>> ♪ >> live from the cbs broadcast center in philadelphia, this is cbs3 "eyewitness news". >> a jury is seated and opening arguments have begun in the murder trial for david creato jr. accused of killing his three-year-old son just two years ago. david creato is accused of killing that three-year-old brendan in october 2015. good afternoon, i'm jim donovan. >> i'm jan carabeo. today first responders began to take the stand as well as

the little boy's mother. "eyewitness news" reporter cleve bryan is live at the camden county courthouse this afternoon where that trial continues. cleve. >> reporter: good afternoon jan. right now the mother of three-year-old brendan creato is on the stand being cross examined by the defense. she testified before that her ex-boyfriend, dj, david jr. creato was in custody of young tren brendan at the time that brendan was found dead in haddon township back in october of 2015. now, this all started in the early morning hours on october 13th of 2015 when dj called 91 saying that he couldn't find his three-year-old son brendan. that led off a three-hour search. ultimately first responders finding the little boy's body down by the cooper river. now, this trial is all about how did the little boy get there and who killed him. right now they believe the prosecution that dj killed his son in an attempt to keep his girlfriend who didn't want to have any children involved in

their relationship but as we just heard from samantha, the little boy's mother that up to this point dj had been a loving father so they're trying to get to the bottom of exactly what evidence the prosecution has to point to dj as being his son's killer and if there are any other possibilities which is what the defense is trying to create that doubt t now the little boy's body found three-quarters of a mile from his father's apartment that morning. and one of the interesting things so far is that the little boy's feet were clean which would lead prosecution to believe that he was placed down by the river by some person. now, the defense points out that it is a possibility that the boy may have gone down there on his own or left the apartment somehow on his own pointing out that the little boy knew how to open the door his father's apartment. so right now we've heard so far from the first responders that were involved in the search, the detectives from the camden county prosecutor's office and then hearing now from the boy's mother to get a sense of the relationship

between the parents for three-year-old brendan as well as what was going on in the hours leading up to when little brendan disappeared and ultimately found dead at the cooper river. so, we will continue to give updates later today. this is a trial that a lot of people have been wondering the inside information because up to this point we don't know how the little boy was killed. it was ruled a homicide by asphyxiation but there's been no information about how the little boy was killed. live in camden, cleve bryan cbs3 "eyewitness news." >> thank you cleve. we'll look forward to your reports later on. in a pennsylvania courtroom the penalty phase of the eric frein trial starts today and he's facing the death penalty. the 33-year-old showed no emotion yesterday in milford township pike county as he was convicted on all counts including capitol murder. frein you may recall opened fire at the pennsylvania state police blooming grove barracks in 2014 killing corporal bryan

dickson and injuring trooper alex douglass. he spent 48 days on the run. a bucks county man arrested accused of robbing 11 banks over the span of four years. today the fbi arrested 57-year-old richard boyle of doylestown. authorities say boyle robbed 11 banks and in montgomery and bucks counties between 2012 and 2016. they say he got away with nearly $500,000. boyle robbed the banks using a mask and a straw hat as a disguise. >> authorities in montgomery county say a woman was taken to the hospital after she was struck by her own vehicle. chopper3 over the intersection of brook road and colwell lane in plymouth township around 9:00 a.m. this morning. police say a woman in her 40's was outside of her car when it rolled over her. she was flown to a local hospital with life-threatening injuries. well, we are warming up to the 70's today but april showers and even a thunderstorm are in our near future. meteorologist kate fehlinger is live on the cbs3 sky deck to tell us when the next round

of vain expected to hit. hi, katie. >> high, jan. we can expect the rest of the afternoon will remain dry t the showers that moved through were scattered in nature. those clouds have parted nicely and it feels great outside, really comfortable air mass despite the fact we've got moisture work with so it doesn't feel per se humid but we do have some clouds and still some wet weather to track. with that settled, storm scan3 is showing the full departure of any of the showers. you can see the tail end of them moving out over that last three hour loop. a wider zoom shows skies have begun to clear. you'll still have clouds as the day goes on but we're going to allow ourselves to warm up a lot more readily here since we have seen those clouds break nicely. 66 the current temperature at the airport into the low 70's millville and atlantic city and we're flirting with 70 even in palmyra at this hour. as the afternoon progresses again expect some sun, some clouds, a light wind overall, very comfortable that said with warmth in the forecast,

mid 70's is what we're expecting but later tonight is when a fresh round of showers and possibly even a few thunderstorms will rumble in. key word there is scattered, however, so a little later in the show we'll track those and also talk about more wet weather chances that await us. guys. >> thank you so much katie. well, in other news this noon a disturbing report out of penn state university police say they are investigating two invasion of privacy incidents. now, the incidents involve someone taking pictures or video of students showering in a dorm. police say the alleged incidents happened sunday night and early monday morning inside thompson hall. police are not preleasing any information right now about those victims. >> well, the investigation continues this noon into a stabbing and assault overnight in north philadelphia. this happened on broad street between allegheny avenue and clearfield street. police say one victim was stabbed while the other was attacked. both are now in that stable condition t police say they do have a suspect in custody. >> police are on the lookout for the individuals responsible for a brutal

attack caught on camera in philadelphia's kensington section. this video was taken around 12:30 saturday afternoon at b and tioga. the suspects attacked a man who left a restaurant. the victim was kicked and punched until he was unconscious. if you have any information you're asked to contact police. responding to a house fire in philadelphia's tacony section yesterday. crews discovered an unusual animal. they rushed to the fire around 7:45 last night had that had to be knocked down by 8:00 but as they fought the flames they came across a foot long alligator inside that home. initially the owner did not want to give the alligator over to animal control. it's illegal to have an alligator in the house in the city of philadelphia. >> the rhetoric between the u.s. and north korea continues to intensify and overnight pyongyang issued a warning to america. >> the warning comes as the trump administration also conducts a review of the iran nuclear deal. craig boswell has more details from the white house.

>> reporter: fighter jets roar into the sky as the u.s. and south korea are holding joint military exercises on the korean peninsula. >> exercise specifically is to strengthen the cooperation between the u.s. and the koreans in order to provide a combat like scenario as real as possible. >> reporter: the threat of a real war gets slightly closer to reality thursday when north korea warned of a "super mighty pretempt tiff strike that would wipe out america." the u.s.s. carl vinson is heading towards the korean peninsula expected to be on station next week. the trump administration says previous administrations have tried to buy off rogue regimes with nuclear ambition. they say president trump won't make the same mistakes with north korea or iran. >> an unchecked iran has the potential to travel the same path as north korea and take the world along with it. >> reporter: the u.s. is conducting a 90 day review of the iran nuclear deal despite acknowledging that tehran is

>> back now on "eyewitness news." a major crime ring is busted involving fake pennsylvania license plates. according to the state attorney general, the organized ring rented the fraudulent plates to people for $400 a month. those with the fake plates would then avoid paying parking tickets and highway tolls costing taxpayers millions of dollars. >> we believe it is possible that these schemes are happening at current time in other states. >> now, authorities say the alleged ringleader is a new yorker named rafael levy. he and his associates along with more than a dozen businesses now face charges. >> well, scam artists go to great thrones fool people posing as everyone from that government officials to your cell phone provider and they're also using social media to act like old friends. it started as a facebook friend request from a high school buddy then michael hanson says his friend. >> right there. >> seen here in his 1971

yearbook message him asking him if he had collected his stimulus money yet. $70,000. he claimed he saw michael's name on a list. the friend said he got money, too. >> and so i went oh, really. >> michael texted the number his friend suggested learning he would get his 70 grand government check if he sent eight lundquist bucks for the delivery charge. >> that was a red flag. >> about the same time his friend message him saying he, too, had sent that money. then michael's phone rang and a caller claiming to be from facebook said he could help michael. all he needed was remote access to his computer realizing that could lead to his computer getting hacked or malware being installed michael said no way. >> they're getting desperate desperately. >> it's forcing con artists to get more creative hitting targets from several

directions. >> you should never pay money to receive money. >> michael knows this and is a glad he didn't fall for the scam. don't you fall for it either. to avoid being contacted by one of these scammers experts suggest you change your security settings on facebook so strangers can't see your photos profile or friends list. >> feel like you always have to be skeptical. >> curious about everything. >> absolutely. mission complete. still ahead on "eyewitness news." >> from liftoff this morning to docking a few hours later we'll show you how the mission of precision high above the earth katie. >> and then looking ahead to this upcoming weekend things are at this point still looking like we'll end up with some unsettled weather. a disturbance to our south will throw some cloud cover and showers our way. it also will as a result stay cooler than average so not the most picturesque weekend coming our way but there are some lights at the end of that proverbial tunnel which we'll discuss on the other side. >> ♪

>> one of the hatches is opened. one on the station side. now they're waiting for the pressure to equalize one more time between the soyuz and the station itself and jack fisher can make their way into their new home for the next several months. >> pretty cool. two astronauts have arrived at the international space station. this is video of the hatch of the soyuz opening. it docked at the space station right around 9:1818 a.m.

it took six hours to travel to the international space station. the pair of astronauts took off at approximately 3:15 this morning from kazakstan. it took the capsule nine minutes to reach orbit. the astronauts will be conducting research and are scheduled to return to earth in september. >> six hours and they don't make them check their luggage. they take the luggage with them. [laughter] >> not like a regular airline where you would still be waiting at the carousel. >> only jokes we could make on that 1t the weather looks pleasant for the rest of the day at least but come tonight i think we'll see a couple showers. >> okay. >> a few thunderstorms move in and that comes courtesy of a couple of different disturbances moving through. for now it's just a few fronts that are lifting in or crossing through and then over the weekend we have that system we were just talking about right before the break that's going to come in and bring additional rounds of showers and certainly some clouds. it also keeps things on the cool side. we're kind of all over the place here but i want to give you the windows of dry weather opportunity right now. let's go out there and one of those opportunities is happening as we speak.

the afternoon looks pretty good. last few hours have cleared out nicely for many of you. not everywhere. i'll show you a couple neighborhood network cameras in a second but looking at the broad scope of things heavy rain across the great lakes. the system that's going to drag a cold front through is definitely showing a lot more signs of organization at this point. you can make out that cold front. that will cross through into tomorrow. it doesn't look like it's an all day event by any stretch but let's walk you through future weather to give you a sense of how things will shake out. later on today, a few pop-up showers through central pennsylvania. it's not until late tonight that any additional showers and storms would rumble in its looking like it would be the northern half of our area. tomorrow spotty shower or thunderstorm with the cold front passing on through. and it really could happen at any time. maybe 1:00 in the morning, maybe another into the second half of the day but the whole day not a washout. be ready for a few raindrops any time. then we start to clear things back out again. meanwhile, yeah, we're looking

at a tropical satellite here. reason being i know this is crazy to be talking about this early and it is very early, but we actually have tropical depression number one out over the open waters of the atlantic right now. crazy to think but if you know what, if you got the right conditions anything can happen. the good news is even though this is making a bit of a northwesterly path it's going to eventually get absorbed by another area of low pressure moving east so sort of gets -- collides with that approaching system and then it's going to go away but very interesting that we are this early in the season the hurricane season doesn't start until june 1st so we're very very much antidepressant had of schedule. sixty six degrees the temperature at the airport, 68 already in atlantic city. here's that little tour around the neighborhood. plowed -- peaks of blue sky and sunshine at kutztown area

middle school. surprised there's no one out here right now, maybe people actually have to go to work and school but regardless a nice afternoon to spend out on the area beaches and the shore points. rest of the day we'll call it partly sunny and nice and mild up to about 73 degrees but later tonight as we showed in you future weather scattered shower or a thunderstorm will rumble in northern half of the region most especially prone to that. moving forward, not looking horrible. but we do have that system we talked about for the weekend. saturday brings in the chance of showers already. sunday looking like the better chance for more widespread showers. it's also the cool left day but then we should start to clear things out and get back toward more typical temperatures on monday and tuesday. all in all not a bad forecast but it is active. >> i'll take it. thank you katie. tennis superstar serena williams gearing up for her biggest challenge yet. motherhood. she announced she's 20 weeks pregnant and expecting a baby this fall. that means she was playing in the australian open while about eight weeks pregnant and

but when right-wing politicians to protect our health care. tried to pass a disastrous health care repeal bill that raises costs and cuts coverage, macarthur wouldn't oppose them. macarthur wouldn't protect us from a bill that raises premiums and causes 24 million to lose their insurance. wouldn't oppose a massive "age tax" on people over 50. and isn't fighting to protect coverage for pre-existing conditions. tell tom macarthur - stop trying to repeal our health care.
