"news nation" is following breaking news on the occupy wall street movement. we are now just one hour from a planned march on new york city's subway where is five million people ride every weekday. it's part of an effort to disrupt the city two days after a temporary evacuation and the movement's epicenter set up shop two months ago today. dozens of arrests were made in scuffles as hundreds flooded the streets outside the stock exchange. they showed police pushing

protesters as they tried to contain them. there reports that at least three officers were injured after they threw things into their faces. in the meantime, they were under way with more than a dozen cities participating in occupy protests from oregon to washington. you see there, look at the map. it's in l.a. right now and they blocked between the bank of america tower and the plaza and 18 people were arrested there. live in zuccotti park, i understand you witnessed a short time ago and you had another dust up between the protesters and police. >> this is by my estimation the most complex day we have seen. a few minutes ago we saw a protester that was bleeding heavily from the head after a

confrontation with police. what was obvious to anyone watching is that this young man was badly injured. all day long since about 7:00 this morning, we have been seeing these clashes with police. not consistent, but they rise and fall. this is definitely the longest stretch of these kinds of clashes. one day that we have seen here in new york, they started out with the watch to wall street. 700 people gathered to try to block and free access. the people working on wall street, prot testers tried to keep them from getting to their jobs and get into subway stations and block the exits. they gathered here and they were evicted from camping, but they are free to come here and gather as the gayer said. that is part of the first amendment right and what they have been doing. there have been a lot of clashes here at the park. every so often police and protesters get into a bit of a scuffle. a few people are arrested and

the crowd gets riled up and things calm down and it happens again. later this afternoon there is another very big event plan and a march that is going to take place. the protesters will be joined by labor unions. they are expecting thousands to join them for a march across the brooklyn bridge and they hope it will be one of the biggest

it will work out some day. >> you feel confident of that? >> yeah. the story will be told, but it can't be at this time. >> do you feel in your heart that at the time this happened you did the right thing? >> again, i'm not going to go into detail, but i think it's obvious i tried to do the right thing. >> he spoke a day after state college, pennsylvania and penn state campus police said they have no record of them filing a report after the alleged incident. he made the claim in an e-mail he sent to a friend. also today a local pennsylvania newspaper reports mcquery joined sandusky at several events in the weeks and months following the alleged incident. attorneys for two officials charged with lying to a grand jury and failing to report sandusky's abuse to police are furious. a hearing for today was postponed until december sixth.

a new judge has been named to preside over sandusky's preliminary hearing on december seventh after it was learned that the judge who sent sandusky free on the unsecured bail had ties to sandusky's charity the second mile. let's bring in the panel to talk about this. she is currently running for state attorney general and clint van zandt is a criminal profiler. coming out with his daughter and hugging his child at his home, obviously reporters outside of his home. it's his choice to talk. >> it's his choice to talk and this was a nice story. show your child out there. he had the absolute responsibility as an adult to protect that child in the shower. he should have been in there ripping sandusky away from that kid if that took place in front of him. >> obviously we do not know his side of the story. he said there is more to come. at least we know that he is trying to through drips and

drabs get his story out. >> it should have come out when the incident took place. if he saw that the university was not taking action, he should have been pounding on the door of the police department saying do something about this guy and you would have hoped that we would all if you and i found ourselves in the case have the integrity to walk away from a job to save a child. >> days and days about this. let's talk about the legal issues and you have the two penn state officials supposed to be in court delayed at the request of the prosecution. they wonder if there is trouble here as far as getting the case against jerry sandusky in order. >> i don't think that means anything of that nature. it's a very frequent occurrence they are scheduled for a preliminary hearing that it is continued by the prosecution or the defense. >> what could be the reason? you believe it is because they are waiting on a new judge.

>> they wouldn't want to put it before a judge as being a former participant. >> let me ask you about mike mcqueary. you have an e-mail that details more of what he said happened and stopped the assault. you have him talking to reporters here and there. a different story in the grand jury report. from your experience as a prosecut prosecutor, does that compromise him as a witness in what seems to be more detail coming from him now. at least in the report we have seen. >> that does compromise him and i hope that the grand jury doesn't put forth every detail nor should it. it's what you need to get the arrest, but all of it will come out with the testimony and the transcripts. from what i read and what mr. mcqueary said, he made sure the assault was stopped.

i didn't hear him saying he stopped it, but meaning he could avoid it until it was over and he left the building. there a lot of unanswered questions that he will address either at court or in trial. >> you have an attorney representing an alleged victim who digs in his heels that his client is ready. what kind of preparation do you believe started in getting these young men ready for what they could face? >> you have something in the case that you never have. that's an eyewitness who can come forward and say i saw this assault. not only do you have the victim or victims, but you have somebody right there who said it happened. >> kathleen points out that mike mcqueary could have credibility issues now. >> any statement will have credibility. nobody has perfect recall, but when you deal with a young child like this, 10 years old when they were victimized, you have to be careful and bring them up slow and help with the in

the four men. they were convicted of raping and killing a 30-year-old woman back in 1994. they claim police coerced them into confessing to the horrible crime. dna link this is man, johnny douglas to the crime. he was murdered in 2008. after 17 years in prison, the four exonerated men are still not free. the judge who overturned the convictions was ordered a brand-new trial. i am joined by a dna expert and defense attorney with the innocence project. thank you so much for joining us. michael saunders was your client in all of this. let's talk about the heinousness of the crime and how these young men were convicted here. >> it's one of the cases that occurred in chicago in the early 1990s. there was a slew of serial murders going on in the southside. they couldn't solve them and they would approach groups of

kids and bring them into the station one at a time and interrogate them excessively and get kids to confess. >> there was another famous case around the same time. ryan harris where two of the youngest boys ever accused of murder around that time were railroaded and ladier freed as well. you have young african-american boys being accused of crimes and how did they get targeted here? >> it's interesting that you mention that case. same cop got the false confessions in that case was involved in two of the false confessions here. you know what happens is that particularly juveniles aring isable or compliant and after you question them a number of hours and the parents are not there, you can get them to admit something. no question from the dna hit which is extraordinary that this guy had killed two other women

who the prosecutor thought was a serial murderer and his dna is inside and he's at the scene. >> 'did it take so long, nearly 17 years in prison behind bars. >> for a long time and most of these cases the state's attorney opposed dna testing and for a lot of these guys, they would come up with new theories of guilt to explain away the dna testing. the tunnel vision sets in on the people, but right now it's up to the state's attorney to do the right thing. >> speaking of the right thing, the judge ordered a brand-new trial and what does if mean for the men? >> for now it means they will be out. do we want to take the case to trial or be done with this? >> why would they want to take it if you have evidence that points to a man that has a history of the same crimes? >> some prosecutors feel it's more important to defend a

conviction and a verdict than to get to the truth. we hope the attorney will want to get to the truth. >> what are is the timeline? >> the timeline is back in court on november 28th and hopefully by that time the state's attorney will agree to throw in the towel. >> one we see too often. >> they are victims. >> thank you very much. we appreciate it. confusing moments in the air when a pilot gets locked in a booth room in a routine flight last night. a delta pilot decided to take a bathroom break before the plane touched down and locked himself in the bathroom. the flight was on the way from asheville, north carolina and a passenger with a "foreign accent " tried to alert the copilot by banging on the cockpit door and that is when you confusion resulted. >> the captain disappeared in the back to use the restroom and he is stuck in the lab and

someone with a thick foreign accent is at the cockpit and i'm not about to let him in. >> tom, we hear the pilot refers to a thick foreign accent and a report indicated a source saying that someone thought it was a middle eastern accent and a disturbing situation resulted in a terror scare. >> this was flying a delta connection from north caroline up to new york. new york as any big city, but in new york after 9/11 is suspicious and concerned about suspicious activities. the pilot left the flight deck and went to relieve himself in the lav and the door jammed. he is banging on the door and nobody is letting him out. a passenger with an accent is trying to help him and he still can't get out. he goes to the cockpit and he knocks on the door and said hello, mr. copilot, your pilot is stuck in the bathroom. the copilot is justifiably

skeptical because since 9/11 the doors are hardened and the doors are very difficult to get through and they are concerned he might try to talk his or her way into the cockpit. they are not about to open the door and the pilot is stuck in the back of the plane and the poor guy trying to help is stuck in the middle. he did manage to break free and he got back inside and they landed the plane safely. it goes to the heart of this concern that is still very acute about the fear that somebody might try to break into the flight deck. the passenger who did have an accent was just trying to help out and everybody thanked him and went about their way. >> where were the flight attendants? >> that's a good question. we put in a call to the airlines flying this delta airlines and they haven't returned our calls. >> let us know what they say
