good morning, i'm rahel solomon. >> i'm jim donovan, here's what you need to know to start your day in morning minute. today is tuesday, august 22. >> breaking overnight, a train crashes into an empty train at 69th street terminal. dozens are hurt. >> i stood to up get off and smack, hit the other trolley hard. >> there were four critical injuries but still officials say none of them are life threatening. >> it will be 15 to 20 minute increment, and you can absolutely expect delays. >> comedian bill cosby's defense team returns to court. he's hired michael jackson's former lawyer, tom mesereau, for his upcoming sexual assault trial. >> we will fight to win.

at the sun, could be little dangerous for us, but again warm muggy, tuesday across the entire delaware valley. and when we are talking about just how warm and humid it will be, we could be looking for heat index values push into the triple digit, exactly what we are talking about. now we could see few showers and thunder storms move on in through the afternoon, but it will be more toward the end of the afternoon and evening and possibly little bit tonight as old front will be sliding through. and once it comes through, and it completely clears the area as we move into wednesday and thursday, it allows for some very comfortable conditions to take over, as we go toward the end of our work week. so that's good news for us. temperatures outside right now , like i said, it is already hot, humid on the skydeck, 75 degrees, in philly still staying in the high 60s, through even the mid 60s through the lehigh valley up in the poconos, no relief heading north of the city. seventy-six wildwood on the beach. definitely not the morning where you want to be out and about doing too much activity, at least early on, dew point for us, seven's, 60s, extremely sticky, very humid,

very muggy outside. it will remain that way throughout the day. and heat advisory is in effect from 1:00 this afternoon until 8:00 this evening. what we are going to be dealing with then for temperature wise, later on into the afternoon hours, going to be temperatures that are in the 90s, little bit of fog has developed because again our dew points are so high this morning. but it is not going to affect travel all that much. again, our day planner for today, all the way up to 93 degrees. and again, the heat index values pushing up near trip ill digit. little fog out there. i don't think it is affecting travel so far this tuesday morning. >> matt, very good to know. thank you so much. yes, visibility issues, not so much, like matt said, maybe if i were seeing that in our camera shots little bit. but overall things looking little better now than they were even at 4:30, 4:30 a.m., a lot of problems, you can believe that. now a lot of stuff clearing out of the way. so here is a view of the schuylkill at spring garden, headlight moving in the eastbound direction toward center city. looking good, there starting to pick up slightly, ben franklin bridge,

same story, in fact, i would say the ben franklin bri about r than what we typically see. overall still looking okay. still traveling at posted speeds, like matt pointed out do have some fog, little hazy in the camera shot. construction crews still out there, 422 westbound between the schuylkill and route 23, left lane compromised there. and then that train accident, that we had about 12:15 this morning, involving two norristown high speed lines, update, starting 6:00 a.m., norristown high-speed line trains running every 20 minute , no express service, no bryn mawr trips, check the schedules on line, rahel, back over to you. >> we will continue now on breaking news, the train runs into a park train, at septa 69th street terminal, upper dash. >> i the crash sent 42 people to the hospital. "eyewitness news" reporter trang do live at the scene. good morning, trang. >> well, good morning, jim, rahel. as meisha mentioned we did get the update from septa within the hour the norristown high-speed line is back up and running. but 15, 20 minute, between trains and no express service,

but we take you out here to the scene here where you can still see the trolley involved has that police tape across it now, despite all of the injuries, very minimal visible damage to the cars involved. but take a look, at the scene overnight. this happened just after midnight, at the norristown high-speed line trolley pulling into the 69th street station. that's when the trolley crashed into an empty car, park on the tracks. in all, 42 people, including the operator, are hurt, four of them critically. now paramedics transported the injured hospitals. here is witness account from raymond woodard pass inning here was just released from the hospital. take a listen. >> i fell asleep coming from work, the train, i hear the train going real fast, like super fast. and i'm looking see that we had 69th street, why

are we going so fast? that's when it just hit the e ass, window, glass shattered, hit my head. everybody on the floor. >> and you may remember, a similar accident here at 69th street station, between a par t, back in february. four people were hurt in that accident. this morning's accident, the cause still under investigation. but for now, live from 69th street station, i'm trang do, cbs-3, "eyewitness news." jim, rahel, back to you. >> trang, such a busy terminal i used to travel through 69 street every day to get to high school. so all right, thank for the report, we appreciate it. >> in other news this morning, bill cosby has new defense team headed into court for today's preliminary hearing in montgomery county. he's hired tom mesereau, michael jackson's former lawyer, for his upcoming sexual assault retrial. joining mesereau is sam silver , who represented now imprisoned former congressman chaka fattah. lawyers from cosby june trial, which ended with a dead locked jury, asked to be taken off the case. time 5:36. in business news this morning, wal-mart is taking aim adam

son. >> meg oliver joins us live from new york with the details , but first a look at the numbers. good morning, meg. >> reporter: good morning, jim , rahel, despite declines in energy companies, stocks on wall street inch. higher yesterday, for the most part. the nasdaq lost three-point. more layoffs ahead in retail world. macy's announced plans to restructure it merchandising operations, which could lead to about 100 layoffs. no word on where the cut would take place. it is the latest attempt to stay competitive, with e commerce giants, like amazon. wal-mart is expanding it grocery delivery service, the expansion wal-mart's effort to curb the grocery push by amazon. wal-mart gets more than half of its annual us sales from it big business. it is now bringing the on line grocery delivery service partnered with uber to two more cities, orlando and dallas. wal-mart already delivers food in denver, san jose, phoenix, and tampa.

timetable. the afghan war now inhe longestr in american history. here's more now from seth lemon. >> reporter: conditions on the ground, not arbitrary timetables, will guide our strategy from now on. >> reporter: president trump laid out a new course of action monday night for the war in afghanistan. the president said he will boost the number of american troops, but wouldn't specify how many. he also wouldn't say what conditions would signal a victory. the president insisted this is not a blank check. that afghanistan will have to carry the heavy load in securing it future. >> we will not dictate to the afghan people how to live, or how to govern their own complex society. we are not nation building again. we are killing terrorists. >> the president was widely applauded by fellow republicans, even those who have come out against mr. trump's response to the

violence in charlottesville. senator john mccain tweeted: i commend pot us new strategy for afghanistan. we must past last admit's failed policy of postponing defeat. >> i'm pleased with the way he went about making this decision. >> on the other side, democratic house minority leader nancy pelosi released a statement criticizing the president for, quote, declaring an open-ended commitment of american lives with no accountability to the american people. the afghan ambassador to the u.s. praised the president's plan. taliban released a statement urging the us to withdraw all troops insisting it will fight with strong spirit, and full determination. set lemon, cbs 3, "eyewitness news." the city council meeting in charlottesville, virginia ends with three arrests. >> protesters interrupted the public meeting some calling on

their rep sieves to resign. this was the first council meeting since the city deadly protest on august 12, protesters were upset that the white supremecist rally allowed to take place, police did remove some protesters. new jersey governor chris christie criticizing president trump over his bode site remark after rallies and after the rally innot any good people on the neo-nazi side. >> there is not a moral equivalent between those who oppose neo-nazi, those who oppose white supremacy. those who oppose fash i am, and though who end game in it and support it, not moral equivalency there. those comments were wrong, were a mistake. >> christie however did make it clear that he does not think president trump is a racist. >> well, police are investigating a possible murder suicide in netter providence delaware county. chopper three was over the scene yesterday afternoon, police say a man and woman pulled up to a funeral home on south providence and chester roads, we're told the woman got out of the car and started

would just and mess, so many people o t outside at the shore, this morning, it is a little bit on the side. because it is so humid. usually tends to give us some of the low-level cloud cover, and again, we're waking up to those muggy conditions, and also, a little bit of haze down in ocean sit, to start out the day today. our weather watch ers, they're up early this morning, telling bus what's going none their backyards, for the most part they're reporting warm, warm temperatures, across the entire area. let's take a look at a picture real quick. >> this came in from keith of course, this is from the eclipse yesterday, a great picture of that partial eclipse from his house in the saylorsburg area, just really kind of pretty good day to see the eclipse, even if it was a little bit cloudy from time to time. temperatures, just role quickly this morning, looking at lots of places in the 60s, zero seven rays, when you add in the humidity only feels more uncomfortable. outside right now, storm scan3 , what we're watching is this area of precipitation,

that's out through the midwest , cold front. that's out there. it is sparking all of the shower and thunderstorm activity, and also seeing. >> so southwest, mixed in for chance of lift from the cold front will give us the chan for showers and thunderstorms as we go later on through the daytime hours today and really through the overnight tonight. couple of spotty showers possible so by 8:00 starting to energy if from the west, colds front will kind of slide on through, we go through the overnight tonight. stowe will continue with our shower all the way into tomorrow morning but for the most part our wednesday afternoon is just going to be dry. >> still muggy severe threat for today, up in the poconos with the front coming through could have slight risk for severe weather, gusty winds, potential for heavy rainfall, even here through the 95 corridor, marginal risk for

severe weather. we will be keeping an eye to the skies later this afternoon 70s, weather watchers talking about, as we add in the humidity later this afternoon heat inch values 103, and 93 will be the high temperature, zero eight for tomorrow, still stays little muggy for us but see the skies clear out, thursday, friday; see lower 80s, much lower humidity, then we could even see some seven's over the weekends, 78 degrees, on saturday, and 79 on sunday i know you like the heat, but jim and i definitely ready for some cooler temperatures. >> i no, i feel like a lot of guys usually say that, they love those 70s, but i have to say, yes. i love those 90s, but hey, i'm happy for you that the 70s are coming. looking outside, 59 looking good, near the betsy ross bridge, see it is certainly starting to heat up a little bit. lot of headlight out there right now, got busy yesterday,

probably around this same time as we are moving toward the 6:00 hour, and the 6:00 hour real when we start to see it heat up. overall 95, boulevard kinds of the same story, isn't as busy as 95 yet but we know it will be vy jump on the schuylkill westbound, the boulevard, carry on westbound, where we start to get busy. right now the boulevard looking okay. couple of construction project to p.m. your attention, these might slow you down. route zero seven westbound closed between hartford road and maple avenue. your alternate, church road or route 38. >> also north broad closed between 68th street and 70 street until october 2nd. alternate, old york road or fifth street is your best bet around there. plus, more construction in delaware, 59 north between delaware service area and christianna. two right lanes blocked there. and more construction in jersey slow out, there as well , lot every crews still out there. 295 southbound the on ram from sloan avenue closed until right around 6:00 a.m. beach another ten minute or so

, updates coming up on the train accident coming up in a little bit. jim, back over to you. >> navy and marine even corpse divers is joined the search for ten missing sailors in southeast asia. navy ordered an investigation into the performance and readiness of the pacific based seven fleet. yesterday the uss john s mccain collided with an oil tanker near singapore. >> this was the second major collision in the past few months, involving the fleet. seven sailors died in june when the fitzgerald collide wad container ship in the waters off japan. meanwhile, a massive ocean search for five missing crew members of an army blackhawk helicopter has ended. the chopper went down last week off the coast of hawaii during a training exercise. the coast guard and the navy search more than 72,000 square nautical miles. military officials say a total of four helmet were found, along with other debris from that helicopter. suspect in the last week's
