good evening, i'm ukee washington. i'm jessica dean. "eyewitness news" reporter greg argos is live in radnor township with how police cracked this case, greg. >> reporter: ukee and jessica investigators say it was quite simple. they walk in this chipotle restaurant here in radnor township and asked one of the employees for pot. this afternoon under cover investigators were able to purchase, a half a pound of marijuana from one of the employees for $975 we're told and that was last straw before this arrest. radnor police say 22-year old robert lane work at this chipotle at lancaster avenue. but he was offering more than just chips and quacamole to some customers. >> there were employees there selling marijuana out of the store. >> reporter: police superintendent william colorul o says that investigation began weeks ago. court documents show under cover officers began purchasing marijuana from lane in mid-may. >> today, they came out here,

with the intention of buying a significant amount of marijuana. that happened. >> reporter: under cover office's rested lane with a half pound of pot on his person. the other man was also arrested. investigators say he is driver of this mazda and one of lane 's coconspirators. our camera rolled as police arrested a third suspect at the chipotle restaurant. >> we were sitting, eating. >> reporter: at the time of the bust patty mcnamara was having lunched in the packed restaurant. >> next thing there was a side door opened and cop coming in waving his arms saying everybody get out. >> reporter: everyone left and then the arrests made. township health inspectors found drug paraphernalia in the bathroom toilet tank and numerous health code violations inside the restaurant. >> health inspectors are going through it. conditions are not very good that we're finding right now. we think there are serious health concerns. >> employee would come out of the store with the marijuana on his person, which indicates obviously that he had it on

his person handling food. >> reporter: back here live you can see this chipotle restaurant is still closed. also you heard numerous health code violations, those will have to be rectified if and when this stories to be reopened. we're live here in radnor township i'm greg argos for cbs-3 "eyewitness news". >> thanks, greg. day three of the bill cosby's sexual assault trial end with andrea constand wrapping up nearly two days on the stan. our joe holden has been following the trial all week long and he joins us from the montgomery county courthouse in norristown with today's developments, good evening, joe. >> reporter: ukee, good evening to you. late breaking developments out here a little bit of chaos as bill cosby was leaving he was surrounded by his legal team and a actress named sheila frazier. she said hollywood needs to support friend in hollywood. basically call for hollywood to come out and support bill cosby. however, much different tone inside where mercon trolled as his defense team tried to beat back some pretty serious

allegations. star power turning out for bill cosby has been limited, on monday it was former rudy side by side with him on the way into court. cosby's wife has not been present but close friend civil rights act wrist mary frances berry was at cosby's side on wednesday. >> i'm a friend. i have men him a long time. he has been in involved in all kind of good causes. he supported me. >> reporter: while comedian's lawyers worked to expose inconsistenceciness testimony from andrea constand outside the courtroom cosby has been animated. here he is seen react to go a order by sheriff's deputy to reporters to turn off their phone. cosby, pr representative says they are grateful for the support. >> mr. cosby is always been or will continue to be a friend, fans, he is not asking them to proclaim his innocence of guilt. he wants them to come inside and hear truth. >> reporter: cosby's legal

team spent the entire day trying to walk back andrea constand's testimony. her attorneys who watched from the gallery said she held up under intense gallon pressure. >> we are very proud of her. you see how difficult it is. then sexual assault victims are criticized for not coming forward more quickly. >> at this point the day wrapped up with andrea constand's mother on the stan, basically trying to inquire to cosby the testimony about what were those pills he gave her daughter in 2004? of course, trial continues tomorrow, so late day fire works here, we are told, to expect much of the same as the process goes on. live from norristown i'm joe holden for cbs-3 "eyewitness news". an 11 year-old girl is hit by a train in philadelphia's kingsessing neighborhood this happened near 56th and grace avenue. police say that the girl was walk ago long the track and who her footing, falling in the path of the train. she was dragged for more than 500 feet before that train came to a stop, and she is now in critical condition at

children's hospital. no arrests have been made in connection with the shooting that critically injured a six year-old boy in wilmington. officers responded to reports of the gunshots on east sixth street yesterday afternoon. police found child with the gunshot wound to the head, and we're told his mother was not shot but hit by broken glass. the young would i remains hospitalized in critical condition tonight. philadelphia's police need your help tracking down this man wanted for sexual assault. officers say that the suspect followed his 23 year-old victim into the wawa on the 3900 block of aramingo avenue and then assaulted him. police say man then jumped in the blood four door sedan, possibly a mazda or honda and then took off. if you have any information call the police. former fbi director james comey is scheduled to testify to the senate intelligence committee tomorrow. according to comey's opening statement released to day he will testify that president trump asked about the investigation into former national security advisor michael flynn, but comey says

trump told him russia investigation was creating a cloud over his presidency, and he says that the president, asked him what they could do to lift the cloud. just moments ago trump's lawyers say the president feels completely and totally vindicated by comey's testimony and is eager to move forward. cbs news will carry comey testimony as a special report tomorrow, join charlie rose, nora o'donnell and gayle king at 10:00 a.m. right here on cbs-3. the president has nominated christopher wray as next director of the fbi, wray currently works in private practice for king and spaulding law firm. he graduated calm laud from yale university in 1989 and earned his law degree from yale in 1992. he also represented new jersey governor chris christie in the bridge gate scandal. it will be quad dan avers movie think fall in the race for new jersey governor. the state's lieutenant governor, took part in the round table discussion today. she said property taxes in new jersey are a crisis and she has pledged to only serve one term if she cannot bring those property taxes down. guadagno will face former goldman sachs executive phil murphy who easily won last night's primary on the democratic side. he served as ambassador to germany during the obama administration and promised to fix the state's pension crisis he also said he will ram up up education spending and join regional greenhouse gaza lines trump administration sought permits that would allow five co to survey the atlantic ocean for future drilling of oil and gas. the testing area includes coastline to coastline from florida to the delaware bay right in our area "eyewitness news" reporter cleve bryan look at the potential impacts that the move could have. >> it would be like living next to a fourth of july fire works display going off for like a week at a time. >> reporter: that was unpleasant according to some lethal impact on marine life

if new seismic survey allowed off the coast of new jersey and delaware. last month trump administration, undid former president obama's ban on testing for oil and natural gas in the atlantic and federal agency sought approval for five companies to begin testing the sea floor from the delaware bay south to florida. >> for over 45 years people of new jersey have for the off shore drilling. >> reporter: environmental groups say air blasts used in seismic testing can disturb whales, dolphins from feeding and migrating. testing request says that the math marine fishery service quote is requesting comments on its proposal to issue incidental harassment authorities to incidently take marine mammals during the specified activities. if oil and gas are found off the coast experts say oil bid would be likely a hundred or more miles from beaches but as oil spill could have a catastrophic impact on marine life and shore tourism. >> we are playing russian roulette with beaches and water and it doesn't make sense. >> reporter: new jersey's petroleum counsel supports

a philadelphia organization is offering a series of events to continue their fight against aid. >> health and services group philadelphia fight hosted a sum to it day at pennsylvania convention center, and, the event kicks off programs, planned all month long, aimed at providing latest information and opportunities for free, hiv testing. the healing powers of music, on the healthwatch tonight patients in the montgomery county hospital, now have not just, doctor and nurses on call but musicians as well. >> health reporter stephanie stahl joins us now to tell us

temperatures really suffer but we are seeing sunshine break ing out right now, check with our live neighborhood network rehoboth beach, blue skies, sunshine, couple people out on the beach, couple people outside on the board but temperatures are still quite chill a long the coast. storm scan three is showing thaws trend especially over last couple of hours that cloud deck eroding off of the coastline there, delaware beaches getting some sunshine as well and up next we will see that sunshine breaking out we are seeing it breaking out of the poconos and lehigh valley and will continue to move off to the south and west and continue to break down so everyone overnight tonight, clears on out. mostly clear, chilly falling back to 54 degrees and has been a cool start to the month after an extremely warm, excuse me, april, cool may and then so far for june we are down about a degree and a half as far as averages are concerned but we will boost that number up as we head in the upcoming weekend. 84 degrees our high on saturday. sunshine with a straight afternoon, thunderstorm
