"eyewitness news" reporter joe holden is live in west chester with more on this, joe. >> good evening. this unprovoked attack unfolded at 2:30 in the morning on may tenth in the parking lot behind me here, police are not identifying the victim, out of, concern for his safety. veteran police officers and detectives say even for them, video was hard to watch. unprovoked punch on a disabled man. >> the defendant just turned, sucker punches him right across the face. >> victim with cerebral palsy walk in the west chester 7-eleven night of may tenth. there on your screen is barry baker, baker, a 29 year-old man, mocks and ridicules that victim. >> the defendant starts to make fun of the victim about how he walks and how he moves and then when victim comes back out the defendant does it

again. >> reporter: baker does his routine imitating victim at least three times before throwing that sucker punch. police say now stunned victim got in his car and called police. >> victim showed a lot of dignity, i cannot say same thing for the defendant here. >> it is sad. >> reporter: we played video for people as you might expect they were disturbed watching bake's allegedly mock the victim. but when the punch was thrown. >> then hits him. >> my goodness. >> reporter: baker surrendered on monday and charged with assault. people believe there should be serious consequences. >> he definitely should do jail time. he clearly deserves jail time. >> reporter: baker has a extensive criminal history according to chester county court record they show he has been in jail before on guilty plea toss theft, forgery, and d.a. tom hogan says a strong message must be sent. >> it is just shock nothing to day's world you would have somebody attacking you, simply because you suffer from

cerebral palsy. >> reporter: we have sent messages and left, messages for barry baker at a number listed for his business, but those messages have not yet been returned. he has a day before a judge, late, later this movement reporting live from west chester, joe holden for cbs-3 "eyewitness news". >> joe, thank you. jury selection is underway in pittsburgh in the criminal sexual assault trial of comedian bill cosby. this is video of cosby arriving today at courthouse in pittsburgh. jurors will be sequestered nearly 300 miles from home, once the trial gets underway in montgomery county. former temple university employee andrea constand is accusing cosby of sexual assault in 2004. choose hog sits on the jury is no easy task especially in a big high profile trial like cosby's. >> jury consultants say right pick can make a difference between guilt or innocence. our david spunt talked to one man in philadelphia made a career out of picking juries. >> reporter: he has, old days of picking jury, crossing your

what he says might surprise you, ukee and jessica i will be back at 11:00 with what he has to say about the cosby case. he says it is unique out of all of the cases we have seen. >> thanks, david. the philadelphia police and fire departments are investigating a suspicious fire we first told but last night, it happened early sunday morning at a home in north philadelphia. the body of a pregnant woman was found inside, "eyewitness news" reporter alycia nieves is live outside central detectives tracking these latest developments, alycia? >> reporter: well, jessica, just a few minutes ago investigators here at central detectives sent this investigation over to homicide detectives. officially ruling this death of the pregnant woman suspicious after already ruling the fire yesterday, suspicious. a pregnant woman's death in this north philadelphia neighborhood is hitting some hard. >> i'm shocked, like that is just awful. >> reporter: this woman lives on west susquehanna avenue a cross the street from the home on fire yesterday morning. she is still struggling to process after the fire was put

out, authorities found the body of a 35 year-old woman here, who was five months pregnant. >> i have spoken to her, quite often. she seemed like a nice lady. she was very polite, all the of the time we have spoken, we always chat. >> reporter: fire marshall was trying to determine the cause of the fire that happened here while police investigate whether the woman was already dead before the fire started. the cloud of suspicion here coming after investigators say that the fire itself, seemed suspicious. >> somebody killed her because i thought that was really nice people i spoke to them all the time. >> reporter: and, while investigators say death of the pregnant woman is now suspicious her body found after the fire it is important to note that officials cannot call this a homicide quite yet because the cause of death for that pregnant woman is still a mystery to them and the medical examiner. reporting live from philadelphia, alycia nieves for cbs-3 "eyewitness news". >> thank you. delaware state police are investigating after an

off-duty trooper fatally shot her boyfriend during a domestic dispute this happened around is 11:00 inside a home on the 3200 block of champion drive-in pike creek. investigators say when office 's arrived they found a female trooper severely beaten they also found her boyfriend four three-year old maurice eiffel with a gunshot to the torso. he was taken to the hospital where he was pronounced dead. the trooper's name has not been released only that she's a eight year veteran and a autopsy is scheduled. frightening ordeal after some people got stuck in the elevator for hours at the tropicana casino in atlantic city. american a dozen people were trapped early sunday morning when elevator was stuck between the sixth and seventh floors. the elevator was in is what called a blind shaft that means it doesn't stop on every floor. atlantic city fire fighters had to pull each person out one by one to safety using a hardness and rope. >> the elevator, was overcrowded, there was 14 people in there next opening wasn't until the 15th floor,

>> um-hmm. >> that rain's coming down, young lady. >> it did. >> yes, it was was relentless. south jersey and shore pick up two, 3 inches have rainfall through the day-to-day g news faucet has turn off in many areas giving us a drying out period as we head into our monday evening. it is still looking pretty dreary as we look live at center city philadelphia low cloud hanging around, fog, areas of drizzle, 65 is our current temperature. temperature because of the cloud cover and easterly wind flow at times keeping temperatures cool but dew points they are elevated in the 60's. we have that muggy factor. temperatures, cooler then average all across the area right now. sixty-four in ac. we are at 63 in trenton. fifty's in the poconos. storm scan three is showing us trend of the entire day to day , cloudy conditions, and rain for most of news and around i-95, points south and east, but it has moved off shore, residual showers along the jersey coastline. we are seeing light rain exiting the delaware beaches right now, light rain coming

down rehoboth beach down into ocean view, and we do have another area of low pressure off to the south and west. one is leaving and one on the way in. in association with this shower activity in and around the south east. our best chance of wet weather activity redeveloping for tomorrow, will again, be on the coastline and south jersey a soak tore day, millville picking up close to 3 inches of rainfall. dover, delaware picking up close to 2 inches. daily rainfall record in ac with close to 2 inches. mount laurel at mom's house .6 of an inch. in philadelphia half inch of rainfall. fairly healthy amount there as well. we will head in the evening, i think we can leave umbrella behind but leave that slick's long. we will have highs of drizzle, foggy conditions, cloud hanging around but temperatures will stay very stable as we head throughout the evening hours. generally in the middle 60's, so we will be on the mild side of average but again, with the dreary conditions and muggy factor it will feel quite damp visibility showing us reduce add cross many reporting sites across the coast and

visibility down to a mile and a half in ac, 4 miles in wildwood, down to a mile visibility in mount pocono. as i mentioned dew points they tell us about this sticky factor where they are in the 60's. you step outside and feel that , gross, mugginess and that is a trend right now that steam factor even though temperatures are fairly mild we have a lot of moisture at the surface that will start to wayne nor the day tomorrow and we will start to feel slightly more comfortable especially during the afternoon but overnight tonight cloudy, muggy, fog, drizzle, back to 60 degrees. for the day tomorrow temperatures jump up in the 70 's, a few degrees below average, mostly cloud which a chance of some scattered showers redeveloping as we head into the afternoon hours, and mainly along i-95 but best chance will be along the immediate coastline. it is hand telling low differently as we approach tomorrow. it is more aggressive model bringing us rainfall, well further west then other models but give you a projection best chance of rain ace long the jersey coast, once again, delaware beaches but we could see showers redevelop in
