"new york times," straight above the fold as well. the business rags, wall street journal has it right there and the financial times, i mean, the financial times, it's a pink sheet, they never have social stories on the front. the supreme court overturned the fell ral rulings on defense of marriage act.

been briefed on his situation. after days of searching woods, ponds and an industrial park near his home, new england patriots' aaron hernandez has been arrested, dressed in white t-shirt and shorts hernandez was led out of his house in handcuffs. he was charged in the death of his friend odin lloyd. hours after his arrest, hernandez was released by the new england patriots. i want to bring in michael floria. mike, thanks for being up with us this morning. describe time line that officials say they put together on this case. >> well, it was a very detailed presentation of a minute by minute account of what happened at least, what prosecutors

believe what happened on the night odin lloyd was killed. through the use of text messages sent by aaron hernandez, text messages sent by odin lloyd, surveillance cameras not only at hernandez's home but public cameras, they made the movement of lloyd, ultimately the car that aaron hernandez had rented ends up back at hernandez's home not long after lloyd was killed. >> that's the one hole, right the? there's a gap they don't know if they can prove that. correct? >> right. there's no direct evidence that he pulled the trigger, at least none that was presented yesterday in court. the circumstantial evidence is overwhelming. it can still be very powerful. hernandez's lawyers was dismissive when that term was

used in court. >> mike, just quickly, how big a problem, the case of cleveland browns player cut, he was charged with attempted murder, lot of criminal cases, how big a problem is this relative to the con cushion problem? >> it's been an ongoing problem. each team can have up to 90 players. you're looking at nearly 2800 total nfl players, it's a small percentage when 25 to 30 have been arrested since the start of the year, but these players have resources available to them that can rely upon to help them stay on the right path, stay out of trouble, and there's just a disconnect between -- between what the nfl makes available and what some of these guys do. they continue to make bad decisions and it's just -- every once in a while it seems like

>> let's go to business. investors looking for another day of gains after all three indices went to the up side yesterday. the dow led by boeing and home depot. meanwhile the price of gold bouncing a bit this morning after touching a three year low. let's touch on that with steve sedgwick live in london. >> yes, on the previous session we were rallies because we had strong data. this session we were rallying because we had weak data. the logic this time around was because we have are more stimulus with weaker data. two day rally up 1.9% for the s&p. gold as you mentioned though still under a vast amount of pressure. a year end estimate for next year of 900 bucks. currently trading around 1240. professional investors are selling on this one. apple, as well. closing before $400. i think investors are waiting if a catalyst to buy this one again

as we have an assault from android and google products and samsung, as well. apple remains under pressure. >> so will we get new coke again? >> how many new coke s do we need? but the industry is seriously looking at new products with low calories. we have a zero-calorie sweetener that they will try in coke light and see how that expands. it's the first time a coke labeled product has been used and the industry needs more diet products with less calories because there is a concern that the consumers are just turning their back on high calorie carbonated drinks. so could be important. >> thank you, sir.
