the investigation and at least two of them are expected to be in court in about 90 minutes from now. the three new suspects went to school with the surviving bombing suspect, dzhokhar tsarnaev. let me bring in michael isikoff. he is standing by with the latest out of boston. michael, as i mentioned, we might see some movement in the court at about 90 minutes from now. >> exactly. we're expecting an initial court appearance and the unsealing of a criminal complaint against these three individuals. now we should make clear, that from what we've been told, these are not charged that these three individuals were involved in the bombing it self. what this relates to is destroying or failing to turn over evidence after the fact, during the fbi investigation post bombing and then possibly lying to the fbi about what they have done after it. two of these individuals are student from kazakhstan who were

friends of dzhokhar tsarnaev, classmates of his, not roommates though, we're told, by a friend. and hey, they had been detained by many gracing authorities as early as april 23, afthe bombing, detained on immigration charged and had been held in a county jail until today. today an additional arrest was made and now all three are going to be presented in court in just an hour, an hour and a half or so. >> all right, michael, thank you. help me bring us nbc correspondent pete williams. he is live in washington with more information on these charges. pete, what can you tell me? >> we now have criminal charges filed against these two and a third. they are all charged with conspiracy to obstruct justice. according to the court documents, they are charged with knowingly destroying, concealing and covering up a laptop computer and the backpack containing fireworks. according to the fbi, the

government searched dzhokhar tsarnaev's dorm room at u-mass campus but to days before the search, two of these men removed items from the dorm room. they took tsarnaev's backpack and admitted later they got rid of it after they concluded on their own that tsarnaev was one of the boston marathon bombers. they say that they saw the pictures that the fbi made public on that thursday night and they thought that perhaps tsarnaev might have been one of the people involved in the bombing. so they say, on april 18th, around 6 or 7 in the evening, these three people, and the third person is identified in these court documents as

robel philipos. they went to the dorm, tsarnaev's roommate let them in, saying that tsarnaev left a couple hours earlier. the three watched a movie. they noticed he had a backpack containing fireworks. that fireworks had been open and emptied of powder. one of them said that when he saw the empty fireworks, he realized that tsarnaev must have been involved in the bombing. so they decided to remove the backpack from the room in order to help tsarnaev avoid trouble and they decided to take the laptop as well because they didn't want tsarnaev's roommate to think that he was behaving suspiciously by just taking the backpack. so that's what i've seen so far, just looking at this. give me a few more minutes and i'll be back to you. >> thank you very much. there are obviously many questions left. let me bring if michael isikoff. michael, i'm not sure if you were able to hear pete williams. he is looking through the charges and it appears, at least

according to the document, he is reading that police allege that these individuals removed these items, backpack, laptop. we know authorities have been looking for dzhokhar tsarnaev's backpack in a landfill not far from there. individuals suspected he might be involved. rather than take the documents or this information to authorities according to this complaint, they removed them to protect him somehow. this obviously warrants a ton of questions about why they would do that rather than take that to police. >> absolutely. and it's clearly the kind of evidence and information that the fbi would take extremely seriously. i go back to, we've been talking all morning and afternoon about that massive fbi search for evidence in the new bedford area. searching through garbage

dumpsters and that landfill in new bedford for that laptop, for the fbi to have discovered that these students removed it from his room and were trying to protect him. obviously, raises a whole host of questions, but in addition, think of all the massive allocation of resources that went into finding that evidence that these guys allegedly were concealing. so i think -- and obviously, the question is motive. is this a friendship or something more? >> absolutely. that is a natural question. i don't think it is one that adds for speculation. that would be a question any investigator would ask here. motivation for taking that -- those dock the or that laptop with the backpack if that is accurate and true and not turning it over to the authorities. many people have asked over and over, if this plot, if this plan ended with those two brothers or if others were involved. >> and when you get a set of

circumstances like that, it obviously raises the questions, how straight these guys are being with investigators and did they have something to hide. again, we have no evidence at this point that they were involved in the plot. we should emphasize that. but i think clearly there's a highly suspicious chain of events that are being alleged here in this criminal complaint. >> let me give you a hang-on, michael, and go back to pete. pete, i understand have you new details for me. >> here is what they say. after that went to the dorm room, reading a little further into the complaint now, after going into the dorm room, and taking the backpack and laptop, they took it back to their apartment in new bedford. they decided, according to the fbi, decided collectively to throw the backpack and the fireworks into the trash because, quote, they did not want tsarnaev to get into trouble. so they put the backpack and the fireworks along with other trash from their apartment into a big

black trash bag and through it into a dumpster near their apartment at about 10:00 at night. and in subs kwequent questionin they denied doing it, then later admitted to doing it. >> do you know what led police to these individuals? they were not dzhokhar tsarnaev's roommates. they were friends, as i understand it. do you know why police found them in the first place to talk to them? >> i haven't seen that yet. i'm sure the answer is here, but i haven't gotten to that yet. >> let's go back it to michael isikoff. michael, we are learning that the car jacked victim, when the two brothers took his suv and it eventually ended in that shootout with authorities in watertown, he is now telling more for the first time about what happened to him that night. and he at least got a read, if you will, or an opinion on the interaction between dzhokhar and

tamerlan tsarnaev. let me play what he said regarding the relationship he observed between the two brothers. >> i think dzhokhar is like fuller. >> why do you say that? >> because dzhokhar went out to the atm. he went out to get the gas. tamerlan never got out of the car. >> in talking to a number of legal analyst say this could play some kind of role in whether or not dzhokhar was influenced or following his brother and that he wasn't, if you will, all in even though his actions certainly, according to authorities, what they've seen on tape, would be described as all in on this plot. and the subsequent bombing, michael. >> reporter: right. from all indications, tamerlan is the key player here. even if you take danny's account as told to matt lauer yesterday,

and i was present for theant view, it is tacker l tamerlan w gets in the car first, wields the gun, says, have you heard of the boston marathon bombing. i did that. and i killed a police officer in cambridge. that of course is mit police sean collier. so tamerlan, by every account, is the key player here, the shooter of collier, according to danny's account, and even presented himself as the bomber. now of course we know that dzhokhar is charged with assisting his brother in the bombing and planting one of the bombs. so he is hardly off the hook here. but i suspect that eventually we could well see the defense that he was being manipulated by his older brother. >> do we still have pete with us standing by? >> yes. >> pete, listen -- what can you tell me here -- i don't think we have pete any more. let me go back to michael

isikoff. we have this photograph of dzhokhar tsarnaev when he was in time square and at least one of these individuals who has been charged was with dzhokhar in time square as well in this photograph, michael. >> reporter: right. and it is interesting that the information authorities have from dzhokhar is that they return to new york, to time square that night, the night of the carjacking and shootout in watertown. now, again, we are far from clear on how well developed their plans were for that night. in fact, every indication is it they were pretty much making it up as they went along. taking danny on this harrowing wild ride, 90 minutes through the streets of boston. it seems to make no sense from cambridge to watertown, back to cambridge and back to watertown. there doesn't seem to have been a well developed plan for the events of that evening.

>> okay. michael isikoff, thank you very much. thanks to pete again. again, at the top of the hour, 3:00 eastern time, at least two of the individuals expected in court and we may have more information on the complaints filed against them. "news nation" also following the continued political backlash. some senators who voted no on the expanded background checks are facing from their own own constituent. two town halls in her home state, senator k keltikangas-jarvinenkesenator k ayotte was confronted. >> you had mentioned that day, owners of gun stores, that the extended background checks would pass. i'm just wondering why the burden of my mother being gunned down in the hall of her elementary school isn't as important as that.

why is that not something that can be supported? >> erica, i'm certainly let me just say, that i'm obviously so sorry, as everyone here, no matter what our views are, for what you have been through. and i think that ultimately when we look at what happened in sandy hook, i understand that's what drove this whole discussion, all of us want to make sure that that doesn't happen again. one poll shows senator ayotte's approval has gone down 15% since her no-vote. joining me now michael smerconish. msnbc political analyst and boom blurring columnist, thank you all for joining us. michael, the town happen halls,

the tea party fought viciously what they called obama care. we heard those people, get your hand off my medicare. they were fired up and town halls captured our attention over the summer. might we see the same thing in the town halls if more of this is repeated when it comes to guns? >> that's a great comparison. and the net effect of what happened and what you saw, the passion in those town halls, is that it resulted in a big swing in the mid term election in 2010. the question is, whether the passion is going to continue through the next election because the raw votes are no question in support of universal background checks. but in primary season, tam tamron, the hard core come out to vote. and at least until now, they've been pro second amendment. >> let me play more of what senator ayotte said. and i want your thoughts on it, jonathan. this is responding more to erica laugherty saying she got backlash from the gop as well. let's listen. >> i took a lot of heat, i will

say, from even members of my own party that didn't like the fact that i voted to actually go to debate on this issue. because i do -- we can have strong disagreements but ultimately everything should always be debated and discussed. >> debated and discussed but it doesn't seem jonathan that senator ayotte offered an idea. what would be her solution to try and prevent another sandy hook, another aurora? what should we do? >> what she said at that town meeting is that there should be new mental health programs. that the default position now when people want to avoid background checks. of course we need both. we need bolstered mental health programs and we need common sense background checks which bears repeating. we're supported by the nra until recently. so this is not radical gun control that we're talking about. it is common sense measures. as michael indicated, the

politics are changing on it really fast. so it's not only senator ayotte. it is senator jeff flake. >> we've got numbers. let me show you jeff flake. approval rating is 32%. that's down 19% since october. rob portman down 18 point since october as well, jonathan. >> that's arizona. classic pro gun state. their senator, very popular there, is just tanking. ohio, a bell weather state as we know. if these numbers hold up over time, and i hate it say this, one of the ways the passion might stay in thissish sue if god for bid, there's another shooting. at that point everything gets inflamed again. the one thing we know is that these things happen a lot in america. so there might be fresh fuel for this and the most fascinating dimension of this to me is that

those who lost family members in newtown are joining the political debate. they're not sitting on the side lines grieving but jumping into the fray. and this is a hugely important development. >> jonathan, you bring up, god for bid, we have another shooting, where there is a lots of life. here have you a situation, and i'll go back to the tea party and those heated town halls, we may not need another tragedy for those who would like to see gun control legislation sensible common sense, whatever you want to call it, if these kind of videos keep coming out from town halls. >> that's right. >> this is not everyday you are faced with someone whose parent or loved one was gunned down. and you have to look them square in the face and say why you chose to take a different route that 90% or 80% of americans support. >> that first trip on air force one when they came across washington and fanned out across capitol hill to lobby, that the beginning of the very commendable politicizing of this

issue. so if other family members fan out across the country at these town meetings and show courage of that young woman, you are going to see -- >> and she was not alone. there were others there to support her. she was not a single voice in there. jackie, let me bring you in. let's talk about whether or not this is real heat on those senators who voted no. kelly ayotte was there. she didn't run from the question. she gave the answer she chose to give. is there proof that perhaps there may be some movement from those who said no in the past? >> she's also not up for reelection in to 16. jeff flake isn't up for -- he was elected last november. so this would have to survive a very long time to actually -- >> listen, we live in a world where people are already talking about who is the next president. >> fair enough. >> we talk about hillary clinton. so these cycles where they used to seem like forever, they come around very fast and these web

ads never go away. >> you know what else is coming up, is immigration. there are other issues coming up that will fill the vacuum that people are talking about. i mean, jeff flake is going to be integral in that debate. there will be other things coming down the pike. it is hard to say what's going to -- we also have a presidential election. i mean, so it is really hard to say what is going to tilt the scales. the other thing is, and i think this is lost a little bit, even if this got past the senate. this would not have passed the house of representatives. so i think there's also that aspect to it. i think you saw some of the senators voting the way they did because they knew it wasn't going to go anywhere. >> right. that point has certainly been made and you are absolutely right to say that. but they are the ones who are feeling the heat. kelly ayotte cannot pull in a house republican from texas, for example, and use that individual as cover. she is standing there alone facing those constituents that she sees are not happy with the decision she made.

>> but will they vote on a single issue? >> i i gragree with jackie on t. the next big thing is the big mid terms. if you see house members going down buzz they have just been blitzed on this issue, that's the language that politics -- politicians understand. when people are defeated at the polls. people have to keep in mind, this is a long term game. this won't get reversed next week. but it is about a movement building. movements take place over years. what we should be cheered by for those who support common sense gun safety, is that there is movement on the issue. >> picking up on your word, movement, michael, listen, manchin is saying this is not over so at least behind the scenes, pat toomey believes it is. but he is fuelled by something

that gives him a bit of confidence that this is not over right now. >> i think there's greater movement available in the senate than in the house. as i'm listening to the conversation, i'm thinking about nate silver documenting how only 35 of 435 congressional district in the country are truly swing. and so, those house members, if it does come to them and they vote against the polls, and you're wondering, how can they do that, it's because when they go home to their districts, there's no accountability. that's a big factor. hyper partisan districts factor into this. >> all right. thank you, michael. i greatly appreciate it. jackie, great to have you on as well. we have to see you more. >> thanks for having me. >> jonathan, thank you very much. coming up, why senator marco rubio says the bipartisan immigration bill he's been trying to sell to conservatives, now he is saying it could be in trouble. we'll explain why. plus, take a look at this. this, my dear, is may in

we continue to follow breaking news out of boston where three additional suspects are now under arrest and charged in connection with the bombing or boston bombing investigation. the criminal charges filed against these three individuals are conspiracy to obstruct justice, knowingly concealing and covering up a backpack

containing fireworks police say belong to dzhokhar tsarnaev. these individuals are expected to appear in court, at left two of them, in about half hour. one of the individual took the trip to new york times square with dzhokhar tsarnaev before the bombings in boston. we will have much more on these charges against these three individuals that are said to be friends, not university classmates, of the youngest bombing suspect who survived. we will have much more on this, of course, in the next half hour when that court appearance is expected. the "news nation" is also following new reaction to president obama's renewed call to shut down the u.s. prison in guantanamo bay. it has come about by a hunger strike by prisoners there. mitch mcconnell told the new york times quote there is a wide bipartisan opposition to the president's goal of moving those terrorists to american cities and towns.

republican congressman howard says the bomb admin never exercised the power its had since 2012 to wave on a case by case basis. most of the restriction lawmakers have imposed by transferring detainees. joining me now here in studio, vince warren, executive director, center for constitutional rights which has led the legal battle over guantanamo for the last 11 years, representing gitmo detainees and making sure all detainees had an option of legal representation. thank you so much for joining me. >> thank you. >> first, let me play what the president said regarding what guantanamo bay does to the united states image. we've heard this before but this is what he said yesterday at the news conference. >> i think it is critical for us to understand that guantanamo is not necessary to keep america safe. it is expensive. it is inefficient. it hurts us in terms of our

international standing. it lessons cooperation with our allies on counterterrorism efforts. it is a recruitment tool for extremist. it needs to be closed. >> the president said he is willing to go at it again but he also defended the actions right now of those to force feed the, what is it, 100 of the 166 detainees who are right now on that hunger strike. were you encouraged at all by what you heard yesterday? >> it was good to hear again that president is up for this challenge. there was an lot new there. but i think what is important to pull out is that this fits into his overall narrative which is that it actually cost the united states more to keep guantanamo open. >> hundreds of millions. >> and i think both in terms of goodwill internationally and an amount of money than it does to solve the problems of closing it. >> what is s good to hear is what he is recommitted to the strike. the hunger strike in guantanamo, these are people not trying to kill themselves. these are people that are

protesting a detainee policy where they are kept in in jail indefinitely without trial. this is a form of protest. so he needs to treat not just the symptom of the hunger strike but solve the problem as well. >> there is a recent new york times of guantanamo prisoner. it did not get a lot of attention to be quite honest. let me read a portion of what he said in his story. i've been detained at guantanamo for 11 years and 3 months. never charged with any crime. i've never received a trial. no one seriously thinks i'm a threat but still i'm here. years ago the military said i was a guard for osama bin laden. but this was nonsense. like something out of an american movie i used it watch. they don't even seem to believe it any more but they don't seem to care how long i sit here either. he talks about a friend telling him that there was work in pakistan and that he had gone it pakistan -- afghanistan, for work, rather. after the attacks, he says he went to, like many others, he

fled to pakistan and next thing he knew he was at guantanamo bay. that's his story. he has never been charged. he sits there and he is part of the hunger strike now. >> yes. two thirds of the base is on hunger strike. of the men there, 86 of the folks have been cleared for release by multitudes of administration agencies, including the pentagon. so one of the questions is, one of our detainees, one of the folks we talked to said, why is it that the president is now moving to force feed the hunger strikers to keep us alive, only so we can die in a definite detention. i think he frames that problem absolutely right. >> what are the options here? the president looked at for example moving detainees to the prison in illinois. that was block bid congress. every step it seems that at least the offers of a solution that were placed in the beginning of his first term blocked by congress. what realistically can happen at this point? >> what's clear is that congress tied one hand behind his back. they now block transfers not to

the united states but any place. >> absolutely. some countries don't want the detainees there as well. >> exactly. but the other hand we have to make sure the president doesn't tie behind his own back, number one he can appoint someone to handle these closurish issues. there hasn't been someone doing that in months. number two, he can end his own blanket ban for transferring people to yemen. most people cleared are yemeni. >> as says the man in the op ad. >> right. finally, the pentagon can issue wavers, case by case wavers and certify national security standard for the people and transfer them. they don't have to do it through congress. congress has given them the power to do this. >> are there innocent people if guantanamo bay? >> most certainly. the government's own evidence years ago, more than half of the

people were innocent. the people we talked to, tremendous number of those people are innocent and then 86 people that the government said these people don't pose a threat. and we don't intend it try them. then why should these people remain in jail for a crime that the government knows they could not commit because of bipartisan wrangling. it makes no sense politically. makes no sense morally. and is unus sustainable. >> thank you for your efforts today. >> thank you. >> a leading republican voice for reform today casts doubts on the future of the bill he helped craft. >> the bill that's in place right now probably can't pass the house or has to be adjusted. because people are very suspicious about the willingness of the government to enforce the laws now and in the future given our experience of immigration in the past. that's a very legitimate suspicion. it's one that i share. >> "politico" is saying that

lachey will permit green cards, something rubio says, it won't pass. let's first talk about the issue again back it the security and the concerns of conservatives that this is not a heavy enough focus on immigration reform border security, kelly. >> one of the things that they've tried to do to get a bipartisan approach, is to balance the call among conservatives for greater border security to get that path to citizenship. we will see, next week will be a hot week for immigration and weeks it come. this delicate balance not coming forward without anyone tripping. mark why rubio is throwing out a paugs light. concerned there are changes that could derail what they are trying to do. we should expect there will be changes. there will be a process that is called a mark-up on capitol hill. you will be able to watch it. it'll be done on camera where

the judiciary committee in charge of this will go through the bill. an enormous bill. there are many concerns. and they will vote on pieces of it, tweak pieces of it and at any point there could be something that presents a political problem. so the lachey idea of extending same sex benefits, that's important to progressives and they believe they could get this into a big bill hoping that republicans also want to see ultimately an immigration pact. so you really have everybody trying to put all of their wish list items on this. without pushing it so far that it topples. there will be bumps in the road. there will be worrisome comments. but at the same time, a lot of the real work is yet to again. >> thank you for the rundown on where things stand right now. we will see the bumps in the road. >> i will bring them all to you. >> i know. thank you. we have breaking news. in fact, we have live pictures from boston. two suspects arrested in

welcome back. we continue to follow break news out of the boston where three individuals have been arrested and charged with obstruction of justice and a few others. let me bring in pete williams. he's been looking over the criminal complaint for details on who these individuals are, pete, and more information on them. what do you have some. >> tamron, there's an astonishing amount of detail in this criminal complaint containing allegations by investigators. to sum up briefly, what the government claims is that three friends of the surviving bombing suspect dzhokhar tsarnaev went to his dorm room after hearing about the bombing and fearing that he might be one of the boston marathon bombers. this complaint says that they had texted with him saying, you know, it kind of looks like you and he says, lol. then he says, feel free to go to my room and take anything you want. so they go to his dorm room according to investigators and find there a backpack containing

empty fireworks tubes. they decide to take the backpack, take it back to their apartment in new bedford and eventually throw it away in a garbage bag. the fbi says agent found it in the new bedford landfill. here is a picture of what they say was contained in the backpack. let's put it on the screen full for you so you can see, you can see the whole thing, according to agents. this is what they found unside the backpack. fireworks, they also say, they took for some reason, a jar of vaseline that they found in the dorm room thinking it might have something to do with it and homework assignment sheet that was in the backpack which the investigators say is from a class which dzhokhar tsarnaev was enrolled. so this -- they did find the backpack, which according to investigators, the three men took from his dorm room and then decided to throw away after the fbi released the pictures of the marathon bombing suspects and te

realize that their friend, dzhokhar tsarnaev, was considered a suspect. there is one other interesting bit of detail, tamron, from this criminal complaint. it says that one of the men told the fbi that when he was eating a meal, with dzhokhar tsarnaev about a month before the marathon bombing, dzhokhar said, quote, that he knew how to make a bomb. that was a month before the marathon bombing. so as i say, there's a lot of interesting detail in this criminal complaint that these young men will face charges on here shortly. again to summarize, no claim in here that they had any knowledge of the bombing beforehand. this entirely deals with what they did afterwards. basically charged with obstructing justice, with lying initially that they had anything do with this, and then admitting it. >> tell us what we can expect in about 15 minutes, if they start on time at the courthouse in boston. >> this will be a very brief hearing.

it is called an initial appearance. this will be the same thing that was done for dzhokhar tsarnaev, but in his hospital room. this one will be in the regular courtroom where most of the hearings take place. they won't enter a plea. they will be assigned a lawyer, informed of charges, and subsequent dates will be set. >> so clarify the relationship between these individuals dzhokhar initially believed his roommate or suite mates at his university, that's not the case. >> that's not the case. we have been told that for several days beforehand. and again today. they were friends of his. he had, according to the fbi, only one roommate at umass. that roommate is not charged with anything here. tees these are friends of his who had an apartment in new bedford. it is to new bedford where they took the items from dzhokhar tsarnaev's dorm room and

subsequently when they came to believe he was one of the bombing suspects decided to throw it away, quote unquote, to help their friend. there is no suggestion here that he ever directly asked them to do this or directly told them that he was one of the bombers. they say that a couple of these friends had contact with him after the bombing. they texted with him. he came to their apartment. they spent time together. and that he never said anything about the bombing but he did send this odd text message to one of them saying, you know, come to my room and take whatever you want. according to the fbi, one of them texted him and said, boy, you sure look like the suspect on tv. according to the fbi, tsarnaev texted back, lol. and then, such things as you better not text me and come to my room and take whatever you want. which the fbi says, one of the friends, interpreted as, jokes. >> thank you for the details.

welcome back. we are following breaking news out of boston with three individuals of dzhokhar tsarnaev have been charged in this investigation. two of them have been charged with conspireing to obstruct justice, a third charged with making false statements to police. authorities allege that these individuals removed a backpack and laptop from tsarnaev's dorm room. authorities say there was no indication that these three men had any prior knollwledge of th bombing. it is said they are no threat to the public safety. let me bring in john burriss.

thank you for your time. hopefully we will learn more about these individuals. one travelled to times square with dzhokhar. it seems they were friends, but it would be natural to ask, why, if these people felt that dzhokhar tsarnaev may be the bombing suspect or may have had something to do with it, they would remove these items from his dorm room. >> well, because they're friends and not thinking through the legal implications of it. assisting in a criminal conduct, they probably didn't think of that. he was our friend, he asked us to do certain things, we didn't think it was that significant. unfortunately for them, given that they knew and had reason to believe he may have been involved in it, then whatever they do after that is sort of, they agree to do something. that's conspiracy. then you have more knowledge. then once they are asked questions by federal investigators, they didn't give a true statement. it is a serious crime to give

false statements to a federal investigator when they are try to do an investigation in criminal offense. >> with your legal background, is it safe it say that authorities thought they would be charged with a serious crime but they face a maximum of five years if prison. two of them for conspireing to obstruct and third individual who is charged with making a false statement, he faces eight years in prison. is it safe to assume they've been interrogated, questioned by authorities and this is what they've come up with? or could they be charged with more later? >> i think they could probably be charged with more later. i think right now, the government wants to know precisely what they have and want it do further investigation. and in cases like this, a young man hasn't been in trouble before. it appears there may be immigration issues. they may want to talk more fully about what they know. if they don't know, the crimes

breaking news on the cycle. three suspects arrested in connection of the boston marathon o bombings are in federal court this hour. they are accused of obstruction of justice and making false statements. all are friends of dzhokhar tsarnaev. the police emphasize there is no threat to public safety. nbc news investigative correspondent michael isikoff is on the ground in boston. michael, what do we expect at this hearing today? >> well, this is an initial appearance that the suspects will be informed of the charges against them. they will be asked if they understand the charges against them. they will be told what the penalties are and presumably we understand two of them may already have a lawyer. a third one will be appointed for the third. so all three will have counsel. we would not expect a lot more detail about the charges but there are -- there is quite a few fascinating details in this
