hi, everyone. the "news nation" is following the second murder of a texas prosecutor in just three months. today, texas governor rick perry warned, quote, everyone should be careful. as investigators remain tight-lipped about a possible plot to kill others. right now, security is stepped up at the county courthouse where both those prosecutors worked. officers are escorting employees into the building. local, state and federal officials are investigating the weekend killings of d.a. mike mclelland and his wife cynthia.

he was shot multiple times. she was shot once with an assault rifle inside their texas home. investigators stay murders were not random but have few other answers. >> we're on alert. we take it very seriously. we're still in shock. i guess it is the best way to describe our feelings about this latest incident. >> these deaths come after texas investigators issued an ominous warning about the arian brotherhood of texas. late last year this happened. just two months ago, someone killed mclelland's top assistant as he walked into the courtroom. at the time, mclelland who was gunned down this weekend issued a warning for those responsible. >> i hope that the people that did this are watching because

we're very confident that we're going to find you, we're going to pull you out of whatever hole you're in, we're going to bring you back and let the people of kaufman county prosecute you to the fullest extent of the law. >> nbc's gabe gutierrez is live for us in kaufman, texas. as you can manning, so stirring to watch the words of the district attorney there, knowing that he and his wife were ground down in their home even though he was warning people to be on alert. >> reporter: yeah, that's right. many people here in kaufman county can't believe it. as you mentioned, security has been stepped up here at the kaufman county courthouse throughout the morning. we've seen armed guards escort some of the county employees into the building. now, the d.a.'s office is also closed to the public. governor perry spoke out today. local officials have asked him to replace the d.a., which he must do under state law and he says he will do that as soon as

possible. this is the 13th u.s. prosecutor that has been killed since the national association of district attorneys began keeping count back in the 1960s. the big questions now are about the investigation. authorities here are still very tight-lipped. not releasing hardly any information about it. all we know is that mike mclelland and his wife cynthia were found dead at their home saturday. the motive is still a mystery. there is a question about whether it could have been connected to that other murder two months ago of his assistant prosecutor. again, authorities have not confirmed any link between the two. and there is also some discussion about whether this could be connected to the murder of a colorado prison chief. again, federal authorities are saying that there is no solid connection at this point. back to you. >> more on what governor perry will to say in his statement. he said i would suggest everyone be careful about what's goes on, whether they're a public official or otherwise.

he did go on to say there is a clear concern for individuals in public life, particularly those who deal with some very mean and vicious individuals. that's the latest statement from governor perry, gabe. >> reporter: yeah. governor perry is echoing what many local officials are feeling at this point. even in harris county, texas, near houston. an arm guard escorted that district attorney into the county courthouse today. so there is a feeling that is very tense, not just here in kaufman county but here in texas because no motive has been established. they're wondering what will happen next and where this investigation will take the authorities. >> let me bring in investigative crime reporter michelle and tanya from the dallas morning news. tan, i can't let me start first with back in december, officials in texas had a warning about white supremists and she said high members are involved in issuing orders to inflict mass cattle or death to laufls who

were involved in case where arian brotherhood of texas or the death penalty. this is back in december. the authorities have not connected the dots. as you and i both know, the authorities are looking at any possible link with this aryan authorities of texas. >> authorities have interviewed dozens of the brotherhood across the state. i know the u.s. marshals were involved in that effort. to date they have not been able to make any definitive links to the killing or this latest incident but it is certainly a concern. certainly it is something authorities are at. >> what can you tell me about the district attorney? i know that at least as far as his security was concerned, he was concerned even when he walked the dog. did peng at least there was some type of threat directed at him? what can you tell us? >> i don't know of any specific threats that have been directed at him.

i know that in the weeks after mark haas's killing, the head of security on mike mclelland. my understanding was that was not the case currently. and you're right. he was known to be armed and from my understanding, from my sources, he was actually, they think that he may have been trying to reach a weapon when he was killed. >> michelle, let me bring you in. gabe gutierrez mentioned at the end of his report that authorities are looking at any possible connections between the killing of tom clements, the colorado corrections chief. that happened march 19th. we know that the suspect involved in his death ended up in a gun battle in of all places, texas here. this obviously again, brings people to the point of whether or not these are connected. what can you tell us? i know you're great at digging around and getting details. >> i've been in touch with all the investigative agencies including the fbi, the texas department of public safety and also the kaufman sheriff's department. this in texas is a three-prong

investigation, a joint investigation. and they're not ruling anything out. they are looking into that. they are looking into the death back in january and they are looking at how this person entered into the district attorney's home over the week. on saturday evening. exactly what happened and where his gun was and why he wasn't able to fend this person off. and a lot of other details leading up to it, including combing through all the of his case files. figuring out if there are any connections there. was at this time direct threat that he came out to say that he is there and that he, there person is going to be prosecuted? or is there a case connection? there is a lot of work that needs to be done. >> the individual killed by the police in north texas who had the suspect in clements' murder, he was in a white supremist group. do we know if that was tied to

the aryan brotherhood of texas? >> we'll keep you posted. >> what do you know regarding any possible connection or at least what authorities are at as a possible connection? >> my sources think it is pretty unlike reply the murder in colorado is related to what has happened here if kaufman county. certainly, the suspect in that case was killed in wise county. he was a member of the 211 gang which to my knowledge, i don't know of any links to the aryan brotherhood of texas. if you look at the killing of mark haas and the killing of mike mclellan, there are a couple of differences. mike was killed publicly. he was from a parking lot to the courthouse. he was killed with a handgun. in the case of mike mclelland, they were killed late at night. he was killed with an assault weapon.

and mrs. mclelland was killed near the front door. they think she answered the door. he was found toward the rear of the house. and like i said, one of my sources said it looked like he was trying to run toward the back of the house. but my sources do believe that mark's death is that mike mclelland's death are related. how often have you ever heard -- >> what are the odds? we're talking about a small town in new york city, this would draw a lot of attention. they have hundreds if not prosecutors for the state and for the city. back to this letter in december that officials, or this on noticed that officials put out in december saying high ranking members of a white supremist group were involved in issuing this order of mass casualties or death. to tanya's point, we don't know what the overlap is if any but this naturally draws your eye to concern and i would manning the attention of the authorities to the aryan brotherhood of texas.

>> you are 100% correct. i just received an e-mail back from the department public of safety. they don't want to go back to that statement. i understand this is an ongoing sensitive investigation. to have that happen in december, to have mark's death happen at the end of january, and then to have this happen on easter weekend at the end of march. literally two months later, there is a time line that is building. there are connections that are made. whether they were the same gun or different guns, to have two prosecutors, a district attorney and then also the assistant from the same place murdered. this is once in a lifetime. >> michelle, tanya, thank you. i appreciate you both giving us these details. coming up, an update on louisville guard kevin ware's condition after literally snapping his leg while trying to make it to the final four. the team made it. now ware said he wants to return to be with his team.

. kevin ware is now recovering from successful surgery on his broken leg. there is a new picture of him released just an hour ago. he is now on crutches after a procedure late last night that lasted two hours. doctors reset ware's bone and placed a rod in his right tibia where he is expected to stay in

the hospital until at least tomorrow. experts don't believe the injury will end his playing career. ware suffered a horrible injury. as you probably know by now during sunday's ncaa midwest regional final. the injury was so gruesome, it left his teammates and coaches in tears. before he was taken off the court, he will his teammates to just win the game which they did, beating duke 85-63, advancing to the final four. after the game, his teammates visited him at the hospital and brought along the regional championship trophy. joining me for more on his condition, the sports reporter dan wilkin who was at the game. thank you for joining me. >> thank you. >> so good news, he is on crutches, he could be out of the hospital by tomorrow. going back to the reaction. the people in that arena, tell me a little of what you saw and when people really, i guess, the impact of what had happened hit them. >> well, i just saw a regular basketball play. he was going out to contest the three-point shooter.

the shot went in. and then there was just immediately chaos around the louisville bench. you saw guys on the floor all over the place. i looked up and saw russ smith in tears. you kind of got a send that kevin ware was hurt but then you looked at his leg and you saw the bone in the wrong place. you knew that this was going to be a serious problem for him and you didn't know exactly how the game was going to go on. the entire energy in that arena had totally been sucked out. >> it is interesting. joe theismann sent out a tweet. he said watching, my heart goes out to kevin ware. everyone's point of reference with these things happening, they don't happen often. i remember with him, he said he wasn't able to way. because of the intensity. cbs made the decision not to allow this video to be looped over and over again. it is absolutely horrific. >> i think that was probably the right call. to see it live was a very tough thing.

what i remember more is the reaction of his teammates. i've never seen something go from normal to completely chaotic so quickly. it happened right in front of their bench it was. sort of a gutteral reaction that was touching on some level but was also very frightening. i don't think anyone knew how bad it was right away. >> and his coach even said, outside of the loss of his own baby, the death of his brother-in-law on 9/11, this was the third worst thing that happened that he's had to deal. with that's incredible. >> rick petino has done there for 30 years. but there is no way to prepare your team or get them ready to go play a game of such importance after something so or ichk had happened right in front of them. so i think this was new territory for everybody. could you tell the last six minutes of that half. everybody was ready to get to the locker room and reset their minds.

b-2 stealth bombers to flight over south korea last week. >> this pattern of bellicose rhetoric is not new. it is familiar. we take it very seriously. we take prudent measures in response to it but it is consistent with past behavior. >> jim maceda joins us from south korea. there is still so little known about kim jong un that no one can say what his actions will be. >> reporter: that's right. forgive me for this, it is extremely quiet here in seoul. you're right. this crisis could now despite all the images we just saw, it could turn out to be more sabre rattling. the sources that we're talking to here are saying that the risk of conflict between the two

koreas has already crested. that said, the supreme leader has already lined up his ducks. north korea's missiles and artillery are combat ready. they're pointing at south korean and u.s. targets now. both sides are saying they'll strike hard, even if there is the slightest provocation. kim jong un has even threatened nuclear strikes on south korea and u.s. targets. that's really unprecedented. though few experts believe that he has that kind of capability. so on the surface, life seems pretty normal here only 30 miles away from the dmz in seoul. people are working. there is no chaos in the streets. hotels and restaurants are full. but that apparently, we're told masks a more general anxiety among south koreans that in this very tense atmosphere, even a minor foul-up. an incident, an accident could trigger a conflict.

or then again it might not, we just don't know. this is a very unpredictable peninsula and a very tense time. we do know that south koreans tend to see him as a boy who cries wolf, if you will. they live through these situations before. belligerent threats, what have you. usually, especially i should say during the joint u.s./south korean war games, and i've just heard that more u.s. ships are on the way toward this area. and they have seen time after time, the rhetoric then being dialed back. so we don't feel the tension so much here. you feel it much more as you approach the dmz. it is a situation where anything could happen today, tomorrow or the necks day. it is that tense. >> thank you very much for the latest there. and back to domestic politics. of course, that reaches far beyond our bored he. senator marco rubio throwing cold water, if you will, on the notion that fellow lawmakers are

on the verge of striking a deal on immigration reform. a major item, as you well know, on the president's second term agenda on. news that labor leaders and business groups have come to an agreement on the guesswork he part of the package, rubio release ad statement through his office that was blunt and to the point with the headline, no final agreement on immigration legislation yet. rubio's statement comes just as other members of the so-called gang of eight, the bipartisan group negotiating a bill are declaring that a deal is at hand. >> with the agreement between business and labor, every major policy issue has been resolved on the gang of eight. i am very, very optimistic that we will have an agreement among the eight of us next week. >> joining me now, nbc latino contributor and usa analyst, and political senior, political report he lois romano. thank you for joining us. lois, let me start with you. colleagues at the "washington post," chris cillizza and shawn

sullivan had this in their article. the statement regarding marco rubio was a deliberate attempt by rubio to slow down the momentum toward a deal on immigration. what rubio was doing in releasing his statement then was ensuring that schumer, that it is all over. but the shouting declaration. they are watching every move the florida republican makes. basically in a nut shell, this article says that the tea party and some of the other conservative who's helped make marco rubio are certainly standing by, willing to break him if they don't like this deal. >> reporter: i think that's fairly accurate. they're doing two different things here. what schumer is doing is he is trying to create positive momentum and that's not all bad. he's trying toy is a we've worked this out and we can move it forward. but the key thing he said is the eight of us. that is only eight people in a room agreeing to all this. what rubio is saying, chill out, everybody. maybe we're going to have an

agreement but then i have to sell it to all these conservatives. not to mention the house which doesn't have an agreement yet. >> and it is interesting. this guest worker program has been the sticking point when immigration reform was brought up in the past. now you have business groups and labor unions if you will, working together. by having the workers in the system. if these groups are involved and we know many times the force is lobbying behind the scenes, why would marco rubio come out and throw up this, or throw out the cold water. >> i think what's going on. i liken the ongoing negotiations on immigration reform. it is like that game janga. it is very nuanced. if anyone pushes too hard, the whole thing will collapse. i do agree with the article you cited. if this is starting to seem like a democratic victory, or that schumer is out in front, it is trouble for marco rubio when he

goes to sell it. all these negotiations that are going on right now as you mentioned, they're behind closed doors. once it is out of the public view, we'll start a whole tug-of-war all over again. that's where it will get even messier. >> it seems that part of the argument, at least public opinion and the public war, that seems to have been fought. i mean, you have conservatives. you've got liberals. everyone agreeing for the first time since i can remember significantly and having grown up in texas my whole entire life. this is the first time i've seen such an agreement on immigration reform. >> especially with regard to the business labor coalition. that's what derailed it last time. and the fact that they're even agreeing in a broad sense on the principles, that's an historic accomplishment. that derailed it before. all that is good. the public support is there, the momentum is there. we have in this party and we've had for quite some time a very vocal, a minority. but they're very vocal and especially in certain

gerrymandering districts, they can exert some pull and kill the deal in the house. so there is still that danger. it is april fools' day. no joke, i truly believe things have not, the odds have not been this good in a long time. >> lindsay graham said on cnn, he thinks they have a deal. he said we have to write the legislation but he believes there is a deal here. again, going back to marco rubio and his party of the puzzle here. is this all for show? is this all for the public? at least what we're seeing from him? >> i don't think for show at all. i think he is very strategic in what he's doing. if you talk to the senators privately, they will all tell that you rubio is the lynchpin. so when he says that, everybody kind of blinks. you can't have rubio away from this. he has to be very comfortable with the deal that he can then bring forward and sell to his colleagues. and the tea party. >> but specifically, at least the sticking point in the past has been the border security

issue. it seems some of that has been addressed, and perhaps resolved. when you have someone who is opposing any issue, the basic question is what do they want? so how would that question be answered when it come to rubio other than giving peace to the tea party members of his caucus who may never be satisfied with this deal. >> i think that he needs to make sure that the nexus between border security enforcement and path to citizenship is all very tate and all the is are dotted and the ts are crossed. the path to citizen has been a sticking point. what the conservatives want to hear, if we're going to buy into this, you'd better really be telling us that that border is going to be secure. and peter king even yesterday said, eight guys in a room telling me that the border is going to be secure doesn't make it so. i need to see what's going on. >> a part of what ramped up the rhetoric from republicans as far as supporting immigration reform

was the shellacking as some like to callett that happened in november. so the desire to have a compromise came from that. we know that, because we know the demographics of this country out west and even in the south with the latino vote will be very important. so while you have an important voice in the tea party as it relates to republicans, we know the whole reason this came to the table and the way it did from republicans was for political reasons, down the lane. >> that's correct. if you look at the rnc's autopsy report, that came out a couple weeks ago, they devote pages and pages to the fact the party has to seem more open. that's what he is saying. i believe he wants to make sure that he has a product that he can bring back to the conservatives and try to get enough support to get this through both houses. >> he wants to make sure that this party is appealing to latino voters. >> i think he is just being cautious. >> thank you very much. it is a great pleasure having

pointing going on. in a lot of ways, a very healthy debate to have that. it won't be something that will get resolved until the republicans end up having their nominee come 2016 and that person being able to win. so this is something that goes on all the time. but you are right. you have social conservatives pointing the finger at economic conservatives. economic conservatives pointing at social conservatives. military hawks saying our party isn't strong enough on defense. it is all coming out into the open. >> we've seen this before after a loss. the new factor, the new player in the game, the issue of same sex marriage. and let me play what brian brown, the president of the national organization of women said on "meet the press" as well. >> marriage is by definition is union of a man and a woman. apart from all of this inevitability talks, 31 states have voted to say that's the truthful they have embedded it in their state constitutions. only four have voted against it. there is a myth that somehow this is inevitable. >> so mark, at least from some

of the comments that i've read, it seems to me conservatives feel like they're not being respected. that somehow, they feel the party believes that it can win big races without them. and they actually feel like the red headed stepchild, to throw out a cliche or a saying there. >> you're right. in one of the arguments that you often hear is that these social conservatives will support the republican presidential candidate or candidate for any kind of office no matter what. they won't be democratic voters. you hit it to say that sometimes folks might feel that they're being taken for granted. this is a debate that's playing out. and gay marriage is really interesting. a lot of the people are saying our party needs to reform, it needs to be more progressive on this issue. a lot of the chatter you're hearing are from the consultant types. a lot of the people who are republican strategists but so far, only one republican has changed their position on gay marriage full stop. and that is ohio rob portman. and that is some pretty striking

development. >> and rick santorum won't to say the republican party is not going to change. if we do change, we will be the weak party. that used to be a joke from liberals who said if republicans did not change, they would be t the whig party. >> it has been built on three legs of one stool. you have social conservatives on the issue of abortion where you have opposition to abortion. then you have the economic conservatives, low taxes, low amounts of regulation. limited government. then you have the military hawks. very strong on defense. when with any kind of stool, you remove one of the legs and it falls down. that's the argument that rick santorum is. would a rick santorum go to vote for a democratic candidate? and that remains to be seen. >> all right. mark murray. great pleasure having you on. we'll see you tomorrow. coming up, an update on the teacher scandal that has rocked atlanta and could have ramifications far outside of

missile over the south korean region to put a satellite into orbit, the u.s. navy put four ships into that region. this time, they are only going to position one guided missile destroyer, the fitzgerald, as a precautionary measure. over the weekend it was announced the u.s. air force flew two f-22 stealth fighters, fighter bombers into the region. but those have land at the air base in south korea and part of a static display to work in conjunction with the south koreans. it is not believed that they're going to fly any training missions over south korea and they're expected to leave sometime soon. these are precautionary measures but it appears the u.s. doesn't want to go too far too fast to provoke any kind of reaction from the north kraens. >> thank you very much. right now we're waiting for 35

form he atlanta public school employees to turn themselves in after they were indicted friday in one of the nation's largest test cheating scams. the defendants have until tomorrow to surrender. they include the former superintendent beverly hall. investigators say she and 34 others conspired to erase wrong answers on standardized tests, often for money. hall was named national superintendent of the year back in 2009. the same area prosecutors say widespread cheating took place. joining me now, james marshall who has been writing about this in forbes magazine. thank you for your time. >> thank you. >> you've written extensively about this. these teachers have another 24 hours to surrender. one attorney said at least two of his clients will do so. this is incredible. this could have, as we pointed out, ramifications far beyond atlanta, georgia of the. >> absolutely. as i write about on forbes, on

my education block on forbes, once the race to the top became obama administration policy, there became a deep financial motive to cheat, basically. and this is representative of that but i think it is just the beginning. i think there needs to be federal investigation of all schools that have suddenly and miraculously within one year imapproved the test scores from like 24% to 84%. i know there are some great teachers out there but those things need to be questioned now. >> the principal hall faces charges including racketeering, false statements, theft. as you pointed out, prosecutors say there were paid bonuses she received and false paying the these scores on standardized tests. at least as far as the investigation and the information you've seen, is it clear that this only started with race to the top? or was this something believed to have been happening prior to?

>> well, the feedback i've got on the crotty on education blog, this has been going on a long time. >> it is not the race to the top was the incentive. i read that this has been part of a long ongoing investigation. not just a couple of years. >> oh, no. you're totally correct. i hope i did not give the impression that it only started when race to the top came into effect. obviously, cheating is part of culture. i mean, it just goes on amongst students, administrators, et cetera. however, the 4 point some billion has given additional incentives to principals, teachers to cleat. in the case of miss hall, this is of course an alleged allegation. she has a right to an attorney, et cetera. but allegedly she made out with

$500,000. that's a pretty big incentive for educators that don't get paid a lot. >> may not while, you have students what's scores have been changed. programs their parents believed they had done far board these exams than they did. and so in many ways, you yes, you have this investigation of the wrong dos from teachers but you have kids once again potentially harmed by the actions of some of the teachers. >> exactly. the irony is, in some cases schools that were considered at risk schools that were receiving extra funding to help improve the situation of kids with difficulties in math and english, because the scores became so great, they stopped receiving those funds. so the kids themselves in those situations were the losers. and you know, i write about this a lot. i'm very concerned. i made a documentary about the drop-out epidemic. 60% of urban black men do not finish high school. there are very effective

years. nbc's leeanne greg is live for us in colorado. some of the victims have worried by prosecutors not taking there plea deal, they'll have to relive the emotion and pain of what happened during that massacre. >> reporter: he is still awaiting the execution 19 years after the crime and it will take a lot of time to finish this case. as it were. now that it is a death penalty case. it could possibly take years. the district attorney is extremely clear this morning when he said james egan holmes for him, justice is death. that d.a. said he and his staff have talk with more than 800 family members, victim about their thoughts on pursuing it. some people thought it would take too long. one man said he wanted to still be alive when justice was served. another said, of course, this

man killed his son. he would like to see him executed. and others said they think that death is too easy for holmes. he had no visible reaction to the announcement today which comes only days after prosecutors rejected the plea deal that would have saved his life. holmes would have pled guilty and spend the rest of his life in jail avoiding the execution. some type of plea agreement is still an option but probably not likely when you consider the words from the d.a. earlier today. the trial date originally had been set for august. that has been moved to february. prosecutors wanted it to be in january. the defense attorneys said they didn't want to start until next fall. so he compromised right now, the first week in february. more than a year after after the crime. the trial is set to begin. >> thank you very much for the live report. that brings us to today's gut check question. should prosecutors have accepted the plea deal that would have
