something else. what is that? plus just minutes ago, a chicago judge sentenced former illinois governor rod blagojevich who for the first time in court admitted, he has no one to blame but himself. we'll tell you what's next for blago. one of the controversial death penalty cases in our country. why the philadelphia district attorney is no longer seeking the death penalty in a case against a former black panther convicted of killing a white police officer 30 years ago. i'm tamron hall. within the past hour, penn state assistant coach jerry sandusky has been arrested again on new criminal charges. it is apparently all part of an ongoing investigation. peter alexander joins me with more breaking news. we know that sandusky was taken in handcuffs from his home. what else do we know? >> first thing want to put up is the newest video. the video you've seen is what is looped for the last several weeks. here is the video from within the last couple of hours where

authorities showed up, four of them in unmarked cars. we've been outside the sandusky family home for the last several weeks. i spent much of that time at state college. they came, they arrested mr. sandusky who you will see from this video. admittedly a little bit shaky as we were forced to stay a safe distance away from the home as he put up no trespassing signs. new security cameras as a result of some vandalization to the home that has taken place. sandusky when he does walk out of the home, you will see he is wearing a penn state track suit that has been a bitter pill for the penn state community to follow given the impact this has had on the community. initially there were eight victims that we knew about in the initial grand jury report. now we know of victims nine and ten. these victims detail, according to the grand jury or according to the attorney general, linda kelly, detail the relationship that they claim to have had with jerry sandusky dating back to 2004. one of the cases, one of the young men who says he was just 11 or 12 years old at the time says that he, like the other

boys in the grand jury report, was effectively groomed by mr. sandusky, taken tame, given gif money that ty were ernight stays at the sandusky family home that included hugging, rubbing, cuddling, tickling and then ultimately sexual assaults which is what these charges specifically refer to. >> so obviously, peter, people are intrigued to know if this is standard procedure in something like this, an ongoing investigation. also there were great questions as you know about the judge who initially set the bail. a judge who had some link to the second mile charity that was founded by sandusky. and that he was allowed to go back into his home without putting up bail. their you see him getting into the car with the track suit. it will come to no surprise to people in the community that he was rearrested and taken behind bars. there was a lot of concern in that community. why this man accused of such egregious crimes against young children dating back, some allegedly dating back to the 1970s, could be allowed out on

the streets. and even joe amendola, the attorney general for sandusky, said a short time ago that it would not surprise him if jerry sandusky was rearrested and taken behind bars where they would keep him there until at least his preliminary hearing, which we know is scheduled for next tuesday. he will have an arraignment before that date for these new charges right now. but the attorney made it very clear that he thought the prosecution was trying to expand this case. and the attorney at one point when we reached out to him about new charges allegedly being investigated, or new claim being investigated, by what's called cys, child abuse services, he said that we believe one of those children, though we dispute the claim, we say we are innocent of all these, one of them was jerry sandusky's own grandchild. so we know there are more than eight victims. >> this comes days after the eighth interview. we're following another big story. this out of chicago. conflicted governor rod blagojevich has until february to enjoy freedom after being

sentenced to 14 years behind bars just a short time ago. it was all announced within the last hour. nbc's nick bogert is live in chicago. give us the play by play. yet again blago having the opportunity to throw himself at the mercy of the court but it did not work. >> reporter: he did just that but you're right. the judge had several things to say about his admissions. but it did not work in the en. the 14-year sentence is just short of the 15 to 20 years that prosecutors had been requesting. and it is far more than the three to four years that the defense had suggested was appropriate. he will be allowed to surrender in february. if he served around 85% of that sentence, that will be 12 years behind bars for rod blagojevich. there was little emotion from the exgovernor or his wife patty as the judge pronounced sentence. the judge mixed a tongue lashing with some words of praise for the governor. he said he had heard blagojevich apologize emotionally to his family. he said i do believe you were a good father to your two

daughters and you're a good family man but i've seen an awful lot of good fathers who turned out to be very bad citizens. he said he accepted blagojevich's acceptance of responsibility. this morning the exgovernor said, i was governor. i should have known better. he said i believe that you meant that, although it came very late. and i believe it came so late because you were the governor and it was hard to admit wrongdoing. and he was insisting this has been an unfair prosecution all along. however the judge had an awful lot of very negative things to say. he said i believe you lied in testimony. i think i think you were ill suited. that you're immature. that you have a tendency to blame others. that you have a need for adulation which was not a good thing in public service. you never asked a lawyer if what you were doing was legal. that's because i believe you didn't want to know. some of these schemes would have been stopped dead in their track that's the you had sought real legal advice. so he said, also, one last thing that he had called blagojevich governor as a subtle reminder to citizens that they get the government they deserve. and rod blagojevich will go away

for 14 years. >> if that is the case, you get government you deserve, the guy in office before blagojevich, george ryan, behind bars. i believe there have been at least four governors of the state of illinois who ended up exactly where blago is going in february. so it is interesting. i think the people of illinois certainly deserve better than that. thank you. greatly appreciate it. more breaking news in the case that has raged for 30 years. prosecutors in philadelphia say they will no longer seek the death penalty against former black panther mumia abu jamal. he was convicted of murdering a police officer in 1981. since then supporters including a host of celebrities have claimed he was the victim of a racially biased system. a few hours ago, retired anglican archbishop desmond tutu called for abu-jamal's release. however, for now he will remain behind prison for the rest of his life. the prosecutors say they reached the decision with the blessing of the widow of the police officer who was killed.

daniel faulkner. she attended today's news conference. >> he has been a celebrity, a cause celebrity. so many people throughout the world for so many years has put him on a pedestal. he has a cottage industry going from prison. money pouring in to his defense fund. it is an absolute disgrace. >> joining me now, nationally isn't indicated talk show host michael smerconish who is an nbc contributor. i should note he wrote the book with the widow of the officer. it was titled murdered by mumia. he also served in the office of counsel. you know that the supporters of mumia abu-jamal says he was treated unfairly. the jury which was all white at the time received misleading information here. so they do not see this case as

the widow of officer faulkner or as you see it. >> right. they certainly don't. i noted today, i require a lot of qualifiers to come on the program. there are two issues here. one is the question of guilt or innocence. and the second is the question of sentencing. just so your viewers are clear, what has been determined today is only that there will now be a change in sentencing. the widow had a very difficult decision. it was technically the decision of the d.a. seth williams. but he yielded to her judgment and she said at this point, it is futile. because if we go back through a new sentencing process, and again it ends up in the court system, it is the judiciary that has stood in the way of the carrying out of the sentence. but the underlying conviction does not change, isn't going to be altered. that's why i strongly disagree with bishop desmond tutu. >> i had to ask you, i'm sure your words will be repeated that you disagree with the bishop there.

of the case. how there were multiple eyewitnesses, how the ballistics matched, how abu jamal the night of the murder said i shot the m-fer and i hope he dies. i like to tell one snippet. his brother billy cook was on the scene and witnessed whatever it is that took place. he's been silent for 30 years. tamron, if my brother were on death row for a crime i know he didn't commit because i watched, i sure as heck would have spoken up. he never did. >> michael, again, you wrote the book on this case. it remains one that draws our attention to the death penalty in this country and how or who is often sentenced to it. and you cannot eliminate the discussion of race when we've seen what happened in, for example, in georgia just this year when a man says he was innocent and was ultimately sentenced to death. i greatly appreciate your insight on this. i think no one knows it better

to decision 2012 where mitt romney says it is time to get aggressive. here's a live look at the man he plans to get aggressive with at the republican coalition forum. that's newt gingrich who just started addressing the audience there. gingrich keeps surging in the polls. 37%, way ahead of romney's 22%. and that is said to have romney's camp on the offensive. romney is telling reporters, he is mapping out a new strategy for the long haul. he says he'll be spending more time in critical swing states and will start appearing more in the media. romney will make his first appearance on a sunday talk show in almost two years on december 18th. while romney has the cash and the operation to come through with these promises, gingrich does not. in fact today the headline for gingrich, the deadline for him to file in ohio to appear on the primary ballot is at 4:00. his spokesperson said he will try his hardest to make that

deadline with few staffers, he has just seven in ohio if you're downing. and ging has missed the deadline for missouri. let's bring in our panel with us. now the associate editor and columnist for the hill is with us as well. let me start with you. we have our republican strategist and we're waiting for rosen who is caught in traffic, apparently. you wrote about this today and you said that newt gingrich can win this nomination. >> i think so. what we're seeing in this new new york times cbs poll is that voters in iowa, very critical, have decided that he is electable. that he can beat barack obama in the general election. that he can be a strong commander in chief and he emphasizes with their views, he is authentic. peter hart who works with nbc often, found people saying that he is grandfatherly. this is the argument. all the money will come. all the debt will be paid off.

all the campaign problems, he'll hire staffers. that will all come. if he can convince primary voters this close to when voting starts in early states that he is electable in a general election, that is the final straw against mitt romney. it becomes a real threat to mitt romney's hopes. >> the tea party is set to be the major factor here. i spoke with a woman in iowa who is a tea party member, loves sarah palin, she has gone down the list. i think she even liked donald trump at one point but here she is, saying she is willing to support newt gingrich. he is not a washington outsider. he is not social conservative on issues that this woman and others say means something to them. but she told me, he is a fighter. she in her mine can visualize newt gingrich going at it with president obama. is that what this is about at this point? >> absolutely. the problem for mitt romney is that he hasn't shown that fight.

he hasn't shown that intensity that voters are looking for. when they say they're more aggressive, that doesn't mean they'll do 30 second attack ads to try to attack newt gingrich. what people want to see in mitt romney is fight. that's what they've seen in newt gingrich. i think that's why he's surging and i think that's the challenge for romney. to show that he wants this nomination and he is a standard bearer who can stand up to barack obama. >> we asked, is it like standing in front of a runaway train? it is not a secret. the things people continue to bring up about his background and even some of the new revelations quite honestly and some of the new comments regarding poor kids and letting them be janitors. it is like teflon. nothing sticks. i think it is solely because of his, as the article and the politico said today, his snarl. newt's snarl is more genuine than mitt. but does a snarl get you in that white house? isn't that the goal here for the republicans in. >> i think we have to pause a

bit on the bashing that's going on on newt gingrich by some on the left. the reality is someone who posted up against bill clinton at the height of bill clinton's popularity. >> the right isn't putting the brake on the bashing on the man in the white house right now. why should anybody pull up on newt gingrich? >> no, no, i'm saying from a strategic perspective, this is somebody who has vulnerabilities but he has been very successful in the past. is he electable? absolutely. i think he is a challenge for barack obama as well. i think getting back to what romney has to do against gingrich, he needs to be more aggressive. he can't just tear down gingrich. he needs to prop himself up with positive ideas and things that he wants to do and show that he has that fight. >> simon, bring me in. thank you for joining us. this same political article that i've referred to said the president's advisers long convince that had romney would be the opponent now think that obama has a realistic chance of facing gingrich. and they are frantically rewriting the play book that they've been in the making with for three years. which was focused on romney at

this point. what do you make of this potential match-up? simon? okay. i'm going to give up on simon. a.b., i can't handle it right now. let me talk to you. you've got the president focused on romney now saying, wait a minute. we have to factor in the newt gingrich possibility here. >> and they will. some democrats are nervous about newt gingrich's interest in childhood poverty, interest in a more humane approach to the immigrant issue. and they're saying don't focus all your guns on mitt romney when maybe this could become your rival and you need to prepare for a campaign. a different kind of a campaign. but i think generally speaking, because of newt gingrich's policy flip-flops, his ethical lapses, his controversial erratic style of leadership. that his party rejected him four years ago. they probably looked more

forward to a gingrich campaign than a romney campaign. >> let me play this new ad. we just got a hold of it this last hour. talking about leadership and what kind of leader he would be. if we have it, let's play it. >> his role as a leader as the speaker of the house will be examined very carefully. people will measure our capacity to lead. and i don't know what that will show with regard to him. i know what it will show with regard to me. >> so that was not the ad. that was romney on with neil cavuto. in the end this new ad says people understand that i'm a man of steadiness and constancy. i don't think you'll find someone who has had more of those attributes than i do. is that a counter to, i guess the excitement with newt gingrich? >> it is clearly, they're trying to draw a contrast with newt gingrich's three marriages. i think that's the beginning but it won't be enough for mitt romney. mitt romney needs to go out there and be inspiring to the

a snowstorm that causeds schools to be closed is now swirling east and moving right up the east coast. so far at least 17 states are in the path of this wicked weather front. and it is set to hit hardest starting tonight. take a look at the rain actually in washington, d.c. pouring. it has been doing that since late last night. mike seidel is tracking the storm from the weather channel. when you start talk b 17 different states being hit by one storm, that's a big one. >> it is. but most everybody will deal with rain and not snowfall. we have snow down south. around huntsville, we had more snow this morning. and jonesboro, arkansas, they've had more snow this season in fargo and buffalo and syracuse. we have the big spin here. that will help fire up this low. we have a lot of heavy rain heading up the eastern seaboard. that's the issue around

the republican governor turns ugly. new allegations out there. >> and mexico said it spoiled a major plot to smuggle one of moammar gadhafi's sons and his family into the country. and personal pictures on facebook founder mark zuckerberg's facebook page are leaked. if it can happen to the guy who founded the coil, can it happen to you? major developments today involving alabama's new toughest, the nation's immigration laws. the state's attorney general says that two controversial portions of that law should be scrapped. one that immigrants carry documentation with them at all times. and another that schools collect information on the status of students. meantime, the justice department which is already suing alabama has sent an unusual letter warning law enforcement agencies in that state, they risk losing their federal funding. justice correspondent pete williams joins me live. pete, let's hone in on the department of justice. an unusual maneuver or letter

from the department. >> right. a letter from the head of the civil rights division to 156 sheriff's offices and police departments around the state saying we know you have to enforce this new law. but as you do it, remember, there is a constitution. there are federal civil rights laws and if you don't enforce this law carefully, you could lose your federal funding. this of course as the justice department is already suing the state of alabama. parts of this law have been struck down but not the part that says when police stop people for questioning, they must determine the immigration status of the person they're stopping. the justice department wants to make sure that latinos are not overwhelmingly the victims of all this. as you say at the same time, the state attorney general is telling the legislature, maybe there are parts of this law we should repeal because it would make it easier to defend the law in court. >> and it is so intriguing what happened in alabama. you have the republicans supporting this law and now see the repercussions, how it is affecting agriculture and farling in the state and believe maybe the state has taken on more than it can chew.

back to this letter. why do you believe this move now knowing there has been this suit filed already? >> because the justice department is doing everything it can to fight this law. it is seeing a number of effects. one of them as you know is especially this provision that requires them to document all the potentially children of illegal immigrants who are in public schools. a lot of people are fleeing the state. and that's what i think has the government so alarmed. they're fighting this law hard. they don't want to see other states follow the same lead. they're saying they'll take the legal fight wherever they have to. that's why i think they're sending this message to the police and the sheriff's offices. >> thank you very much. great to have you. seven decades after their ultimate sacrifice, americans are honoring the men and women lost during the attack on pearl harbor. today's emotional ceremony also represents the last time the pearl harbor's association will formally meet in hawaii on december 7th. nbc's stephanie stanton is live in hawaii for us. and so much to talk about. i want to talk about the

association as it says that they have to look at the reality here. the age of the survivors and their fear that this will eventually just become something we look at in history books and not have this moment live as we're seeing now. >> reporter: yeah, good morning to you, tamron. indeed, it is the harsh reality of life. the pearl harbor survivors association. we are told they have about 2700 members. those numbers are dwindling. we understand they're dying at a rate of about 70 per month. the association is officially disbanding at the end of the year. and for many of these survivors, they are in their late 80s and their early 90s. this will indeed be the last time that they are able to come here to pearl harbor. of course, the 70th anniversary, this ceremony began at 7:45 this morning. at 7:55 this morning, there was a moment of silence as well as a military flyover by the hawaii air national guard in the missing man formation. of course, that marks the exact

moment that the japanese carried out their surprise attack here on pearl harbor back in december 7th of 1941, more than 2,400 people died on that faceful day. here, some 3,000 people have come to remember this day, including more than 100 survivors, tamron. >> all right. thank you very much. we greatly appreciate your live report. we see the images there behind you as well. the already bitter battle involving the effort to recall republican governor scott walker appears to be getting even uglier. within the past few days, two recall opponents were arrested. one for allegedly trying to deface petitions. amanda reports on this from the "huffington post." good to see you. >> thanks fortune having me. >> when we say it's getting ugly, we mean it. people are getting physical in wisconsin. never with you tempers were flaring and the tension with this, incredible. there are national implications in what can happen with scott walker. >> symbolically, one of the biggest races of the year. there were massive protests in

february when thousands of people turned out to the capitol and protested. it started a national discussion about the role of unions. so tempers are very, very high on both sides. >> what are some of the thing happening there? >> well, recall organizers say at one point, a man tried to back his truck up into a bunch of volunteers. signs have been ripped up. petitions have been defaced. and some of this may seem small. it may seem silly but some of that is a femme. you can get up to a 10,000 fine or three and a half years in prison. >> in someone situation, someone collected petitions only to destroy them on that you recall. so like trekky going on here. >> some people were like, i'm going to pretend i'm a recall volunteer. collect petitions and never hand them in. then the state board said you can't do that. that's illegal. you can be arrested for that. so a lot of it is making sure people know the rules and that you can't go around doing this. >> oxley they know the rules. i would imagine. this is heavily covered in the state of wisconsin.

statute, fine would be arrested. a third man is also accusing the assistant basketball coach. former assistant basketball coach of sexual abuse. a federal investigation is underway into his claim. fine denies the allegation. mexico says it has foiled an international plot to smuggle one of moammar gadhafi's sons into that country. the interior secretary says the plan was to bring him and his family under false names with false documents. the suspects opened bank accounts, even brought property to be used as safe houses. the plot was discovered in september and stopped before it could be carried out. three people are under house arrest. and a story during these tough economic time for so many people with so many folks struggling to make ends meet, or even struggling to stay in their home. a seattle chiropractor and his wife are accused of checking welfare benefits for more than eight years. all while they were living in a mansion. and driving luxury cars. mike taibbi has more.

>> reporter: nice house. all those custom wind owes looking out over lovely lake washington south of seattle. a million-dollar view. actually, the house is now valued at about $1.2 million. the woman of the house assaulted her several bank accounts with big recent deposits. for more than $31,000, two for more than $5,000, one for nearly $11,000. the man of the house, a chiropractor with an in-town practice, drives a blag jaguar. on his private dock, a sleek boat. nothing unusual, says the next door neighbor. >> i know them as good friendly people. pretty typical, according to the neighborhood. >> reporter: over the past eight years, federal investigators say dr. david silverstein and his wife while living in this house have collected tens of thousands in food stamps and disability payments. and approximately $135,000 in housing six did i benefits. and now in a federal civil suit, the government wants it all back. this is the undersecretary for the agriculture department which

administers the food stamp program. >> when we come across cases like this alleged case, we think, you go, bring on the heat here. because these are serious violations. >> reporter: the alleged scam was relatively unsophisticated. when his wife applied for the benefits investigators claimed each time she lived alone with her two children with almost no assets. a few hundred bucks, a $200,000 car, and listed her husband as her landlord to whom she needed help paying rent. he reportedly listed his office address as his residence. on his website original a personal note, i'm happily player witness two children. it was a government database cross check that finally caught up with them. >> i think the public should be reassured that this is an absolute anomaly. this is a rarity in this regard. >> reporter: rare, perhaps, but undetected for years. during which time they lived in the lake front mansion and vacationed in paris, moscow, israel, turkey, mexico. while checking thousands in your
