delayed, until february, a judge made that call, in court this morning. in september, reckless endangerment and involuntary manslaughter charges were dismissed against brandon bostian but an appeal was later filed by the pennsylvania attorney general. thinks after district attorney 's office decided not to file charges saying that there was not enough evidence. bostian was at the controls of the train when it crashed in port richmond back in may of 2015. eight people died, 246 were injured. also repairs are underway to the highway and guardrail damaged after monday's train derailment in washington state crews removed locomotive this morning, the other train cars were removed yesterday. the ntsb says the train was traveling 80 miles an hour in a 30-mile an hour zone. federal investigators are looking into whether the engineer was distract at the time by a employee in train when that train went off the track. crash killed three people, injured dozens of others. getting help, quickly

during an emergency, in how new jersey is facing a shortage of volunteer emts. volume volunteer squad folded and others are merging with paid ambulance services shifting burden to taxpayers. "eyewitness news" new jersey reporter cleve bryan is in salem tonight with more on this growing problem, cleve. >> reporter: ukee, reason you see two different ambulance trucks behind me is because many towns like salem here of had to turn to their neighbors for help to overcome this shortage of volunteer emts. if you want to know what a volunteer ambulance squad wants for christmas these days , just ask captain cameron kegel of the fenwick squad in salem, new jersey. >> i would love to have my staff be 20 people. >> reporter: right now they have only 10 and half of them are emt certified. the training requirements to become certified in new jersey have more than doubled this decade and people willing to put in the hours as volunteers have fallen by the wayside. >> when we do recruit somebody

they are all gungho and then they find out i cannot make that because i cannot get a sitter. i can't make that because i have my second job to do. >> reporter: volunteer shortage is being felt throughout the garden state as e ms council of new jersey lost a quarter of their volunteer squad. many like fenwick are merging with nearby towns with paid ambulance services which can add to the tax burden. experts say that the state need to make changes like modifying emt training schedules and location toss berth accommodate volunteers home and work lives. >> we need volunteers but the legislators need to somehow step up and help these towns to try to recruit people, make it easier for them, make training easier, make it rewarding. >> reporter: squad like fenwick will continue to feel the staffing pinch especially around holidays when emergency calls increase as same small number of volunteers, dashing off to help. >> it is one of our busiest days, so, we finally opened up presents for your kid and your family and then we have to go on a call. it is hard to do i don't

shows eye much quieter scene in boardwalk plaza in rehoboth beach. a lot of cloud cover this afternoon. these cloud starting to push south of the area and there is not a whole lot going on across the northeast tonight. is there lake effect snow, a couple of snow showers across portions of new england, we have to widen out to see our next system and it is not really forming yet this area will move off the coast, this system part and parcel that will move in and pull in moisture from the south. that is system that will impact us friday night and saturday. as far as tonight is concern it is partly cloudy, cloudy, cold, 29 degrees the overnight low. for tomorrow plenty of sunshine cold, seasonal, 42 is not far off the normal for this time of the year but it will get even warmer, as we head in the weekend. here are temperature swings chilly for tomorrow but you can see that mild air rising up, by saturday but watch what happens heading in to christmas day. we will get a fresh ingestion of cold air and that could coincide with perhaps a system

along the coast that could throw some moisture back in the region, perhaps, perhaps for a wintry mix or just some rain on christmas day. here's your holiday weekend set up possibly a shower friday night. showers and steady rain at times on saturday but very, very warm. that system gets out of here but what we have to watch for on christmas day is a new system forming along the coast model here is european model. this is most active on christmas day with the chance for wintry mix to the north and some rain to the south. two of the other models just i have few flurries and mess of the storm off the coast. something to watch but there is a chance for messy mix to the north and west on christmas day. travels for tomorrow, pretty quiet across the northeast. we have sunshine in the northeastern cities. southe maybe a delay in orlando with the stray thunderstorm, up to the midwest we have some rain and slow downs in chicago and omaha, and to the west we will go with some sunshine in san francisco, los angeles and phoenix. denver could experience travel slow downs and locally best

with her children and sister, she has high hopes for their future. >> i live in a house. get backup. >> reporter: and i spoke with one kid who says that the best part of moving to new jersey was the fact that he got to see snow for the very first time. live from camden, chante lens for cbs-3 "eyewitness news". >> thank you so much for that. a lawsuit has been filed against the parents of the cosmo dinardo, one of the men charged in the bucks county killings of four people last july. the family of one of the dinardo's alleged victims mark sturgis filed the suit. they claim the parents did not safe guard their gun which was allegedly used in the murders of the sturgis, jimmy patrick, thomas meo and dean finocchiaro. dinardo and his cousin sean kratz have both pleaded not guilty to the murders. a new jersey schoolteacher is now facing charges tonight for at alleged sexual assault of an under age male student. this is the suspect, five three-year old brian mcfee, of

port republic atlantic county. mcfee was victim's seventh and eighth grade choir teacher at port republic elementary school and also served as choir director at victim's parish st. paul united methodist church. mcfee sexually assaulted the victim twice a week for the past three years. he is now being held at at the atlantic county jail. disgraced cardinal bernard law died today at the age of 86 after a long illness. pope francis expressed his condolence in a tell i gram to the dean of the college of the cardinals. pope's letter did not mention law's former role as archbishop of boston and that is where he fell from grace back in 2002 amid revelation that he covered up for priest whose sexually abused children law was never convicted of any crime, a funeral mass will be held tomorrow at the vatican. italy's capitol city is deck out for the holidays with lights and decorations, every where, but lots of people in rome are angry over the cities
