face jail time since the juvenile system has no mandated sentences for those charges. sentencing is set for the end of pavement in wilmington, jan carabeo cbs3 "eyewitness news." >> in other news a lawyer for the united airlines passenger who was forcibly removed from a flight is speaking out about injuries suffered during the incident and the passenger's family addressed the media for the first time. minutes ago dr. david dao's daughter and his attorneys held a news conference in chicago. the attorneys say that dr. dao was removed from the flight using unreasonable force. according to one of his

attorneys dr. dao suffered from a concussion, a broken nose and he lost two front teeth in the ordeal. >> this lawsuit among other things hopefully will create a not just natural discussion but international discussion on how we're going to be treated going forward. >> what happened to my dad should have never happened to any human being regardless of the circumstances. we were horrified. >> the united airlines ceo oscar munoz issued an apology and promised the company would review policies for seeking volunteers to give up their seats. the chicago airport security officers involved in the incident have been put on leave. >> meanwhile back at home jury selection is set to begin next tuesday in the trial of a camden county father accused of killing his own son. d.j. creato sat quite in court. he's accused of killing his three-year-old son and dumping

the toddler's body in a wooded area of cooper river park in 2015. a judge said he'll allow jurors to visit the exact location before brendan's body was found. and today is the last day of testimony in eric frein's trial before the easter break. yesterday jurors heard entries from frein's journal which he kept during the manhunt for him. at one point frein says the police were about a football field away from him. he's accused of shooting and killing state police trooper bryan dickson and wounding another trooper. >> so far today has been a mix of sun and clouds. meteorologist katie fehlinger is live on the sky deck with what we can expect. >> the rest of the afternoon looks very pleasant. i still feel like i need an extra layer but now there's more blue sky and with that that sun pounding down on us right now it feels really comfortable but with that said you mentioned it, a mix of sun and clouds is what we can expect for the rest of the day. we start things off by taking a quick glance at storm scan3. you'll see a deck of clouds

that rolled through through the next hour and a half or so much it continues to make its departure out to sea. we'll still have some showers -- i'm sorry, clouds rather no showers in this forecast for the rest of the day but it is a pleasant spring day and certainly a lot closer to where we shouldn't you should be. mid to upper 70's, 80's that the not where we would top off in april. 57 is the current temperature, about a another nine trees to get tacked i don't ton that daytime high with just just clouds sunshine and quiet conditions a very modest breeze out of the north-northwest for the rest of the day. with that said i think this pattern will last through the end of the work week. we'll hit the weekend with a different change of pace. there are a couple of storms that are going to be moving through for the easter weekend. we'll talk more about that later in the show but for now quiet. generally very seasonable for the next two days t-the rest of today and tomorrow. a cool night granted coming up here and also a cool morning as a result but no chance of lane in sight, at least not for now. but as i mentioned later in the broadcast we'll talk about that next chance for rain and

whether it has any impact on your outdoor plans for the holiday. guys. >> katie we'll check back soon. thank you. one person rushed to the hospital after a car smashes through a building in east oak lane. the crash happened around two:30 on west cheltenham avenue. two cars collided as they drove down cheltenham avenue. both cars hit a guardrail and careened into the front yard of a building before that one of the cars hit building. so far no word if the person injured was inside the building or inside one of the cars. >> well, dozens of veterans show their support for a fellow vet after he was terrorized in a home invasion in northeast philadelphia. [cheers and applause] >> want to let you know we've got your back. >> the man behind that door is 88-year-old korean war vet peter laduba. we had told you about this story yesterday. police say two men invaded his home in bustleton tied him up robbing him of 10s of thousands of dollars and stealing his cadillac.

when the warrior watch riders heard the news they took action. >> someone tried to rob him and steal his money. he worked for it. our backpack says we got your back at home. we want to make sure veterans are not forgotten. >> police arrested men two hours later in north philadelphia where they found his blue cadillac. they have yet to be changed in this case. investigators are still looking for a female suspect. >> overseas now a show of power amid high tensions. one of the world's most secretive countries invited the american media to see the unveiling of. a -- an economic center. >> ben casey has an up close and personal look. >> reporter: on the ride through pyongyang we saw north koreans preparing for the military parade. we saw large crowds of people on either side as much our bus. they took us to the center of pyongyang where massive crowd tens of thousands of people were assembled and then north korea's leader kim jong un showed up. he cut the ribbon on a huge

new cluster of highrise that is north korea is touting as a sign that their economy is strong despite the current u.s. sanctions. but in truth, poverty here is still pervasive and it's unclear what demand there is for all these new housing units. kim jong un did not speak at this event. he let these buildings do the talking and his message to america is your sanctions don't work. we will keep building our buildings and our missiles. new sat lied images examined by a north korea watchdog group suggests the country is preparing to conduct a sixth nuclear test which could be timed to coincide with this weekend celebration of north korean founder kim el sun. president trump has warned all options including a military one are on the table. the president trump and the president of china have had one call about what options may exist. china is still north korea's main benefactor but appears to

>> police in delaware trying to calm the fierce of a community after a four-year-old girl is abducted and sexually assaulted in new castle county testimony "eyewitness news" at john dick kin sob high school last night where officers gave stranger danger tips to parents. a child was kidnapped outside of her home in the village of plum run last thursday night. she was found nearly two hours later walking by benning park. >> this incident has struck a cord with everyone on our police department. everyone is concerned. everyone is putting forth their best effort. >> and police still looking for the child's abductor. parents we spoke to understandably say the disturbing incident has shaken their view of their normally quiet community. gunshots just miss a little girl in arizona while she sits in a store. >> this disturbing surveillance video shows a four-year-old girl playing in her grandfather's barbershop outside of phoenix on monday just as she sits down, bullets smash through the window and the girl runs to safety t1 man

heard the shots while working next door. >> really shocking, really lucky that she didn't get hurt worse. >> police arrested the suspected shooter. they say he had a money dispute with the tattoo parlor next to the barbershop and meant to hit the tattoo parlor. he faces multiple charges including aggravated assault. some shocking footage out of australia shows young children slipping through the cracks between the trains and the platform. reminding people to keep a close eye on their kids. video released is part of the safety campaign in new south wales. 81 children suffered injuries just last year from slipping and falling on train platforms: what a close call. clouds on the move making quite a sight. still ahead on "eyewitness news" -- >> we'll show you a place famous for its misty rains and cloudy days. >> we'll have clouds here and there guys but we look ahead

valleys like all of those things play into the fog formation. >> okay. >> i'm geeing out, can you tell. >> i enjoy this one. this isn't above my head. sometimes you start talking and i'm like beyond. >> i try to keep it as simple as i can. >> don't get in the clouds. >> i can understand fog. >> don't get me wrong he knows his consumer stuff so we have to keep -- >> meteorological stats. >> good day so far. >> absolutely is. we definitely had some clouds out there. it certainly is not going to be as warm as the last couple days but it's still really nice out. it's mid april guys. we expect mid 60's at best on this particular day of the year as it is. so the fact that we still end up a little bit above average for the daytime high we're not doing too badly. it's not going to be necessarily shorts and t-shirts weather through the rest of the afternoon. we'll start things off by look, at the overall pattern and what we can expect down the road here and then we'll sort of fine tune and zero in on specific day parts but for now notice your eye of course getting immediately drawn to

this batch of rain and showers that's moving its way through the midwest. notice what happened though. this is a nice long six hour loop. this was way more impressive when it was over illinois and wisconsin than it currently is. you see how it's fizzling. even though this is going to roll through our area it comes through with clouds. it doesn't come through with wet weather. high pressure is generally on our side and it continues to be so right through tomorrow for that matter. will will eventually be a storm system that develops across the center of the united states moves our way and that's what we look ahead to for the upcoming holiday weekend. so as high pressure leaves we'll see this next storm move in and the actual core of circulation with the storm is going to remain well off to our north but we're going to see the warm front move through first from south to north. that's going to help really warm things up into sunday and then the cold front crosses through later on that night. so o-typically with frontal passages up tend to think okay there might be somebody wet weather around and i think we'll see some wet weather mainly saturday night and again late on sunday generally

into the overnight so that's good news. if you've got egg hunt plans brunch plans sunday service plans i think up get them in. the daylight hours should be okay and future weather shows this very well. you've got a couple clouds from that first disturbance, no harm no foul. come friday also featuring clouds but some sun as well and temperatures that remain where they should into the mid 60's. then comes that frontal boundary. the beginnings of it already over the great lakes at high noon on saturday but our wet weather out of it, a, looks scattered and b, wouldn't get here until later that night after the sun has set so good timing, mother nature. then we start to warm up between those fronts so that's why we're calling for about 80 degrees and possibly higher than that for some of you as we move into sunday. look, outside the beach patrol headquarters, a live view for you definitely more clouds than what you'll find back in kutztown but it's still a pleasant start to the afternoon and we'll have a chance to moderate up a few

more degrees before you before it's all said and done. you have to deal with the gun the bad on days like this. the pollen levels are still quite high. u.v. index we'll call it moderate. don't underestimate that april sun angle. that could still get you. for the rest of the day the high should hit about 66 degrees t ever so slightly above average, very comfortable outside too and then the warmest day comes on easter. despite that system moving through i think we'll have a really nice weekend. >> we need a little rain for the flowers. >> sure we do. >> absolutely. >> you need a jolt today. >> wawa is offering you all the coffee you need and you won't have to pay a dime. >> that's because it's wawa day. the company is celebrating the anniversary of the opening of their very first convenience store in 1964 by giving away free coffee. by the end of today wawa will have given away 2 million cups of coffee. the company announced today that more wawas are coming to center city. >> two knew what whats, 22nd and south street 13th and chestnut street.
