down the government. >> in 237 seasons this transformed in to an egotistical self destructive maniac. >> at this hour the federal government is closed for bichlz federal firefighters, cia agents, fbi agents, federal prison guards are now asked to protect us without pay. national park rangers and zookeepers are out of work. thousands of children may find the doors to their head start schools closed. babies in need will be without the help of women, infants and the children nutrition program. the military will be unaffected by the shut down but thousands of civilian defense work withers who support them will not. tonight the president had this message for them. >> the only way to keep the government open would be for the house to pass the resolution that we have already sent them, is that correct? >> that's right. it keeps the government funded.

continuing resolution. up to this point, house republicans refused to go to conference on a the federal budget which is how we wound up with the resolution. duct tape that keeps them open while the long term plan is worked out. reid said a conference committee is a nonstarter. >> we passed the budget. we passed the budget because it is the right thing to do and republicans said we should pass a budget and we did. senator murray has for more than six months, requested conference on the budget 18 times. so we like to resolve issues but we will not go to conference with a gun at our head. the first thing house has to do is pass a clean six-week cr and they can do it right now. >> congressman van hollen explained why republicans don't want to negotiate on the budget, they can't.

why? ted cruz whacko bird wing of the party won't let them. >> the only way to keep the government open tonight, which is now closed, was to take up the senate continuing resolution and fund the government. and yes, then we should go to conference on the budget. mr. speaker, we have been trying to go to conference on the budget to negotiate our differences since march. on 18 occasions, senator lee and oh republican senators blocked the effort to go to budget negotiations. senator mccain said that was insane for republicans in the senate to do. because he pointed out that our republican colleagues claim they want to work on the budget negotiations all along. why would you block that, mr. speaker? when you go to budget negotiation you have to compromise. you have to meet the other party half way. and you have got a tea party right wing in this house that refuses to compromise. >> joining me now the national review's robert costa.

"new york times" political reporter ashley parker. i want to start with you, you broke the news of plan d a few hours ago. that was the conference committee plan which seems to be getting the hand from harry reid. is there a plan e at this point for house republicans? >> i think plan "e" sounds like this. the house republicans for a few days will endure a shutdown and feel the political pain. there is a generational divide between members. some younger members elected in 2010 and 2012, they need to feel the pain and come back to the table. >> ashley, there's so many flaws and chinks in the armor with the plans abc, d and possibly erkts. one of the problems is it is a reminder of house republicans rejected the compromise committee 18 times before as hoyer pointed out. it sounds like the democrats

will beat the drum as long as republicans propose this committee. >> the first problem with a conference committee is it involves both chambers. the house may want to go to conference but as you pointed out, harry reid said it is dead on arrival. it is unlikely the senate would even go to a conference. it's unlikely the conference will be an avenue for negotiations in this fight. >> robert, where's john boehner? we know he's been -- he's going to give a statement in a few minutes. in terms of his power within the caucus, is it weakened, strengthens, status quo. what's your analysis? >> i think it has weaken. ed. john boehner is an institutionalist. he did not bring a clean cr to the floor. even though a lot of house republicans would have been willing to support a clean cr.

he stumbles ahead. doesn't have a coherent strategy. trying to use a conference as a message in the senate but doesn't have an out. that's what he will have to find. >> ashley, part of the reason this has been particularly hard for the republicans, independent of the war they are having between moderates and tea partiers is democrats have stood in lock step through almost all of this. i want to play a little sound from nancy pelosi tonight at a press conference. let's listen to that. >> to get out of a shutdown could democrats accept any small narrow change? >> no. >> in this setting -- in other words, we always think that any bill that is passed can be improved upon, but you do not use the threat of shutting down government to try to advance your policy agenda. that's just not the way it works.

>> ashley, it's like a study in contrast. john boehner, who has little sway with his own caucus and nancy pelosi, the sort of fearless general putting down the rolldown gates on any suggestion of deal making with republicans on anything relating to obama care or anything in the future, perhaps. what is your thinking about how much she keeps her caucus together in the coming days? >> democrats and a bunch of the fights in the house and senate having unified. no chinks in the armor and, you know, part of that is because democrats feel, at least when it comes to repealing, defunding or delaying the health care law, this is through a became law on the books in 2010. we have had three years to fight about it. we have had a presidential election to fight about it. at this point, president obama is the president of the country. the democrats control the senate and they don't see any reason to cave or negotiate on this. >> robert, i think for people who haven't been following this closely who don't have their own

at-home government shutdown clocks on their desks, they may wake up tomorrow morning and wonder what is going on a number of levels because the aca has rolled out at the same time this happened as the government shutdown happened. obama care, the exchanges are open. the republicans have done nothing to stop that. i think that double underscores the futility of all of this. >> there's definitely an aura of futility to a lot of the republicans' maneuvers right now. the implementation of obama care on october 1st is really the reason for all of this 11th hour scrambling by republicans. within the con srvetive ranks there's a fear that come october 1st, once obama care starts it will be a federal entitlement, a bureaucratic program that people like and conserve tys fear that. it is popular as social security down the line and they want to stop it before it starts and becomes popular. that is causing problems for boehner because he is dealing

not only with a political scenario and legislative scenario but dealing with members who have their hands in the air, pulling their hair out about the implementation of obama care. and that is causing the conference to go in unrealist directions. >> i was talking to chuck todd earlier about the game of hot potato, that nobody wants to be the last person standing in the way. it seems and sounds like republicans actually have ended up with the hot potato. i think that is expressed in some part by the fact that john boehner has not spoken. everybody is waiting to see what his, i guess, his excuse or reasoning is at this late hour. in terms of that game of back and forth, it seems like the democrats have the upper hand. >> yeah. this is something republicans, house republican leadership feared all along. they said while repealing obama care is a popular motto and

rallying cry and gets constituents worked up and units all members of their party it is a pr nightmare. if the government shut down happens the only thing more unpopular than that is a shutdown of the government. they knew they were going to get stuck with the blame no matter who ping-ponged the last bill when the clock struck midnight. >> worth noting the house just passed a bill to go to conference. how far do you think that republicans can make that talking point? how much can that be a talking point in the coming days? >> i think republicans want to try to win the pr war. there is a sense of nervousness among republicans. they are not sure how it will play out. they hope the president may shoulder some of the blame, that he will look disengaged from the process but they are not sure that will happen. right thou now there's a lot of wareness of how to proceed. does boehner have the ability to

the speaker of the house is weighing in. let's listen in. >> all americans under obama care. the senate has continued to reject our offers. under the constitution, there's a way to resolve this process and that's to go to conference and talk through your differences. i would hope that the senate would accept our offer to go to conference and discuss this 0 we can resolve this for the american people. questions? >> speaker boehner, mr. speaker, the stakes have been raised in this now. you have members and both parties who want to vote on a clean cr. you said you would like the house to work its role. would you vote on a clean cr? >> we are hoping the senate will take our offer to go to congress and let us resolve our differences. >> later today, 800,000 federal workers will receive notices they are no longer need on the job. what's your message to them? and do off plan to restore back pay to them?

>> the house has voted to keep the government open. but we also want basic fairness for all americans under obama care. >> what do you say to those workers, sir? >> joining me now, the former deputy assistant secretary for economic policy for george h.w. bush. he writes for the new york times and fiscal times and the political reporter for buzz speed. bruce, a short statement by the speaker of the house. he has one talking point, it seems the senate continued to reject our offer. we want to find some avenue for compromise. rings a little false after 18 rounds of rejecting compromise on the budget before. what do you make of it? >> first of all, let me clear up something. those 18 votes on the budget had to do not with appropriations, but with the overall guidelines for appropriations under the budget act of 1974. so that is important because it guides the appropriations

process and right now we are faced with no appropriations, and under the anti--deficiency act of 1868, this requires the government be shut down. so while the two are related, they are really different issues. i don't want people to get confused about that. >> let me follow on that, bruce. we're not actually even arguing about a budget here. we are arguing about a stop-gap measure. i want to hear your thoughts on the point that others have made which is the reason that no budget no, real bills can come to the house because there is no consensus because john boehner cannot pull the two ends of his party together. >> actually i think he would if he wanted to. i don't think -- i mean the republicans have i believe 233 votes in the house. so only 16 republicans would have to switch to vote with all of the democrats to do whatever they want to do. there's clearly far more than

that who would follow john boehner if he simply released them to vote their conscience. but he won't do that because people like jim demint and the club for growth and the tea party cooks will not allow that to happen because they don't believe in democracy. they believe they should get whatever the hell they want and to heck with the constitution. >> kate, we -- john boehner -- or there's been a lot of talk with regard to john boehner's speakership about he hastert rule and how reluctant he has been to break it, even though he has broke it several times in recent memory. a majority of republicans have to support something before it is brought to the floor of the house. it seems like a majority of republicans don't want a government shut down. so why did one happen? >> i think what you are seeing right now is that john boehner is actually trying to protect his majority. by not allowing -- by holding on to the hastert rule and doing all of this obama care,

defunding delay, he is preventing primary challenges for a lot of his members. i think that's -- it's very difficult position for him to be in both ledgislatively and politically. he doesn't want to see a shut down but his hands are tied by members and outside conservative groups that said we are willing to primary anyone who goes against us right now. >> bruce, i guess i take -- i don't take issue with what kate is saying because i think she is right but this idea that boehner would go down if he did the statesman like thing which is of course to listen to the will of the american people and to continue forward with the american democracy and a represented democracy and introduce legislation that will pass in ten minutes in a bipartisan fashion. i mean, john boehner wants an oil portrait hanging in the halls of congress after he retires from the speakership.

given that, why doesn't he take the high road to your mind? does the tea party -- you tweeted earlier there is a slight nooblt boehner is a genius and the tea party will die a well-deserved death in the next few days. where do you think we are on that prognosis? now the government has been shutdown? >> it will entirely depend on the political reaction to the shutdown. as every polling organization in the united states is probably out right this minute trying to get the pulse of the american people. if the polls and the buzz and the phone calls and the e-mails to in the members of congress, if it turns very, very heavily negative against this government shutdown, you will see them change their positions overnight. that's what we are really waiting for is for the american people to speak in some way that allows them to finally move forward. >> kate, we began this segment

with an awesome but actually in terms of finding ended up being slightly awkward bugs bunny clip of the dangers of touching a hot stove. that is in reference to a "politico" story that said that john boehner needs them to touch the hot stove so they are burned and maybe don't approach it again. that is a reference to the debt limit fight on october 13th or fights in the future. do you think that robert costa eluded to a generational divide in the republican caucus and these younger guys don't remember '95 and '96 and need to experience this pain. do you think that is true? do you think they are they can feel pain at this point? >> well, certainly i have spoken to a lot of members in the last couple of days running around on the hill who were here. and staffers who were here to who said the government shutdown in the '90s was just miserable.

you have constituents calling your office every five to ten minutes. needing government service, needing help with something and there's nothing you can do. at the end of the day, the feeling is that people will come back more willing to compromise, being more willing to say let's pass a clean cr and move on and compromise in the regular legislative process. that's a big hope, though. a lot of the republican members come from very republican districts. this is what their constituents have been asking for. it's difficult to tell them or convince them that this is not a good idea because they really feel like they are hearing from their constituents to say please, please continue to stand on this principle and don't negotiate and hold the line there. >> bruce, where does ted cruz pop up in the hours and days after this?

he's been both cheering on the sidelines for an extreme stance and egging members of the house on over the edge in my humble opinion. yet, owning the government shutdown seems like something he wants to have no part in. he haven't heard from him this evening. lee said that they are working to defund obama care because it's the president's own decision that he wouldn't follow the law. he's rewritten it three or four times. americans would have never looked at this and seen the hypocrisy. does ted cruz weakened or strengthens at this point? >> well, i think it depends on how you define the terms. i think in terms of what he is trying to accomplish which is make himself the president of the united states or the republican nominee for president in 2016, i think he has nothing whatsoever to lose. i think he is moving ahead.

in as far as his influence in the congress and senate is concerned, i think he has certainly moved back wards in that respect but i think he cares nothing about that. so it is a matter of no importance to him. i think the important thing to understand here is that only half of americans vote in general elections and only tiny percentage vote in primary elections and a little over half of that is all that is needed to control one of the political parties. the tea party people are very fervent, very disciplined, extremely well funded by plutocrats and that's thae the reason we have this problem and that is a tiny minority of one party is the tail wagging the entire dog. >> tierney of the minority. thank you both for your time tonight. >> thank you. >> thank you and congratulations. coming up, president obama said he would not let republicans use funding the government as a way to pressure him to cave in to their demands. republicans attempted to call

funding our government without making extraneous, and controversial demands in the process. the same way other congresses have for more than 200 years. >> in the spotlight tonight, president obama says no to negotiations. seven hours before midnight, president obama stepped up to the mic wane told them once again the affordable care act is the law of the land. >> let me be clear about this. an important part of the affordable care act takes effect tomorrow. no matter what congress decides to do today. the affordable care act is moving forward and the funding is already in place. you can't shut it down. >> reporter: >> then the president laid out his bottom line. >> i'm always willing to work with anyone of either party to make sure the affordable care act works better, to make sure our government works better.

i'm always willing to work with anyone to grow our economy faster or to create new jobs faster, to get our fiscal house in order for the long run. i've demonstrated this time and time again. often times to the consternation of my own party, but one faction of one party in one house of congress in one branch of government doesn't get to shut down the entire government just to refight the results of an election. >> joining me now msnbc's crystal ball, luke russert and former congressman patrick murray. luke, i want to start with you. john boehner just had a press conference. it was almost more a statement. you asked if he had a response to the 800,000 government workers who now find themselves furloughed and it didn't sound like speaker boehner had an answer. tell us more about that interaction. >> i asked him that question. he said the house voted to keep

the government open but weal want fairness for all merns under obama care. that's not a direct answer to the question i put toward speaker boehner. i have covered john boehner, alex, since the day he became speaker. i can tell you the only other time i seen him like this is he held a press conference during the debt limit negotiations where he announced he was no 0 longer to talk to president obama anymore. that was a sad, dejected bonn boehner. that was a john boehner who had one thing to say. he is usually jovial with reporters, likes to talk. he didn't want anything to do with us tonight. he wanted to get to bed or plot the next move about how to keep the government open. as far as that question i posed to him, alex, one of the under reported stories here on the hill is these federal workers who will be furloughed. there's no guarantee they get their pay back. you are from d.c.

you know how many federal workers there are in the dmv area. i was speaking to a few of them today and there is a real worry because of the appetite of cutting spending in congress you could see it go on a few dans these folks be presented with house saying why should we pay you for days you didn't work. but where we move on from here your guess is as good as mine. the idea to move from confer rhees, that prized them. they didn't see that coming. that was supposed to be the magic bullet that was supposed to solve this. harry reid will table that later on today. the idea is they have to pass a clean government funding bill with senate votes. it's a question of when. not if but when, sorry. it is 1:30, been here for a while. >> you are excused. >> yeah. and we don't know. there could be more riders attached on to bills going to the senate, the house gop

conference they are not expected to meet early in the morning yet. we don't know where they will meet next and they said we can weather the first day or two of a government shut down. the longest i have heard is four or five days and the earliest is tomorrow at noon. pick your poison in between there. >> actually getting the government back up and running depends on democratic votes. as trent frank says i'm convinced once the government shuts down you have to have barack obama's permission, as it were. you need democrats help to start it back up again. if they think the country is blaming republicans they will not hesitate to keep it shut down as long as possible. that's a very tough position for republicans. >> that is a tough position and completely false, by the way, alex. the democrats aren't the ones that are holding our economy hostage right now. to go to an earlier point, luke

talked about the folks in washington, d.c. furloughed. my brother is an air force major, 1,000 mime miles from his family right now. doing search and rescue from the air force. he was just told, i'm not sure if you should report to work tomorrow and he is not sure how he is getting back home to be with his family when his tour is over. this will hurt everyday families. these folks are laid off and we don't know if they are getting back pay. the democrats are willing to put forth a clean cr. the republicans are not. >> crystal, i think sort of the thing we haven't talked about as much as we talked about house republicans in disarray and terrible strategy is the power the democrats knew wield. the fact the president drew that tough line and i thought appropriately and shrewdly brought to bare the notion that real people are going to suffer

in this shut down. >> right. >> as the congressman points out these are cousins, brothers, sisters and neighbors of people. the effects will be felt around the country fairly immediately. unlike the sequester. >> they will be. as you are pointing out, we have seen the president. the president has a lot of credibility here. he has gone to the republicans and negotiated in the past. he has, at times when myself and other democrats have said you should draw the line here. we can't keep going back to the well. finally he said, this is it. let's keep in mind, we are talking about a six-week cr. six weeks. so let's say he gave them whatever ridiculous absurd thing they want at this point, who's to say six weeks from now they are not going to demand some other list of goodies. finally he said, look, we have a constitutional balance of power here. you are upsetting what the will of the people are by taking -- we're not even talking about a majority of the republican caucus. we are talking 30, 40, 50 members of the republican party

shutting down the government. it's an absurd di. i was reminded of that famous will rogers quote, i don't belong to an organized political party. >> i have a quote from paul ryan. in the margins i wrote fool heartiness. paul ryan was asked about the president's no negotiation on the debt ceiling. paul ryan says nobody believes that. the president himself negotiated bowles-simpson on the debt limit with democrats. i think most people believe he is posturing for now. i do not know fi would bet against president obama's convictions at this point. >> it seemed when whe had his statement today he left the door open to negotiating on entitlements but i don't think you will see it to the degree which you have had the past few years simply because of the

timing. there's not enough time to have the discussions like in 2011. interestingly enough, you are starting to see this narrative, which is crafted by folks on the left and folks within the speaker's realm. the idea that boehner is allowing his conference to let out their hot air on this issue so it makes raising the debt limit that much easier by showing the public pr catastrophe the house republicans could obtain from having the government shutdown. who knows if that ends up being correct. what i will say is house democrats are elated that president obama has not negotiated on this. they have always felt he has given way too much. nancy pelosi, she had a great line last week. she said i wish he had never given away the 14th amendment option. we should have just done that. you can see where house democrats minds are on this. and i think move forward they will be emboldened by their

moments ago speaker of the house john boehner tweeted senate democrats chose to shut down the government rather than discuss the failures of obama care. joining me now democratic congressman dan kildee of michigan. he's a member of the house financial services committee. congressman kildee, what do you make of speaker boehner's line of argument? >> it is unbelievable. since april 23rd, we have been asking the speaker to appoint people to a conference committee to work out the differences in the budget. suddenly, 15 minutes before the government shuts down they decide they will make an offer to have a conference committee when the real question is why aren't we taking up the senate

cr. the president will sign it. the senate already passed it. we know a majority of the house would support it. so this notion that suddenly they want to talk when for seven months or six months we been trying to get them to conference with the senate on a budget, it's just really insincere, and it's unfortunately another example of john boehner's failed leadership. he's not the speaker the house is. i don't know what his job is, but it's not the speaker. >> what guidance have you been given in terms of next steps here? the democratic caucus has seemed very much in line and incredibly organized, surprising many who have watched democrats over the years. this is actually a great moment for democratic organization, holding fast to democratic principl principles, insofar as you can divulge what is the next move, what can we expect from the

left? >> we are going to be consistent. we have given a lot of the cr that we were ready to agree to was at the republican number. this is time for the adults in the room to take claharge. we're going to press to get government open again. and if they want to have discussions about the affordable care act, entitlements, whatever, it's, we're there to talk. the reason that we're unified is that we're sticking to the principles that we were elected on. republicans talk about principle. what they have done is purposely set out to wreck the government because they have a group of political arsonists over there that want to sit back and watch the house burn. they're enjoying this. and it's really a sad day to see that. >> you said it's the priority of democrats to get the government

house republicans have also tried to tie a couple of things to a continuing resolution, including a medical device tax, the addition of a conscience clause and a vitter amendment, which would force the congress and their staffs to participate in the health exchanges. at which point do you think they put a clean continuing resolution on the floor for a vote? >> reporter: that's the question now. and i spoke with house members right after this plan was announce the, right before they were going to go vote on it. and they themselves really don't know what the next step is. the senate has already, basically vowed to regent this idea to go to conference. and basically, democrats are just going to sit back and wait and see what happens. you know, honestly, at every turn of the day today, this last week, house republicans and outside observers alike have just been wondering what's going

to happen, and i think that remains an open question. >> on the aca, the weirdness of the strategy cannot be overstated. republicans have vilified it because at the end of the day they're pretty sure americans are going to love it, so it seems like there's a very small and ever shrinking window for republicans to keep vilifying the aca. >> that's something for a lot of democrats, they themselves and folks around the country are still waiting to see what obamacare is really going to be about. there are going to be technical glitches, bumps in the road. they are truly believes, they believe obamacare is the end of the world obama administration is making a big bet that folks are going to like this.
