tension is good but keeping is tough i'm cleve bryan. we will tell you why people are frustrated with the summer flounder season. investigation currently underway after a man is shot dead by police. evidence officers are now focusing on as they look into this deadly shooting. it is 6:00 o'clock. call to repossess a minivan end in gunfire. police say boyfriend of the vehicle's owner is shot dead by the tow truck driver trying to haul away the van. tonight we are learning why that repowe man said he had to pull out his weapon and start shooting. good evening, i'm natasha brown in for guess contact ukee will be along in just a moment. "eyewitness news" reporter anita oh is tracking latest developments in the deadly shooting in point breeze tonight, anita? >> reporter: good evening, in a cash a neighbors say thinks corner known for violence with several shootings here in recent months, and this morning violent encounter left one man and a dog both dead.

>> just like firecrackers. >> reporter: that is what mike young who was working nearby said he heard just before 10:30 on the corner obviate event and dickinson street in point breeze. >> it it was wrapped fire. it sounded like a fire cracker we saw smoke. people screaming, running from the scene. it was pretty scary. >> reporter: philadelphia police say tow truck driver had attempted to repossess a silver toyota minivan by santana mini market without realize would go man was inside. she got out, started arguing with the tow truck driver and called her three two-year old boyfriend to the scene. >> we heard lady screaming, and i guess he came and situation escalated, to the point where someone is dead. >> reporter: when boyfriend arrived he pistol whipped tow truck driver and according to investigators they started shooting at each other. boyfriend later died at thomas jefferson university hospital and neighborhood dog, caught in the cross fire was also killed. >> it is sad it happened. things didn't to have turnout

that way but it is unfortunate that it did. >> reporter: investigators laid out 27 markers for ballistics, which includes shell casing and fragments and police recovered weapons from both men. >> it makes you realize that anything can happen at anytime >> reporter: police say after arguing with that car's owner the tow truck driver did call the bank to confirm that those car payments had not been made we are told he is cooperating with the authorities but at this time no arrests have been made and no charges have been filed. live from point breeze tonight i'm anita oh for cbs-3 "eyewitness news". >> thank you very much. also tonight a philadelphia police officer is on administrative duty after a deadly shooting in feltonville this happened last night on the 4200 block of whittaker avenue. investigators say the officer attempted to question a man who was driving a dirt bike, recklessly when a struggle ensued. we have now learned that surveillance video recovered nearby shows the man running away when he was shot and killed. witnesses told police that the

man appeared to be reaching for a gun. >> the officer grabs him, and appeared to have a weapon. he himself, looked the guy in the face and said don't do it, man. >> regardless of the facts a young black person was shot and killed by a system that repeatedly kills us. >> police have not released the man's name just yet and shooting does remain under investigation tonight. a spokesmen for bill cosby says that the comedian may in fact, take the stand at his sexual assault trial. this is video of cosby walking in to court today, and day five of the trial. cosby spokesmen andrew wyat dropped surprising news on the courthouse steps by announcing the possibility of cosby himself taking the stand. >> nothing is ever off the table in a trial of this magnitude. you have to weigh all of your options. in a ballgame things change, players have been taken out and sometimes the star player plays and sometimes they do

raising the size limit. >> reporter: new jersey's decision to snub federal guidelines comes after analysis by montclair state university that found raising size limits to 19 inches could carve state's flounder industry 800 million-dollar, and about 3500 jobs. he thinks federal regulators have gone way too far. >> it is pathetic performance. >> reporter: reviews to come in compliance could backfire and lead to the federal ban of flounder fishing in new jersey decision is pending right now. trying to compromise the state of new jersey shorten summer flounder season by almost a movement not only have they shortened summer flounder season but they have cut back on the number of keepers to take home from five to three. we are still working on my first. frank caught the day's only keeper john smith caught two just under legal limit. >> what is it like having to throw back that kind of fish. >> for me it is almost normal. keepers are far and few between. >> reporter: are you okay with that. >> you accept it.

chop held alex lemonade stand kick off event today. they handed out a very special award. ellen tracie was honor with this year pitcher of hope award. she's senior director of clinical operations, oncology and medical nursing at chop. tracie and nursing staff has done a lot in the fight against childhood cancer and today chop hosted 28 stand all throughout their care network.

mostly clear, perfect fire works weather as we head in the day tomorrow we could see passing shower, rumble of thunder, best chance northwestern suburbs lehigh veil and poconos but that is all quickly clearing out as a little disturbance will make a quick passage through delaware valley. if you are planning on going on a hike this weekend, doing camping poconos forecast is looking beautiful. that chance of the spotty thunder shower in the morning tomorrow otherwise sunshine, for sunday, high temperatures up around 84 degrees and in your extended forecast, we're really heating things up to 92 , potentially dealing with near record high temperatures, sunday, monday and tuesday. so yeah, no errors in this forecast, but sunshine and heat taking us all the way into next week. now to pack it up and head over to the greek festival and take in all of the sights over there and see you at 10 and 11:00. we will be right back.
