good morning i'm thomas robertsing the agenda, bain on the brain, mitt romney is talk ag bought why he believes he's better at fixing the economy than president obama. he's promising he will take the unemployment rate falling for months under president obama's leadership and take it down to 6%. this is something the non-parlt i son congressional budget office predicts will happen anyway in four years. he says his bain background gives him the economy tools to fast track our recovery. here is mitt romney defending his record at bain and taking a swipe at the president at the same time. >> i'm pretty confident the overall record of the enterprise i helped begin is one that is solid. a business like bain capital was successful 80% of the time, and 5% of investments went bankrupt,

one-term proposition. his policies failed to make things better. we have governor romney, who has released another ad putting out specific ideas, ending the job killing regulations, doing away with big government, standing up to china on trade issues, these are bold ideas that will turn the economy around and put some of the 23 million americans back to bowork. he will repeal obama care that will go a long way for making the economy better and also ahavi approving the keystone pipelines. these are policies obama has failed to come through on and governor romney supports. this will put people back to work and turn the economy around. >> i want to ask you about president obama enjoying the strong lead, 30 points in the telemundo points. mitt romney making a strong play, speaking with another or reaching out to these voters with this spanish speaking tv

are people who -- this election cycle across all spectrum, they have been following closely, centering around immigration but all issues. >> the president is leading but mitt romney is closing this gap in all three states, we talked about those, let's show them to everybody. is this a natural tightening or is romney's economic message final lly ratcheting up? >> we're still a ways out from the general election, most of the voters will decide are going to be making their minds up near the end. so as you're seeing the polls move around it will go up and down, depending on exactly what is happening in a given week. you've seen over the course of the past few days this set of attacks, you've seen him start to engage on that level in an

interview yesterday with "time" magazine. i think as we watch these numbers move, it's a question of how are voters responding to taking the deeper look at mitt romney's personal background. remember, he's still not as well known to the majority of the american public as say president obama is. so you're seeing a reflection of that process as well. >> you wanted to jump in? >> two things about the numbers, in virginia and ohio, as relates to joe biden, he is an outstanding surrogate for obama in those states, he can have conversations with white male voters that obama cannot have. so i think he will be a terrific asset for him and what is more important, people know joe biden that he's goofy and says things, when romney goes off message and talks about let's bet $10,000, that strikes the public as astonishing, joe biden's gaffes are the eye rolling variety. >> i want to bring up

republicans may have found the favorite target in joe biden. do you think in state s like pennsylvania, michigan and ohio, 40% of voters in swing states view him favorably, is biden a liability tee, an easy target for republicans as we steam forward toward november? >> many of the polls show biden's unfavorables are higher than favorables. he's an easy target, the gaffe master people are voting for president, we're seeing in recent states just this week alone in arkansas and also in kentucky people are identified democrats are voting against the president, taking time-out of their day to go and vote against president obama, they don't agree with the policies, they don't believe that he is going to turn things around, and this bodes very well for governor romney, the cases ee pointing in terms of the polling will go back and forth, in '08 the lead

changed between mccain and obama 24 times. lead will change we're seeing in florida and north carolina governor romney is leading the president and that doesn't bode well for the president because people now trust that governor romney has the policies and ideas to turn the economy around and that is the issue number one in this election. >> casey, look ahead as we talk about the president going to iowa, gop caucuses burned a lot of memories in our brains. the reelection team making a blai f play for the hawkeye state. what do you predict whether or not it is up for grabs or not? >> it's going to be an interesting bellweather, obama is struggling there, under 50%, but the unemployment rate there is also very low. they are not suffering the same effects from the recession as some other states. other places romney will be

of the most famous missing child cases in american history and today, new york city police have a new jersey man in custody in the case of etan patz, one of the first children put on a milk carton. a search turned up nothing, but now there could be a huge break in the case. ron allen joins with us more on. this bring us up to speed, this has been changing a lot this morning. >> reporter: 33 years to the day tomorrow from the time etan patz disappeared, to recall, he was walking about two blocks from his home at a new york city neighborhood to catch a school bus to get to school. he passed by stores, not what new york is these days, but fairly small town feel back then. nonetheless, the reporting is a man named pedro hernandez was a store keeper along the route or worked in the store, and he told police he lured him in the store with candy and apparently is

saying he killed him and disposed of the body. police are trying to corroborate that story, they don't know if it's true or not. this man has been on and off the police radar during the past 0 years or so -- 30 years or so, other people named as suspects. this is happening now because of the search back in april. some of the man's relatives remember him saying back in the 80s that he had done harm to a child until that neighborhood. and when they saw the search going on for etan in april, in the soho in new york, they associated that with him. a sister in law or relative called police and he was questioned. they are trying to corroborate this, to make sure the story is true, it would be an incredible breakthrough in a case now 33 years old. >> something that a lot of people suspected would not be solved because of the amount of time between when this case happened and where we are today but as you bring up that search in april in soho, if i remember correctly, they were searching

the basement of where he lived, because he had laid a cement floor and taking up the floor, is that correct? >> the basement of another handyman's workshop, not the man in custody now. and you're right, the cement floor was poured after the boy disappeared, was suspicious, there are a number of suspects, persons interest named back then. this man is in custody alone. so yeah, just again fascinating and incredible breakthrough if in fact it is true. we hope to hear more from the police later this afternoon. >> ron allen, we'll check back with you, if you get anything else. appreciate it. we'll have new developments on the story we brought you yesterday, high school freshman jessica barba suspended after posting a fake suicide video and matching facebook page. this was all to draw attention

>> it's generic pablum. president obama put a plan in front of the american people to reduce the deficit. you want to go big, let's go big. republicans didn't want to do it. this president has been tougher on china than anybody else, tires, lawsuits. solar panels, that was a story a couple weeks ago. he has been tough on china and mitt romney has not come out with any kind of plan what he will do when it comes to trade. he's a free market, outsourcer, willing to see jobs shipped overseas, yet to come up with a plan how he will support the manufacturing sector, all it has been is an attack on wages and the middle class. he talked in the day one ad about crippling regulations. give me one. give me one. he never speaks in specifics. this is his big problem right now. he can't get down the devil in the detail with the american people on what he will do. >> one thing he has said he can get the unemployment rate below

6%. in his first term in office. however, the non-partisan cbo put out a prediction in january saying right now that is where the unemployment rate will be. >> mitt romney is all over the rate. anything over 4% is unacceptable, he can get it down to 6. there are economists who say we will never get below 9%. in ohio, pennsylvania, virginia, florida, you're seeing unemployment trend down ahead of the national average. the president with 26 months of private sector job growth is headed in the right direction. i think the obama campaign is just going to have to remind people how close we were to tipping over back in 2009 and where we are right now and how far we've come. >> one thing i want to get you on the record about is wisconsin, your show has been out front on that story all along. we have the recall election coming up at the beginning of

june. for governor scott walker. right now things are looking good for the governor to stay within his position he's becoming a gop favorite, appearing around the country. some people might speculate maybe he'll get a nod at the convention. if he is able to keep his seat. what do you think -- >> i think that would be great. there has been no governor that has attacked the middle class more than scott walker if they put him on the ticket, win, lose or draw in wisconsin it would be the dream tickets for the dem krats. easy so vulnerable. if republicans come out and vote, they have to save a political candidate. they may be voting for a criminal. they will have to weigh this. this john doe investigation is reeled off a bunch of people who have come forward, and been charged with felonies. these are his people. so we don't know where that is going. walker has gone after teachers, gone after the middle class, this is what makes him a hero.

but i think what really underscores how important the race is, look at the outside help, such as tim pawlenty, nikki haley, they are all in. this is a message who democrats how bad the republicans want this on the national level and that will motivate a lot of democrats and a lot of independent voters. >> do you think it reads badly for the president in wisconsin in november. if walker stays in place? >> you can slice that any way you want. if obama goes there, biden goes there, talk of bill clinton going there, all of that is a side show right now. the bottom line is that the badger state has to make a decision what their belief is what should be in front of the middle class. should the wealthy get more, should the middle class pay more, should we go after teachers and firefighters, police officers, should we go after state workers the way they have? should we get rid of collective bargaining? this is one for the archives and i just do not believe the polls

trading on the nasdaq there may be a status change in the works. cnbc says they may be moving to the new york stock exchange. nasdaq got a black eye last week when the system froze after being overwhelmed with orders for facebook stock. so today, stock shares are trading, just point 2% above where they opened, 32.07. in the first three days of trading, facebook stock fell, more than 18%, now many are raising questions about how the stock was valued or why it was valued so high. dan ackerman, savannah took time off from facebook profiles. we'll talk about credibility issue that facebook is having with this. let's first talk about the fact that today, fidelity investments say there is confusion over whether some of the customers fully knew what the stock valuation about facebook was really going to be, where they

thought the initial ipo would be. dan, what are you hearing about that and were people behind the scenes getting whispers knowing analysts overinflated it. >> that is one of the two big issue, the first is the software problems, the second one being investors getting last minute update saying that facebook's revenues won't be what people thought they were, they said we are not going tobi biauy as muc. mark zuckerburg loss more than three billion. the co-founder lost nearly $800 million. sean parker has seen over a $400 million slip away. these are not skipping meals, they will be fine because of the money they have, but that is a lot of money. savannah as we talk about the tact they are being sued, sued by the lawyers who represented people that sued enron and won

for $7 billion. when we talk about enron, people have a visceral reaction, what does this mean for facebook going forward? >> there is a few lawsuits going on the main one filed what dan was talk about that certain investors got a tip off more specific projections about facebook's revenue than the average investor did. when a company goes public they have to put it in the registration statement, all their financials, so everybody is on a level playing field and what is alleged here that is certain kind of high roller type investors got information that the average investor didn't get. now facebook will say look, we did put some of this in our prospectus, we mentioned there were questions about growth, the revenue stream from facebook mobile, so that will probably be where the fight is in court, whether or not the average investor was warned.

>> they are saying they did nothing illegal, certain people would look at that, and say this game is rigged. >> i don't know facebook would acknowledge that actually happened. that has been reported in a couple sources an who knows what the truth is, that is one of the facts that will be hotly litigated at trial. what is interesting the plaintiffs are suing under a section of the securities laws that permit plaintiffs to recover even without showing that facebook intentionally misled. if they can show there was a material omission or misrepresentation of facts in that registration statement, they potentially could recover damages. >> dan, what does this do for facebook in the product it that does as opposed to the business model that it is? >> they have been very focused on saying we will do long term product development, make it better the ads may come, go, revenue may come and go, if you're looking for a short term gain, they warned i this is not the stock for you. >> everybody is so curious about the facebook flop. how it could flop. we shall see how it plays out.

appreciate it. coming up hewlitt packard slashing jobs, the biggest purge in the company's 73 years history. the news sent shares of the computer and printer company up by 10%, we will see how that goes. the commerce department says new car orders jumped 5.6% last month. car sales are expected to top 14 million up from 12.8 million last year. now, the auto industry is hiring. chrysler adding 3,000 jobs, volkswagen, 800. toyota is hiring 1000 new employees at five u.s. plants. chris woodyard covers the car industry, also the eld i tore of drive on blog. great to have you with us, this is good news growth-wise increased sales, those are very

positive numbers, the hiring going on in the auto industry bail out. is there a single straight line we can attribute all this growth to or is it just the facets of what we have seen over longer period of time? >> it has been driven by people buying more new cars. a lot of the peoples cars on the road are plain wearing out. average age of a car on the u.s. road is past ten years. never been that old. people finally have to buy them, the economy is a little better, there is deals to be had at the dealerships, all going to mean better car sales this year. >> so the trouble in the auto industry really hurt swing states, talking about ohio, but now their unemployment rate is below the national level, something the president is out there touting. because they are seeing the gains within their borders. but is there a pitfall awaiting the industry? this is come back here to stay what is a lot of people want to know. >> it all depends on the overall economy. in europe and other things factor in to that. there is no question about it.

she watched him put him in a washer. it's both their fault. it's her fault, too. >> we have a break down, let's explain what is the mother's recourse? there is video but what is the likelihood charges can be breast ed -- can be pressed. >> the prosecutors are saying this was not criminal, it was stupid, unfortunately for the mother, filing criminal charges is the sole discretion of the prosecutor's office. she can seek civil recourse if she wanted to sue them in civil court and try to get financial compensation but she can't bring criminal charges on her own. however, if the prosecutor's office decided to reconsider based on the fact she does want to see them prosecuted criminally, they may look at things like child endangerment, negligent, everyone here acknowledges that it was an accident that nobody wanted this little boy to be hurt but the mother is saying he went through a traumatic experience, he could potentially be suffering physical damage from that and she wanted to see them held

accountable. >> what are they saying about the bruises, scrapes, visible, what are they saying anything about long term problems he could face? >> so far, thankfully looks like he's okay. the babysitter took him to the hospital afterwards, she didn't tell the mother which is irresponsib irresponsible. the hospital said he was fine, prosecutor's office said no major injuries. the mother says he's looking around, doing things he didn't before. it's still to be seen if there are lingering effects. >> great to see you, thank you. a terrifying crash caught on tape in russia. a dash board camera mounded on an suv caught the whole thing as an on coming truck driver rounded a curve too quickly. the driver says both he and the truck driver are going to be okay. look at that, how scary that is. harvard alumni at their 50th class reunions are getting updates including that of una bomber ted kaczynski who

ending work place discrimination, and a range of other issues of i am importance to the community in terms of family, safety and access to health care, but what i think is most important about the effort that we're making is not just to remind folks about what has been done and what is left to do but also draw very sharp contrast between this president and governor romney, and his views on lgbt issues and in particular his commitment to write discrimination in the constitution. >> you can talk about the contrast and outline them a lot of people now that the president has come out in support of marriage equality will want to see actions as opposed words. yesterday's poll registered 59d% of african americans who expressed support for same sex marriage and 18 point jump from polls taken before the president's endorsement. while the president coming out for this certainly changing hearts and minds, especially in a community within the african american community, this have been slow to accept marriage

equality as being that of a civil right, but the lgbt community will want to see more from the president on a federal and state level, if they believe that he fully supports this, don't you agree? >> well, not only do i agree, and let me just say i think it's not to be under-estimated the strength and historic nature of the president's words and what that meant to americans and as you said what it meant to continuing to change the hearts and minds of americans. that is not to be under-estimated. but as i said, the president has committed first and foremost and has been on record since his time in the senate, to repealing the defense of marriage act. that is significantly important from the federal level, it's something that we not only need to get the president reelected to be able to do but also need to insure that we have an lgbt friendly majority in the senate and bring back that majority in the house. the president has made clear and i agree with him that we are in

this together. he and the community and us and our allies in congress, so to continue to do that work we need all those things to be in place after this election. >> joe, you brought up employment non-discrimination act, the president has not signed an executive order, do you expect movement on that front in the next six months? >> i do. there are, as you mentioned, there are two roads to end work place discrimination. something the administration is not doing right now, but is something that i think whether it's that or whether it's moving a fully inclusive employment non-discrimination act are both things we look forward to do after the election cycle. again, though, moving a fully inclusive employment non-discrimination act is something that will require more lgbt friendly faces in the house and senate and that is something we have also got to be focused on in this election cycle.

the first concert 11 years ago it came into crystal clear focus to me that not only, this is not just an important holiday, it's the most important holiday. by that i mean without memorial day, we have no other holidays. there's no need to have any other holidays because it was the sacrifices that the young men and young women of all ages actually throughout our history over the 200 years of america's history, the sacrifices they made has allowed us to be the country that we are, the beacon of light for the world. what the rest of the world really aspires to be. even if all our flaws and foibles, this country, our princip principles, what we're based on is what other countries aspire to be. memorial day, heroes like justin who have actually gone out there, and, you know, freedom's not free but somebody pays for it. the military are those who do it. so memorial day to me is the most important holiday we have.
