the dover air force base mortuary. house oversight committee gave the department until 5:00 p.m. eernl time today to hand over information dating back on to 2002. the air force chief of staff says he believes all the problems regarding the improper handling of america's war dead have been identified and fixed. to talk more about it, i'm joined by msnbc military analyst and retired colonel jake jacobs. thank you both for joining us. let's me start off with you first. i saw you on "nightly news" last night featured in the story last night. you talked about the heart break. you did not know that your husband's remains were in that landfill, that image he we see over and over of that place where trash is taken. not the remains of the people we love. >> correct. i did not have any knowledge that that is even a possibility for our military to dispose of our heroes serves overseas and freely dying for this country,

to put them in landfills. never crossed my mind. >> how did you learn that your husband's remains were there or placed there? >> i was first told by dover that no one wanted my husband, so he was cremated with the rest of the medical waste from the hospital and thrown in the trash. then, obviously, prompted me to start asking questions. i was demanding an apology for being spoken to like that, and dover wasn't appalled that somebody said this to me. that made me think, what are they really doing with our remains? that's when i started to investigate and really going after dover to get the answers. >> let me bring in colonel jack jacobs with us as well. colonel, here you are, medal of honor recipient. we know right from wrong in this country. we know that we're supposed to support our service members, the men and women who put their lives on the line. this is happening at the dover air force base mortuary. no one knows better than i would think these people how these remains are supposed to be

handled. >> they're not properly supervised approximate if all the things you're talking about aren't continuously reinforced, even good people get sloppy, will get to a point where they make a decision. they know it's wrong and auto do it anyway because they're too laz lazy. anytime you have people in a bureaucratic organization not properly supervised, things like this happen. the worst part about it is the fact that the air force didn't come clean right up-front. bad news doesn't get any better with age. you got to get it out right away and clean it up right away and make sure it doesn't happen again. >> over four years the air force dumped more than 2700 partial remains in the landfill, nearly 1,000 have been identified through dna belonging to the 274 military killed in the wars. what's the within thing you need to know? we have this deadline in three hours from now where the documentation needs to be turned over to this oversight

committee. what do you need to know? >> what i need to know is where the air force gets this date of 2003 that this began. i have e-mails back and frort between trevor and dean myself that indicates this was a practice and policy that was completely standard when trevor dean began employment with dover air force ba air force ba air force back in 1996 and it was his knowledge it was a policy before 1996. >> i want to play what the air force chief of staff had to say about this yesterday. let's play it, please. okay. in part he says colonel, clearly the officials at the mortuary believed it was acceptable to handle it. i won't justify what happened, but it's important that the employees at the mortuary came to the conclusion themselves in 2008 that there was a more dignified way to do. this wow. >> general schwartz is right there was no standard operating procedure, and so they had to

invent it themselves. what they did is use what you use in hospitals of getting ready of medical waste. it should have -- you shouldn't need a standard operating procedure written down telling you how to treat the remains of our fallen. he's right that there was no rule, and there's going to be a rule now. there should have been a rule in the first place, and anybody could have figured that out. >> thank you very much, colonel, and geri lynn thank you for joining us. >> thank you. to decision 2012. a new glimpse into what else mitt romney has in store for newt gingrich. in fact, a new ad from a super pak supporting romney that according to politico was mistakenly leaked onthe to the internet last near. here's the leaked ad. >> newt has a ton of baggage, like the fact that gingrich was fined $300,000 for ethics violations or took at least $1.6 million from freddie mac just before it helped cause the economic meltdown.

front-runner, so governor romney, the super pacs and outside groups and people that serve with newt gingrich are starts an intensive education effort about some of the liabilities he brings to the table. he is a person that has great talents, but he's a person with great flaws. there's a robust discussion around all of that. it will be interesting to see the consequence of it as you get ready to start the voting process. if it starts to take him down a little bit. right now he has clear momentum in the race. we'll see how it works. >> that was so beautifully put by steve, but the bottom line is it's getting down and dirty. no more mr. nice guy, at least for mr. mitt romney. newt gingrich says i'll take the high road for now. you don't need a crystal ball to know what newt gingrich is capable of pushed into the corner. he wants in nomination at this point. >> that's right. that's what people like so much about newt gingrich, is that he does bring the heat and go into the politics of personal

destruction in some ways. what's interesting to see is this debate tomorrow. does that come out on stage. you have mitt romney there who backed away from things his surrogates have said in trying to tear newt gingrich down. does he man up on the debate stage and take it to newt gingrich there, and does newt gingrich keep his promise? i was covering him yesterday in south carolina. i asked him directly, folks say you're self-grand yoising, and what do you make of that? he laughed it off and gave a santa claus belly laugh. it's a question of whether or not he's going to be able to maintain that discipline. that's the big thing. the big question surrounding newt gingrich overall is is he able to maintain this discipline not only on that front or whether or not he goes on the attack, since he's been aattacked negatively. whether or not he can be disciplined overall throughout this entire campaign. >> there's a conservative pastor, someone of great influence according to many out there. he's a filmmaker, entertainier.

molatav mitchell going after newt gingrich, but in an interesting and what some might call an odd way. let's play that ad. >> i can't stand barack obama, but at least he doesn't trade in his wives like used cars. newt respects marriage about as much as kim kardashian. that's right. newt gingrich is the kim kardashian of the gop. >> it is not just the old school republican wos didn't like newt from when he was house speaker. this conservative pastor supports rick santorum. he's using a little imagery. he says i can't stand barack obama, but at least he kept with his wife. at least in that area that conservative scores president obama higher than newt. >> the thing about gingrich right now is he's got to withstand some of his venom. early it will kill him or he'll

be inoculated going forward. what was it tough in 2008 was watching barack obama go through the attacks, but he came out of the attacks stronger. either newt gingrich will take his attacks now and live through them or they'll kill him off. >> back to this debate on the weekend and wonder if romney will stick it to newt gingrich, romney held this town hall today and he yet again brought up congressman paul ryan's budget. we know that newt gingrich said it was right wing social engineering and after the comments attempted to intimidate the media not to report them. here's what romney said about it today. okay. we don't have either. i guess i'm going to be the voice of mitt romney today. he went on basically to say i've spent a good deal of time with congressman ryan. when his plan came out i aapplauded an important step. this is a place where speaker begin rich and i asgree. i believe it's important.

here's mitt romney bringing up the dreaded race right wing social engineering, which you know steve, newt gingrich did try to threaten reporters say approximate if you repeat this, you're repeating a lie, even though he said those exact words. >> i don't think the republican nomination is going to be decided on the grounds of fidelity to the ryan plan. i think at the end of the day, this is an audition to see which of the two leading candidates can take the fight to president obama. i think that newt gingrich right now is very much in touch with the tone of the republican base. he is delivering a message they want to hear. i think mitt romney's challenge in the debates is to convince voters he's the mother electable candidate in the general election and able to deliver a message about how to grow the economy and create prosperity and how to beat the president. i think that's how they'll be evaluated by voters going forward in the race. >> right now the iowa caucus-goers say they're enthusiastic about newt gingrich

at 44%, ron paul 31%, romney at 28%, only one point behind him is michele bachmann. romney's got his work cut out for him if that's what he needs to do. hang on a second. i want to switch over to governor rick perry and his ad. he's discussing the repile of don't ask don't tell equates it to kids not praying in school or celebrating in christmas. these are things out there now spoofing him. >> i'm not ashamed to admit i'm at atheist. you know there's something wrong with the country when politics hate on gays and nonbelievers. >> there's another with guys from "brokeback mountain" alongside rick perry. did it backfire on him? >> well, i sure hope it does. i think the ad's a disgrace. there are thousands of americans

strauss-kahn is part of a an elaborate setup. he's facing a civil suit by the alleged victim even though criminal charges were dropped. michael joins us live now. this is the surveillance that i guess belonged to the hotel and it was turned over as a result of the civil case. is that what happened here? >> this is surveillance that was turned over as part of the chris case, and it was obtained by nbc news. it does add yet another mystery to a sex scandal that brought down one of the world's most influential financial figures. at 1:29 p.m. on may 14th a call to the police from this upscale hotel. >> i want to report a sexual assault. >> nbc news has obtained hotel video taken as a security official at want front shown of the hotel calls 911. >> it's one of our room attendants. apparently she was assaulted by one of the guests.

her fight against controversial voter i.d. laws. family tragedy. the stars of a popular reality he show, 19 kids and counting, are now asking for privacy after announcing michelle duggar suffered a miscarriage. they sent three cruises, not one, not two, but three cruisers down the street after me. >> in today's "news nation," gut check. why that 80-year-old woman you just heard from could go to jail. they came after her. you heard her. with cop cars and everything. her crime? feeding ducks and geese at a park. it's our gut check. house majority leader eric cantor is under fire today for delaying a vote on legislation that would ban what's compared to insider trading by members of congress. right now lawmakers can legally make investments based on non-public information they receive while doing their jobs. now, two house democrats sent a letter to cantor asking him to explain why he asked the house financial services committee to delay a vote that was set for

next wednesday. cantor's issued a response say, quote, in this instance a large group of bipartisan member ws o the committee thought it was flawed and being recklessly moved solely in response to need ya pressure. the media pressure cantor is referring to came after the 60 minutes exposy where people on both sizes of the aisle benefitted financially. we don't know if they were using information they received behind closed doors, but there's a case to be made to question the actions. >> yeah, the issue is there's really no clear rules that ban members of congress from trading on insider information. we don't know for sure that they are, but if they are, it's legal to do so. this legislation would say very clearly, members of congress cannot do this. >> cantor's under fire today for the decision to block this, and there was bipartisan support to do go about this. obviously, this leaves you

wondering why. >> there's lots of twists and turns in any legislative battle. this is one of them. since mr. cantor blocked the hearing, the bill is now generated more than 218 supporters in the house. so it now has a majority and enough votes to pass the house. the momentum is building for the bill. >> what do you make of cantor talking about the media pressure? we know a lot has changed in this world due to media pressure. he would note that was a reason or part of why he didn't want to move forward, again, makes you wonder why. >> that's true, but there certainly has been a lot of pressure for this bill to go forward. my ago it had nine co-sponsors, and in the last month, three weeks really it's had another 200. i think it's okay for mr. cantor to say hey, let's slow down and see what we're doing doesn't have unintended consequences. >> what's next? >> next week the senate is going to move forward with a hearing and a vote on it. a vote in the committee.

while the house is sort of pausing, the senate is moving forward. >> all right. we'll see what happens next week. have a great weekend. the family of a retired fbi agent that vanished more than four years ago in iran has released a proof of life video of him. robert levinson went missing while investigating cigarette smuggles. they received the video last november from his captors, but it was released to the public just today on the family website. >> i need the help of the united states government to answer the requests of the group that has held me for three and a half years. 33 years of service to the united states deserves something. please help me. >> just a short time ago lev levinson's wife talked to andrea mitchell about the toll this is taking on their family.

>> my granddaughter was born almost three years ago. her birthday is coming up december 16th. it's very difficult because every celebration he's missing. my hope is to get him home this holiday season so we don't miss any more family events. >> levinson's wife adds she's confident the fbi is doing everything to bring her husband home. disturbing new information about dozens of people killed in an early morning hospital fire in india. that tops our stories around the "news nation" today. officials at the hospital in eastern india say 85 passengers and 4 staff members were killed. investigators say in some cases medical staff abandoned their patients to save themselves. six hospital directors are now charged with manslaughter. the chief minister of the area ordered the hospital's license be withdrawn. the fire started in the basement, but the cause is still under investigation. the duggar family is asking for privacy after learning yesterday that michelle

miscarried her 20th child. it was just last month when the family announced the latest pregnancy on "today." michelle duggar says her other children were excited about the new baby, and that the hardest part was breaking the news to them. the family privacy. new information on the shooting that took the life of a virginia tech police officer. yesterday they say the gunman ambushed derek krous during a traffic stop. he was not involved in the traffic stop and fled, changed his clothing and took his own life. there's no clear motive. krouz was an army vet and father of five. emotional reaction from the mother of a missing florida mom after learning that her daughter's cell phone was recovered yesterday. michelle parker vanished more than three weeks after appearing on "people's court" with her ex-fiance. he's a suspect, and she's holding out hope her daughter will be found alive.

analysis back from bits of charred wood they found in the desert 30 miles away from where josh powell said he took the children camping at midnight on the freezing december night two years ago, the night that susan vanished. they won't say whether or not the results of those tests are connected with susan's disappearance. salt lake city, december 2009. the impeding christmas holiday was the last thing on the minds of susan powell's friends and family. gifts, carols, normal things fell away. all they could think of was finding her. despite their best efforts and extensive multi-state search operations, the mystery lives on. >> people that know me know i would not hurt susan. >> susan's husband, josh, remains the only named person of interest in the case, but he's never been charged. >> it really hurts that people would try to say that i don't love susan. >> i'm not sure anybody said you

didn't love susan, but they say you killed susan. sometimes you kill the one you love. >> well, i never hurt susan. >> but josh's own sister, jennifer graves, has her doubts. >> his actions have told me all along there's something wrong there. >> after all, josh powell is the last person to have seen her alive. he says he left to go camping with their two very young boys around midnight with a serious winter storm on the way. susan's parents among others have questioned the story. >> she would not leave the children. for her to leave the house without her purse or her cell phone or anything is just -- she would not do that. >> susan and josh seemed to have a fine marriage, as far as anybody could tell, at least. >> they're kind of sfil in the newly wed stage even though they were married for three years. they were kujdzing and hugging each other. >> josh's father interpreted susan's affectionate in a

different way. >> susan was very open, and i would say very aggressive in male/female relationships. she called the shots. >> behind steven powell's public theories about susan and sexuality was evidence of private activities that have landed him in jail. he's now awaiting trial on charges of voyeurism and possessing child pornography. while in family court, susan's parents fight for custody of josh and susan's little boys. the case has been in the public eye since it began, but so much remains hidden. wild allegations of abuse, religious conspiracies, sexual deviance. >> that struggle in court by the way over the custody of the two little boys sgegt more and more intense. josh has now filed a paper in court to suggest that the coxs, susan's parents, are trying to get the boys to dislike their family. he's terribly upset by that. they say they're trying to support and protect these little

at the local pond. the city of lynn filed a criminal complaint against claire butcher on wednesday after officers spotted her feeding ducks and geese at park twice. the city says she's in consistent strilgs of a no tress peace order issued against her in 2009. they saw butcher brings a shopping cart full of loaves to dump at the pond. anyone caught feeding the wildlife can be slapped with a fine. she says the animals at the pond belong to god. >> they sent three cruisers. three cruisers down the street after me. lynn has nothing else to do but chase an 80-year-old woman down the street for feeding the ducks? >> cue the music from "bad boys." residents are not happy about the feeding either. this is their complaint. they say these ducks and geese bring in piles of waste. nasty. city officials say feeding the
