the conservative base who are crucial if he is going to run for president in 2016, he is going to remain a major force in conservative politics there is little doubt, as senator schumer saying this thing is going forward f it doesn't go forward in the senate it is now going forward in the house of representatives. so, it's very unlikely that rubio, whatever he does is going to stop this from happening and he doesn't really want to stop it he just wants to appear tough while he is doing it. >> nervousness about it. the director of the center for immigration studies told the "washington post" this, "at some point, rubio will either have to lash himself to schumer or walk away from this thing. i'd bet my lunch, though maybe not my authority mortgamortgage end up waking away and say i tried in good faith, we made progress but the administration and democrats are unwilling to play ball." what's the risk? >> the cynicism is described well. he does want something to pass. what we heard over the weekend

about the details labor and business have come to they don't contradict what rubio was talking about before. we don't hear about the ancillary issues this might be poisoned pills here. what rubio is doing is getting in line with what senate conservatives like jeff sessions said they wanted, they wanted a bill to not be built in the back room and forced upon them. that was never going to happen. this thing needs to move through committee, through judiciary. what rubio is saying is you can trust me on any of the details so far, not specific what you were doing to kill this thing is not what rubio is doing. >> jeff flake said he is not walking away. let me play that. >> i think that we will stick together as a gang and i hope that we can pull some republicans our way. i think a number of them are

with us already. i don't want to talk about walking away, i don't intend to do that. >> pull some republicans our way, dana hospital. are they looking to recruit into this? >> you have john mccain and his two cloerngs lindsey graham and jeff flake. and there's a whole lot of other republicans, look, even if they are philosophically opposed to this deal, they realize, as the republican party's postmortem from the election shows, they have to get on board with comprehensive reform here, even rand paul is talking about getting behind some kind of comprehensive reform. it is a matter of what the nitty grit city when they work it out, a substantial problem but one they will have to work out. >> we haven't seen the exact language for the path to citizenship. let me play for you what lindsey graham had to say about that. >> as to the 11 million, they will have a pathway to citizenship but it will be earned. it will be long and it will be hard. and i think it is fair. >> i don't know, dave, if you saw this piece in politico, but

they basically said the path to citizenship is still a real problem because the requirements are so tough that really only a fraction of people will be able to become legal. what are the chances that this is all going to come out and then there's going to be a big backlash? >> the way they have structured this, again, we are all basing this on back channels and leaks and talks, senators are not commenting, apart from the guys sound day shows, it's a long enough timeline that it probably ameliorates some of the concerns people had about apple nesty in 2005 and 2006. i'm referring to the people who are very angry at lindsey graham and he called them bigots. this is alighting some of the problems they had with it. they are going to they were out but nothing like the 1986 amnesty. if that is the gold standard for what makes people panic and walk away, we are not going to get that. >> i want to bring in congressman steve israel exdemocrat from new york and chairman of the democratic national campaign committee. good to see you, congressman. good morning. >> morning. >> you heard dana talk about

this there is a house bipartisan group. what are the chance it is passes the house? >> i hope it does pass n senate, sounds like they are dotting some is and cross ts and house republicans have to decide if they will cross their base, cross their tea party extremist base. in the senate, you are going to have republicans and democrats, conservatives and progressive agree on something, the chamber and senate agree on something. only house republican does stop it now. >> will they? what's your gut? >> so far, not shown ability to compromise. they are inflexible. they are chaotic, put politics ahead of solution f they continue down that route, then i'm less optimistic. they have to make a fundamental decision. do they want to be problem solvers or be part of the problem on this and other issues? >> the perception that mark yo rubio is emerging leader of the party? >> if rubio and others if they block it i hope they don't that they continue to make decisions that politics is more important than solutions.

you know, look, the republicans after this election, i would have thought the photograph wore have broke. they did autopsies, he did postmore tells. we realize that americans think we are inflexible and intolerant. we have to go through this extreme makeover. what happens after that extreme makeover? you have don young using the worst kind of vilification against latinos. you have a congressman from pennsylvania today saying that he will oppose any compromise on immigration. they are who they are. they have got to decide do they want to solve problems or continue to be the voice in the face of extremism, intolerance and inflexibility in this country. >> i'm get agency sense i'm having a preview what we are going to hear there is another election that based on the conversations already, seems to be just around the corner. you folks at the dccc are already on lines, 17 house republicans you are targeting. why and how many of these do you think are truly winnable? >> we need 17 seats to take the house back and elect a congress of problem solvers versus partisans. >> are these the 17 you think are most vulnerable? >> no, about 50 to 60 seats in

play. and 2014 will be a referendum on the republican congress. have they solved problems? have they compromised? have they met in the middle? >> we are holding republicans accountable in districts throughout the country to the standards. if they are problem solvers, thank god f they continue to choose inflexibility, chaos and destructive politics, we are going to hold them responsible with the kind of aggressive advertising we hold today. >> are you going to have the money to do that? >> yeah. we have been outraising the republican congressional committee every quarter consistently and our grassroots base is fired up, big time. >> sounds like immigration, certainly in some of his district suss going to be important what about guns? will you target them on guns? it does feel, to some extent, in spite of what the president said very emotionally last week that the momentum, some of the momentum was lost. >> and if that's true, it would be tragic. we keep seeing these tragedies, like in connecticut, saying they are teachable moments and we very quickly forget the lesson

wes thought we had learned until the next tragedy, we can't afford another tragedy. members of congress are paid to vote we expect speaker boehner to allow us to vote on every element of gun violence prevention. people can vote for it. you can vote against it. earn your salary and give us a vote and don't hide behind the speaker of the house. let's get it all out on the floor. let my colleagues vote and let their constituents know where they stand on these issues. >> in the 50 to 60 house seats that you think are potentially in play, how many of those might turn on an issue like guns? >> you know, i don't think that a district turns on any specific issue. it turns on the aggregate of issues. do i have a problem of congress following comp prom says no do i have a member of congress who is willing to get it done? do i have a member of congress following move the country forward rather than the right or left? when you have a member to in congress like one in pennsylvania today, at a time when john mccain and jeff flake are agreeing with chuck schumer and labor on immigration and says, no i will not allow this

to go forward, that shows that you're out of touch with the people in your district, you're not willing to move this country forward based on solutions, you want the old politics and partisanship of the past that's not working. >> congressman steve israel, always good to have you. >> thanks, chris. senator lindsey graham said he won't filibuster gun legislation. let me play that. >> well, i like to have an open process. the only way i would filibuster a bill was if senator reid did not allow alternative amendments. >> but at least five others are considering it. over the weekend, jeff flake said background checks go too far. dana, you wrote a piece today that they just waited too long. are we talking about congress here? is it too late? >> well, i hope i'm wrong about that but it does sort of have that feeling it's too late. and it's a bipartisan problem. you have democrats hesitant on this issue, just saw the congressman, asking about guns and he was pif volting it back

to immigration. they are still gun shy on this. harry reid basically acknowledged reality and took assault gun ban off the table. now, republicans feel they can even defeat background checks supported by 90% of the public. not a proud moment but the long they are goes on, the less likely we will get anything of substance. >> fair criticism, conkman, especially given what harry reid did? >> i as one member of congress, i would vote for universal background checks. i would vote for cap pays the on magazines. i would vote for an assault weapons ban, but give me the right to vote on those things. i think that standard is a fair standard for all members of congress, for senators and house members and a standard that all americans want to see. >> dave, let me ask you about the "new york times'" piece on harry reid, very interesting n 2010, there was this picture, a lot of people remember it, there he was standing next to wayne lapierre at a shooting range but the nra did not endorse him and now he is trying to get votes

for whatever legislation he can cobble together on guns, minus the assault weapons ban. how do you twist the arms of the senators, especially the ones we know are vulnerable democrats. >> the polls matter and on the question -- >> do they? do you think they really do? >> it's hard to make an issue a priority issue where voters are going to reject you because you went the wrong way or because you blocked this. i think that's the new element that mike bloomberg has introduced in the last six months. there wasn't previously a giant wad of cash that would fall on top of your head if you voted the wrong way on guns, from his per spec at this time. i think on the questioning of timing, dana was bringing are up, i'm into the sure you could ram something through the beginning of january before inauguration there is a political backlash when you are seen to be using a crisis. even though what they do is use crises. the way this was played out to give democrats maximum amount of time and republicans who might be amenable, the maximum amount of time to work this out, i'm

not saying the white house sin fallible, but that might have been the only option. the grim and true thing about guns is it -- given the recent history in this country, if we were -- not only going to talk about guns when there is a mass killing, it would be great if newtown was the last mass killing for a while, that hasn't been the case there have been hundreds of shootings since then or hundreds of people killed by guns since then. so we will probably get another opportunity to talk about this. the poll tricks not as easy as wayne lapierre resent setting his message. >> congressman steve israel, thanks. a massive manhunt in texas for the kill here gunned down the kauffman county district attorney and his wife. mike and cynthia mcclelland were found dead in their home on saturday two months aft of his assistant prosecutors are also murdered. police are already checking on a link between that killing and the death to of a colorado prison chief and threats from a white supremacist group. so far, they say there is no solid connection.

the united states is flexing its military might as tensions escalate with north korea. f-22 stealth fighter jets have been deployed to take part in the annual war games with south korea joining b-52 bombers and b-52 stealth bombers dispatched last week. kim jung-un has been making threats to the u.s., something officials here have been taken seriously. >> not an empty threat. i wouldn't be concerned about them hitting a u.s. mainland or any u.s. territory. the real threat is to what north korea might be boxing itself into. kim jung-un is trying to establish himself. he is trying to be the tough guy. he is 28, 29 years old.

and he keeps going further around further out. i don't know if he can get himself back in. my concern would be he may feel to save fair, he has to launch an attack on south korea or base in the pacific. >> bring in form her new mexico governor and former ambassador to the u.n., bill richardson. good to see you, governor. good morning. >> thank you, chris. >> let me get your reaction to what you just heard from congressman king, i know you visited north korea just last year. how concerned are you that kim jung-un could back himself into a corner and might launch a strike just to save face? >> well, i am concerned. he backs himself into a corner he is trying to appeal to two audience, one is the north korean people, second slit north core ryan military. he never served in the military. he is 30 years old. he is somebody that is still trying to position himself as the real leader of the country. what i see, however, chris over the weekend is a lot of what the

north koreans is doing is part of their game plan, bluster, threat threats no action yet, good news. that is the only good news i see. it is still a tinderbox there and i think the administration was right to send the message of the b-2 stealth bombers. tough let them know we are around and even if they consider these retore rickal flourishes as not action, nonetheless, they are really increasing tensions in the peninsula. government the last three morning, they have launched long-range rockets, withdrew from the korean armistice, conducted that underground nuclear test and they also responded with a propaganda video showing missiles shooting the b-52 out of the sky. they are certainly not without rhetorical flourishes, the spokesperson said to totally cut the wind pipes and show them

what real war is like. i mean, it's the kind of stuff, governor, sounds like crazy talk but does beg the question how unstable is kim jung-un? >> there's uncertainty who is pulling you the strings. my worry is the hard line elements of the socialist workers party of the north korean military, which really runs the show, are pulling his strings and he is kind of -- he is kind of on the sidelines. the worry i also have over the weekend, the korean workers party, north korean workers party, basically said they are going to continue on a track of, one, improving their economy, which is going to be very hard to do with their system but ting their nuclear weapons development. that is worrisome. we have had a posture, republicans and democrats, to try to cool them down in that area, that's not good news. on the other hand, you see signs

that, for instance, the kay song industrial facility, a joint north korea/south korea prayer, employed 54,000 north koreans has not closed down, despite threats by the north koreans. >> how sigg -- [ overlapping speakers ] that factory, one of the key things that would be an indicator? >> yes, i think that is an indicator. the north koreans have said we are going to shut it down. but it's 54,000 jobs for them. it is hard currency for them that would really be a tough economic decision for them. they haven't shut it down. they have threatened it my hope is that things cool down after this north korean workers party congress and maybe the two sides, north and south korea, get into some kind of a dialogue. that's my hope.

any minute now, we are expecting the president and first lady to come out and officially kick off the easter egg roll. we will have that for you when it happens. the meantime, let's talk about a former first lady, hillary clinton, running or not? we have seen lots of hockeying for position on the republican side but it seems democrats are holding off until she makes her choice. while they wait, hillary clinton is returning to the speaking circuit two big events this week, new york, washington. but reports are her first paid speech will be april 24th at the national multihousing council in dallas. let me bring in amy holmes, anchor of "real news" at the blaze and danielle from the center for american progress. good morning to see both of you. >> good morning. >> "the new york times" reports that hillary clinton has a small staff, a half a dozen people running her transition office, not really a problem to pay them out of her pocket, considering the clintons have assets of something like $14 million

writing another book about her time at the state department, she makes some money with that, with her speeches but danielle, how calculated does she have to be about the speeches and the projects she's choosing, just in case she decides to run? >> well, i think even if she wasn't going to run for president, she would still be calculating and choosing the right projects that make sense for her. and you know, i know that we are very -- we love talking about 2016 here but i think she does have some time to take a rest and figure out what it is exactly what she wants to do >> i was semijoking earlier, amy, the surerest sign she was going to runs, the clintons were denying they are buying a multimillion dollar house in the hamptons. the serious side there are three super panks for hillary, even though she is not endorszing them, one anti-.. if she does decide to run, can anybody match her financially? >> never too soon to start raising money for a big billion dollar project like running for president of the united states, as we saw in this last leeks

cycle. i think there is a problem with her trying to create this inhe have vitt tabbili-- inevitabili. not necessarily put out narrative just yet that 2016 is on the horizon, we are only in 2013, i thought i would feel better rested. >> talk about inevitability, anybody raise the kind of money she could? >> who knew that senator obama at the time would come out and such a powerhouse. >> break all records. >> vice president joe biden certainly made noises about the possibility of running for president in 2016. does he have the same sort of money advantage? perhaps if he plugged into president obama's own fund-raising machine, but that's for democrats i think to sort out. >> none of the other potential democratic candidates has anything like this. not joe biden yet. not andrew cuomo. not martin o'malley. do they all have to wait for hillary clinton to make a decision?

>> i think they do have to wait, but i also agree with amy that i think it's possible for other candidates besides hillary clinton to raise a lot of money. like you said, nobody expected then-senator obama to raise that much and we just don't know exit is so early, you don't know what is going to happen in a year. anything is possible. >> at cpac, citizens united, was sure to remind everyone how they could attack her if she ran, playing this. >> she is steeped in controversy, steeped in sleaze. that's why they don't want us to look at her record. >> i think it's worth remembering, after her health care fiasco, the clinton team pushed her aside. >> certainly you have to ask whether or not she has learned a lot from that experience. >> i mean, amy i certainly they are saying, look, there's no lack of material to go after the hillary clinton. having said that, hard to find anyone to criticize her tenure at the state department or for that matter, even in the senate.

she gained a lot of respect even on the republican side. some of this decades old stuff, bringing out the health care issue after, frankly, it's now the law of the land, are they going to have to do better than that? >> i think decades old scandals are old news. the clintons, as we know exsort of the teflon dons of scandal. however, in her tenure as secretary of state, she got tremendous criticism, in fact, over her handling or non-handling of benghazi, i this thank you is completely relevant to whether or not she would be an effective or competent commander in chief. but as i say, we know the clintons have been very good at being able to sort of outrun these scan dams that are always seeming to be nipping at their heels and hillary clinton did leave the secretary of state with extraordinarily high approval ratings. she is one of the most popular politicians in america. >> speaking of heels, could benghazi, you think, daniella, be her achilles' heel? >> you know, i don't know. i don't think so i think the

fact that you saw this ad where they are pulling you stuff from decades ago and i don't know they talk about benghazi in this ad, just shows that they are really scared of hillary clinton. they are scared of what her campaign can mean for the republican side of the ticket e so you know, remains to be seen what will happen. i think that they are definitely frightened of what a hillary clinton ticket can mean. >> dan gel la begins leger are thanks for being on the program. next hour, accused movie theater killer james holmes will find out if prosecutors will seek the death penalty. holmes has offered to plead guilty to avoid execution but prosecute rears jekt it had last week. the 24-year-old is accused of opening fire during a midnight screening of the dark night rises last july. 12 people were killed, 70 others were hurt. officials blame the fog for a massive 95-car pileup along interstate 77 in southwest virginia. three people were killed. 25 others were hurt. police say 17 separate crashes happened within just a one-mile

span. california police meantime trying to figure out why a man intentionally plowed his car into a san jose walmart, then began attacking shoppers. he is now under arrest but not before he drove the car 10 to 20 feet into the store sunday morning. four people were hurt, one of them seriously. it has been ten years since u.s. special forces staged a brazen rescue of p.o.w. jessica lynch. iraqi insurgents captured jessica during a firefight where 11 members of her company were killed. she has had 21 surgeries stemming from her injuries. this morning on "today," jessica talked about the lessons she's learned. >> every day i wake up, you know, i have that never give up attitude, you know? as much as, you know, i have the ups and down days, it doesn't matter, as long as you keep it in your mind that you can do anything, you can conquer it.

a new study on the highly competitive college admissions process may change the way schools do their recruiting. the "new york times" reports that when detailed information packets about college admission standard and financial aid policies were sent to high-achieving low-income students, 54% of them were admitted to colleges, matching their academic qualifications. but if they didn't get the packets, just 30% got into those highly selective schools. "new york times" washington bureau chief dave leon hart wrote about this eye-opening study and joins me now. absolutely fascinating, dave. good to see you. >> thank you, good morning. >> so you write that a lot of these selective colleges have done well, actually, diversifying the student body ethnically, religiously, geographically, not so much socioeconomically. is there a sense this new study will change that? >> i think it's hard to know at this point. i think the thing that could really change this is a ruling at the supreme court. if the supreme court somehow restricts affirmative action and schools want to continue to have
