witnesses. joining me now is defense attorney and legal analyst ann bremner. there report that is the legal team was split. they thought he would be crucified in f he went on the stand and another thought the jury would convict without murray's testimony. what do you think? >> i think he had a huge risk in testifying. should he testify or shouldn't he testify? will he testify or won't he? the thing is, he could be crucified and he kind of testified in the statement that he gave to the police about his version of events where he said he was not guilty of homicide. >> a lot of folks contended had he not been so forth coming with police after the initial parts of the investigation, the prosecution's case may not be strong as it is. >> that's a problem. a closed mouth gathersno foot. you have to be quiet. i tell my clients to be quiet. if you are well-intentioned, you will have problems if you talk

to police and testify in a courtroom. at the end of the day, there has been such a mountain of evidence against him in the prosecution's case, they put in a good defense in terms of michael jackson could have done it himself and he is loved by his patients and leave it at that. if they put him on the stand, they may ruin the entire case. >> does doctor murray's decision not to testify say anything to the jury? >> it shouldn't. the doctors can be unified, but it's conrad murray's choice alone and they are instructed to take no negative inference from his fail tower testify. jurors stick by that. i have seen that in 28 years of practice. when you tell a jury you can't make a negative inference, they follow that. >> is there anything he could have said that would have convinced a jury that he is innocent? or not guilty? >> the only thing he can say is

s&p 500 and nasdaq also sharply lowered today. joining me now is sue herrera, the coanchor of power lunch. it started when greece threw a monkey wrench into the deal. >> that's right and it's a fluid situation. things are changing hour by hour. what happened is the greek prime minister basically decided to take this big bailout package that includes a lot of austerity measures for the citizens of greece. he put it to a referendum vote that stunned european leaders. they were under the impression that they basically had a deal put in place. that's why the market rallied so much last week. this was a pretty stunning development that he was not going to basically decide this within his cabinet and he was going to put a vote to the people. the market is worried that that vote or package will be voted down. as a result of that that, once again put europe into a very

large crisis and some say it would trigger a default in greece. that's why we have such a difficult situation on wall street today. there conflicting wire reports coming out that that vote will not take place. that's when we saw the dow jones come off of the negative 300 point mark and moved to negative 185 which relatively speak suggest still a big loss. better than expected. >>ç there is confusion over whether that will happen in greece? >> yes and we are a wading clarification on that. the market itself i think is pretty much convinced that there is now dissent within the greek government. the bigger question is not whether or not the vote will take place, whether the referendum will take place, but whether or not the greek government survives or whether or not that doesn't get dissolved and a new government gets put in place. if that happens, they have to start all over again. start from scratch in terms of

negotiating a new austerity package and debt reduction measures. it's very much in play at this point. >> cnbc, sue, thank you so much. >> pleasure. thank you. >> to politics, day two of damage control by leading presidential candidate herman cain today. he explained why he seemingly changed his story as the day went on monday about a settlement with a woman who accused him of sexual harassment as president of the national restaurant association in the 90s. >> i recalled that there was an agreement with the lady who made the charges and they were found to be false. i have never committed sexual harassment in my entire career. i absolutely believe this is an intend smear campaign using these two cases and like i said, i'm not aware of the second one. it is a smear campaign. when they cannot -- >> by whom? >> we don't know.

we have no idea. >> joining me now, news deputy director mark murray. there those who are speculating that a contender may have leaked this story orç in association with the wannabes may have leaked the story. will we know where the story came from? >> we don't know where it's come from. so far i haven't heard any of that type that came from a rival campaign. there had been some chatter here in washington that there was a story about herman cain. politico broke the news on sunday night. instead of whether or not who came up with the story, the biggest story for herman cain is does another shoe drop. he pretty much came up with the case yesterday and it evolved over last night he never sexually harassed anyone and somebody falsely thought it was

sexual harassment and he said he reached an agreement, but it wasn't a settlement even though earlier in the day he said there was no settlement reached. >> none of this appears to be hurting mr. cane n terms of fund-raising. his campaign manager said all this controversy yesterday, the campaign managed to raise about $250,000. >> our nbc campaign in fact said they raised $300,000 yesterday. what we have seen, the conservatives and cain supporters have come to his defense and rallied around him. the biggest question is, is there another development. if a shoe drops, you may see it ralliying around herman cain. of course this remains to be seen what happens. this is a feud situation and they thought the campaign handled the situation a little

inconsistently and turned into a rough day for herman cain. >> thank you so much.ç appreciate that. i want to bring in our nationally syndicated host michael smerconish and msnbc contributor as well. i want to start by playing cain's evolving responses yesterday from morning until night. take a listen. >> you remember everything about an incident from 12 years ago? i know there was an agreement, whether it was a settlement or agreement or whether it was termination papers, i don't remember what it was called. so that choice of words i'm not going to say that it's changing my tune. >> i want to start with you, jp. herman cain, has he done a good job of explain something. >> the difficult thing is he doesn't take himself seriously. that's the problem we saw as the story evolved from sunday night into yesterday. he kept on slightly tweaking his

story and maybe it was that they were crafting messages or making phone calls to make sure everything was factually accurate, but you don't want to get knocked off your horse this way. he was sort of. this was for him to showcase economic expertise and he had the right experts. instead he wound up talking about this thing. you need to be better prepared for this. this means the end of his campaign? no. anyone who said it's over, they are overestimating the problem for this story. in the coming days, if more comes out, then it will be a problem, but this is something as your colleague mentioned was a good fund-raising day for him and he had four million on hand. he's in good shape. >> do you think another shoe is going to drop? >> i think herman cain's handling of this hasç dramatically increased the odds. another shoe is going to drop.

craig, grown he harassed anybody, but i believe that his handling of it yesterday at best was evasive. how can you go before the national press club at lunch and say there wasn't a settlement. three or four hours later sit down and start speaking in detail about the settlement and play the clintonian game of it depends what is means. this woman or these women are out there. they are watching television. they are evaluating how he handles it and it's conceivable that they say that's not right. i am going to come forward and defend myself and give up whatever that payment may have been to keep me quiet. >> we have all covered enough scandals to say it's not a scandal itself that leads to a campaign's downfall. it's generally the handling of that scandal. do you think that had the cain campaign handles this thing

differently, do you think that the out come would have been dramatically different? >> we still haven't seen the out come. the out come doesn't seem like it's too bad. also this thing is not over. on the other hand, what it indicates is that is considered a front-runner by his opponents. if you think about the timing of how this story came out again, it eclipsed the roll out of his economic plan. that is something that you would do in the matter of a campaign. this is not politico working on its own. they took a tip and i am not accusing them of bias, but this means they are taking him seriously enough as they did. >> iç don't want to get you to speculate, but what do you think the tip came from? >> i don't know. i have been listening to callers who want to say it's ideologically driven or say it's racially driven. it's a legitimate story.

a major spike in immigrants around the country becoming u.s. citizens. the miami herald shows 750,000 people were naturalized, up from 680,000 last year. officials say the new citizens are primarily hispanics who want to vote on the issue of illegal immigration. the justice department filed suit against south carolina over tough new immigration laws that require police to check the status of everyone they detain, a lawsuit argues that that

requirement is unconstitutional. the governor is vowing to block the law that is set to take effect on january 1çst. pete williams is live. alabama, arizona, this is the third lawsuit that they filed against new measures and they enacted to crack down. how can we expect this legal battle to play out? >> like the other, i suspect. the government will go to a federal judge and said please block enforcement of part of the law. the judge will decide. it will go to an appeals court and the government makes the same claim and said the states are free to take steps to try to deal with illegal immigration and they can't pass laws that are at odds with federal policy and that under the constitution preempts the field. arizona's case got through to the supreme court and we are waiting to see if the supreme court will take the challenge over arizona's law that has been stopped.

the enforcement of most of the contversion provisions have been stopped because of the court and we are waiting to see if the court takes the arizona case. if it does take it this term, that will go a long way towards sorting out the claims between the states and the federal government over how much the states have and how much they have to defer. one of the arguments here is they say that south carolina as did alabama in passing the laws said the goal is to try to push illegal immigrants out of their states into somebody else's and let someone else deal with it. what the justice department said is he can't have a policy that consists of every state trying to shove the policy into someone's back yard. they are taking the case and go a long way to sorting this out and waiting to see what it will do. >> pete williams from washington this afternoon, thank you. >> you bet. >> as earlyç as today, hundred of prisoners could go free because of a change in the way

kelgy o'donnecorrespondent, kelly o'donnell. how much optimism is there that they come up with an agreement by thanksgiving? >> reporter: if you take a snapshot of the moment, there does not seem to be much optimism. they have them testifying. he worked extensively on the issues and former senator alan simpson and experts on this. a budget expert and people who have been neck deep in the problems and workinging to to try to come up with solutions. solutions they put forward in the past have been ignored. their big concern is that this committee with the special charge and deadline to get something done will somehow be ignored or not be ableç to complete the task. in this moment there seems to be a bit of a trough in how people are feeling about this. >> what do we know about the reports that have been holding

separate meetings to hammer out a plan? >> the public meeting is a way to show the public what's going on. the bulk has been in a series of private meetings. sometimes in large groupsing to and democrats and republicans meeting separately and meeting with the leadership and going-over with the staff experts and people who work for the committee who know a lot about these issues and have been turning it out. no one is saying they are not turning hard. they are putting in the time and trying to make compromises and come together. these are big problems and as the experts were saying, this is a foreseeable problem. it will only get bigger. one of the things is the component on the debt itself will be one of the biggest problems. that will compound and be a snow about ball rolling into the future and one of the many things they need to tackle. >> kelly, thank you.

>> reporter: thanks. >> about 2,000 prisoners are eligible for early release thanks to a new change in the way sentences are being handed out for crack cocaine. sentences for crack cocaine will be closer to penalties for powder cocaine. the effect of that change will be spread out over a few years, but estimated 12,000 prisoners could benefit overall. inmates will get an average of three years shaved off the suddens. alex johnson wrote about the story for msnbc and today is the first day the new changes take effect and how many prisoners be set free today? >> a lot of them are waiting for this day. a lot of requests were already in the pipeline and it created a backlog in districts. there is no way to know exactly how many will go free today. you are right. it's projected that close to 2,000 people will be eligible for immediate release beginning today.

>> the disparity in sentences for craig versus powder was considered discriminatoryy and it affected them proportionally. explain how they are different under the so-called fair sentencing act signed by the president last year. >> before you can be subject to a minimum five years if you recall holding five grams of crack. less than a fifth of an ounce. to trigger the same sentence, huh to be holding more than a pound of powder cocaine. 500 grams. the new rules don't eliminate that. they don't make the amounts of cocaine to trigger the minimum sentence identical, but they cut it drastically. instead of a 100 to one ratio, it's in the neighborhood of an 18-1 difference that get you that sentence. >> msnbc.com. thank you. >> thank you, craig. a boeing airline makes an

emergency landing without the landing gear. that tops our look at stories around the nation today. dramatic video show a boeing 767 landing on its belly. warsaw airport after the landing gear failed to open. 231 people on board that plane there that crash triggered sparks and small fires as well. no one was hurt, but the plane circled boost airport for about an hour, dumping fuel before it made the landing. nearly two million homes and businesses are in the dark three days after an early snowstormer to through the region. they ever waiting to buy gas for cars and generators and at least 23 deaths have been blamed on the storm as well. tennessee's governors defending the arrest of dozens of occupy nashville protesters and even though a judge said to stop enforcing a curfew that led to the arrests.

the decision came after protesters went to court yesterday and arguing that the curfew and arrests violated a right to free speech. important news today concerning home foreclosures. a government announced up to four million homeowners who may have been improperly foreclosed on can get their cases reviewed. we cover the housing market and what's this all about. >> paperwork scandal, a federal banking regulator's enforcement that was announced last april. part was in effect today. the part where the banks must offer reviews of foreclosures and you are foreclosed on only in 2009 and 2010. you believe that you are wrongly foreclosed on.
