>> live from the cbs broadcast center in philadelphia this is cbs3 "eyewitness newscbs3 eyewi. right now at noon knew information yesterday' shoot afghanistan peps state trooper. corporal seth kelly fights for his life as the suspect accused of shooting him also recovers from gunshot wounds and faces charges. the suspected shooter arraigned from his hospital bed this morning on multiple charges including a tempted murder. good afternoon of one i'm jim donovan. >> i'm rahel solomon. joel holden is live in bethlehem where a press conference wrapped up a short time ago. joy, what is the latest? >> reporter: rahel, jim, you can sense the emotion here at this state police barrack.

officials took questions after their news conference for about 15 minutes and then took off to go back to the hospital to be with corporal seth kelly and his family. corporal seth kelly remains in critical but stable condition and we have a picture to show you of the wounded corporal much he is a 13 year state police veteran. corporal kelly is originally from holmes dale pennsylvania. kelly was backing up trooper ryan seal yesterday morning on a traffic call. corporal kelly was shot at least twice taking heavy fire from a man another trooper had pulled over along route 33 in northampton county. trooper seiple initiated the traffic stop. the man pull over was free to go but he stop before leaving to inquire about paying a citation he had been issued. investigators say that man identified as daniel clery appeared to be under the influence. he radioed for backup and informed cleary he was no longer free to leave. corporal kelly arrived on scene

and that is when things turned extremely violent. troopers were unsuccessful subduing him. it was close two minutes. minute and a half to two minut minutes. which doesn't sound like a lot but believe me when you're out there fighting with someone and it was a heck of a knock down drag out fight when you're out there along the side of the road doing that, you got vehicles whizzing by you that's very very long time to tussle with someone along the side of the roadway. >> reporter: and this is the picture state police confirm is their shooting suspect he is daniel clery ephrata. he was able to hustle back to his car he received a semi automatic handgun and began firing. the corporal was hit in the leg and neck and shoulder area. trooper seiple sustained minor injuries in the fight and shooting. he was not hit. now troopers back back at suspect. he himself was shot unknown number of times and drove himself to the hospital.

he remains there right now. he was arraigned in his hospital bed b by a magistrate on charges avenue tempted homicide of a law enforcement officer. and a whole list of other counts. at this time, state police are crediting a device found in their cruisers for saving corporal kelly's life. we will show it exactly what that is starting on "eyewitness news" at 5:00. but for now that is the very latest court rt rog live outside the state police barracks this noon. joe holden cbs3 "eyewitness news". >> thank you, joe. well delaware fire officials now say second person has died after a house fire yesterday in wilmington. the 79-year-old woman who was rescued from the burning home on norway avenue has died from her injuries. 60-year-old man died yesterday and a 59-year-old man remains in critical condition. investigators are still working to determine the cause of that blaze. investigators looking into the cause of that plane crash that killed former phillie roy

halladay. >> all star pitcher's aircraft went down yesterday off the gulf coast of florida. here's a look at the wreckage today. the water is shallow enough for salvage operations to take place with people wading in the water. investigators say halladay never made a may day call. this is not the first deadly crash involving the type of icon plane that he was flying. in may two i couldn't employees were killed in crash but the n ntsb blamed it on pilot error. supporters last night. >> this is a movement that is tired of seeing a system that systematically picked on poor people, primarily black and brown people. >> i'm just crowd proud. it was good fight. i fought it, and i would do anything for our city because i love it. >> krasner takes over for seth williams who's convicted of corruption and sentenced to prison. the city controller's race democrat rebecca reinhart defeated republican mike tomlinson 43-year-old reinhardt left the job in finance to work for the nutter administration and then stayed on with the kenny administration she has pledged to bring new transparency to the controller's office of the. allentown mayor ed pawlowski won a fourth term despite facing federal corruption charges he denied accusations he's accepted campaign contributions in exchange for city contracts. his trial is set for january. while in atlantic city city council president frank gilliam defeated mayor don glad january. he ran aggressive get out vote

where there was still some snow on the ground. i mean it was it wasn't much move of the it has melted away temperatures risen well enough above freezing in most of these spots this is up at ski big bear up. the skies really cleared out nicely many if there were any other snow which i'm sure there was out on the slope that has since just melted away. so this too is going to disappear. interesting shot to show you meanwhile this is how we ended up doing yesterday with that disturbance picked up an inch plus picturesque wintry scene in these areas. and even a five-tenths of an inch at mount pocono too. the disturbance in question is long gone. we have have however still had moisture working its way through left over here in sussex county it has been pretty damp in that area throughout the morning now into the early afternoon. it's still looks very cloudy and there are a few little rounds of showers that continue their way through the southern delmarva peninsula. if you're headed down that not only does it turn grayer but a couple much showers or just light drizzle something like

that. but we are sitting between systems for the most part right now. with time another arctic front however that is going to drop in here and bring win it some very very chilly air. so it's pent up the core of that arctic cold way off to the north. you going to pretty high in latitude here. however, by the time we look ahead to friday and saturday especially, some of that cold air will drop south here with the jet stream and thats going knock the temperatures back with the next cold front and pretty substantial way which you'll see in the seven day and then as we move forward into the weekend it turns less harsh when you see those warmer colors the reds, orange, yellows nudging further north it's just warmer air doing the same thing. so we do have the opportunity to rebound here. but it does stay below average right through the seven day as i mentioned. so it looks right now saturday will end up being the coldest morning. the early morning low is 25 degrees -- what? >> i heard that rahel. twenty-first record set back in 1961. so we're coming awfully close to that and that's where we expect

to see the first hard freeze. that will put and end to the growing season looking at the coastal flood advisory here locally we have already seen the morning high tide come in and out. keep in mind that will right along the immediate shore points into the back bays you could still have maybe a few road closures from the higher tide coming in and leading to some minor flooding. having seen too much of that at this particular shot outside beach patrol headquarters. bright blue skies in the poconos and the city. the further south and east you travel it's not necessarily the same story. meanwhile we've hit 50 in wilmington. not quiet there in philly but a few more sleeves up our sleeves before it's all said and done. expecting the high to hit 52 the normal high is about 59. five to 7 degrees off from that here in and the next couple of days again not one day is even seasonal. but snack dab in the center of that seven day it might as well be christmas, jim. >> low to mid 40s at best. >> make it feel alive. >> you're weird. >> a man who takes volunteering to another level. >> meisha is here with today's love it. meisha. >> we've heard it said before that age is just a number. that age is a state of mind. there's no denying that some people seem to defy the years youthful spirit keeping them healthy, happy and content. today we're meeting a man from maryland who emulates just that. take look. >> don't let the number of his years a cane or the hearing aid fool you. >> you got to go. you got to go. >> glenn brew baker is 101 years young. he's been volunteering at the urban volunteer fire department in frederick county for more than four years. >> i never used that word in my life. >> at 101, he never says he's tired. he lives every day like it's his last with an energetic spirit infectious smile and a heart to give and on most days you can find him helping others out in the kitchen. a place for conversation and connection. >> everybody appreciates his help and his, you know, always

brings a good mood to everybody. >> that's not the only thing they say. >> i've known him all those years and never heard him say anything bad about anybody. >> and what does he say? >> great. great. where is that man at 101. i want to shake his hasn't. >> no doubt people are more friend toll mr. brew baker because real who'll wouldn't be he makes it so easy. >> yes. he makes it so easy to love him. i love him. the guys at the fire department say that glenn makes new friends everywhere he goes and always finds time to socialize, smile and offer a kinds word. they say he's everything you'd hope to be when you're 100 plus years old. >> i'll have what he's having. he looks great. >> probably scotch. >> i got to tell when you he said that everyone seems to get nicer, i was like i can toll until cute little old man. he never says he's tired. >> well i can't say that for myself. >> i can't say that either. i think i say it -- ad nauseum.
