day set i don't view train operator who crash in the park train hurting 33 people. officials say one train over ran its stop and slammed into the park train at 69th street station. this all happened just after midnight yesterday, authorities say they are reviewing the vehicles and safety systems but as of right now the cause of the crash is still unclear. >> we will be here on the scene for four or five days collecting our evidence and once finished here we will continue investigation back in our home, headquarters in washington d.c. and then eventually, when we finish investigation nine to 12 months from now final report will be available to the public. >> in the meantime "eyewitness news" has learn that the train 's operator has given samples for drug and alcohol testing. new jersey politicians are remembering life of the state senator jim whelan following his death last night. whelan represented atlantic county asiana semmably hans man in 2006 and then as a senator two years later before that the democrat was term mayor of atlantic city, city schoolteacher and life guard.

whelan did not seek reelection in november. he had kidney surgery just last month. no word on his official cause of death. jim whelan was 68 year-old. governor chris christie says i came to know jim as a forthright, on owes leader whose word was his bond. current come back in atlantic city is due in no small part of the efforts and passion of jim whelan. stephen sweeney says jim was rarely one to raise his voice but was a advocate for atlantic city. city he loved dearly and determined to see it thrive. we are learning that one of the sailors missing after the accident involving the u.s.s. john s mccain in southeast asia has ties in our area 22-year old kennett smith spent his senior year of high school at cherry hille, smith was working as an electronic technician aboard u.s.s. john s mccain when it collided near a tanker trip n'synx pour on monday. he and nine others remain missing. smith's mother is hopeful they will be found real soon. >> i just want to be over

will be sometime before we have any answers. ntsb investigators combed tracks at 69th street terminal after a terrifying crash between two norristown high speed line railcars, one pulling into the station, other park on the track. the accident which happened just after midnight on tuesday injured 33 people, including the train operator. >> i see that we have 69th street why are we going so fast, just take the train, boom. >> reporter: ntsb investigator rubin says agency hats an eight member team on the ground in upper darby. >> they will be collecting evidence in their specific disciplines which includes mechanical, operation, signal train control, crash worth iness, emergency response and human performance. >> reporter: so far investigators collect on board video recorders from both railcars and they have plans to interview the operator sometime wednesday. >> we cannot rule out anything right new. >> reporter: passenger told "eyewitness news" that the train seemed to have trouble braking at two prior stops.

the council would man never made bigoted remarks and claims of any remarks should be substantiated and made public. charlottesville, virginia residents demand confederate statues being taken down city council decide to cover them up instead. city leaders made the decision yesterday. they say they are going to cover statues of robert e lee and stonewall jackson, less than two weeks after violence broke out angry residents showed up at a meeting demanding that the statues be removed. city council member explain the decision. >> we are not allowed by courts at this point because of the injunction to do anything physical to the statues, we cannot put up scaffolding or anything like that but it seems something we could do that does not damage the statue it is not in violation of the injunction but it does express our sorrow as a community for what has happened. >> residents however say covering statue is not enough, and they need to be completely removed. odd story, tensions surrounding monuments in charlottesville prompted espn
