they vote to give the congressional gold medal. discussing why she helped lead the effort to honor these heroes. . the "news nation" is following the latest developments in the penn state child sex abuse investigation. a lawyer who is advising the alleged victims said he is worried they could become scapegoats for people angry about the firing of the legendary football coach. live from state college, pennsylvania. a lot of things to catch us up on. a new coach has been named. what is the latest happening there now? >> fortunately it's a lot calmer here on the campus than it was in the overnight hours. i don't think anybody really expected the students to respond the way they did to the sudden announcement as to the firing of joe paturno. the last day was ended in that

bizarre way with students taking to the streets and overturning a news vehicle and turning their eye towards the coach at the center of this, jerry sandusky who left the campus 12 or 13 years ago. a new coach will take over when they play on saturday. last night the students went over to joe paturno's house and he came out of the house with his wife, sue. here's what he had to say. >> hey, look. get a good night's sleep. study, all right. ? we have things to do. i'm out of it maybe now. we will go from there. thank for coming. one thing. thanks and pray a little bit for the victims. >> a lot of critics looking at the season. that was an inappropriate response to the turmoil unfolding on the campus. serious allegations of sexual

abuse of young children by the former coach. the interim coach, tom bradley who took over for joe has mixed emotions about assuming the throne here at penn state. an around football power house. what he's told are the expectations and will not waiver from those, but it's important that the entire university community begin the process of healing and showing the community they want to restore the confidence that they had. >> it's interesting that tom osbourne from a nebraska, the athletics director is saying there will be increased security at the game on saturday when penn state plays. there is a lot of concern about the savvy and and one reason is you have an assistant coach who testified to the grand jury that he witnessed sandusky sexually assault a child as young as 10 years old. he did not call the police.

he called joe paturno. he will be on the sidelines this saturday. >> the interim coach said that will be a game time decision and he will coach from the press box. we will know probably saturday morning. we are getting word that the president of the student body here is asking and encouraging the students to not be violent or show any signs of violence on saturday in the game. the coach doesn't have any fears about the safety for his players and his staff. hopefully the students will adhere to their student body president's wishes and not turn into a violent display on saturday. >> live for us in pennsylvania, thanks, ron. foxsports.com jason whitlock. i saw you last night on with ed schultz and particularly the influence and power of the covers of college football. they call them the faithful who

show up on saturday. i love football as much as the next person, but what we are seeing here, how do you categorize that riot on campus and people continuing to at least show very little compassion for these alleged victims? >> it's hard to read too much into the rebelliousness of at p state. the whole thing is about the worship of institutions and placing people on pedestals that they do not belong on. in this country we worship corporations and people too much. joe papersono is an institution for penn state university to make a lot of money off of and people don't want to see him go down because we worship him. it's inappropriate. we are putting the needs of the institution ahead of vulnerable children. we just heard joe paturno call

the kids victims. they and other adults fail and they need to pay a price for that. >> what are do you think of the way joe paturno handled it, wanting to stay on knowing the board would say he needed to go. his comments outside of his home where he said at the end after rallying the crowd, say a little prayer for the victims? >> i think joe paturno baited these kids and had he done the right thing and been interested in the welfare of penn state university, he would have resigned. he would have never forced that board of trustees to fire him. he would have taken that out of their control and told those kids on the campus, hey, i have been here 46 years and i had my time. i made a mistake or there is the appearance i made a mistake and time for me to move on.

>> so michael we know that franco harris said in that interview, what happened or allegedly happened to the children is disgusting and unacceptable on every level how things were handled. he kept defending joe paturno. >> he regarded this as a university matter to which i would respond as a criminal matter. i don't believe that joe paturno dischanged his duty. i'm not speaking legally, but as a human. i don't think he discharged his responsibility to the children. he a report of fondling or doing something of a sexual nature to a young boy in the shower and that's as far as he takes it. it's not like the case of workplace impropriety where someone takes a toner cartridge or a sheet of paper from the copier. these are kids who are being victimized. you have to do more. >> real quick, michael, what is your take on the fact that he is

not calling police after he testified to a grand jury that he witnessed a child being raped in the locker room. he will be representing penn state in some capacity whether up in the booth or the sidelines on saturday. >> not right that he is uk walking the sidelines based on the grand jury report. he had a duty to intervene immediately according to the report. he saw a rape of a 10-year-old boy in progress and kept walking. that's not right if that's the complete story. >> jason and michael, thank you very much for joining us. appreciate it. now to the race for 2012 and the aftershock from the gop debate, the biggest one felt. rick perry's disastrous brain freeze. perry appeared on new fewer than five morning tv shows and one radio show trying to dig hills out of what he said he stepped in. >> it's three agencies of government when i get there that

politico. i will let you start off here. no one likes to -- everyone saw it felt uncomfortable with the situation, but the reality is that is part of presenting yourself to the american public and you were able to take the pressure that you can stand the heat. what do you make of the day after in your thoughts on rick perry last night? >> let me say to the public that i came out in support of mitt romney. without a disclosure there. it is sad. we have been in the positions where we have the brain freezes, however we are not running for president of the united states and as republicans, we are not running against barack obama. president obama is eloquent and does well at the debates and public speaking that republicans have to look at someone's ability to stand to toe with the president coming through the primaries and it's not the first time. if it was the first time and

didn't play into the narrative that we have over governor perriy that he is not quite competent at any of the debates prior. this was sort of a big one. if this was his only flub, i think it would not be the big story. it's when a mistake plays into a narrative. you and i could misspell to po tato and it wouldn't be a national story. >> romney avoid commenting on this gaffe or whatever. maggie, i think it was andrea mitchell who said rick perry is not rate for prime time and he is going on late night. that will give him an opportunity to loosen up, but he's got the money and support, but everything else is falling apart around him. >> he money going into october. one thing that's a problem is this really hurts his fund-raising. i can't imagine donors thinking this is a good investment. his campaign is doing the best they can to get back where they

should be and put on the tournequet to stop the bleeding, but this was not a good moment, but it was a human moment and everybody felt discomfort watching. >> we want our president to be super. >> but republicans want someone to debate the president of the united states. also this is the question about perry. is he ready for prime time and up to the task? is he nimble and think on his feet? none of those questions got an answer last night. >> at the polling, rick perry was slipping and i use this as my a it is now gone. the perry sign is gone from the front lawn of this home. obviously that's not a poll, but we see the numbers. can he survive this? >> no. i think he was finished before last night.

i feel badly for him as the others do and it's a shame that this will be the lingering presentation of rick perry, but he was already finished. his numbers have been in decline. >> why does he remain in the story line? you are as confident as others who said he was finished before last night? >> he has been good copy. he has been kept in the headlines for all the wrong reasons. the speech in new hampshire didn't help him. the next who will have the wind at his back will be newt and it will be a short duration and he too will fade. >> let's go to herman who is apologizing for referring to nancy pelosi as princess pelosi. let me play the apology. >> i apologize for calling her princess pa pe loelosi.

>> he refers to her as princess pelosi and he gives what can be interpreted as a half hearted apology. if you want it, i will give it to you. here. is it over for him? >> i was actually watching him give that apology and i'm sure he was thinking thank goodness i'm only answering questions about only calling her princess nancy. he should have been so much more careful. this goes back again to the premises of your first question. this is it. these are the big leagues and running for president of the united states. commander in chief. leader of the free world. you have sexual harassment charges swirling around you and when people are looking to see what is your sensitivity and response. he should have thought more clearly to say i can't afford to be insensitive to women in any way. >> he the wind at his back in that the crowd supported him when maria bartiromo asked him question about character and

welcome back to "news nation." the justices are meeting for a critical debate on president obama's health care law. the administration asked the court to weigh in and four cases are challenging the law's mandate and whether it is

constitutional. pete williams joins me live from the supreme court and no news today, but we could get some soon. >> we don't know what it means. the justices could have already decided whether or not they will hear this series of cases and we are not going to find out today that we will find out monday which is the usual day when the court lists which case they will take. there was a chance we would find out today because of the unusual nature of the cases. next monday is the next chance to find out. no guarantee for then either. no deadline for the court to act. the reason today was significant is this is the first day the cases were on the list for the justices to discuss. they expect the supreme court will take up the cases and when it does, it will be one of the most important in well over a decade, sketching out not only

kidnapped in venezuela. one of the washington nationals's most promising stars is taken by gunmen, stormed into his family's home. overdue honor, the senate approves a congressional gold medal for the first african-american marines. a controversy of what was said to have some boycott his restaurants. big banks and vitale. >> wilson ramos. officials said they found the vehicle used by four armed men who abductioned the washington nationals catcher in venezuela. they vow to rescue him and prosecute his captors. the 24-year-old just finished his rookie season. i am joined by a spoerpts reporter for "the washington post." what else can you tell us at this point? >> today the major league baseball department of investigations joined the search

and joined forces with the venezuelan authorities to help find wilson ramos. you covered what the police have determined that he is alive and they confirmed that. they found the car that was used and think that will be a key clue. they have not heard from the kidnappers and at this point just hope and wait. >> we know that in the past in south america and america co, you have wealthy people who are target and some of their family members. we have seen the kidnappers target the wealthy sports stars and not them personally, but their families. >> it is believed to be a first that an actual player has been abducted. it's not always the player targeted because they are a player. there can be other reasons. sometimes it's not 100% why.

no one knows the exact motivations of the kidnapper, but it's presumed because he's a major league player and he made $400,000 in salary and they see him as a wealthy player. >> do we know why he was in venezuela? that's his home, but was he there for a camp? >> he was doing a winter ball team down there. there is a league of about six or eight teams where a lot of minor league players and major league player guess to stay sharp in the winter. some guys do it to gain attention from their teams. ramos was there to play because he always played there as a minor leaguer at home. he has to keep sharp in the off season down there. >> thank you very much for the latest on this investigation into the kidnapping of this major league baseball player. thank you. >> thank you. >> we are following developing news on capitol hill. the senate is voting on two provisions in the jobs bill.

a super committee stalemate and a new proposal to raise revenue by $300 billion was flatly rejected by democrats. they want more. the committee has just 13 days. look at the calendar. to broker a deal to shave up to $1.5 trillion from the deficit. his party wants to increase revenue with an overhaul of the tax code. >> let's adopt the recommendations from every bipartisan commission they said any revenue needs to come from pro growth tax reform and let's offset that revenue by reducing the size or value of deductions that people can take and generate revenue for deficit reduction. >> kelly o'donnell is live and people usually make you an offer you can't refuse. this doesn't seem so difficult for the democrats to turn down.

>> democrats wanted to make a point that they don't think it goes far enough. this is a big concession when they have been so strongly opposed to any change that would be interpreted by some as a tax increase. you heard the senator say by getting rid of deductions that you get money in without raising the rate. there aides who are telling us about conversations going on, but certainly a glum spirit about what they can get accomplished. republicans suggest that the democrats want to see this committee not be able to reach an agreement for the political gain on that. being able to say that republicans were not cooperative enough. others say no, it's bigger than that and about the country and the attempts to reduce the deficit. there many play layers to this and what we know now is they are not close enough. >> we talk about the president's jobs bill. we know that the republicans have flatly rejected it on several fronts. there could be and expected to

be success when it comes to the tax credit for companies that hire vets. >> if you have been waiting for bipartisan cooperation, here it comes. the president's jobs bill has been defeated before. this is a slice of it that does offer tax incentives to companies that hire iraq and afghanistan veterans more if they are disabled and more if they were long-term unemployed and another that would change a tax code for businesses. democrats, republicans, and the white house all agree on this. we will expect to see this piece of the president's jobs plan with retooling past this afternoon. >> that's at least a portion of the deal that you can't refuse, especially when you are talking about helping the vets. >> one more thing. there is joe paterno news here. the senators have now said they are rescinding their recommendation that paterno, the coach, be given the nation's highest honor, the presidential

mr. chairman? >> the texas department of motor vehicles voted against a plan to put the confederate flag on a special set of state license plates. texas governor perry previously defended the value of the symbol and said it could open old wounds. the naacp and other groups called it a racist relic. families of troops killed overseas are devastated after a stunning admission by the air force. officials say the dover base mortuary dumped the ashes of u.s. troops in a virginia landfill without telling the families. the air force said this was standard practice between 2003 and 2008. the details come after several investigations showed gross mismanagement of the remains of service members at the air base. the chief pentagon correspondent joins us now. when people hear the cremated remains were dumped, hard to believe that was an acceptable

way to handle remains. >> this was just the latest in a series of scandalous revelations about the handling of america's war side at the military mortuary. according to air force officials, what happened is that they would take partial remains of dead service members that had been uncovered after the victim had been buried and got permission from the families to dispose of the remains, but they didn't tell them they were first being cremated and buried at a landfill. this follows on the heels of several investigations found that there was mishandling and loss of body parts there at dover air force base and one case tech anythings sawed off the arm of a dead marine to get the uniform on the marine for burial without telling the family. an office of special counsel skpil investigation found there was gross mismanagement and a

marines and thank you very much for your time. >> thank you. >> we are talking about 19,000 african-american marines who trained and a lot of people have never heard this story. why were you so moved to help lead the effort to get them the recognition they so deserve? >> well, first of all, it is locationed in north carolina. we have more marines in north carolina than any other state. it is truly my honor to be able to put forward this legislation to honor these men. they were discriminated against and did this in periods of intolerance against them and they enlisted and fought for our country in some of the bloodiest battles and out of 19 to 20,000, 120 of them are still alive today. i was with about six of them this morning and even though they are in their late 80s and 90s, they are so positive and looked like they were in great health. >> they are marines, what do we

expect? it is your home state and many others are from the home state. lawmaker who is did not take the lead or join the effort as you d did. what was the personal connection? >> i know a lot about the marines. my father in law who passed away at the age of 96 was a major general in the marine corps reservice. throughout all the years i was with the general he was so proud of the marines. it's something that has been passed down in my family and to be able to do this to honor these men who fought for our country and were the first african-americans to be allowed to enlist in the marines. it is truly a time that has come. they will join the air men at the buffalo soldiers for their place in history. >> as you pointed out, maybe 120 of them are still around with us. we wish that all of the 19,000
