not only those outside the area but a lot of people here wonder should he be on the sidelines or in the press box come this saturday when the nittany lions play their home game here. >> what else is the latest in the investigation? as i mentioned, another person has come forward saying he was abused by sandusky. what do we know about this latest case? >> that's the concern of authorities here. they fear that now that this has been made public, or they're concerned. they don't fear. they're concerned that now that this is made public, we'll hear from a lot more victim. sandusky was supposed to be in court. that hearing pushed back until december 7th as they continue to investigate and try to determine exactly the reach and extent of the damage here. there is a growing concern, like you talked about, that there will be a lot more victims involved in this.

>> all right. jay gray live for us. now let's bring in michael smerconish, you wrote about this. like you, i spent the other night reading the 23-page grand jury report. and was stunned and just boofld so many levels. i think you really captured the moment. you talk about one of the incidents that was in 2002 where an assistant walked into the locker room, the shower area, and he says he saw sandusky with a child having sex with that child. he reported that information to joe paterno. i'll let you pick it up from there and what the grand jury report says. >> let's talk about what he didn't do. he did not immediately intercede. he did not immediately call the police. he did not immediately go out and find other folks in close proximity to seek their assistance. instead he called his own father, his father said come back to our home. he went back to the family home.

didn't make any outside call that we're aware of that night to paterno. the following day, a saturday, calls paterno. goes to paterno's house. makes some level of report toog paterno and paterno in turn talks to the athletic director about it. what i keep coming back to is what about that response? i think it goes without saying that anybody who was in the loop who didn't call the police needs to be ousted from penn state. but i keep drilling down on the fact that that graduate assistant who today is the receiver's coach for penn state, did not immediately intercede. tamron, imagine if a woman were being raped in an alley and he saw what he saw in this case, and didn't immediately intercede or call the police. there would be a human cry. there needs to be in this instance, too. >> i have that same reaction thinking, while i read the report that this individual walked in. granted, he was a graduate assistant. i cannot put myself in this person's shoes, walking in to

see something like that. but you're right. we asked ourselves, what would we do if we saw a child being sexually assaulted by someone? yes. i'm going to tell you flat out i would think that i would go over and rip that person's head off if i could and save that child. with that said, again, this information according to the report, that graduate assistant called his father. his father told him to call joe paterno. it was the following day they met with joe paterno. this man has had a storied career. has run by all accounts, a clean program. they've not gotten involved in some of the other scandal that's have torn apart university college football programs. and he is revered. so much so, you say the last night. these people were outside of his home cheering him on. and showing him love, if you will. perhaps those people have not read the grand jury report here. but with all of that said, you are an attorney. you are a father. joe paterno had the information

delivered to him in a meeting by that graduate assistant, who as you point out, should be answering more questions. what should joe paterno have done after that? >> that i think it is not a circumstance where you're in a work place and someone has taken the toner cartridge. so you report it to your next in line and you've discharged your responsibility. my standard is, when there's a victimization going on here of children, you have a duty. and i don't mean legal. i mean as a human. you have an absolute responsibility to make sure that law enforcement has been contacted. now there appears to be a factual dispute in terms of what paterno claims he was actually told by the graduate assistant. if i look at what his grand jury testimony was, by joe paterno's account, he was told this guy, the coach had been seen, quote, fonding or doing something of a sexual nature.

he had an affirmative responsibility to make sure the police were called. >> according to the information no, one attempted to find out the identity of the boy at that time, michael. >> it's horrific. it remind me of what we've all seen in the church. this same passing of the buck and trusting the institution, more than looking out for the '50s themselves. sf we're out of time but our gut check question, should joe paterno leave before the end of the season. >> yes. >> thank you all. i talked with former philadelphia eagles star al chesley and he now advocates for children's rights. now tonight's debate is being called other the have the elimination round. tonight is the ninth debate and it airs on cnbc. the topic, the economy. herman cain's rivals could go on

the attack over his sexual harassment allegations. nbc news political director chuck todd joins me now. we've heard a lot about the other candidates not wanting to go after herman cain too hard in that they might need his supporters later on down the road. chris cillizza was on with andrea mitchell and he believes someone might take that opening. >> i think it is a danger to do it if you're one of the guys that is not named mitt romney. because right now, cain's supporters seem to be as defiant as cain himself is on this. if it looks like you're siding with the political elite or if you're a cain supporter and you believe it this combination of the media and political elite out to get him and you pounce on that as a fellow republican, it is one of those things that you could get punished by these supporters. but at the same time, when you're rick perry and you're a night gingrich, you're trying make this leap into the first tier and be the next not mitt

romney to take on mitt romney, you need cain supporters. a delicate balance. it could turn into one of these political suicide deals. he went after bachmann and they both went down. it hurt him and then it helped somebody he will. >> so are the candidates concerned, if you will, the air will be sucked out of the room by this herman cain sexual harassment allegations and they will not be able to talk about the economy and at least their plans or take the tough questions on the economy? >> well, this is a delicate balance for the organizers of the debate. for the folks at cnbc, our colleagues over there. we all know the elephant in the room. at the same time, you have these great folks at cnbc who know the european debt crisis a lot better than you or i. they can go three, four levels deep on this. and it is an interesting time for them to be grilling them think of the old murder boards

at schools. grilling them on what do they know about this? going a level deeper on housing that we haven't seen before. so in that sense, and i know that they see, they know what you have to ask out there on certain things. for herman cain, it is a leadership question. how you're dealing with this crisis. your defiance, at this point it does fall into that aspect of it. >> live for us, it should be an interesting combination of thing with the economy and things happening with herman cain. it will be at oakland university. watch your money, your vote. on cnbc at 8:00. a short time ago we received an update on a joint news conference that may involve all four women accusing herman cain of sexual harassment. the attorney representing karen

kraushaar says it will likely happen in a matter of days. she was a spokeswoman for the inspector general office. she reportedly received a $45,000 settlement in her complaint against cain. >> we are in the process of trying to get the other women who have either filed complaints glens cain or alleged sexual harassment by him to cooperate in a joint press conference. my client or i will be contacting the other women today to see if they want to participate. >> i'm now by sexual harassment attorney deborah katz. thank you so much for joining me. so deborah, let me get your thoughts on this strategy of having all the women together at one news conference. we've heard from one woman already this week and read reports from the others. what does this strategy do to have all of them in one place? >> well, i think what it does is it provides a face to these

women. it makes it more difficult for mr. cain to simply say that this is a witch hunt. this is all fabricated. this is all made up. when people come forward and they have very specific detailed allegations, it makes what they have to say more credible. >> but might it be seen also, if people believe herman cain, that they're gang up on him? they're trying to make this a media spectacle by all being there, obviously, with the lights, camera, action, being present as well? >> well, it clearly does run a risk of turning into something that looks circus like. in the beginning, none of these women wanted to come forward and none of them did come forward. until mr. cain categorically said that these women were tarnishing -- were making this up. these were trumped up allegations. this was a witch hunt and i think he threw down the gauntlet. he said may behavior is beyond reproach. when he did that, some would put

the burden on these women to come forward and say, no, we're telling the truth. there's something here that's very important for the public to know since this man is running for the president of the united states. >> even given the more graphic details that we learned in one of the alleged situations, we've heard so much already. what more can these women say gelt? is it ball the visual? >> we don't know about some of the allegations. we know about miss bialek. we know she has alleged that there was a sexual battery in effect. he put his hand under her skirt and tried grab her genitals. we know from her statement that he tried to force her to perform oral sex. but as for the other women, mr. cain himself has tried to write it off and say all i said was, you're the same height as my wife. we don't really know what those

worries. as a matter of fact, we see a lot of pressure in our own financials. the market is worried that there is going to be a contagion or a domino effect, if you will, if italy continues to have problems. >> the domino effect, many would say that it was seen to be coming our way or the way of italy, i should say. that we were watching greece, and italy could be next. >> yes, indeexd i think the market was hoping when mr. berlusconi said that he would resign, yesterday we saw a sigh of relief in the market. then the problem was that he said yes, i will resign but after we get the budget put in place. and they have not even brought those budget measures to a vote. so now the market is coming to the realization that it may be some time, several week before mr. berlusconi steps down. if that is the case, an you have a lot of uncertainty remains. at our low we were off 404 points. >> when we started speaking with

actor producer brett ratner is booted. and we continue following the sex abuse scandal at penn state university. legendary football coach joe paterno announced he will retire at the end of the season which could be just two and a half weeks from now. paterno has been under fire for a lapse of, quote, moral responsibility for not doing more to stop his former assistant coach jerry sandusky, the graduate assistant in 2002 after allegedly seeing sandusky molesting a 10-year-old boy in the shower at penn state. now a nine alleged victim of sandusky has come forward. now al chessley who played college football at the university of pittsburgh and was abused as a child himself. thank you for joining us. >> my pleasure to be here. >> let me get your reaction. you've got the grand jury report. we know the allegations. what is your reaction?

at least to the grand jury believing that, a, university officials tried to cover up and perjure themselves and b, that others knew what was going on with these children? >> well, first of all i would like to say that i'm a spokesperson for the national center for victims of crime. and we see this more often than not. it's a travesty and atrocity, what has happened at penn state. as i said, this is not new to me. it may be new to the world. it is evident that this goes on in institutions cover up the most horrific crime possible. as you stated, i was abused as a 13-year-old. and it is devastating. for officials that are trusted servants to do that, it is just morally, legally wrong. it is just the worst crime. you murdered a kid. and for him to continue to do what he's been doing and it wasn't the first time that he

was caught. the allegations are just mind blowing. you couldn't think that could go on at a university such as penn state or any university. that's why we have to have the ncaa step up their efforts to interview people and screen them better and in this case it was clear. the writing was on the wall and they didn't do anything. >> for his part, jerry sandusky maintains his innocence, as do the other school officials who have been charged with perjury. when you first told what happened to you, you said i just wanted to free myself. we talked so much about joe paterno. that's one part of story. the greater part are these children are now coming out saying then abused. in the case, at least two instances, people witnessed the children being abused. i cannot imagine the child who was in that shower and the assistant coach says that he believed sandusky and the child

saw him witness what happened there. to feel so alone. michael smerconish was on our show, says how does a child feel when they know someone is seeing what happened here and no action was taken. >> that goes to show that when someone that has the authority, the kids have trusted, usual lay parent or someone knows that they're with that person. and they've given them the permission to be with that person. so they co-sign what the perpetrator does. not knowingly, of course, the parents are innocent. they didn't know what was going on. in these kids' cases, they have the ability to take advantage of them to tell them, to lure them there and groom them with football promises or gifts or whatever. in my case, that's what happened. in my case it was a d.c. police officer. and he was an entrusted guy. he hung around the football fields and that's what goes on.

in institutions such as boy scouts, coaches, the whole kitten kaboodle. 99 has gained the trust of the parents, that's what happens. the travesty is, i was just in harrisburg less than two weeks ago. we were trying to get attention of the co-representative, he would not answer the doors. we had over close to 2,000 signatures. and might have, and close to 50 people were trying to just get an answer and ask him why he wouldn't look at our bill. we had house bill 832. house bill 878. and he didn't even answer the door. maybe representative ron will give us a chance to talk to him. and i will say, that you do have legislators that are championing efforts to protect the kids. i'll mention representative louise out of philadelphia.

louise bishop. she is being accountable. this is two weeks ago. and now this happened on their doorstep. on their watch right here in pennsylvania. and as you mentioned, i went to the university of pittsburgh. this touches me closely. i got to meet joe paterno personally, a great guy, a super guy, a hero of mine. he was our rival. i have so much respect for him, such a competitor. for him to do that. how can a kid even deal with something like this? here you have a guy of his caliber who has achieved great thing and i have a lot of respect for him. i'm sad and my heart is broken. >> you're not alone. having the same feelings of your heart going out to those victims. we greatly appreciate you coming on. thank you so much for your time. and your bravery in sharing your story. thank you, al. >> my pleasure, thank you so much for having me. anti-abortion have had a caste say their fight for a controversial person hood

amendment is not over, despite defeat at the polls. women's rights groups cheered after learning the amendment failed. it was so controversial, the white house issued a statement calling it a victory for women's rights. person hood usa, the group behind this measure claims the work is not done saying we vow to continue on this patz pads toward affirming the basic human rights of all people because we are sure it is the right thing to do and we are prepared for a long journey. joining me, she writes about politics and feminism and has her own blog. thank you so much for joining us. great to have you on. the fight continues, at least in the minds of this organization. they have their sights society other states, at least six others, florida, ohio, montana, florida, nevada. but analysts said if it didn't pass there -- >> i have to wonder if they have an ulterior motive of trying to pass these amendments. >> what would it be? >> i'm not entirely sure. if that you know it is going to

lose over and over again, why would you put so much effort into it? why wouldn't you change strategies to something that could win? i have to wonder if there's an long game that they have intentions here to at least open up a debate about whether or not there is a fertilized egg. >> at least you get headlines. you don't win the war but you stay in the news and the headlines and increase the attention. the white house made comment about this saying it is a victory for women's rights. what is intriguing, there were people, even conservatives in the state, people consider they have pro-life who were uncomfortable with it. the governor expressed his discomfort even though he won't to vote for it hadch in itself is another whole conversation. us about there were conservatives not ready to go this far. >> they shouldn't have. this law had so many implications. it could have opened up investigations on women who miscarried for criminal negligence. it could have created a situation where women's employment was restricted on the

theory that they could have fertilized eggs inside them and possible it could have the birth control pill banned. >> what is the downer going back to these advocates saying this is not the end, despite the defeat in the polls. women's rights advocates, groups, i imagine, now have to at least shore up for the possibility of another battle along the way. >> yeah. i think it will be coming up again and again. it is very easy it seeps to get these initiatives on the ballot and then very, very hard to get them passed by the voters. part of the reason that it's hard is that women's groups go out there. they do these public education campaigns them spend time and money. if nothing else, one of the reason to get this on the ballot is to keep women's groups busy doing something else so they can't do other things. ohio governor john kasich is rethinking his stance on an ann union bill after voter success any defeated the measure.

front lines reminding the american public, and people out there that our vets need the support when they return home and their families need support from us. >> i agree. i don't think that it is any lack of good intentions on the part of the administration or the v.a. or the american people. i think that we're dealing with a whole new set of problems that we haven't encountered before. i think thanks to modern medicine, many warriors who maybe in wars or could not flicks past, the recoveries can be quite difficult when you talk about people with burns all over their bodies, their face or missing limbs or whatever it is. sometimes the recoveries and the transitions back into civilian life can be quite difficult. and i think this is a difficult problem than we've encountered before. >> where do we believe the government is dropping the ball? 52% of them say the government

has not given them the help they need adjust back to life. >> well, i think that again, this isn't a lack of good intentions. i think that the v.a. is doing everything twhek a limited budget. i think we've pass ad good g.i. bill a few months ago that help vets get to college. that i think programs it is, our thinking is a little bit, you know, it is a little bit years past compared to the problems they're facing as they come back now because of the unique states that they're in. so in terms of what the government could do better, i wouldn't call it dropping ball but i would say maybe one thing they could do better, ne helpin transition, maybe more job training or job placement. maybe more focus on mental health issues and making sure that vets with various issues always have access to counsellors and psychiatric help. >> that's interesting. the list of thing you've just laid out aren't new thing.

we know the unemployment vets coming back, 12%. we know we've seen the highest numbers when it come to suicide. we know the adjustment when it document marriages, coming back into the homes, divorce is high. so it is not dropping the ball, what is it? >> i don't know. i would say we should look at this study. this pugh research did a fantastic study. they've sort of dug in about veterans opinions about what's going on. we should find out what exactly it is they need and do a better job of getting it. part of issue is now at a time of budget cutting across the bored, when the government is looking for cost sxucuts and sh the sacrifice, the first place they look is toward the v.a. or other veterans programs. if anything, this study indicates these programs need more resources.
