"eyewitness news" reporter joe holden is live in powellton village with the details on that lawsuit, joe. >> reporter: public safety hearing is now guarding the fraternity house, we have reached out to, each of the defendants, here named and many had no idea that it even happened. those who did know, declined to comment. meanwhile allegations played out on this very street, two years ago and forever changed one man's life. december 2015 move in weekend at drexel and iain mcgiven was out with his brothers. they were at an all you can drink event at a delaware avenue bar after catching a cab back here that powellton

avenue iain and his friends ran in trouble. word were exchanged with another group and fight broke out. drexel university public safety incident report shows iain punched in the face, fell backward. you can see iain is helped back to the fraternity house, vomiting, in and out of consciousness and confused, nobody ever called his parents or 911. even as they struggled to walk him right by a campus emergency beacon. iain had to be getting promising business career. >> to that extent he has mom and dad helping to put his clothes on and tie his shoes. >> reporter: iain mcgiven would suffer what court papers described as a catastrophic brain issue to call 191 and get him to the er. >> they would have been able to relieve the swelling, give him medication, and prevent his brain from swelling, so much, that they had to take the top of his skull off to relieve the pressure. >> reporter: now the fraternity and its local chapter iain's frat brothers

within that night, two men who engaged with them in the fight , even the war are all named in a lawsuit claiming negligence. nobody would answer at the fraternity house, but only this man above taking our picture. >> they robbed him of his chance of recovery, it was stolen, from him, by the fraternity system. >> reporter: roddiannely mc given said something was wrong when iain didn't come home, they would eventually locate him inside frat house that they called 911 had they waited we're told he would have died. >> it has been two of the war years of my life, and i don't want any other family to have to go through what we have had to go through. >> reporter: we're back live drexel university police investigated and conduct a lengthy review in 2015 incident. after repeatedly requests to the university, they told me that quote the drexel police notified the office of the district attorney and it was determined that no charges would be filed. well, we just checked in with the philadelphia district attorney's office and they tell me that they never

received an official referral of the incident and that meant no investigation by them. live from powellton village tonight joe holden for cbs-3 "eyewitness news". >> joe, thank you. he has been granted parole , and tonight questions are swirling about o.j. simpson's future. he will be a freeman after spending more than eight years in prison for a high tell room heist in vegas. "eyewitness news" reporter david spunt is live in the sat center with more on the hearing and robbery victim who spoke at today's proceedings, david. >> reporter: o.j. simpson was supposed to serve 33 years behind bars but he could leave as soon as october 1st those details are being work out as we speak. today simpson had friend, family members in the courtroom but it was victim of an armed robbery authorities say he was involved in who grabbed attention of the parole board members. >> he made a mistake. >> reporter: sitting a few inches from o.j. simpson bruce fromhold, a victim of the armed robbery involving

simpson and associates testified on the football star 's behalf. >> i don't feel that he is a threat, to anyone out there. >> reporter: simpson claims he didn't know his associates were armed with guns. >> i spent nine years making no excuses about anything. i am sorry that things turned out the way that they did. >> reporter: nevada parole board saw things simpson's way and granted him freedom. >> i do grant parole, and that would be it. >> reporter: simpson, during his last parole appearance in, 2013 seemed emotional and thank board before walking out of the room. his daughter, also testified on his behalf. >> i know that, he is remorseful. he truly is remorseful and we just want him to come home so that we can move forward. >> reporter: it was his forgiveness that surprised many across the country. >> i said i forgive you. we all make miss takes.

laid to rest, family and friend gathered at funeral mass for thomas meo, it was held this morning at saint an slam church in northeast philadelphia. memorial gathering will be held for mark sturgis starting in about an hour. family and friend are invited to the funeral home in bensalem starting at 7:00. an excessive heat warning is in effect right now in the region dealing with sweltering temperatures. it is feeling like triple digits out there, meteorologist chelsea ingram outside tracking temperatures from the sky deck, chelsea. >> we have had excessive heat warning and that will remain through 8:00 o'clock hour as we head into tomorrow evening and that is what philadelphia and all of the surrounding counties thaw see on the map and it is going to be very hot tomorrow. we could see heat index values of 105 degrees. we are well in the 90's at this hour. 94 degrees in philadelphia. ninety-two in wilmington. when you factor in the combination of both heat and humidity it feels warmer then. that feels like 98 in

philadelphia. trip old digits for atlantic city where it feels like 103 degrees. we have a severe thunderstorm watch issued for philadelphia and all counties northward and thinks for a very strong line of storms that we're tracking on storm scan three right now making its way in the poconos. we will track these storms for you and let you know when we will finally get some relief on the heat coming up. for now back inside to you. chelsea, thanks. philadelphia new has a new interim district attorney. late this afternoon board of judges select kelly hodge from more than a dozen applicants. she will be the cities first african-american female district attorney. she is former city prosecutor and currently is in private practice in blue bell. she won more than 50 percent of judge's vote. >> we have a interim candidate who put their name in the hat and she's an excellent choice. >> hodge could be sworn in as early as, tomorrow and she will take over for former d.a. seth williams who resigned

last month after pleading guilty to federal corruption charges. gunman who confessed in the shooting of christopher dorman learned his punishment today. judge sentenced daunte island to between 33 and 100 years in prison. last month he pleaded guilty to attempted murder. officer done man was at sentencing. island shot him seven times when responding to reports of drug activity, behind apartments, on elmwood avenue last june. septa police released this dramatic body cam footage of the police shooting that occurred last night in kensington. a suspect was shot multiple times by septa and philadelphia police officers responding to reports of a woman shot. suspect has been identified as jose lebron and is now charged with attempted murder. he is less ted in stable condition, woman he is accused of shooting is also listed in critical condition. tragedy in south jersey as two brothers, drowned in a vineland lake. >> the fisherman died together yesterday while swimming in the former sand quarry.

"eyewitness news" reporter cleve bryan brings you the story. >> this is a shame. >> reporter: friend of the 27 year-old saul and antonio vargas say brothers loved to fish and loved each other, they drowned wednesday, crystal lake in south vineland park, officials believe, one brother may have been trying to save the other. >> it appears that one of the individual went swimming, had a problem of some sort and then it looks like other gentlemen jumped in to help. >> reporter: the dive team recovered bodies around quarter after 9:00 on the southe side of the lake away from the fishing dock and fisherman area another reported seeing bodies body. >> they had a good last seen point report report local say lake used to be a sand quarry, last month we showed you how dangerous it can be to swim in old quarries after a man drowned in mays landing. one of the most severe dangers is you don't necessity how soon it dropped off or how deep it goes. >> you can be walking one

in february ukee introduced us to a man who gives haircuts to the homeless and not in a barber shop. >> he meets them where they live on the streets but now he says he is having a problem with city philadelphia city hall. this winter we watched jones shaving on the street in chester sprucing up beards and hair for free. >> did an excellent job. >> reporter: reading calls it haircuts for the homeless. he estimated since he started he has given 500 haircuts in multiple states. people like philadelphia mayor jim kenney stopped by for selfies. >> that is what it is all about spreading love and giving guys hope. >> how far do you go. how far can you go. >> sky the limit. >> reporter: brendon say haircuts for homeless is now grounded at least in philadelphia. he says on money had just started another day of cutting hair at this traffic island at

received two complaints from l and i, cities primary worry was that the traffic island was not a safe place. they say they did offer some alternative sites for brendan to cut hair. now those don't work for him they will explore other options, including one that would be outdoors. breaking news now on sunoco's construction of the mariner east two pipeline we have been reporting on, pennsylvania governor tom wolf says that work has been halted on some areas along the pipeline. sunoco says west whiteland chester county is one of those areas. you will remember there was an incident where drilling compromise sod well water for about a dozen homes, and even more recently there was a surge of ground water in middletown township when an aqua fire was hit by drilling operations. there have been some spills of non-toxic drilling lubricants. pennsylvania department of environmental protection is investigating the incidents and we will continue to follow this.

meteorologist chelsea in gram joins us now and we have been looking at a string of 90's, in our area. >> yes, more to come unfortunately, two headlines we're talking about the heat and also severe thunderstorm i'm tracking. we will talk all about. that lets start off with temperatures officially across the region today. high temperatures that were well into the 90's, man, look at this, made it to 96 degrees in atlantic city officially in philadelphia right around 95. that is well above average high of 87. ninety-five in trenton. allentown mid 90's and in reading and wilmington the official high temperature was right around 93 degrees. is there more to come but excessive heat warning remains in place through 8:00 p.m. tomorrow evening, we can see heat index values upward of triple digits and up to around 105 in some location as cross the delaware valley. particularly around philadelphia. so very warm air even in place at this point in time we are still in the 90's. ninety-four in philadelphia. ninety-two wilmington.

upper 80's in millville. wildwood at 89. ninety-two in atlantic city. down the shore temperatures comfortable for places like ocean city where we have 84 degrees. that sound good right about now. factor in the combination of the heat and humidity and, of course, still feels so much warmer out there. feels really hot in philadelphia. 98 degrees. into, into new jersey, feels more like triple digits for millville, atlantic city feels like 103 degrees. heat index values will continue to climb as we head into tomorrow looking at triple digits for friday. saturday not much in the way of relief but 96 degrees is what it will feel like in the afternoon. we have a severe thunderstorm watch that has been issued until 10:00 p.m. tonight for philadelphia and counties on toward the north. that is for very strong line of storms that we are tracking , making its way in the poconos at this point in time. we are talking about a very strong wind associated with these storms and severe thunderstorm warning for carbon, monroe counties until

6:30 p.m. we have a break of around 60 miles an hour. we could see quarter sized hail. we might see some right around mount pocono at this point in time. so as far as tracking these storms we are seeing eight and 10:00 p.m. we could see thunder in center city a after tenor 11:00 tonight things quiet down. start out your day on friday with partly cloudy skies and sunshine in the afternoon. it will be a scorcher. it is imperative that you find a way to cool off. get inside air conditioning go see a movie, perhaps head to the library or mall. just find a way to get relief from the heat or go down the shore. sunshine hot sand tomorrow, 90 . eighty-seven saturday. we will risk to are shower or thunderstorm as we move in the weekend. overnight low temperature around 78, muggy, warm, heading in to tomorrow high of 96. dangerous heat with sunshine. you're witness weather seven day forecast looks like this heading in the weekend we are talking 90's in the forecast.
