tony parker acting like a champ in the nba finals. it's game one, but things getting hot in miami. it is a friday. it's national doughnut day. it's "way too early." good morning, everybody. it is june 7th. later on this national doughnut day, i'm going to reveal, in my opinion, what is the most underrated doughnut in these united states of america. i'll do that in the cooler in a few minutes. i want to begin with what information the government has on you. if you have placed a call or sent an e-mail, the government knows about it. the national security agency monitored americans telephone and web data for years. it falls under the laws passed in the wake of 9/11. the nsa collects data on everything from e-mail to video

chats. it includes an effort to sweep up file transfers and log-in information. the so-called prism program collects records from the largest internet companies from microsoft, yahoo! google and facebook. they collect information from the three largest phone companies with hundreds of millions of phone customers. that data includes a record of the location, the number called, the time of the call and the length of the conversation. officials say the effort does not monitor the content of the e-mails or phone calls but looks for larger trends of communication. the obama administration's embrace of this outraged critics. they used a link between the current president and his pred assessor. that's spooky, by the way. the program has plenty of defenders who say it's a

critical tool for national security. >> within the last few years, this program was used to stop a program, excuse me, stop a terrorist attack in the united states. we know that. it's important. it fills in a little seem that we have. >> we have debated this several times. more than a dozen times in the intelligence committee. it has been the subject of judiciary committee hearings. it has been the subject of extended floor debate and votes. there is nothing new in this program. this was a routine three-month approval under seal that was leaked. >> should it be investigated? >> i think so. i mean, i think we have become a culture of leaks now. >> there's a new angle in a story about chinese hackers gaining access to u.s. systems.

u.s. intelligence traced a cyber espionage for senator john mccain and then senator barack obama. mccain's campaign was surprised to get a phone call from a chinese diplomat upset the senator drafted a letter to the new president of taiwan. the letter he was angry about hadn't been delivered yet. the timing could not be more precarious. it comes on the eve of a two-day summit between president obama and the chinese president where hacking is expected to be near the top of the list in terms of talking points. attorney general, eric holder, is looking to tamp down the tough tactictactics. critics accuse them of overstepping authority by taking aim. they say the probes will have a chilling effect. during a hearing yesterday,

holder tried to assure senators they would not be targets as criminals. >> the department has not prosecutored. as long as i have the privilege of serving as attorney general of the united states will not prosecute any reporter for doing his or her job. federal student loan rates are set to double in less than a month after the u.s. senate failed to keep interest rates where they are. last week, president obama shot down a proposal by house republicans saying it would eliminate safeguards for low income families. it's the second in a year. without a fix, interest rates go from 3.4% to 6.8%. in perspective here, folks, total student loan debt is estimated at $1 trillions. veteran senator frank lautenberg, the last world war ii veteran in the upper house will be buried this morning in

arlington park. hillary clinton was among the dignitaries on hand for yesterday's memorial. new jersey's attorney general has been tapped by governor christie to fill lautenberg's seat until october. he will not run himself. christie was forced to defend the time line of the costly special election for a permanent replacement which will be held a few weeks before the scheduled general election. >> we would have been sued for 2014. the democrats have made that clear. a $12 million cost while not insubstantial is, i don't think something in the context of a $32 billion budget, something that should persuade us from giving people an opportunity to get an elected senator as quickly as we can. >> 165 kidnapped migrant workers including 20 children are free after mexican soldiers stormed

across texas. mexican officials say they are the victims of human smugglers. instead of getting them to the u.s., the kidnappers planned to extort money from their relatives for their release. most were from central america. at this point, they are not saying who is behind the kidnappings. they were found in an area known to be home for organized crime. all eyes on the upcoming jobs report after a roller coaster day in the markets yesterday. the dow finished up a half percent of 80 points after being down more than 100. cnbcs steve is live in london. talk about jobs here. are we going to get growth to spark another rally or expectations tamped down? >> yeah. it's amazing, brian. you know as well as i do how the market has been about the jobs markets. we would be excited now it seems we get less.

there's a lot going on here. we are expecting 170,000 jobs created. 7.5% unemployment rate. 34 year low. it's not good enough. if we get participation up, we can have confidence about the economy. confidence from retail. retailers are getting to grips with the situations. heavy discounts for costco, old navy and gap having a very good month. elsewhere, facebook has a bewildering choice of appetizing venues for customers. 27 ways. they are going to make it simpler. they are expected to have 31% increase in revenues in 2013. things are going well. i want to make it simpler. >> drives me crazy. >> mostly draft beer guys in the uk. i thought beer in a can was old
