prairie fire. but he left out some facts. his speech was more like a cow pie of distortion. >> the new attacks are somewhat unconventional this early from a sitting president. the romney campaign calls eight sign of desperation. but it's one more indication this campaign will be unlike any other. let me bring in msnbc political analyst and former rnc chairman michael steel and strategist kiki mcclain. good morning. >> good morning. >> all right, does going on the attack mode this early, michael, make the president less presidential or is it smart, frankly, given the tone of what we've seen so far? >> i think when you're president you always look presidential, so you can't take that away from him but i think the attacks do speak to an urgency that the obama team is seeing not just on the political side but also on the financial side. he's got to get his donors fired

up and in this thing. they don't want them to take for granted the election and assume he will win it. i think romney is proving himself already to be sort of a difficult opponent in the sense that a lot of the things they have thrown at him so far some of it stuck but not to the degree they thought it would. the story about his boyhood indiscretions in high school, so the reality is this campaign as you said it, chris, will be one for the books. they know it and they want to get in front of it as much as they possibly can. >> he makes an interesting point when he talks about what sticks, kiki, is this like, we're in a season where maybe the vast majority of the electorate isn't paying attention well oh throw things up and see what sticks and we'll be ready to go? >> i don't think anything is loosey goosey. michael knows it's about defining choices. everybody always looks up and says the campaigns go so much

longer the differentiation starts earlier, it doesn't really. i bet if we looked at transcripts you would find this going on. what you're seeing and experiencing now, romney will be the nominee. the dialogue and choices between these two men, now is the time to defining who they are, and the differences among them and i think it's come lpletely legitie when we are kneein a discussion economic future, who they are. with mr. romney he has a record given a lot of different positions on frankly, what that real history is. >> david axelrod said there is no point in being coy, you can't accuse the president of doing that. we put together a set of clips, this is part of what he said just yesterday. this is the president. >> i know governor romney came to des moines last week. my opponent in this election, governor romney, the main goal of a financial firm like

governor romney's is not to create jobs. governor romney has made his experience as a financial ceo, the entire rationale of his candidacy for president. >> do you agree with kiki, mike sme he'll -- michael? >> i think kiki has it dead-on. this is about two things in my view, defining your opponent and yourself in a way that the voters get to see you as the fighter, the charger, the change agent, and for both of these men, they want to make that argument for change. the president, there is more change that we still need to do despite the congress that got in our way, and romney, who says we need a change from all this change that we were promised

four years ago. these two guys are putting it down i think it's good politics right now for both of them. >> it's interesting, if you go back and look at 1996 reelection of president clinton, i think there are a lot of political scientists who would tell you bill clinton won that campaign in the summer. bob dole didn't have a shot come labor day, because the real definition of who both of them were occurred over the summer and the reality is, chris, with social media, and all the other avenues we have in media today and great shows like yours, people pay attention now. this concept people aren't really paying attention is not true. >> we will be using that clip, great shows like yours. there was a pretty tough article in politico, obama stumbles out of the gate talks about the president's message, fundraising, that has fallen off a little bit. at the same time, let me play a clip of mitt romney out on the

campaign trail, yesterday and he of course has also been accused of having a muttled message. >> my opinion is such an urgent priority to bring jobs back to get the economy going again, put people to work. >> i want to hear from of you, michael, it seems he's trying to hit it again. how do you think both of these campaigns are doing at this point and what is your assessment of the adjustments that need to be made? >> i think they are both are adjusting, the obama campaign thought it would start out of the gate stronger than it has. it hasn't. i think they are now trying to deal with the fact their money is lagging behind the gop team. they are trying to catch that up. their messaging is all over the place you heard the president stumble through his stump speech figuring out do i use his name here or not. and romney on the other hand is also kind of getting the boots on as the nominee.

he still remembers in a republican primary process, states still have to vote. there is a conservative base not as warm and fuzzy as he would like them to be. they have work to do, they both came out of the gate slower than they like to, certainly on romney's team it took a little longer to get to this point he had others to contend with. i think once we get past july 1st, you will see this thing lightning speed to the conventions and then game on. >> are you agreeing with that, kiki? >> i think there are a couple things. i think michael and i both agree this will be a battle of two highly disciplined organizations supporting their candidates. >> yes. >> we haven't seen that since 2000, really. 2004 and 2008 were uneven in that respect. one speech here or there isn't the whole life of the campaign. the one thing we know barack obama has a record to run on and he's very committed to it. what he has done for the automobile industry, how he

dealt with taking eye iriraq an moving in afghanistan and killing osama bin laden, what he has done to move this economy however slowly, we kept it going. for romromney, the same problem before, in the primary conservatives didn't know who is the guy, moderate or conservative. as he moves in the general, moderates are saying is he that extreme guy we heard during the primaries or the moderate? he's not defined his own record as governor, in fact he tried to walk away from it in some instances. >> all of us agree this is an economic election, but i want to have you both stand by and move on to and you mentioned briefly, kiki, osama bin laden and there is a lot of other stuff looming out there on the international front. lawmakers have been absolutely outraged over the treason sentence for that pakistan doctor who helped to find osama bin laden, the senate appropriations committee voted 30-0 to cut $33 million in aid to pakistan, that is a million

dollars for every year of his sentence. >> his help, after all, was instrumental in taking down one of the world's most notorious murderers. that was clearly in pakistan's interests as well as ours and the rest of the world. >> joining us now is richard blumenthal, a member of the armed services committee. senator, good morning. >> good morning. secretary of state clinton said the doctor should be released, i assume you agree. can the u.s. make that happen? >> i believe that the united states can make it appear, perhaps by opening the supply lines essential to our drawing down troops in afghanistan. the fury that has been articulated so eloquently by

both the armed services committee reflects a bipartisan outrage at the pakistanis dealing so mercilessly and unfairly and unjustly with someone who brought to justice one of the monsterous murderers of all time. >> the head of the ruling party talked with andrea mitchell. this is the argument he made about the arrest. here it is. >> unfortunately, andrea, that anyone collaborating with foreign intelligence, even of a friendly country, anywhere in the world is a crime. >> he makes it sound very logical, senator, we were just following our own laws. where is the problem in that? >> logical if you are in a kind of alice in wonderland, where the opposite of the truth is taken as the truth. and the fact of the matter is that the pakistanis have said

consistently that they were not harboring osama bin laden, that they wanted to assist the united states in tracking him down, and then when one of their citizens in fact does provide help in bringing him to justice, they bring him to court. and sentence him to the rest of his years in jail, 33 years for dr. afridi is a life sentence. there is something really totally unacceptable and inexcusable, not only unfair, but unjust about this sentence and following their laws doesn't make it right. >> should the president get involved, do you think, peter king was saying it yesterday, dennis kucinich was saying that. >> the united states has advocates in the secretary of state who expressed outrage and anger about this unjust result. i think that coming back the fundamentals here we decided to reduce aid by $33 million.

a symbolic step, admittedly, no more than symbolic, in light of the billions of dollars in aid that we have provided the pakistanis since 9-11, in the range of about $18 billion overall and with holding aid right now partly as a result of an amendment i offered that says we should with hold the aid unless and until the pakistanis provide greater assistance in intercepting, detecting and stopping the flow of fertilizer that is used for the roadside bombs that kill and maim our troops. as a practical matter the $33 million withheld is a very strong, symbolic step, but we need to face the fact that the pakistanis have basically been against us as well as for us. in other words, they've harbored the haquani network, permitted

the fertilizer to be transported across their borders, after it's made in plain sight. material that is used to blow up our troops. they have harbored whether with full knowledge at some level, there was knowledge of osama bin laden being in their country. so they have been basically two-faced and we need to confront the fact that we need to provide greater incentives, both carrots and sticks for them to be on our side. >> let me bring kiki and michael's son. he suggested the pakistanis were waiting for an apology over the 24 soldiers that were killed, and that was what needed to happen. kiki, is it that simple, we trade an apology to get the supply lines open and potentially get the doctor released? >> i think people more familiar with the personalities at play that can make that judgment.

what we do know as he said yesterday, in a very simple statement, he tried to point out their justification for the decision making but what we also know is senator blumenthal made clear, there will be a reaction and response to that, which they now received. part of the art of diplomacy is an understanding of how far this goes and how far you take it but i think the message has been very clear from the united states on this. >> it's part of the concern, do you think, michael, for example with the situation with the doctor going to jail, it's something the u.s. has to fix because otherwise the message gets sent out be careful if you help the united states, this is what could happen to you. >> chris, that's exactly right. the senator hit it on the head. there is what is legal in pakistan but then there is also what is right under the rules of engagement here, given the fact that we are still in this war on terror, trying to fight terrorist networks as a senator and kiki pointed out the diplomacy here dances on the

some indications this morning that after a week of deliberations, the jury at the john edwards corruption trial may be closer to a verdict. they asked to see 20 more evidence exhibits and the judge gave them access to everything, 503 exhibits. edwards walked over to a baseball game with his daughter a few blocks from the courthouse. >> joining me now former prosecutor and civil attorney, john q. kelly. good to see you. we thought it was an open and shut case, now they have been deliberating almost a week. they asked for exhibits, they have 503 sitting with them now in the jury room. what do you think is going on in there? >> i think they are doing what the judge asked them to do. they were instructed to take the first two counts related to the buddy money first, they asked for exhibits related to that. >> they moved past that.

>> they went to the baron money, '07 and '08 contributions. i think if they asked for exhibits dealing with false statements or conspiracy after that, they've reached a conviction on one or more of the campaign contribution counts. you can get an idea where they are going right now. no indications they have reached an agreement on anything other than the buddy money, but reached an agreement on that when it's guilty or acquittal, we don't know, i think they are done with that part of it. >> one of the things that i thought of when i heard the judge said look, do you want everything? that could complicate things, 503 is a lot of exhibit. >> there is a lot of down time, they have to put the note together, the foreman has to get it to the judge, people sort through and fine it. why don't we give you all that, you can pick and choose it will save time. >> we talk about friday verdicts, now the friday of a holiday weekend not like they are sequestered, but does that

tend to push juries to wrap things up more quickly? >> i don't think you will see it today. once they start on the next two counts, friday morning, you won't see a verdict. >> really? all right. there are also some reports of what i think can only be described as bizarre. overt flirtation between john edward and an alternate jurors. they usually get dismissed. they were asked to stay, they were there. she is described attractive young woman, one report says even edwards lawyers have to work to suppress their laughter at the absurdity of it all. should they not be laughing and say to john edwards cut it out? >> i think he has lost his mind if he's doing that. not only is it bizarre like you said, it's distasteful, disrespectful, if this man who is asking 12 jurors to decide his fate of incarceration or freedom, and he's more concerned with flirting with an alternate juror then the task at hand i

don't think they will cut him slack. >> presumably the other jurors are seeing this. if the reporters seeing it, the people in the gallery are seeing it. >> i'm sure the other jurors are seeing it. edwards, i don't know what possessioned him, he might be getting played by the juror. let's see what he does when i do this. this was a horrible trial with very painful cat a trtestimony,s concerned with flirting with an alternate juror than what is going on with his fate. >> what do you think will decide this? >> i think the evidence at hand. they will probably convict him of one or two counts of the baron money. >> so much feeling how tough a case this was. >> it is a tough case i'm not saying that with my usual level of confidence but fair level of confidence they will convict him on one or two counts. he is not helping his cause

strategist julian and alice stewart. julian, the president struggled with this particular group of white middle class voters before, he did it in 2008, i think this is one of the key numbers behind the numbers. 31% of these voters describe themselves as republican, 27% as democrat, which obviously leaves 42% who are independent arguably, more up for grabs. can the president win them over if the economy doesn't make a big turn around? >> i think the president will win enough of them to win the election, the same poll it shows the president actually beating romney by a couple percentage points. this particular demographic, mostly non-college educated white voters, obama only won the same percentage in 2008 as the poll shows. if you look at the overall percentage of white vote. obama has between 42 and 44% right now. the only way romney can win in

november is if he were to hold obama to 38% of the white vote because the non-white vote has expanded so much. when you look at the numbers for obama in the entirety of the poll they are very, very good, they are very daunting for romney. >> let me look at the overall poll, it shows, alice, among all voter, 50% think the president would do more to advance their economic interests or interests of the middle class compared to 44% for romney. what do you think is behind the number, do you think the bain attacks are working, what is going on there? >> i don't think the bain attacks are working that is why democrats are distancing themselves from that attack, many say it's unfair and unnecessary and not going to work. in regard to the cross tabs on those particular polls, what we're seeing is people out of work of the 23 million people who are out of work in this country, they don't look to obama as someone who is going to change and turn things around.

the overall snapshot of who is the best person to turn the economy around and create jobs and create a good business environment for this country, poll after poll after poll, people stand behind and trust that governor romney is the person that is going to instill confidence in the economy which will help businesses invest which will create jobs and turn the economy around. we will see occasional snapshot in time, where obama may come out on top but poll after poll, people trust governor romney, to turn the economy around because president obama's policies have failed to make things better for the american people. can i respond? >> this becomes a discussion we have been reading a lot about this with aanalysis, about whether his business experience qualifies him to be president. is that the message that will be out there from the obama campaign, that the two don't mix? >> first of all i think what alice said is wrong. you put the figures on the screen that showed that in the

poll the public trusts the public generally trusts obama far more than romney when it comes to fixing the economy. and that has shown up time after time with the polling. so what alice said was wrong. alice did not respond to the fact that obama is doing as well, if not better with white voters, the fact that the non-white voter base is expanding, these numbers are very bad for romney. that is point one. point two is the obama campaign and i think democrats are not questioning private equity, what they are questioning is romney's record. romney's record as governor of massachusetts where he's 47 out 506 in terms of job creation and how well he did when he was in the private equity market in terms of creating jobs. he himself made that the issue, that is why the democrats question it. >> he is not running on his record as governor you don't hear him talk about that very much. in fact if you look at the latest poll he will lose massachusetts in the general. >> we will be happy to contrast

governor romney's record of success as a businessman to president obama's record of broken promises. time after time he made promises that he has broken. here we have the longest recorded record of unemployment above 8% in recorded history. 23 million americans out of work. we have the median household income dropped $4,000 per home, and this is a bad economic times and this is directly a result of the failed policies of the obama administration and the president himself said right after he was elected if he does not turn things around his presidential title will be a one-term proposition and it will be. >> when the president came in office we were losing 800,000 jobs a month we're now gaining 200,000. that is a million jobs per month positive net swing. when the president came in office we were at negative 9% economic growth, now 2% positive. that is a positive 11 point

swing in gdp. can you give the viewers a positive turn around in both job numbers and growth in the last 30 years? >> ways wondering how long you blamed the predecessor. we're looking at bad economic times. >> we have tremendous debt, we have tref defenmendous deficit. >> alice, julian -- >> alice was not able to cite any time where the economy where we've gone from positive million swing in jobs a month and positive 11 point swing in gdp in a matter of a couple years. let's note for the viewers alice was not able to cite a single time. >> let's note we have 23 million americans out of work will go to

the ballot box in november and vote for someone they know that will create jobs and turn the economy around. >> the polls don't show that. >> that is the last word. >> thank you both. good to see you. developing now, the suspected killer in the etan patz case has been taken to a new york city hospital. he's 51-year-old pedro hernandez arrested on thursday in the murder of etan patz, a case that captivated the nation. he disappeared 33 years agoing today while walking to his school bus stop in the soho neighborhood of manhattan. ron allen joins me now live from the courthouse. what can you tell us? >> reporter: we're expecting the arraignment later this afternoon. you're right, mr. hernandez is now at a mental hospital under going an evaluation, also on a suicide watch, which is standard procedure in cases like this. his family has indicated that he has some mental issues but don't know the extent of that at all. the bottom line this is was a

stunning development in this 33-year-old case. 33 years agoing today, patz disappeared. hernandez was not a suspect in the case. police say he was never questioned and they are in fact two other men who were thought to be suspects. you may recall in april the police dug up a basement in that neighborhood and tried to -- named a suspect, a person of interest back then and there seems to be no relationship between hernandez and that person. there is also no physical evidence at this point linking hernandez to the crime. he has told police, we understand, he was a store clerk back then, he lured etan in the store with a soda and strangled him in the basement of that store, disposed of the body and so we have no idea where the body is right now. again, a lot of questions about the case, we expect hernandez to be arraigned later this afternoon. >> ron, thank you.

that late breaking development, there will be much more on the story at the top of the hour. another developing story the second charity started by jerry sandusky is asking for court approval to shut down. second mile has been financially crippled by the sex abuse scandal involving sandusky. the charity is asking to transfer programs and millions of dollars in assets to a texas-based youth ministry that receivers abuse and neglected children. sandusky goes on trial in june. more than 50 counts of sex abuse against him involving 10 alleged victims. it took 10 years but a football star who hoped for an nfl career has his life and dream bank. brian banks name was cleared yesterday after a 2002 rape and kidnapping conviction. a private investigator captured video of his accuser admitting she made the story up. on "today" he said he hasn't thought about the word revenge. >> it's easy to have those
