courtroom since the trial began and he joins us live from the montgomery county courthouse in norristown with the day's developments, joe. >> reporter: interesting moments here inside montgomery count i courthouse. andrea constand has spent the day on the stand, defense attorneys, really going after some inconsistencies. attorneys say that they make little, if there is substance, in these inconsistency but what really has emerged out side the courtroom is some stern conduct on the part of the court and light hearted moment bill cosby shared with his assistant. animated bill cosby appears to joke with his assistant outside courtroom where his defense attorneys have been feverishly working to feedback algations that he drugged and sexually assaulted this woman andrea constand. she has now been on the stand for a full day, constand testified cosby gave her three

pills that caused her, to slip in and out of consciousness on a january night in 2004. she said that she awoke to find cosby performing a sex act. defense attorneys seized on phone record showing constand continued to call cosby after the alleged assault. constand's own lawyer says that she had no choice, telling us that she was doing her job as a temple university basketball director because cosby was a school trustee. about her composure on the stand. >> i thought that she was wonderful. she is maintain her cool, i would be out there screaming are you kidding me. >> reporter: since trial started officials at montgomery county courthouse has closely monitored the horde of reporters and, and high profile, glare why allred , after her cell phone rang. court workers ushered her out. cell even if use in the courtroom is banned. local tv news digital producer is now barred from covering the trial after he texted in the courtroom. he apologized at conclusion of

christopher wray is receiving bipartisan support at this point as nominee for the new fbi director position. president trump has select his pick for new fbi director, announcing the news in an early morning tweet. the president tweeted i will be nominating christopher a wray a man of impeccable credentials to be the new director of the fbi, details to follow. there were no further details offered, it comes as a day before the fired former fbi director james comey was to testify. christopher wray is considered a safe main stream pick, a former assistant attorney general overseeing the department of justices criminal division under president george w. bush and he also played a key role in overseeing actions in the war on terror after the 9/11 attacks. he recently served as new jersey governor chris christie 's lawyer during the george washington bridge lane closing investigation. two former christie aid were convicted of plot to go close bridge lanes to punish a democratic mayor who wouldn't endorse christie. governor christie was not

charged in the case. >> he seems like to me he is perfect kind of person, i thought we should have a career person, i think over the fbi, someone with a deep bench of experience. he seems to fit that bill. >> reporter: reaction to wray 's nomination has been pouring in from tri-state area legislators on capitol hill. republican, pennsylvania congressman pat meehan taught ed his work with wray during enron scandal. he issued this statement saying chris wray is a terrific choice by the president to lead the fbi at this critical moment in time. he will bring credibility, credentials and great character to the role, and will earn the respect of the bureau's agents. delaware democratic senator chris coons also issued a statement endorsing christopher wray saying in part i'm encouraged that president trump has nominate sod one with significant federal law enforcement experience, rather than a career in partisan politics. christopher wray currently works in private practice for king and spaulding law firm and graduated couple laud from yale university in 1989, earned his law degree from

it follows a month long investigation in which authorities say, that some employees, sold drugs, to under cover officers. our greg argos has been working on this story all day long and greg, what can you tell us now. >> reporter: i can tell you that this happened around noon lunchtime this afternoon, and, very packed chipotle restaurant. police had their eyes on one of the employees at this restaurant for a week and decided to make an arrest after that employee tried to sell a half pound of marijuana to under cover officers, for $975. now our cameras rolled as 22-year old robert lane was arraigned on numerous drug charges. radnor township police investigators say 24 year-old kadeem was charged was co conspirator. a third person arrested this afternoon. this investigation lasted weeks as court paperworks shows under cover officers bought marijuana from lane, multiple times, as he uses his position inside chipotle as cover. lane's mo we're told, carrying drugs on him inside the

restaurant and making transaction, outside. now the bust as i mentioned happened at height of the lunch, rush hour, tonight at 6:00 we will hear from someone , inside of the restaurant as police, stormed the restaurant hear exactly what he has to say. i will tell you why health officials from the township were inside, hours after the bust happened, that is coming up in just about one hour. for now we are live in radnor township i'm greg argos for cbs-3 "eyewitness news". an 11 year-old girl is struck by a train in philadelphia's kingsessing neighborhood. it happened near 56th and grace avenue. police say the girl was walk ago long the track and who her footing, falling in the path of the train. she was dragged for more than 500 feet, before the train came tie stop. she was rushed to children's hospital, in critical condition. the french continues search for suspects in connection with the shooting in wilmington that critically injured a young boy. officers responded to reports of the gunshots on the 700 block ofe sixth street yesterday afternoon. that is where they found a six

year-old boy who had been shot in the head. we're told his mother was hit by broken glass, police tell us that the young boy remains in critical condition. and engineers are expecting the area where a construction fire closed both spans of the delaware memorial bridge and snarled traffic for miles. chopper three captured these images earlier today, delaware river and bay authority officials say that sparks from welding, ignited construction material underneath the bridge about 10:00 o'clock this morning. twin spans were both shut down for hours, but all lanes are now, reopened. well, it is a case that is making national headlines. >> coming up on cbs-3 "eyewitness news" former high school student is on trial for allegedly using text messages to put her boyfriend to commit suicide. it caused him to take his own life. we will take you inside that courtroom. also, a summer heat starts to settle in there is a push for technology that could prevent children from being left in hot cars. find out how it could warn

we don't have summer like temperatures but we brought back sunshine across the area and we can see rehoboth beach, people outside on the board as well, soak nothing that sunshine that has been absent over last several days and we can see on satellite imagery a picture of the cloud over last couple of hours. right along the coastline we have seen really nice clearing , same case in the delaware beaches and off to our north, that cloud deck is eroding and it will do so for us over the next several hours so gradual clearing, yes, we might even see the sun before it sets this evening. cool temperatures, hanging on to middle 60's. overnight tonight feeling chilly once again need that extra blanket, mostly clear falling back down to 54 degrees but wind light and variable so not too much wind chill impact. temperatures we are certainly on the much cooler side of average, 66 degrees in trenton sixty-four in ac. sixty-five in dover. as i mentioned dew points have dropped off, muggy damp day yesterday, dew points down about 10 or 15 degrees. we are feeling much more

after the alleged incident. the president announced in a morning tweet that he has nominated christopher wray to replace fired fbi director james comey. wray is an attorney who represented new jersey governor chris christie in the bridge gate scandal. he also served in the department of justice, in 2003 through 2005. tomorrow comey will testify in front of the senate intelligence committee. according to his opening statements that was released to day comey will testify that president trump asked him, to remain, loyal, to the presidency. good evening, i'm ukee washington. i'm jessica dean. unusual trial in massachusetts , teenager is charged with allegedly using phone calls, and text messages to convince her boyfriend to kill himself. the prosecution called michelle carter's friend and acquaintances to the witness stand on wednesday, they all received text messages from carter around the time of her boyfriend's suicide. one high school class made read one of the texts from carter. >> he called me and i heard

like muffled sound and some type of motor running and it was like that for 20 minutes and he wouldn't answer. i think he killed himself. >> reporter: prosecution is trying to show carter pushed conrad roy to commit suicide, the 18 year-old died of carbon machine oxide poisoning in his pick up in 2014. on the witness stand carter's friend samantha boardman read messages she got from cart their july. >> i was on the phone and he got out of the car, because it was working and he got scared and i told him to get back in. >> reporter: carter sent board man another text when she learned detectives would be looking at roy's phone. >> they have to go through his phone and see if anyone encouraged him to do it on text and stuff. they read my messages with him i'm done. his family will hate me and i could go to jail. >> reporter: carter's defense team is trying trying to show roy's death was the result of the own mental health struggles and he made other attempts to kill himself. >> also saw in his various text message that is conrad roy was, speaking with

neuroblastoma. >> idea of hope has been implanted in me from the very beginning. i can say that alongside of that, the fuller, richer picture of the experience, as families navigate are not only those difficult points but also, those really incredible moments that they also share together because cancer brings families together. at the same time it is really difficult, it pulls the family closer. >> reporter: families like this, tony need a kidney transplant. his mom like so many others is counting on funding and research. >> i want to work toward finding more cures and less toxic therapies because i feel like it breaks my heart to see other children get through this. >> is there kid literally cured today because of the research that we have been able to fund. >> reporter: and yet hope comes in a variety of experience was parents, of little children. >> i hope this is true, i hope that this is not the path ahead for us and they sit and wait during that diagnosis period. when the reality comes that they are diagnosed with cancer

"eyewitness news" reporter greg argos is live in radnor township with how police cracked this case, greg. >> reporter: ukee and jessica investigators say it was quite simple. they walk in this chipotle restaurant here in radnor township and asked one of the employees for pot. this afternoon under cover investigators were able to purchase, a half a pound of marijuana from one of the employees for $975 we're told and that was last straw before this arrest. radnor police say 22-year old robert lane work at this chipotle at lancaster avenue. but he was offering more than just chips and quacamole to some customers. >> there were employees there selling marijuana out of the store. >> reporter: police superintendent william colorul o says that investigation began weeks ago. court documents show under cover officers began purchasing marijuana from lane in mid-may. >> today, they came out here,
