change in the policy. above all, i would like to single out the person who is next to me at this table. admiral mike mullen, his courageous testimony and leadership on this issue. i think they were major factors in bringing us to this day. let me also if i can give you an update on the defense budget and where that stands at this point. as you know, the department -- >> to leon panetta, marking this historic occasion at the end of don't ask don't tell. i have colonel jack jacobs including a war vet who fought in iraq and did not reenlist as a result of don't ask don't tell. we see the shoulder of mike mullen, but leon panetta said it was part of the testimony given by that admiral that may have

changed this game. i remember he talked about how he served with men who were gay and they have a place at this table to fight for our country. men and women. >> anybody who has been in combat, i you don't care when the shrapnel is flying around what anybody's orientation is. we fight for each other under the most difficult of circumstances. it was admiral mullen's testimony. it was inevitable. sooner rather than later. there a lot of people, officers both retired and on active duty who thought the sooner we get this, this is a problem in not resolving the issue about gay and lesbians serving in the military. let's get it resolved and out of the way and move on to what we need to get done. >> absolutely. my father served the country in the army for 31 years and he said when it came to african-americans in the army,

he said when i was a young man i felt the country was behind what was happening in the military and felt the embrace of other men who fought alongside of him in vietnam and korea, but he got out of the army and saw a different side of the nation with segregation and other things that were going on. do you believe now that this really will resonate in places that we are not ready to accept the end of don't ask don't tell? >> they don't know a gay or lesbian person. they don't have direct knowledge. when they served next to them and they finally come out to them, they have an example, that is what a gay or lesbian service member is. i know on that level and i have no problem with that. >> thank you for your time for the service to your country. also we are following other breaking stories out of georgia why where a few hours ago where the board of pardons spared the life of convicted killer troy

davis. davis claims he was wrongly convicted in the 1989 murder of a georgia police officer. the board said it considered the totality of the information presented before making its decision. she set to be execute bide lethal injection at 7:00 p.m. local time tomorrow. >> this is a civil rights violation. and a human rights violation in the worst way. to execute a man with this much doubt does not bode well for any of us. this is a new era. >> i am joined by al sharpton, host of politics nation. reverend al, you have been tuck bei talking about this on your show. troy davis is set to be executed. what is your reaction to the board a few hours ago? >> well, i think it's

outrageous. i have been involved in the case with the network and as we say we have been talking about it on policies nations. when you look at the facts, tameron, that this man was convicted with no physical evidence and no dna. he was convicted basically on testimony of nine witnesses. seven of whom recanted their testimony. some say they were coerced. we had an expert that talked about how some of the witnesses were brought together to the scene and some were only shown one photo which was troy's. with this doubt, how do you execute a man? i think it is absolutely an outrage. it is also very telling. here we are with all of the heads of states from around the world in this country that we watch tomorrow night the possibility of executing a man who has not clearly found beyond

reasonable doubt to be guilty of this capital crime. i do not think it bodes well for the nation. >> why do you believe the board -- again the board said they reviewed the information, what do you believe is behind the decision? >> i don't know. i don't think we should get into name-calling. i think can we have a precedent where when you have the only level of evidence, the eyewitnesss and they say no, we were wrong or no we were coerced, it can cost your life. that is say threat to all americans. i am going to atlanta and we will be there all day. i was there over two years ago standing in the courtyard with his mother and they stopped it. we are praying for a miracle. maybe the da can withdraw. i don't know what can happen, but we intend to stand and raise this issue. >> you have also offered your thoughts and prayers to the family of mark mcfail and have

happened. they are hearing for early reports and they could be wrong. the suicide bomber actually came for a meeting with former head of the transitional peace council, trying to negotiate with the taliban. he was perhaps a known member of the committee and blew himself up and killed the president in his home. >> this was expected to have an impact on whether he would be able to attend at the un. >> he was here or most of the way when he heard about this attack. he met with president obama today and will be going back in the morning. i don't know that he will be able to deliver his speech. it just e enforces the tragedy and how long it is going to be before we can meet our schedule of redeploying withdrawing by 2014 and the fact that there have been so many recent attacks in kabul. it makes it more critical. >> let's transition to libya.

the president attempted to take a victory lap there while also offering up caution. >> there is a long way to go, but libya at least they have pinned down the forces. the gadhafi forces. gadhafi is no longer in power and not here in new york at the general assembly with a 90-minute speech and all of the other performance that went on connected with gadhafi. libya has a way to go. six months and one day after the joint un nato military action that the u.s. participated in. it's not over yet, but it is certainly a success at least in terms of the military and the political and diplomatic. under cutting a lot of what the president is trying to accomplish here in new york is this showdown between the palestinians and the israelis. that is not resolved today. >> what are the negotiations happening behind the scenes?

fascinating. it gets you into how it put this is work together. the reporting exercises are always difficult. there is an accumulation of small errors here that keep me awake at night. generally the picture he portrays of a dysfunctional team was very much in line with what i read. what he wrote about in his book before that. >> what do you make of that and the extreme push book back to his surprise what he articulated today and he didn't see this coming. as he pointed out, he spoke with people like anita dunn after the fact.

welcome back, everyone. it is enough to make your stomach turn and dirt and grime and even bacteria everywhere. it is lurking in fast food restaurant playgrounds across the country. this is some of the video she took at one play area and posted on you tube. erin is a professor who specializes in child development. she was so disgusted by what she saw at a play grund, she spent her own money for tests. the results were shocking and she has taken her crusade on the road. thank you so much, professor, for your time. >> thank you. >> you are a hero to a lot of people. parents and germphobes out there. i believe you looked at about 50 different play areas? >> so far it's just under 50.

black and rotting food and an old band-aid with blood and curse word, f this and f that and stuff spilled and tracked through the playground. it smelled. it was an awful sight. i complained repeatedly and when it was evident over a month, they had no intentions of making creeks, i enlisted the help of a colleague who is a microbiologist and i reached out and we started swabbing and i looked all over arizona and all over the country. >> the only place that was clean at least in the 50 you tested was a chick fill a you found. 1 out of 50. mcdonald's said they put customers first and taking the concerns very seriously. they spoke with you and assigned a team to review the report. burger king said they havedaley and monthly cleaning of the pads and foam and chuck e cheese said

they use sanitizer to clean up the equipment, but the problem still exists and we are not singling them out. these are restaurants that are giving out statements. i know there is a push for stricter standards in the battle to keep these playgrounds clean. >> right. i would say mcdonald's hasn't made any corrective changes. there hasn't been anything done to address the problem. burger king has one of the highest levels of mold i have seen and lots of broken equipment. chuck e cheese has garbage and there has to be a standard that requires sanitization and disinfecting. they are growing at enormously high levels at numbers indicateda as too numerous to count. there is problems with equipment in disrepair. climbing calls held together with duct tape and string. broken windows and missing

>> kelly o'donnell joins us live and interesting comments from the senator liberating here. what more did he have to say? >> lamar alexander has a reputation for liking bipartisanship and it's not so easy to achieve. being the number three in leadership in the senate is a very big job within the party and for people who love politics. this was a surprise shake-up. he said he would like to be one of the voices who could try to work with the other side and bring about deals that might be on issues that are not the big political story of the day. he had once been secretary of education. that's an issue that is dear to him and not a lot in our day to day politics. i noted his use and you used it in the clip. the word liberating. when you are in the leadership, you have to fall in line with the main message, the main set of goals and this would be a way for him to get out of that. still work to do the things he cares about.

he will run for reelection in tennessee and the governor of tennessee. this is somebody with a long time in public service and what it also does is shakes up who will take his place. he has been talked about that some day a candidate in south dakota puts his hat in. everyone watching john corn on in charge of senate republicans, he might be someone moving into leadership as well. the number two will retire in january 2013. a big mix up on the prominent faces in the gop party. >> kelly o bonle live. thank you, kelly. john boehner used particularly colorful language in his attack on the president's plan to raise taxes on millionaires. take a listen. >> giving the federal government

more money would be like giving a cocaine addict more cocaine. >> joining me now is cnbc's correspondent john harwood. john, does congress have a coke habit? i'm not sure where he was going with that. we get the point, he doesn't like what he heard from the president. >> he was reaching for that colorful language because he and other republicans in congress, democrats in congress too came back from a very difficult august when their ratings went down as the president's did. now all of a sudden they have this feisty president coming at them on jobs with a proposal to tax millionaires which is popular in the polls and trying to figure out a way to push back. the anti-spending argument is the best thing the republicans have going for them because right now with unemployment at 9%, the economy growing slowly, a lot of people look at the deficits look at the stimulus plan and what it did and didn't

do and see spending as evidence of the problem itself and not a cure for the problem. >> it's not like the interpretations of the poetry. it's math. i saw this article that said listen, the president's math is all wrong and the rich don't pay more. break it down. >> it's math, but also values. the income in the country had a tremendous shift up the income scale. the people have doubled their share of national income. the top 1% over 30 years. there is clearly a shift and the president is saying the wealthy are doing better than the middle class and the working poor so i'm going to hit them for the money we need to fund the government. on the other hand, because of the shifts, many people no longer make enough money to have

income tax liability. the same people who have a lot more income are also paying a higher proportion of the federal income tax builds. republicans say that's not fair. you shouldn't fund all of the government on the backs of a small group of people even if they make a lot of money. that's the core of the argument and the president thinks he has the high side. 80% of the american people say they support a sur tax on millionaires and 60% want to get rid of the tax cuts for people over 250,000. they have an argument to mobilize the public opinion to his benefit. >> john harwood, thank you, john. heard breaking testimony in the connecticut home invasion trial that tops our look at stories around the nation. dr. william pettitte who lost his wife and two daughters took the stand in the trial of the man accused of the deadly home invasion. pettitte is the only survivor of the attack, defense attorneys

meeting of the united nations general assembly convenes. rick perry blasted the palestinian authority's attempt to gain recognition and attacked the mideast policies. >> simply put, we would not be here today at this very precipice of a dangerous move. if the obama policy in the mideast was not naive and arrogant, misguided and dangerous. >> also minnesota congresswoman michele bachmann weighed in, denouncing his visit to the u.s. >> i call upon president obama to stop him from coming to the united nations. when mad men in position was power like this make wild and genocidal threats against another nation lick israel, we should listen to them and we

should take necessary counter measures to stop them and their evil intent. >> i am joined by ken vogel. i should admit romney said over three years, they have been throwing israel you should the bus and undermining negotiations. let's talk about the comments regarding israel and this possible resolution or the veto from the united states. can these candidates pick up track? rick perry talked about appeasement today. >> they believe they can. it will be harder to come at foreign policy and military affairs type issues than in 2008 when he was veried vulnerable on a short-term senator who didn't have a ton of experience. with the killing of bin laden and afghanistan. it's going to be harder to make the case that he is weak on foreign policy, but israel and palestinian issue is one place in which the republican candidates believe they can come

at him and show him to be insufficiently supportive of a key u.s. ally. >> the comments from rick perry, he was standing with leaders and he's accusing the u.s. of isolating israel. some of the rhetoric here certainly by the president's supporters can be seen as dangerous and extremely exaggerated for political gain here. again, i go back to this, how does rick perry capitalize on his comments and trying to hit the president hard when we know that if this resolution comes up, by all accounts they will provide a veto to it. >> that's right. it's a tough one to figure how this particular fraping of it around this vote which the u.s. and the obama administration has been close to what the candidates are saying they would be gives them much traction. however they call into question

time for the gut check. does the punishment fit the crime? a shoplifter is sentenced to life in prison for something that happened nine days after his crime. the video from a wal-mart shows kennedy trying to leave the store with a $348 tv. when an employee tries to stop him, he pushed the man to the ground and walked off. bruce florence, the man who was pushed was taken to the hospital for his injuries and died nine days later. the medical examiner rule heed died of a liver condition, not the fall. kennedy on the right was sentenced to in prison. even the victim's widow thinks the sentence is harsh. >> here i go to the hospital where he is and this knot on the side of his head. his arm scraped.
