brandon bostian. bostian was at controls when amtrak train 188, derailed, on frankford curve in 2015. eight people died, and hundreds more were hurt. philadelphia judge on tuesday prosecutors did not present enough evidence against bostian to sustain criminal negligence charges, and dropped the case. naacp leaders say the justice system unfairly allowed the whitening near to go, free for an accident, while a black contractor was found criminal ly liable, and convicted for another accident , the deadly salvation army collapse in 2013. >> griffin campbell could have died in that wall collapse but yet he was found with criminal charges against him, he was convicted and put in jail. this is a great injustice, and it is justice working, two different ways, in one city, calling it one justice system. >> griffin campbell is serving a 15 to 30 year sentence,

naacp is working toward getting him a new trial. excavate or sean benschop pleaded guilty to involuntary manslaughter for his role in the collapse. toxicology reports showed that he had painkillers and marijuana in his system at the time. benschop was sentenced to seven and a half years to 15 years, behind bars. a former pennsylvania state trooper has pleaded guilty to two counts of the involuntary manslaughter in the death of his pregnant wife authorities say that joseph miller shot his pregnant wife joanna in the family'se norton home in 2014. she and baby both died after an emergency c-section. authorities say that miller told them his gun went off as he prepared to clean it. he is expected to be sentenced within 90 days. police released photo of the suspect wanted in a roxborough home invasion that we first told but last night. police are searching for this suspect, mark mclaughlin a former neighbor of the victim. authorities say that the 21 year entered hill road home, salted a seven five-year old

occupant, took a purse, and then fled in the victim's car. if you have any information, you are asked to call the police. well, calendar it is still summer and today it feels like it. hot, humid conditions have made their return. meteorologist kate bilo joins us now tracking the heat and the chance for a few spotty showers, kate. >> that is right, kate we are track remnants of what was once hurricane irma. you can see circulation, around what was once that system is definitely all, really fallen apart by now but you can see a few spotty showers, mainly have missed us to the north. lower new york state, up are pennsylvania, and into portions of new england that is where the majority of the spotty showers and thunderstorms are this afternoon and this evening. but we cannot rule one out popping one out locally closer to home. one tried to form over chester county and then fell apart before making its way in the city. we are in and out of the cloud cover here throughout this afternoon and evening, and it feels, warm, and steamy outside. temperatures right now, in the 80's, 81 in philadelphia. eighty in trenton. eighty in wilmington.

winds are out of the south and west and it is feeling definitely still like summer, and temperatures will be averaging, above the normal right through the weekend. dew points are on the high side not as steamy. dew point also in the 60's. that means it is feeling on the steamy side, humid but not oppressively so. a few pop up showers and storms, could be around through this evening, and through the overnight hours tonight, and then same story tomorrow, cloud, some sun, and we will see a couple of pop up showers, coming up we will talk about how it feels tropical outside, how long that will last, and storms through weekend and more on jose, tropical storm now but that track is heading north, could we be in for impact? we will have the latest on that, jessica. >> kate, thanks. president trump is embracing his role of comfort er in chief, today he traveled to southwest florida to assess his damage left behind by hurricane irma. as recovery efforts are in high gear across that state president trump and first lady handed out food and water to residents in naples. >> we are there for you, 100

percent. >> reporter: moments after shaking hand was storm victims trying to put their lives back together. >> working hard. >> yes. >> wonderful, thank you. >> reporter: first lady later tweeted this video of flooding from the air. in fort myers president praised local officials and heroic work of first respond ers. >> thousands and thousands of people may have their lives ended and the numbers, they are a very small number which is a great tribute to you. >> reporter: many remain without electricity, and with more than 20,000 utility work ers, statewide, power co, say they are making wrapped progress. faster then in previous hurricanes. >> we have restored many of the big blocks, of customers, and we're now going in to neighborhoods and some cases going house by house. >> reporter: in the devastated florida keys, power, running water and communications have been virtually non-existent since sunday. officials say that full recovery in the keys, could take years.

further north authorities continue to evacuate nursing homes left without power. investigators executed a search warrant at hollywood hills facility where eight seniors died this week. we're getting a look at more hurricane damage in the florida keys, this is devastation irma left behind in the city of aisle moredo, the storm did not discriminate , mobile homes and mansions all left in ruins. irma washed boats assure in key wet and right now crews are working to restore power and water services there law enforcement is preventing keys residents from returning, citing safety concerns. despite the mandatory evacuation order, some residents chose to remain, and they cannot believe the devastation. >> we were here, we were on a big house in the ocean which we were told would be safe because it three is stories and the house basically caved n we barely made it. >> reporter: all three hospitals in the florida keys remained closed. people in the british virgin islands are beginning to pick up the pieces after

hurricane irma caused complete devastation there residents of the island says it feels like armageddon as houses were leveled to ruble and cars were reduced to hallow shells. but both clean up has started and british officials pledged to get the island back on its feet. >> it feels like we're in armageddon. >> just waiting for the zombie s. >> you know, we've got our sense of humor through this. we have no where to go but building up. >> reporter: many residents say that they have to rebuild. on the island of saint john, what was once a lush, greenland scape is now a battered weigh land. trees are name to the bark, power lines are toppled and homes are on the edge of hills volunteers have already started to deliver food and water and navy and coastguard officers are patrolling to prevent looting. and this is saint martin, wind, rain tore apart homes there, debris, litters roadside, every where. despite european and american governments stepping up efforts, power remains out on the island.

many residents worry about dwindling food and water supplies and there are widespread reporting of looting. president trump has apparently reached around republicans and across the aisle to find common ground on daca. senator chuck schumer and congress woman nancy pelosi, both democrats, met the president at the white house last night and they left with the framework for possible compromise for so-called dream ers n exchange for tougher border security. >> we're not looking at citizens ship or amnesty but we're looking at allowing people to stay here. >> we're in the looking at amnesty, we were never looking at amnesty. >> the agreement between the president and the democrats does not include border wall, something that the president, says he will remain committed to doing. the legal battle over dune construction is over, in margate. >> sit has agreed to drop its lawsuit in exchange for multi million-dollar drainage system at no cost to the citizens. cleve bryan is live in margate with more, cleve.

>> reporter: well, it is a victory to some because city will get a new drainage system funded by the federal government, worth some say as much as 10 million-dollar and hopefully will prevent some of the ponding we have seen on the beaches just like this, on the inside, part of the dunes. now this is what it looked like we have shot a little video an example of the drains that will run from the streets , under most of the beaches and out into the ocean this was over in vent are in we got video, a very common thing using these pipes at the shore. army core will build five of these pipes, in margate, to collect water from under the street and then it takes them out to the ocean, but to get drainage system the city has agreed to drop their dune lawsuit and event inner toy a long term beach maintenance plan in the state of new jersey. some are not happy about the pipe which inevitably can get exposed at beaches erode and they called the pipe a solution to an unnecessary problem. >> they built the dunes, they took the sand out, we have a problem.

well, you have seen videos by now, people in texas or florida evacuate their homes due to the devastating hurricane. >> not only are people displaced by these storms, many pets are now finding themselves without homes as well. the dogs have made their way to our area, for a new beginning. "eyewitness news" reporter anita oh has more now from camden county. >> reporter: destruction and despair left behind by hurricanes harvey and irma, the world also saw the rivers, people would float across to save their pets. >> there is an emotional impact and connection with their pets. we don't leave without them. you see these images of pets being carried on peoples shoulders, you know, life rafts, and carts. >> reporter: on thursday vicky rowland executive director of camden county animal shelter introduced animals welcomed to new jersey from overcrowded shelfers in texas and florida. those shelters have sent pets

to other areas early on anticipating the need important more space once the storms hit. >> these are just two of 10 shelter dogs that have been rescued from areas affected by hurricane harvey and irma but in total there are 60 dogs and 85 cats that need a new home. they are all available on county house road in blackwood >> this is marcia. she's 10 months old. she's from texas. she first came in she was really scared. as you can tell she's not scared anymore. >> reporter: volunteers here hepp during a time in which so many have lost, so much, that these animals can gain a loving family again. >> come down, adopt, foster, you can see that these dogs are just loving dogs. they didn't ask for the hurricane they are just looking for a home. >> reporter: in blackwood, anita oh for cbs-3 "eyewitness news". >> they are darling. kate joins us now with our forecast on this friday eve. >> friday eve, yes. you know what today turnout not to be as active as we

thought it might be because showers and storms missed us to the north. we have a few popping up here and there but not a bad day all things considered.up here it feels tropical. it feels like we are in the islands with the big cloud rolling through. it looks like it could storm and then sun comes back out and same pattern will be with us for really tomorrow and weekend but showers and storms will get more and more, hit or miss over the next several days. lets look outside and start off with a live look at our library camera from the parkway central library looking at city and you can see blue skies, also those big , fat, puffy cumulus cloud, and some of those looking a little dark. could be a few sprinkles here and there but most of the area will be rain free for majority of the tonight, just a stray shower or thunderstorm, here or there so not that bad of the day, yesterday ended up being a little more gray then today turnout to be. take a quick look down the shore, down to the delaware beaches where rehoboth people are making, you know, kind of make lemons out of lemonade. it didn't look that great of a beach day but down there it is not that bad. lets get the stuff, sit on the

sand and see it is looking like high tide not a lot of beach here but a lot of folks still on the beach at 5:17 in the afternoon. storm scan three does show the center of irma off to the north. you can still see a few showers over northern, new jersey, northeastern, pennsylvania and these though mainly off to the north and not a whole lot going on in our region. we are still under the influence of that broad area of low pressure, and will continue to be for the next couple of days. enough instability in the atmosphere that right through weekend we cannot rule out a stray shower or thunderstorm, especially in the afternoon, mainly heating of the day driven, that is a shower or storm, because it is mainly in the afternoon when it gets hot and steamy, air destabilizees and sun goes down and they fizzle. tonight we are in the speccing too much of anything. tomorrow a lot like today. mixture of cloud and sunshine. warm, steamy. you can call it hot for this time of the year. watch for just a pop up shower or storm in the afternoon. they fizzle out quickly once the sun goes down. saturday same story we will start the day with cloud and some breaks of sunshine and

then watch for a stray afternoon shower or storm. so right through sunday we are warm, steamy, temperatures five plus degrees above average. pop up thunderstorms if you do have pool plans keep an eye to the sky but all and all a nice summer weekend. let's talk about jose a tropical storm not a hurricane but it will be a hurricane again shortly and hurricane jose will make a closer track to the east coast then originally thought. it is starting to push west. this is not until tuesday. it does look like it will stay off shore but could brush the coast with some rain or win, and, of course, rip current risk will continue right through the weekend, as that system starts to make eighths approach and certainly, next week with that storm off the coast, rip currents will be a major concern down the shore. we will have more on hoy say and latest models in our next half an hour. for tomorrow, sun, cloud, a stray shower is possible, 83. tomorrow night for tell oil u-mass it looks good. it will be dry. seventy-seven at kick off. temperatures will drop once the sun goes down and then your seven day forecast keeps it warm, steamy through the

meet and greet with fans in new york city on wednesday, the day before she revealed on instagram, that she had a kidney transplant over the summer. the post showed her in the hospital, beside her friend, actress frances ryasa who donated the organ. twenty-five year-old singer said in party found out i needed to get a kidney transplant due to my lupus. it is what i needed to do for my overall health. >> i expect that she's going to do very well and she will have a very positive outcome. >> reporter: doctor singh medical director of kidney transplant center at jefferson said lupus, auto immune disease that gomez has causes the body to mistakenly attack its own tissues. >> it can affect practically any organ system in your body. it can affect your heart, your muscle, it can affect your joints, it can affect your skin and it can affect your kidneys. >> reporter: for patients like gomez who needed a transplant an organ from a live donor is preferable and donor does not have to be related, only

"eyewitness news" reporter jan carabao shows us a new program that just began this month. >> how is it. >> oh, great. >> reporter: deborah has come to rely on this box of food, each month, the usda donated box is delivered to her senior housing community in germantown. >> my favorite is when we get the spaghetti. >> reporter: she uses food to supplement her pant try, and feed her children and their children. >> peanut butter, the protein. >> reporter: she knows how important these supplies are. >> i wouldn't know what to do without them. they are an official part of the senior living. >> reporter: but need is so great there is a wait list for the governmental box. so philabundance is now stepping in with a new program called pantry boxes through a grant from the ww smith charitable trust, 625

additional eligible seniors, in philadelphia and delaware county will now get this, 15- pound box of shelf safe food once a movement philabundance says it helps a particularly vullable group of people. >> trying to pay for your bills, medical expenses, prescriptions, food is one of the last things that seniors end up paying for when they have to stretch their budgets. >> reporter: but grant for pant try boxes only covers six months, and while the pilot program is getting rave reviews, more generous donors are needed to keep the program going. not only that, but even with the additional food boxes, is there still a wait list. >> it goes to show that it is really helping fill that gap, and whether it is so much larger need then there is supply at the moment. >> it was diced tomatoes for spaghetti. >> reporter: for deborah, she shows her gratitude by volunteering, helping to organize and hand out to others, very same boxes, that have made a difference in her life. >> we are willing to give back to the community as well, this is why i volunteer.

a new census report out today find philadelphia is still most poor big city in the nation. >> cities poverty rate remained the same in 2016 and cities median household income was lower, in 2016, then in 2015. on average, other big cities, saw an increase in incomes and poverty rates generally declined. the report also state that had one in three philadelphia children are living in poverty there is growing concern, over the shrinking size of airline seats. safety advocates say it could put passenger at risk in the event of the an emergency. space between rows have dwindled from as much as 35

cassini spacecraft will make a dramatic dive since arriving at saturn in 2004 this probe has beamed back more than 300,000 images of the ringed planet and dozens of moons. but now, cassini is almost out of gas and it was going to use what is left to plunge into saturn's atmosphere. >> what will happies it will streak down toward the upper atmosphere and as it does so it will fragment into little pieces. those pieces will heat up, it will burn but as it head into the planet as upper atmosphere it will continue to collect data about what that atmosphere is like and it will be sending that information backup, as long as it possibly can until the spacecraft is completely broken up. >> new missions to saturn perhaps to look for life are already in the works. two weeks after hurricane harvey brought flood to southwest texas some people there are just returning home to assess the damage. they are finding out struggles are still ahead. correspondent don champion reports now from houston.

portions of the midwest, over ohio, down into kentucky, and these will roll through tomorrow. we cannot really discount possibility of the shower or thunderstorm at all for the next several days, but they are few and far between. our high today hit 84 degrees. normal is 79. full 5 degrees above average. record 92. that was set just last year in 2016. our low this morning was 69. temperatures right now still in the 80's, warm, it is steamy, and we have expected more fog to form. visability will drop a little bit tonight and by early tomorrow morning, watch for some patchy fog, visability, could drop to under 1 mile, or around three or 4:00 a.m. in the first part of the morning commute, and just in a few spots so that is something to watch out for. tropical satellite here's tropical storm jose, this has been going for nine days now, it was a brief major hurricane a chief cat four status and back to the tropical storm but it is expected to go back to the hurricane this will be living for more than three weeks, as a tropical system. a couple of waves off the african coast to watch, nothing imminent with those
