recanted testimony, most claiming police coercion. amnesty international and naacp delivered petitions with 650,000 names on them to the georgia board of pardons and paroles in atlanta. the petitions seek clemency for davis. >> they have the opportunity and the authority to weigh in and to make sure that the state of georgia does not carry out what could be an unimaginable and irreversible mistake. >> joining me now, managing editor is also an msnbc contributor. thank you for being here. when we look at the latest plea, do we think there might be another delay and maybe progress on clemency? >> if you look at the facts of the case, we think so. this was sent back by the u.s. treatment court. they have death penalty cases and ask the appeals court to look at it again. 7 out of 10 recanted testimony.

the appeals court found it was the burden of proof to prove that in fact troy davis was innocent rather than the other way around, the burden of proof being on the prosecution. he couldn't meet that bar. so far there is not a lot of positive movement out of the georgia board of paroles. no one has interviewed them. >> three times before has he not exhausted all the possibilities in terms of the way the law works there in the state? >> he exhausted all of his appeals. his case has gone to the supreme court and they ruled that while his case is troubling and not certain, that's troubling to a lot of people who said the court itself said his guilt is not certain and yet they were allowing this execution to go forward next wednesday. >> remind us, this is about the death sentence specifically. is that correct? >> this is about the death sentence. whether or not it had a new trial to be found not guilty. the problem is as you said, he

exhausted all of his appeals and there is no other place to go. >> he was so close. let me ask you this. how does this chapter differ from the previous ones. now that we're looking at today versus the other three appeals. >> the difference is the public pressure. one of the things we used to take a look at is how the death penalty has gone off. not the ricky ray rekter case where bill clinton flew home to complete an execution or the timothy mcveigh case. this is the first time you have seen a huge public outcry. >> no physical evidence links him to the crime. >> the gun casing that was consistent with a previous crime. he maintained his innocence throughout. >> very good. thank you so much and contributor for msnbc. thanks for stopping by for the latest. the reverend al sharpton will be live from atlanta on the show

that is tonight on 6:00 p.m. eastern. the u.s. supreme court stopped texas from convicting a double murderer. pete williams will have details about that story and the controversy coming up at the bottom of the hour. the results of a dna test could answer a 10-year-old mystery in new mexico. what happened to robbie romero? he vanished more than a decade ago when he was 7 years old. he was presumed dead and an 18 year old told police he is romero. he agreed to give a swab of saliva for dna testing. >> i think it will be a total life-changing to have him back in our family again. just introducing him to his brothers and sisters. i believed in my heart if robbie ever came home, he would not be

a found person. he would have a lot of issues. >> michelle, when we hear stories like this, it's amazing and at the same time skepticism. >> there is. there is a lot of dynamics going on in this case. i spoke with captain wheeler from the police department who gave me a detailed break down on the investigation. how it all went down. the new robbie came forward about two days ago. actually they were led to him through an anonymous tip. what he did was met over at evelyn's house, robbie romero's mom. he was cooperative for about 30 minutes. gave a dna sample and when police wanted to take his picture, he said no, i'm done with this. i'm out of here and he left and hasn't been cooperative since. they have the dna. it's going to take about 48 hours for the results to come back. you have to recommend that robbie romero's father who is deceased and his older brother

who is decease and his mother. we will know soon here within the next two days whether this is in fact robbie romero. >> his older brother that was again going missing, he was one of the suspects early on. >> he was. he was arrest and put away for drugs for about a year. he actually said that hey, look. i'm going to tell you where the is. he recanted his story. this was a horrible roller coaster for the mother. then he died. while he was behind bars. there was a drug overdose. he kind of if he did have information, he took it to the grave. this case is unbelievable. if it is him, this is going to be another one of the instances that is jaycee dugard. eric hornbeck. so many cases that are like this. that could be like this. we will know very soon. >> very interesting story. so difficult for the mother, no

doubt. we are getting a better sense of how much administration officials believe a default of california sump solyndra would weigh on the obama administration. an office and budget official said the optics of a default will be bad. the timing will likely coincide with the 2012 campaign season heating up. kristin walker is live at the white house. that's quite a revelation from the e-mail. >> white house officials are pushing back again for the notion that there was anything political about this process. here's how this started. back in 2009, this energy company received about $500 million in a loan that was approved by the energy department that was all a part of the stimulus fund. then just about a month ago, that company went bankruptcy. now we will see the e-mails surface as a part of the

investigation. white house officials according to the e-mails were quite interested in the timing of the loan process. white house officials say they needed to know because vice president joe biden was going to attend the groundbreaking ceremony for the company. house republicans see it differently. they think it's an indication that the white house was rushing this loan process. again today, white house press secretary carney pressed back against those allegations saying the loan was purely merit-based. richard? >> what about the chief of staff to switch gears here. there was criticism in politico about the chief of staff, bill daley. >> there has been criticism and rumblings that people are not happy with. said he doesn't have enough experience for this job. i have spoke tone folks on the hill that reiterated the notions. however white house press secretary jay carney at an often camera briefing earlier today

said that is absolutely not the case. i will quote him here. he said bill daly is an excellent chief of staff and fantastic leader internally and externally with policies and goals. of course this administration is coming under pressure right now. the unemployment rate is above 9% and approval ratings are down. this report not necessarily surprising, but the white house said there is absolutely no truth to it. >> at the white house, thank you. >> just earlier we were telling you about the effort to stop the execution of troy davis. he is scheduled to die next week in georgia. joining me now to talk more about this is al sharpton. following the story and the host of politics nation. reverend, thanks for being here. you have been reporting on this case and you had the opportunity to sit with troy davis as well as his mother. what did you learn?

>> i got involved in this case several years ago with the network and i met with troy davis once on death row once about two years ago with one of the local minsters. he stated unequivocally he was not involved in the killing of the officer, the off duty officer who all of us clearly want to see justice for. there is no one that is excusing the fact this man was killed and there should be a just resolve to that for his family. if troy davis is not the guilty party, that is not giving justice to the family. he was able through his sister and others to establish that he was convicted with no dna, no physical evidence, nothing that would approve him in a physical way connected to the killing.

the gun was never recover and he was convicted with the testimony of nine witnesses. seven of those witnesses have recanted and some of them have said they will coerce. one of the two that has not recanted has been accused by a couple of them that haven't been the who was the actual trigger man himself. on that kind of flimsy case, how do you execute a man? many of us are here and there will be a rally at the church martin luther king used to pastor and amnesty international and congressman john and others will be saying that you should not execute a man that clearly there is this much reasonable doubt in. >> reverend al, thank you so much. the host of politics nation. he will have much more on the troy davis case there live from atlanta on his show tonight at 6:00 p.m. eastern here on msnbc.

about, education was probably the most personality. >> how do you get them to take on that message and say yes, it is important to us? >> what we are doing is doing surveys and doing surveys and interviews with young people in the high schools and north lake college and asking questions. for example, is access on information on education available to you? is it something that is perhaps more cultural or is it economic? >> we got a sample of that to show all of our viewers. let's listen to part of the viewers. >> great. >> from who i was until now, it's a lot. it's basically to prove to myself that i can do it and i'm here for a reason. i'm not here to mess around.

i'm here to learn and see something for myself and my future. >> early on in the campaign and the research right now. any indication about how showing these videos to those who have questions about whether they should go to college, any evidence about how successful this might be going forward? >> it's going to be successful. there so many people that are first in their family to go to college. if they don't understand, how do they fill out the financial forms? do they understand if they go to community college first, they can get transfer scholarships and if you make good grades and get in, you can get full tuition scholarships. there is so much money out there for the young folks if they just know how to access it.

rivals ammunition against him. a huge swarm of tens of thousands of bees go on the attack twice on week out west. the u.s. supreme court issued a stave execution thursday night for a texas death row inmate. duane buck had eaten what he thought was his last meal. he was scheduled to be put to death for the 1995 murder of his former girlfriend and her male companion. his guilt is not in question, but his death sentencing hearing was racially painted. joining us now is pete williamson. how rare is this decision that we saw come down from the supreme court. the hearing was tainted because of a psychology that tomorrowed whether somebody would be a danger in the future is their race and what the defense

lawyers say that should never have been allowed to go to the jury and similar cases in which testimony was offered in those cases, the state of texas conceded an error was made. what the state said in this case is that the defense is the one who put on that psychologist and the defense is the that asked him about whether race is a factor, not the state. all the state did is ask the guy again. he referred to the testimony in the closing statements. the state said there wasn't a problem here. the defense is the 1 that caused the issue. none the less, the supreme court agreed to put a hold on the execution while it considers whether to take up this appeal. just to be clear here, his guilt is not a question as you pointed out. they are not asking for a new trial. the defense is asking for a sentencing hearing. the supreme court is deciding whether to grant that or look at his appeal and they put a hold on his execution while they

think about that. there is no deadline for the supreme court to act, but i would be surprised if we got the answer to that earlier than late october or november. >> they have time ahead of them, but very, very soon. pete williams, thank you so much with the latest on that. president obama signing a new bill into law today to stream line the patent process for new u.s. inventors and took a moment to promote the americans job act. >> i need everybody who is listening to tell congress to pass the americans job act. we came and we should be able to coming to to put people back to work. >> the president announced plans to help companies developing new life-saving drug companies to get the products to get them at a faster rate. rick perry said social security amounts to nothing more than a ponzi scheme. there is a new poll that shows how much his view on this issue

might hurt his run for the white house. the latest poll shows 32% of independents are less likely to vote for the governor because of his comments and thoughts on this subject. 19% of republican voters feel the same way. let's bring in deputy director mark murray. good friday to you. as we watch this debate go on, perry is responding to all of this by turning and going on the offense against mitt romney. let's listen to that response. >> governor romney's misguided health mandates slowed the income growth and cost massachusetts their job creation in that state is 47th in the nation. romney care has driven private insurance costs up by $4.3 billion. it costs taxpayers in iowa and across the country. think about what obama care will

do to this country. >> we see perry trying to distinguish themselves from romney, but at the same time he is making the comments about social security. do you think they will continue to dog them going forward? >> there will be a sx or seven-month battle against the most reliable conservative. perry or romney? you will see perry attack romney on health care saying what romney did is i depth cal to what president obama did on a federal level. you are seeing mitt romney take a shot on social security. the one thing and while social security may not be a good issue if he becomes a nominee, there was another poll that came out in bloomberg that showed 65% of voters believed that social security is a ponzi scheme. something that resonates with the republican electorate. it may not be a good general election issue, but there is the

dynamic that you see on who do republicans want? do they want somebody who agrees with them on the issues or who might seem as the most electable candidate? >> another that will take six to seven months to play out, this issue about jobs and being the candidate. there is new information coming out of texas that the jobless rate that we learned this afternoon, that increased to 8.5%. that's the highest level in more than 24 years. some might ask how perry will spend that. >> he would say look, it's still lower than the national average of 9.1%. he will be able to say over this period of time, texas created a million plus jobs while he was governor of texas. how he will transition and this is what i was talking about earlier, it will be more about governing philosophy than results. rick perry will say when i was governor, we had low taxes and little spending. look what i was able to achieve there.

look what mitt romney aided with while mitt romney was governor of massachusetts. that's that is probably more the line of attack. >> let's talk about the endorsements from jimmy carter. >> i hope he wins. i'm not taking a position, but i would be pleased to see him win the republican nomination. i don't think anyone is going to beat obama next year. my preference is for his faith not to be a factor in who is representing the republican party. >> the former president there yesterday and saying he likes romney. is this going to help romney or hurt him? >> i don't see how it can help that jimmy carter gives him the thumbs up in a republican primary. in at the end of the day, it won't matter. i doubt anyone like rick perry or bachman said mitt romney is

president obama presented dakota meyer with the medal for saving fellow marines and afghan soldiers. >> four men in southern california are recovering for dozens of bee stings after coming under an attack. this started when a man in a wheelchair disturbed a hive containing about 60,000 bees. thousands of bees swarmed the man, knocking him out of his chair. three other men came to his rescue and were stong dozens of times. we are joined by gene robinson at the university of illinois. when we hear about stories like this, we think of movies. we think of the dreaded killer bees we heard about for so many year. is that what we are talking about here? >> this is an unfortunate incident and we hope for a speedy recovery for those involved. at this point it's too early to

say whether this is africanized bees or not. it's not out of the question. bees will generally leave people alone if there is a chance encounter and a sudden disturbance. there can be an arousal on the part of a honey bee colony. those that are most at risk are those not able to escape rapidly and so it sounds like that's something that happened here. this sounds like this was an unknown, undiscovered colony of bees that was come upon. >> this is uncommon. the person in the wheelchair, not the hive had thousands of bees attacking him. this is uncommon. >> this is extremely uncommon. usually the whereabouts are known and people can stay away from them. this is something that happens very rarely. there has been a lot of improvement in the ability of safety personnel to learn how to
