re-read testimony from a 2005 deposition, where cosby acknowledged a sexual encounter where he says he gave andrea constand three pills. he called them her friends and said they would help her relax. he said they were benadryl. constand, a woman cosby had been mentoring, told markedly different story explaining cosby a periods with the three pills and she says he described them as herbal or natural. she testified she became incapacitated and claimed when she regained consciousness, cosby was performing a sex act on her. cosby's defense team has hammered at constand's version of the 2004 night, pouncing on inconsistency with dates and recommendations. the prosecution has written that off telling jurors those inconsistencies were minor. legal expert have said the trial boiles down to the question of con send. under the influence andrea constand being able consent to sexual activity, prosecutors say no, but cosby's team says

district just closed minutes ago at noon. all after school activities are canceled. camden city school district will dismiss at 1:00. after school activities there also canceled and hamilton township school district is having a one session day. meteorologist, katie fehlinger tracking record breaking heat. how hot do you think it will get today? >> few more degrees up our sleeves here for the rest of the afternoon here, rahel. already as of 11:00 a.m. we had cracked 09 degrees at philadelphia international airport, so the he is definitely palpable. as is the humidity. that's the other xfactor, the other weather variable in has to come into play here today. so definitely steamier with the actual air temperature, not to mention the dew points, climbing on us. we take quick peak at storm scan3. you won't find any stormy weather. totally clear. couple of scattered clouds out there. but it is hot. these are your all air temperatures, 92 at the airport, so right on case to hit a record breaking value. now, the call that we've made as the eyewitness weather team is 96 for the day. and you can understand why.

there is heat advisory that just went into effect in the last four minutes. and it is not specific to the entire region, but the urban corridor absolutely up and down i59, and the flanked counties, that's where you will see the worse that far oppressive heat. and it will last us up until 7:00 p.m. the advisory that s but again, record heat projected. ninety-six is the call for today. that would break the record of 95 last set in 1956. so of course the question s. when does this wrap up? in short, that wraps up by tomorrow, rahel, but there is quite a pattern change that awaits us, we will talk about that later in the show. >> kate, see you soon, thank you. after brief stand-off with police, the husband of murder south jersey radio host under arrest and facing weapons charges. over ocean hearts avenue egg harbor township, the atlantic i am county prosecutor say when raided the business and home of doctor james kauffman, he displayed a handgun. later surrendered with the assistance of police negotiator. april kauffman found shot to death in her lynnewood home in 2012. no one has been charged with her murder.

eighteen penn state fraternity brother wait fog finds out if they'll stands trial in connection with the death of a fraternity pledge. yesterday prosecutors show chilling surveillance video of 19 year old timothy piazza appearing unconscious as members of the beta theta pi frat sat on him and poured liquid on his body. piazza seen attempt to go stands several times but then collapsing. >> video shows a barbarick death, young man who was struggling, who was sick, who was ill, who was in pain. >> videotape was simply stated too painful for the piazza's to watch. >> piazza died after falling down the steps at the beta theta pi house in february following a night of heavy drinking, officials say 911 wasn't called until nearly 12 hours later. university has permanently banned the fraternity. >> this new, attorney jeff sessions preparing to face the senate committee investigating russia meddling in the 2016 election, testimony comes as president trump is reportedly considering firing the special council who recently took over the fbi investigation on the

nine or above. in may we had three. season so far obviously doing the math, had six. average is 23 days that hit at least 09 degrees, so on our way at least. now, there is also an air quality alert we have to mention here, good portion of the delaware valley is included in this. that does mean it is unhealthy for you to be out in this for very long, if you fall into the sensitive category, any lung disease, or asthma, or if you're, you know, little kids or the elderly respect just not great to be out in this kind of heat for very long. so please take it easy out there. looking at storm scan, couple of showers, thunderstorms have gun to pop here, back through part of the midwest. we, how much, as i mention at the desk, will see front drop in here t really is not looking to me like it will produce much, perhaps you see spotty shower, thunderstorm late today, tonight, maybe even as light as early tomorrow morning. but that's it. the big legacy that front leaves behind is the temperature drop. now, we're switching gears and talking about really cool event going on later on tonight. it has been hell off multiple times. but there is rocket launch going on at wawa island

tonight. as it takes off, there could be some really cool views, in the sky. i'm told that there are about ten different chemical canisters being released once this launches. so between 9:09 and 9:19 tonight, look up to the sky. you might be able to see almost like an artificial, with these loom necessary end clouds that will take shape. cool stuff. i have to set my alarm, because i know we're all asleep by that point. meanwhile outside, at the cove haven in the poconos, i love this shot, if you look real closely looks like the set up for a wedding here, couple of white chairs, some decorations on this scene here, beautiful, great excuse to hit the beach if you are lucky enough to have the afternoon off, close enough, rehoboth certainly is packed right now. it has been every day in recent days here through the course of the weekend. here's how it feels, folks. as we hit high noon, more so toward triple digit territory in dover. you're now scaled back to 98.

you'll holy father nerve that zone through the next couple of hours here. it feels like 98 even in reading, here in the city specifically at the area port, feels like 93. brutal stuff. so please take it easy. but this is last day like it before this pattern really changes. and we turn it on hereby thursday it is less humid, it is very pleasant, we don't break out of the 70s, and that will last us through friday in fact. now saturday and sunday, some more showers, some more thunderstorms start to arrive here. we rebound at least but turn for the worse if you were hoping for more sunshine. i don't think i can promise that right now unfortunately this weekend. >> i have to say quite the forecast, we had the hallahan girls in the fountain, we had somebody setting up for a wedding i. >> i love it. >> something happening all over the place. so today we're meeting nine year old hero. meisha joins us with today's love it. >> good morning, good afternoon. we never know when tragedy will strike and when we'll need the helping hand after hero. in today's love it we're meeting courageous view, at the right place at exactly the right time.

coincidence? you decide. the warm weather opens up schools, causes for the lakes, makes you dream about the ocean but for one young toddler in north carolina that calling was a close call to say the least. on a bright summer day little noah didn't feel like swimming in the community pool. so his mother karen took his floaties off while she fix add bottle for her daughter. when she look up, he was no where to be found n those few moment, he submerged himself into the water and began to drown. his nine year old cousin was walking up to the pool when noah's body began to float. believing he was already dead, but without hesitation, she braved the unknown, got in the pool, and pulled his body out as karen ran outside. >> i got him in my hands, and he was purple. >> then, a man at the pool, complete stranger, carlos rodriguez, offered to help. >> he pulled him on the floor. he just said i'm sorry, i'm so sorry. he's gone. >> but right then, rodriguez's wife melissa also stepped in

immediately giving noah cpr, which to everyone's relief, finally released water out of his mouth. after a long night in the hospital, doctors discharged noah with the good bill of health. >> oh, and his mother says never one, never take your eyes off your kids, two, the next trip to the pool will shall for swim lessons, a former lifeguard myself, that's a good idea. local police department gave the nine year old noah chief coins for their living selves. do you believe more in fate or coincidence? >> i draw the line. >> yes. >> okay, so maybe a little bit of ♪ >> all right. yes. >> all right. so divine intervention, coincidence? i don't know, but what i do know is heroes come in all shapes and sizes and ages. way to step? and do something, if you have any inspirational story ideas please sends them my wave at meisha p johnson, or meisha johnson at cbs-3.
