accusing herman cain of sexual harassment. he made inappropriate sexual advances towards her client. she is identified. nbc news has not confirmed the allegations and herman cain has not released a statement responding. here to discuss the controversy and a new poll on how this is affecting his campaign, i am joined by a correspondent for the nation and a republican strategist. i will start off with you here. the conference is here and here is gloria allred who represented any and every type of case in hollywood. they have not confirmed this woman's allegations, but it's a fourth person accusing herman cain of harassment. at least with republicans, many

of them consifbatives, this is not sticking. >> what are he has done and he will continue to do is pitch himself not in a fight with these individuals as you say, some of the accusations have not been proven, but in a fight with the media and a scandal and saying something we heard republicans say before. they are out to get us and they are distracting from the issues and he said i am doing well regardless. leave me alone. >> they said the allegations are not having an impact on how they see herman cain. two things that can be at play. the first being that people or these folks don't take sexual harassment as an issue or you have republicans, many of them conservatives who said time and time again, mitt romney is not their guy and they're looking to put their support behind herman cain. >> it's nurth of thoeither of t.

i think they take it seriously, but i think there polls that show indication that we know democrats gave bill clinton and they defended him and trashed the women. i don't think republicans are going to do that, but haley barber and others said get the details out because it's better for the party to get this over with. it cuts both ways. herman cain does not want to address it. on the other hand, people are not quite sold on the fact that he is guilty of something when the details haven't been put out there. it might be she a flirt. you have gloria allred out there.

think they didn't meet the standard. the reporting was on point and it was very, very fuzzy. that's why. it's like pulling the band-aid off slowly. you have seen polls that showed support and some people want to rally around them and think he is not being treated fairly, but in the end, the primary voters are going to want this to carry on for too much longer. >> i want to read a quote from ed rollins as he is described as a long time operative. he worked with michele bachmann's campaign and he said this guy knows nothing about that policy. 9-9-9 have been ripped apart and the girl problem has not gone away. a thin skin that will get him in trouble. his days are limited. with that said, the same article indicates a lot of other republicans are afraid to go at herman cain because he is likeable within his party.

conservatives don't want to see him beaten down too much and they are afraid to take him on with the openings and as ed rollins referred to it, the girl problem. >> i would take it a step further. his candidacy is not limited, it's finished. i will tell you why. not because of all the things like the lack of foreign policy and experience and it botched everything whether we are talking about foreign policy or lack there of or fiscal or luj etary issues the bottom line, herman cain from day one was a distraction. he was a feel good candidate for the tea party to essentially say see, we are not racist and we are broad base and we can get behind a candidate. his candidacy was going nowhere from the beginning. now i will say one other thing. all you have to do is follow the money. just came out today that when it

comes to money, you have to have an organization and essentially money. you have to have leadership on the ground within the states. you have to actually be there building the base. herman cain made it clear, i'm not doing any of these things, but he doesn't have any money and funders have fled from him like the plague. his candidacy is finished, dead in the water. >> the first thing i want to read from herman cain, vice president of communications said as the country began to refocus on the debt and unacceptably high unemployment, gloria allred is bringing forth accusations against the character of herman cain. the other is there is a verdict in the trial of michael jackson. crazy day for sure. we are juggling a lot of things. there is a report the jury reached a verdict. we will talk about that in a second.

comfortable with that. he is a series man with serious ideas and he looks for serious people with serious ideas. that's his strength and he is willing to listen to ideas and go into corners and listen to ideas. he's for real. >> the question at the bottom of the screen, could newt be next? do you believe that perhaps he can find a way to move up above herman cain and be a challenger to mitt romney. >> earl there. this is interesting. let me bring you in on this. could there be an open are figure newt gingrich, cherry is absolutely right. he is a laughingstock with the trip to hawaii and the crews and saying he was not committed, but he is inching up at 12%. that's better than the 2% or 3% than before. >> yeah, but at the end of the day, it's been there done that.

whether he has to say he is wrong, he has to get out the information. we have a primary going on and the other candidates wanted a chance to get their message out. they don't want to deal with this. >> we appreciate you rolling with us with this breaking news. ari as well. a lot more going on. let's get back to the other breaking news that came down in the conrad murray trial. reporting the jury has reached a injured. legal analyst ricki climan, the second day of deliberations. not even a full day. what is your take on the timing? >> one would think that the verdict is going to be guilty. it is hard to believe that under this much evidence for the prosecution that the verdict could be an acquittal in this short of a period of time. they took a full day on friday and that was good. that makes us think they looked

at the evidence and certainly i suggested when i was in l.a. on friday they might want to sleep on it. if they had taken the straw vote and came in today, we have to remember with the time change here in new york, they are three hours earlier. they knew what they were going to do today. >> what are double is at the heart of the deliberations. we don't know what's going on in private room, what would have been the lingering information that lasted in your mind? >> this is a battle of experts. we had two different theories of the case as to who administered the fatal dose of propofol. it was michael jackson reaching for more drugs or conrad murray who had the propofol in his hands? you had the simple issue that the experts differed upon. the amount of time that dr. murray left the room and is this a case of abandonment? two theories of manslaughter went to the jury and in either

case they had to think about causation. who caused the death? >> protesters have been in front of the courthouse all morning and as with michael jackson's and death, we can expect the scene outside of the los angeles courthouse. the last report, the family and others will be given two hours to get there and get in place. the jackson family has been there every day. conrad murray was seen with his child and his girlfriend who was one of the witnesses during this. we will see what happens as it comes down. we will bring out audience the latest. the sex accuse scandal rocking penn state. jerry sandusky was arrested on charges of sexually abusing boys. he met through a charity and found it for at risk youth. in the last hour, the pennsylvania district attorney called on one of the alleged victim who is has not come forward to identify himself.

that they pernlgure themselves. >> one will resign and go into retirement and the other is taking a leave of absence. penn state will support him through the legal process. a lot of people are saying joe paturno, what is next for him? the famed coach of state for so many years and so many decades. linda kelly, the attorney general said he is not a target. he did what he was supposed to do that was report to authorities when in 2002, a graduate assistant said something was going on in the locker room with jerry sandusky and a 10-year-old boy. now it's did he have the moral obligation and not only the legal obligation. about 80% of people think at least without any further discovery that joe paturno the

head football coach should either give us his job and resign or retire. only 2.4% said they thought he would actually get fired from this. there is more in the legal process, but i don't think people think penn state handled this well. >> what are you hearing the larger criticism of the conversation? you saw students who were worried about the reputation of the university because there is a fear as you well know that this information will start to come out and perhaps people did know far more than they were revealing and had to reveal or had the moral obligation as you point out to reveal. >> not only is it how long it went on, but also the initial reactions i don't think have helped penn state at all. when you think about the president coming out on saturday saying he gave the unconditional support to the two men who turned themselves in today.

i don't think people were happy with that comment and happy with the comment of joe paturno saying he only new so much and it wasn't in specifics. people want more in these situations and as you know, it's a difference between crisis management and what they are doing legally. >> joining me now, the former nhl player, sheldon kennedy at the hands of his minor league coach. thank you for your time. >> thank you. >> what is your reaction to the allegations that we are all hearing now and actually are still quite stunning? >> i work in the area and have for the last 14 years and it is stunning. and the most important piece here is there 8 a individuals that are victims in all of this

and one of the things we realized over the last 14 years of working with the issues and pushing them forward and giving changes is the damage that these issues have on our individuals. they are off the cases. taking this stuff seriously. >> you have to be asking that one of the kids who were allegedly abused and this is the allegation that an assistant walked in and witnessed this abuse and they want this young man at the time they believe he was between the age of 11 and 13 to come forward. you came forward. talk to me about the process and how difficult it was. here you are this nhl star and you have been a star athlete almost all of your life. you were suffering at the hands of a coach here. how difficult was it for you to come out? >> well, it's hugely difficult.

especially when you look at the imbalance of power. you look at the powerful organization of state and the coaches that are involved. the biggest question is the sexual assault and sexual abuse. the individual that had it happen to him, those are the questions that are asked, i believe. that's the biggest question asked. >> it is a big question because you look at a coach, someone who is trusted and who might have spent long periods of time with the child and given the allegations against him, they are allegations he bought one young man clothing and he took him to buy marijuana. this is outlined in the case against him from the da. there is a level of trust and beyond this case, a level of trust extended to coaches and

parents believe their child is okay in these cases. >> absolutely. there is a huge gap. you look at the situation and everybody that was involved in a situation and surrounding the situation for all these years that this stuff was happening and there were a lot of good people that were seeing something and that's where it is. we need to really educate and rally around what is sexual abuse and what is bullying and harassment. what are these issues? they are signs we can give people the process to come forward. i don't think it will stop this stuff from happening, but stop it from being institutionalized. >> to the point, arnie duncan

here we have the big day for us for ohio. what do you make of the polling showing this measure will be repealed? >> americans are waking up and saying the whole question of wall street protests, americans are saying that it was the labor unions that really protected and increased their manner with wages and benefits and safety and with these governors through the stroke of a pen trying to

repeal the gains that made america's middle class strong. >> 60,000 public employees that would be affected by the law. what do you think is the different dynamic and what we could see in ohio tomorrow? >> i think people had an opportunity to see what happened in this and didn't happen. quickly people now have been able to get the facts that they were able to organize and get out to people to say this is the situation. as a matter of fact in ohio, when labor unions were organized, there were less labor problems with public employees after labor unions were created in ohio than before. they were positive and people felt they could talk to the employer and the employees and may moved the state ahead. the people of ohio will send a

resounding vote to say that enough is enough. we have to continue to have collective bargaining. >> the implications that this could happen a year from now. ohio being a key state and the democrats and the unions pull out a victory there that this showed that voters, democrats in that state are motivated and they would possibly be there for the president in a year from now. do you see this vote tomorrow could have a larger impact on the president? >> very key. it will be key in states like michigan. the same situation they had in ohio. michigan where the president bailed out chrysler and they have one of the hottest models and the big three have all had increases in production and therefore increase their organizations. i heard that tomorrow in ohio will be key and we will see

to see the latest. the circus has started with people showing up. la toya jackson tweeted a short time ago that the verdict was in and she was shaking so the jackson family already reacting to this. what do you expect? obviously his fans want to hear a verdict of guilty. >> of course. >> people want justice in their eyes for michael jackson. a story of two men, was michael jack this drug addict who needed sleeping aids or whatever else to function? conrad murray was this doctor who was working for him for hundreds of thens of dollars. >> i think it's somewhere in the middle. michael jackson was desperate to sleep. he needed and wanted this tour. he understood if he couldn't rehearse the concerts would be postponed. they had gone through a terrible time with the promoter. they had been cancelling concerts and you were dealing with someone who knew he had to sleep and he was going to find

someone to give him the drug he wanted which was propofol. while saying that, dr. conrad murray is a doctor, not a drug supplier. i don't think that conrad murray was in it for the money and certainly the prosecution portrayed him as such. i don't think he's a bad man. i think he is a man who is in over his head and really cared about michael jackson. he is a person who seemed helpless to deny him. >> with the events that played out including why would conrad murray takes a patient on his iphone, second some of the information brought to the courts by the first responders, the paramedics who asked conrad murray specific questions that he either according to the prosecution misled them to believe or gave erroneous information to the people who were there to save his life even

though he was dead when they got there. >> you bring up a point that the prosecution argued well. a tremendous lawyer, he went right back to that. all of those things, not telling the paramedics he used propofol and not telling the emergency room doctors he used propofol. things he didn't say and we call consciousness of guilt that can be taken by the jury as evidence of guilt. this was someone who either didn't want to say what he had done or forgot what he had done which was not the logical conclusion. >> the make up was seven men and five women. seven hispanics and nine of the people had previous jury experience. does that help in maybe their ability to read through the information? >> i often said that people whoa had prior experience, especially the person who has been on the jury numerous times, they can order the deliberations and ultimately the foreperson will

have that duty. there was never enough time in a day and a half to be able to go through all of the evidence in detail. that's not to say that the jury had to either. the jury has been sitting there for weeks and knows what the evidence is. they either believe the government's theory or they believe the defense. >> we will see what happens. we should have the verdict very soon at some point in a couple of hours from now. thank you very much. we appreciate it. president obama is blaming senate republicans for blocking job growth and demanding they step up and do the right thing. president obama officially rolled out a program he announced back in august that would help post 9/11 vets find jobs. beginning today, vets can download what's called a gold card and visit a new website to find jobs they qualify for. they said republicans said no three times to his ideas for job growth and they need to say yes. >> i won't wait nor will i let

politics get in the way of making sure veterans share in the opportunity they defend. if congress won't act, i will. >> joining me now, an expectative director of the office of the american legion. thank you for your time. >> the labor department said 12% of vet who is served since 9/11 are unemployed, higher than the national average of 9%. people respect the people who served and wonder why more attentionsh should be paid to vets. >> if this is a military issue, it's not. it's an american issue. when we allow our military to leave and transfer out and walk out of the gate and take off the unifor uniforms, they allow their education, experience, and knowledge to be ignored and for them to exit the bases of military bases and enter the

roles of unemployment. it's a poor investment to the taxpayers. >> many of the soldier his a hard time translating the valuable skills they learned fighting for the country into the workplace and part of the problem is to give them access to six months of personalized assessment and counseling at career centers. what impact would that have? >> that should have a huge impact. we as a nation spend a lot of resources on training them and how to be good members of the military. we need to do now is invest on the transition when they decide to leave the military. we need to spend just as much time and give them the opportunity to access resources to better understand how to make themselves more marketable as they enter the workforce. they need to invest more resources to ensure that their education training experience transfers into the civilian

workforce. >> the president said there was no reason for lawmakers not to support the effort to help with the veterans. what would you say to lawmaker who is wouldn't vote? >> they have been fighting for years. with other administrations and almost a decade. we have focused on military experience and education in training. we approach every congress and every administration the same way and put veterans first regardless of what power is in power or position. we have an obligation. no single party can claim they take better care of veterans women need to be more vocal and provide the strong voice here in washington, d.c. to congress and the administration to do what's right for the veterans. >> we are thankful you are fighting for the nation's vets who served us. they are there for us. thank you very much. greatly appreciate it. thank you, sir. >> greece is reshuffling the government. the prime minister will resign.

they are close to naming an interim prime minister. michelle kosinski is in athens. at one point is teamed like things were moving slowly and it picked up. what is the latest there? >> at least an agreement has been reached and we kind of know the lay out of the plan. they will form a coalition minister will not leave. they will hold elections in a couple of months and most importantly this temporary government is going to approve the bloud of greece. it's technical, but the context is simple. why don't i take the idea and put to a public referendum. let the public decide what to do. that's a good idea. this infuriated the euro zone and world markets.

breaking news right now from los angeles. we are awaiting the jury's verdict in the trial of michael jack's doctor. the court announced about an hour ago the jury came to a decision. they have a special code for communicating with the judge and the jury buzzed three times and an indication that a verdict had been reached. judge michael pastor said there
