now at noon there is still no verdict in the bill cosby sexual assault trial, but jury is asking more questions, and one day after telling the judge, that they were dead locked. jury is in the fifth day of deliberations good afternoon i'm rahel solomon. i'm jan carabao in for jim donovan. our joe holden has been covering this trial every step of the way, and he joins us live now at the courthouse in norristown with the very latest developments, joe. >> reporter: we are still here still waiting for any possible verdict but lets get to what

the judge told, bill cosby, this morning before the jury was brought in, the judge asked cosby if he understood the definition, of a possible mistrial. now cosby said that he did. the reason the judge said that was because he was aware that double jeopardy in a future prosecution was to happen, would not apply. lets get ahead and tell you why the judge is having this back and forth with bill cosby we understand the judge asked this because of andrew wyat cosby's spokesperson claiming on tv yesterday, that when the jury announced it had dead locked, that it was a victory or vindication for bill cosby and his legal team. cosby answered that he did understand that, he would not be subject to any double jeopardy issues, if the prosecution was to bring a case again. now we have not heard from andrew wyat yet on this tenth day in the trial, the jury has been deliberating all week. even though they announce thread dead locked,

deliberations are continuing, and we spoke to a legal expert , about andrew wyat's comments, to reporters. >> he is also, i think, probably, uncomfortable about the press spokesperson for mr. d critiquing the trial process. he has a first amendment right obviously but in the middle of a trial like this would you hope that the press spokesmen would be reserved. >> reporter: now, also this morning, the jury asked to review, a previously sworn testimony by bill cosby, and that is what they referred to inside the courtroom, out here it is men as that sealed deposition from 2005 that really was smoking gun behind all of this. jurors wanted to know about cosby and his use of quaalude on women. the judge reviewed about 20 pages of testimony, from that deposition, and then they also asked for the definition of reasonable doubt. so, a question, and a request, and some back and forth between the judge and bill

wave run tours look out in the water. search is limited right new to just on the beach. here's what we know from the officials. around 6:00 o'clock yesterday life guard left the beach they pulled everybody out, told them not to go back in on or around 6:30. fire department got a call for two swimmers sucked down by a rip current. within five minutes rescue swimmers were in the water but they never had a visual of, on the two people. through discussion they have learned that a group of teens have gone into the water around the rock pile, and 16 year-old caylee hand from atlantic city was caught in the rip current near the rock pile and then 15 year-old roman quinn, from pleasantville, new jersey tried to save her. unfortunately he went under too. >> so, it is, it can go from, you know, 2 feet to five or 6 feet, rather quickly. it seems to be the case here, it seems like they were on a rock pile and got sucked out and then probably panicked and swallowed water.
