finally access damage. good evening, i'm jessica dean i'm ukee washington. feel's mates one quarter of the homes in the keys have been destroyed. florida's governor says many bridges connecting island chain appear to have escaped serious damage but they will need more time to inspect them meantime, some resident are ago loud to return to parts of the keys that are closees to the florida's main line. access is still cut off in other places. irma is being blamed for more than a dozen deaths, since making land fall on sunday as a category four storm. seven people were killed in florida, four in south carolina and two in georgia. 15 million people across florida are still without power, as the state braces for a punishing heat wave, this week. >> irma also caused record breaking flooding in jacksonville, florida. cbs news correspondent moa lenghi takes a lot a the dam age there. >> reporter: ukee and jessica those historic flood water starting to recede here in jacksonville this is one jacksonville neighborhood where at the deepest point it

more aftermath of irma's wrath including power problems and gas shortage as cross the state of florida. >> "eyewitness news" reporter greg argos is in miami's little havana neighborhood with that part of the coverage >> reporter: good afternoon, guys. we are in little havana a neighborhood outside downtown miami and remnants of hurricane irma having an impact on this part of the southern florida. i can tell you this is a common sight many streetlights , without power, throughout the area, hundreds of thousands if not millions of floridaian is still without power, florida power and light which is basically the peco of south florida, has tens of thousands of crew members all throughout the area trying to restore power because it is very critical to get things backup and running. on top of that fuel is still out for many of the fuel stations, gas stations here in south florida. in fact, there are long lines for the few stations that actually have fuel, but many still without it right now. once again, power is out. miami police right now, directing traffic, and every

few minutes we will see another line crew in here with those long poles they have to restore and rebuild those poles. many knocked over because of the massive hurricane, which struck florida just a few days ago. thinks going to be sometime before this state fully recovers. that is very latest from southern florida i'm greg argos for cbs-3 "eyewitness news". hurricane irma was a category five storm when it crashed in the caribbean leaving 36 people dead in its wake before moving on to florida. as the clouds clear over place s like virgin island destruction is now becoming obvious. this is the view from space, and these images show irma's effect on the british and uv virgin island. they were acquired, august 25th and september 10th to provide before and after pictures and context. no where near as bad we are feeling the remaining effects of irma here as well as hurricane jose. storms are churning up up waves down the shore. we are looking live at ocean city and cape may, swells

generated by irma and jose are creating dangerous conditions for swimmers. high rip current risk in effect. so kate, what are chances of feeling eerie affects of irma. >> good news, irma is no longer a tropical system. irma has died for all intents and purposes but left over remnant of this large storm are impacting really the entire eastern half of the country and other side of the mississippi river. it is all strung out, moisture from irma really extending from portions of the outer banks now all the way down into louisiana and portions of the northeastern texas. we will tap into these showers , as early as tonight or perhaps, tomorrow, you can see these bands of cloud, lift nothing, perhaps a stray sprinkle down around lancaster county but really tomorrow and into thursday this system continues to churn our way. our impacts are very, very minimal. we will feel those gusty winds pick up, also the rip currents down the shore. we will talk about jose in just a moment. increase in heat and humidity. it is near 80 degrees right now. it will get steamy as that

moisture from irma which originated in the tropics is lift nothing our region. as you wake up tomorrow morning at 9:00 a.m. we will need that umbrella scattered showers on and off throughout the entire day, not a lot of sunshine. this system will take its time , moving out, and this isn't the end of it. coming up we will tell but more showers moving through, and it really is in association with irma and we will talk about jose and whether that system will directly impact us, here in the philadelphia. ukee and jessica, back to you. see you shortly, thank you today judge ruled that the deadly amtrak crash in 2015 was more likely an accident then a crime. >> our joe holden was inside the courtroom and joins us live from the criminal justice center in center city with more on this decision, joe. >> reporter: jessica and ukee, this case was very interesting to watch unfold in courtroom 305 at cjc. it really hung on four word: lack of situational awareness. a judge finding that brandon bostian at least from his point of view on the bench was not criminally negligent.

>> today a good judge made sure that justice was served. >> reporter: major developments surrounding the deadly wreck of amtrak 188, a philadelphia municipal court judge is letting man behind the doomed train, off the hook , for now. >> everybody came to the same in escapable conclusion, this was not a crime. >> reporter: attorney brian mcmonigal hammering outside a similar argument he made a short time ago right before the judge who dismissed the charges that amtrak 188 engineer brandon bostian was not in his word, criminally negligent for the deaths of eight people that night in may . tom kline is among host of attorneys representing the victims at the crash. >> the attorney general's case was built on the fact that there was a wreck less disregard for human life taking 50-mile an hour curve at 106 miles an hour.

>> reporter: testimony during the four and a half hour long hearing pivoted from the grizzly scene first responders came pneumonia to bostian's own flawless safety record prior to the crash. young engineer tracked the frankford s curve 25 times, before on that night, it is believed bostian developed what the ntsb developed a lack of situational awareness and that was apparently triggered by radio reports along the northeast corridor that a septa train had been struck by a rock. bostian's attorney had a theory that he powered the train to full throttle mistaken that he had already passed through the curve. those representing the victims see it as more than just a mistake. >> brandon bostian's only job was to get people from one point to the other, safely. he didn't even need to steer the train. >> reporter: with today's outcome the question is where do we go from here. we pressed the deputy attorney general who was prosecuting this case before the judge today, he declined to comment

heavy drenching rainfall, bad news not a lot of sun for next few days. we will take a look outside, up in bethlehem where we are still seeing blue skies, just a few patchy cloud, starting to roll in right now and not bad, been a nice day, not a ton of sunshine not that brilliant blue skies we sometimes see this time of the year but enough, pleasant day, up tic in heat and slight up t ic in humidity today. bethlehem and down through the beaches. look at rehoboth beach, still folks outside on the sand people walking outside on the boardwalk, everything looking good but the problem is the ocean and the surf. we have a high rip current wrist income effect for all of our shore communities here and that goes as we head into the next couple of days, really with jose out to sea. we will talk about that in just a moment. lets go outside to storm scan three showing those cloud lift nothing a few showers, popping autopsy cross western pennsylvania. these are outer bands of what was once irma that circulation really dominating the eastern half of the country as i showed you before, you can see

it, actual center still down south, throughout the mississippi river delta there and producing rain in the region. showers, all the way up into our neck of the wood and this will continue to sit, spin and make a gradual exit by end of the week. it will not get out of here anytime soon. let's time out precipitation. tonight cloud are rolling in, may start tomorrow morning with a few sprinkles at the bus stop, may come in more like nine or 10:00 a.m. first part of the commute may be cloudy and humid and damp. that first batch moves on out, and clear it out late tomorrow night and then another round of showers, perhaps a thunderstorm, on thursday. notice these are scattered, this is not heavy downpours we're not talking flooding rain here but we will have scattered showers possibly even into friday, friday has a better chance of drying out. how much rain? not much. in our area, less than half inch, a few spots off to the west, down toward lancaster county could pick up an inch of rain. this is relatively light for being associated with a tropical system.

outrage at a local high school officials are under fire for their response to death threats against students. authorities say that the threats on social media targeted students at west chester east high school. >> "eyewitness news" reporter alycia nieves tells us they know who posted the threats. >> reporter: death threats at chester county high school made in the form of someone posting these photos to the now deleted instagram account. photos noticed on sunday are a student who will quote die, each post was punk waited with racial slurs toward the student's being threatened. stacy's 11th grade son was one of the east high school students targeted. >> when i found out, at first, i woke him up at 1:00. >> reporter: her son, seen the powe but didn't tell her. >> he talked to the administrators in the building , felt like they didn't take it seriously.

consider his feeling. >> reporter: she's among several parents upset now not only with the threats but how the school may have handled the incident. >> it was just basically being brushed under the rug as oh, it is hoax, we will deal with that. >> this is a history and a habit of west chester area school district and it has to change. >> we take all threats seriously. safety is our number one priority. we look at some of these things, particularly social media and try to decide fit is credible or not. >> reporter: superintendent says posts were determined to be more of a hoax then a threat by police. within hours, authorities had determined who made the threats and made an arrest. >> there was a lot of concern i think about the hate aspect of this. juvenile being an african-american, african-american 14 year-old juvenile. >> reporter: fourteen year-old a freshman at the school is being charged criminally with making terroristic threats, harassment and cyber harassment. >> any racial slur will not be tolerated in our school system

>> reporter: on top of serious charges the student who made these threats on line is facing, suspension, right now, possibly expulsion. the district also says that it will meet with its students to talk about the importance of racial sensitivity. in west goshen, alycia nieves for cbs-3 "eyewitness news". family of the 15 year-old boy is suing the boy scouts of america for $1 million for their son's death on a backpacking trip in june. reid carmena was going after his final merit badge, and then collapsed and died of heat stroke in remet western texas. during his final merit badge he signed up to complete an introduction backpacking trip at the buffalo trail scout ranch, where his parents expected he would learn outdoor skills for two days before heading out with two adult leaders. >> i felt like he would receive the education that he needed to be able to do what was asked of him on an introduction hike. >> what we have signed him up for, he was more than able.

>> reporter: his parents say he was unexpectedly moved to a more advanced hiking group and took off days earlier then planned, in 99-degree heat, reid was air lifted from the trail but his parents say they weren't told their son had died for four and a half hours after his death. school district of philadelphia is facing a, federal class action suit alleging gender and race discrimination in girls sports kyw news radio reporter cherri gregg tells us tonight the plaintiff claims that the district's actions caused her to lose a scholarship to a division one college. >> it made me feel like we weren't good enough to play lacrosse. >> reporter: this is a face of the class action that claims the school district of philadelphia discriminated against girls from low income, african-american high schools. mccray began playing lacrosse at strawberry mansion high but suit claims that the district failed to provide support. >> they neat bus, support from

districts, they need funds for uniform. >> reporter: attorney glenn ellis represents mccray and says the district violated federal law when it provided mansion and similar schools less resource toss play non- traditional sports like field hockey and lacrosse. it gave to more affluent schools like central. >> i knew that there were barriers. >> reporter: coach smith said she was fired by the district when she spoke out after mansion girls could only play three other teams during the season. none were teams from the more affluent schools. >> very hard to get any girls recruited from that then. >> reporter: suit claims mccray got a scholarship at university of hartford and then lost it when district failed to file proper paperwork. >> i felt like my heart just stopped beating in my chest. >> reporter: they had no choice but to sue and response to the lawsuit, school district issued a statement, one of our core values as a school district is increasing opportunity in the classroom and on the playing field for all of our students, regardless of race or gender.

of irma spawned in waterspout in south carolina at the time there was a tornado warning. it disappeared as it reached the beach dumping sea water on the inundated shore. celebrities are doing their part to help the victims of irma and harvey. beyonce, george clooney, oprah , and dave matthews and many others will appear in prime time tonight for a fundraiser called hand in hand , a benefit for hurricane relief. you can watch it tonight at 8:00 right here on cbs-3. the world's most active volcano continues to put on a spectacular show in hawaii. kilauea volcano sent streams of lava flowing down the mountain on the hawaii's big island this eruption first began in early 2016. it has been entering nearby pacific ocean since summer of last year. now take a look at this frightening small plane crash in connecticut. that tree cushioned the plumet from the sky before it landed in the parking lot. amazingly, pilot survived with minor injuries. faa is investigating the cause of that crash.
