2:30 am
bit less. this is "way too early." our promise to you is we're going to try not to stink today. really setting a high bar here on "way too early." good morning, everybody, i'm brian shactman. it is thursday, june 6th. breaking news out of philadelphia. an update on the death toll from that building collapse. 6 people are dead, another 14 hurt after the structure unexpectedly came down yesterday. it's a four-story building actually in the process of being demolished, but a thrift shop next door was open for business. rescuers literally using buckets and their bare hands to remove rubble in a search-and-rescue operation that could last through this morning. those rescue workers did have some success, we can tell you. here's some new video of a survivor being pulled out. 61-year-old myra plekam is from philadelphia. she's currently listed in critical condition, but she is
2:31 am
alive. she was pulled out last night. take a look at the building before the collapse. right, that's it right there. and now look at what it looks like after it fell down. just unbelievable. of course, as you might imagine, investigators on the scene looking into what might have caused it. also this morning, a disturbing report of unprecedented collection of phone data from millions of americans by the federal government. according to the british newspaper "the guardian," the obama administration is conducting a massive domestic surveillance program which requires verizon to provide the national security agency with telephone information on a "ongoing and daily basis." that includes both domestic calls and communications between the u.s. and other countries. the order was issued by the secret foreign intelligence surveillance court and granted the government unlimited authority to collect data over a three-month period, which ends on july 19th of this year. "the guardian" report said the actual contents of the calls are not recorded but the government
2:32 am
does track the phone numbers, location data and the length of conversation. i want to point out, nbc news does not have independent confirmation of this report or the legitimacy of the document. now, the order falls under a pretty controversial section of the patriot act, which allows the government to make these types of requests from telephone carriers. however, "the washington post" reports, this appears to be a so-called rubber-stamped order, one that is "reissued routinely every 90 days," and it's essentially ongoing, so we have to figure out when it started and it's a complicated story. the white house, justice department and verizon have declined to comment on this story. we also have new information this morning about the military's controversial drone program as classified intelligence reports show u.s. officials may have ordered strikes in pakistan without fully knowing their targets' identity. nbc news's chief foreign correspondent richard engel has the story. >> reporter: does the u.s. always know who drone strikes are actually killing?
2:33 am
nbc news has examined classified documents detailing 114 drone strikes in pakistan in 2010 and '11, locations, death tolls, alleged terrorist affiliations, but they also reveal what u.s. officials don't know, like how many killed. between 7 and 10 in one strike, 20 to 22 in another. u.s. officials do seem certain they almost never kill civilians. in those 114 strikes, only one acknowledged civilian casualty. >> they want to maintain the myth that civilians are not harmed with drone strikes, which is simply implausible. >> reporter: what's more, about a quarter of those killed are described generically as "other militants." it suggests u.s. officials don't always know exactly how many or who they're killing, sometimes targeting suspects based on what's called a signature terrorist profile -- where they live, who they meet, who they talk to. several former senior officials
2:34 am
have told nbc news that they had concerns about signature strikes. one told us the u.s. sometimes executes people based on circumstantial evidence. but many counterterrorism officials insist drones are far more precise than conventional attacks, and they work, with a proven track record against al qaeda. >> it's been a tremendous step forward in military technology. it's combined the capabilities of surveillance, strike and long endurance all in one platform. >> reporter: drones are part of war now, but determining from afar who is a terrorist remains less precise than the weapons used to kill them. >> that was nbc's richard engel reporting. he will join us a little bit later on "morning joe." pentagon investigators have uncovered the source of the national security leak that found its way into an oscar-nominated hollywood screenplay. former cia director leon panetta reportedly revealed the name of the commander in charge of the raid on osama bin laden's
2:35 am
compound. he apparently disclosed the name during a ceremony attended by "zeer yro dark 30's" screenwrit. he says he did not know a member of the general public was in attendance. it didn't accuse panetta of wrongdoing, but under federal law, the name was supposed to remain confidential. it's been a bruising month for attorney general eric holder, whose department of justice is mired in scandal surrounding leak investigations. still, the nation's top lawyer says he has no plans to step down from the job. in an exclusive interview with pete williams of nbc news, holder admitted the doj's balance between protecting the country and investigating journalists' roles in obtaining leak information was in need of repair. >> well, i'm a little concerned that things have gotten a little out of whack in the sense that i think that our rules and regulations need to both be updated and need to reflect, and in a better way, just
2:36 am
personally, they need to reflect in a better way the striking of that balance. i think we can do a better job when we have. >> the department of justice has come under fire for pulling records of 20 phone lines belonging to "associated press." the department is also facing criticism for labelling fox news reporter james rosen as a possible co-conspirator in a leak of information linked to north korea's nuclear ambitions. holder says the department's guidelines need to be changed. >> it's also consistent with our need to, i think, change our rules, our guidelines and change the statute that is actually involved in that matter so that you never call a reporter, who is simply doing his or her job in gathering news, a criminal. that is not something i'm comfortable with. i am not comfortable with guidelines, with rules, with laws that would force us to do something like that. the popularity of president obama's signature health care law seems to be flagging. a new nbc news/"wall street journal" poll shows 49% of
2:37 am
americans believe the law is a bad idea. that's the most since it was passed in 2009. 38% of families believe they will be worse off under the law, while just 19% say it will improve their lives. and yet, president obama has unlikely allies, believe it or not, for at least one section of the law. arizona governor brewer who once sued to overturn the law is now so adamant about adopting the medicaid expansion portion, she's vowed to veto any bill that comes across her desk until the gop-led legislature in her state complies. and other republican governors are supporting the medicaid expansion as well, many at odds with their own state legislatures. the tsa is reversing course on its plan to allow small knives on planes. the move comes after lawmakers, airlines, labor unions, law enforcement groups, just about everybody complained on this one. it basically argued the weapons represent a threat to passengers and crew. despite the tsa's position that it's unlikely the small folding knives could be used by
2:38 am
terrorists to take over a plane, the agency is no longer pushing forward with the new rules. it had hoped the new rules would allow screeners to focus on more serious threats, like explosives, since the tsa confiscates more than 2,000 small folding knives each and every day. now to business. wall street trying to rally after basically three major indices fell 1% yesterday and the dow now below 15,000 after its worst two-day drop since november. let's get the word on the street with cnbc's steve sedgwick live for us in london. hey, steve. >> hey, brian. yeah, the markets don't know which way to turn at the moment. a week or so ago, if you had bad economic data, this was seen as a good sign for the markets because it meant more quantitative easing, more kool-aid for the markets. now we've had a weakish beige book, a weak private sector employment report as well, which has also been seen as bad and the major indeces fell heavily on it. what is a concern is the service sector and manufacturing are both seeing sluggish signs. as a matter of fact, manufacturing dropped 6,000 jobs
2:39 am
last month, according to the adb private sector survey. and this, of course, ahead of the big payroll figure tomorrow. we're expecting 170,000 jobs created. elsewhere, though, it looks like apple does look like it's expanding its workforce, at least will go 50% higher as cupertino base if plans are approved by local officials. it wants to build a new campus, which has been told will look like a spaceship, basically, a 3.5 million square foot, 7,500 new employees could be working in cupertino if they get their way. and at car price service is launched by evans.com. this will give a locked-in price online, which is hard for car buyers to get over the last years or so. it means consumers can get a locked-in price, no haggling. the only problem is it doesn't take into consideration trade-ins and your credit history, both which could be absolutely key when buying a new car and getting the best possible price. >> so you can lock in your 50,000 pounds for your tesla model x then? >> i was just about to say,
2:40 am
brian, you won't be doing any trade-in. you'll just be adding. you're like jay leno, aren't you, with the advanced number of cars. >> oh, yeah. >> you petro heads. >> the bentley is next. steve, see you tomorrow. appreciate it. last night i was winding down, looking for my latest "hunger games" news, right? what do i do when i'm looking for the latest? i discovered liam hemsworth joined twitter yesterday. besides being subjected to stories on him and miley cyrus, i'm pretty annoyed. he got 50,000 followers with two tweets. i can't get over 10k here, folks. and i know, of course, you're all relieved that he's on board on the twitter train, but here's the point here, folks. we want to know who isn't on twitter that you'd like to get on board? each barnacle's on twitter. #2earlytop3. we'll read the most creative answers next on the show. i'd like to see president bush tweeting. i'll give my answers later in the show. still ahead, a potential bombshell in baseball.

it's their job. now, adding an extra allay to the story, the "daily news" is reporting that anthony bosch, who is the former head of the florida company biogenesis clinic at the center of the investigation, asked a-rod for financial help following an mlb lawsuit against him in march. "did t "daily news" says that rodriguez denied him when he asked for hundreds of thousands of dollars. shortly thereafter, bosch reportedly approached mlb to cooperate. now, some of a-rod's teammates were asked about the allegations. mariano rivera, cc sabathia said they would support rodriguez, no matter the outcome, but mark teixeira seemed less enthusiastic, speaking generally on it, saying "i think it's embarrassing. this is all speculation, but if it's true, then i don't think it's good for the game. we're supposed to be good examples for kids, for fans. it'd be one thing if we didn't have a policy. we've had a very tough policy for a long time. if that many guys are still cheating, it's just very disappointing. there's no excuse for it. in the late '90s and early 2000s, you could claim
