report details how levinson, a retired fbi agent was contracted by people within the cia to gather intelligence without the knowledge of top agency officials. working essentially as a rogue spy. today the white house had this to say. >> bob levinson was not a u.s. government employee when he went missing in iran. as there is an ongoing investigation into his disappearance, i will not comment on what he may or may not have been doing. we continue to pursue all investigative leads as we would with any american citizen missing or detained overseas. >> the white house also criticize the associated press for running the story out of concerns for levinson's safety, calling the decision, quote, highly irresponsible. but levinson's family says it hopes the report will put pressure on the government to do more to bring him home. in a statement the family said

in part, there are those in the u.s. government who have done their duty and efforts to find bob but there are those who have not. it is time for the u.s. government to step up and take care of one of its own. we begin with nbc news national investigative correspondent, michael isikoff, after holding this story for a criminal period of time, its decision to run the details we're now discussing. >> a lot of controversy about that decision. i just spoke with senator bill nelson from florida who has been active in trying to bring him home, one of his constituents called off the head of the ap yesterday and urged them strongly not to run the story as did the white house itself, white house chief of staff, dennis mcdonough, the ap -- senator nelson says the ap told him erp they were running the story because they believed bob levin son was dead and it was

okay to run the story. senator nelson doesn't believe that and people in the u.s. government and family don't believe that. so yes, there's going to be a lot of questions about the decision to publish the story but that said, now that it's out, i did speak this morning with the lawyer for the levin son family who says genie is out of the bottle and lawyer confirms the essence of this, bob levinson was there in iran on a mission for the cia, hired to look into oil skimming by iranian officials and done by people in the analysis division of the cia. they do not run ops, it was an unauthorized mission, rogue operation. >> michael, a portion of the associated press statement in defense of this decision from kathleen carroll, the senior executive editor, this story reveals serious mistakes and improper actions inside the u.s. government's most important

intelligence agency in the absence of solid information about levinson's whereabouts it's impossible to judge whether publication would put him at risk. serious mistakes and improper actions. in the report the highest level of officials of the agency unaware of this. >> >> reporter: no question about that, tamron. they confirmed that the cia, top cia officials came to him and mrs. levinson some years ago and issued a formal apology for what took place here. told him that three analysts had been fired and seven have been disciplined and paid the levinson family $2.5 million in an out of court settlement. they were threatening to file a lawsuit against the cia over this. so that's a pretty big con suggestion by the u.s. government that something was amiss here. >> it's interesting also, the levinson family, said bob is a

courageous man who dedicated himself, including risk of his own life and service to the u.s. government but the u.s. government has failed to make saving had good man's life a priority. it should be. what is the family -- what is their hope that will happen next? some of the thought -- >> reporter: no, they are hoping that somehow this will shake the tree that this will put pressure on the iranian government to provide some information. the iranian government has maintained for all of these years it does not know where bob levinson is and has no information about him. that video and photos you showed came out, they came from an internet address in pakistan that according to dave mcgee went dead the next day. someone was trying to suggest that levinson was in pakistan. the u.s. government has no way of knowing that. that's what's so agonizing for the family. it's been three years since they heard anything about bob levin

son's whereabouts. >> we greatly appreciate it. tomorrow families in newtown, connecticut, will privately mark the first anniversary of the shooting at sandy hook elementary. we just got word the president and first lady will hold a moment of silence. last night, several hundred people did gather at washington's national cathedral so remember the 22 children and six adults killed along with sermons and prayers, there were also calls for congress to revisit gun control legislation. this as a new nbc wall street journal poll finds support for those measures has dropped to its lowest level since the shooting, 52% of americans want stricter sales covering the sale of firearms and 30% it should remain the same and 8% less strict. many of the victims families are asking for privacy this weekend as a result nbc news will not be in connecticut. however, three family members

>> of course, that was a very moving piece and what the country experienced a year ago was gut wrenching for all americans, whether you're a democrat or republican. you are right in the legislation to change gun laws at least federally in this country did stall, that happened in april when the senate was unable to pass universal background checks. our poll makes it pretty clear why it wasn't able to do so at least legislatively. the political parties are in two different places, 76% want stricter gun laws and 28% of republicans want the same. when you have those types of divisions, it's hard to get immediate and instantous change. a lot of times and something that is fueling a lot of those people and kate snow's piece, change often can build in decades and this might be the first for them and might end up seeing this change 10 or 15 years down the road. for a lot of those pushing that, that's no comfort at all.

>> people right after newtown would say the phrase everything ha has changed now that newtown has taken place. meaning for the first time while we were going to perhaps see a compromise on legislation, that didn't happen but looking at the state gun law trends since newtown, 70 -- let's show the map here. 70 of them in green loosened gun restrictions and 39 states tightened gun restrictions. since newtown, where do you see from what you hear on hill and the people that you know inside the beltway if anything? >> i think what you're seeing on display is the red/blue divide i was talking about in the statistics. if you run a blue state, you probably tighten your gun laws if you're from a red state, chances are you probably loosen them. it's really that political conflict going on between democrats and republicans. one thing that did trouble gun control advocates, in purple

the montana newlywed who pushed her husband after the cliff faces life in prison after making a surprise guilty plea moments before closing arguments at her trial. she will be sentenced on second degree murder charges in march. the judge in the case accepted the plea only after saying he wanted to hear graham tell the truth about why she committed the crime. she told the judge, i wasn't feeling like i should after you get married. going on to say it was a reckless act. i ran back up to the car and left. i was scared of what happened and in the moment i was so scared i didn't know what to do.

joining me now from washington, d.c., michelle segona, thank you for your time. listen, in this confession or details that she gave to the judge, part of that discussion was the fact she said she was scared and didn't know what happened but she did send a text to a friend pretty much a light hearted text after the death of her husband. >> right after the death of her husband. along with concocting so many different stories in this and maybe she's young and maybe she was confused and the fact of the matter is if her husband did in fact go off the cliff and it was an accident, why didn't she contact someone right away? there was a series of those few days from july 7th until she led park rangers to his body when there was all of these different stories and elaborate schemes and things like that going on. one thing that happened in the courtroom yesterday, tamron, is

that yes, although she pled guilty to second degree murder, the family finally has a little bit of answers from her and sometimes families decent get anything. so the fact she was able to explain herself a little bit may offer them some sort of piece of mind. >> she explained some of it and it doesn't certainly mean she revealed all of the details but to your point for the family of cody lee johnson, they have some information from graham. but this surprise decision right at the point of closing arguments. >> yeah. >> she stunned everyone. i saw the alert that went off, that she decided to plead guilty. i don't think anyone saw this one coming. >> i don't think anyone saw this one coming. trial started on monday and here we are on thursday. closing arguments ready to take place. jury selection took a half day. the prosecution took about three days. the defense really only took a few hours. when i talked to the u.s. attorney's office in montana

earlier this morning, what jessica fare told me, she is facing the maximum is life in this particular case. but there's a probation officer that will put together a set of guidelines and present that to the court. the sentencing is supposed to be held march 27th, 2015. as soon as she pled guilty she was taken out of the courtroom by the u.s. marshals and that's where she's being held until she appears back in court on march 27th. >> it is one of those bizarre, eight days of marriage. >> eight days of marriage and here we are, cody's family, they are -- as you can only imagine, beside themselves, this is traumatic, not just his family but her family as well. a lot of people and a lot of tears and confusion. >> his mother, sherry johnson, cried in court and one individual said the family is thankful for the outcome.

wichita airport. justice correspondent pete williams joins us now. what can you tell us? >> he never got anywhere close to doing that. this is one of those operations where the fbi got wind of what he was up to very early on and from that moment on had him under constant surveillance. ty name terry lowen. worked as an af yonices technician and he had a badge that allowed him access to parking areas and get his car into parts of the airport with a public would normally be able to get. and according to the fbi after some period of time he came up with the idea of filling his car full of explosives and setting off a suicide car bomb attack. but he never actually built a bomb. he thought he had. he thought he had explosives that were given to him by

someone who was equally committed to jihad. that material turned out to be inert and that person turned out to be an undercover operator for the fbi. the court documents say that federal agents became aware of him fairly early on, in august of this year, when he was making statements about how he wanted to commit some sort of jihad attack, he said let me preface the bottom line by saying i have become radicalized in the strongest sense of the word and don't feel allah wants me any other way. it's a somewhat unusual case in terms of his age and the fact he doesn't seem to have at least from the court documents we've seen a previous connection with islam from for example coming here for an islamic country but in any event, it's an example of somebody becoming self-radicalized but the main point here is he was under constant nb surveillance the whole time dealing with

and cornyn and a list of undecided republicans. >> reporter: well, one of the functions of the senate, you don't have to really commit until you have to commit, meaning the time for the vote. part of what may happen is that senators are really engaged in what's been going on separate from the budget deal. a lot of energy has been spent in the fight over nominations and rules change. so i think we will see spr talking to a number of senators ted, they are taking time to review it and think about it and go home for the weekend and back on sunday. they'll work very long days next week when they will have to finally commit to this. what we may see is a split where some republican senators will vote to allow the budget deal to move forward, one of the key procedural steps then vote against it later. so in talking with senators here, there's an expectation the budget deal will pass. one of the challenges is which republicans will be on record supporting it at a time when

unlike in the house where paul ryan was the leader of this in the senate, it patty murray, the democratic senator from washington who is one of the more progressive senators. she didn't have the same alliances with republicans trying to bring them along as paul ryan did in the house where he could ask friends and colleagues to join him and have that special sway. i had a chance to spend time with marco rubio. when you heard speaker boehner talking so much about the outside groups, remember how marco rubio went through a difficult time over in immigration where he was going for the bipartisan deal with the outside groups. here's a piece of my conversation with marco rubio as it relates to this budget deal. >> do you think outside groups have gone too far? >> i haven't followed what they are saying on this issue. it's a free society. i've been on both sides of outside groups supporting what i'm doing and against it. this isn't about the tea party or me or paul ryan or speaker

boehner or outside groups, about the united states of america and government continues to borrow 20 cents out of every dollar it spends at an alarming pace. >> that issue for conservatives has been about increasing how much the government spends, that makes them uncomfortable and they fight against that, then there's the argument for trying to do something that keeps the lights on and process moving forward. is compromise in the air? it will take longer from the senate side to see if that resolves itside. >> thank you very much. from the battle in d.c. to battle of a different kind, this is a story a lot of you have been reacting to on twitter and facebook. a young florida boy with autism and his parents fighting to keep pet chickens that have helped the boy deal with his autism. now, after originally ruling 3-year-old j.j. hart could not keep his pets, the city council says it will vote on a special resolution that would allow j.j. to keep his pets.

family attorney says the change of heart came after he threatened to sue the city in federal court. and joining me now is j.j., with one of his pet chickens, his name is snow and parents ashley and joe hart and their attorney. thank you for joining us. >> thank you for having us. >> ashley, let's start with you, i said it before, j.j. needs to keep -- if we needed to get signs to help him, we wanted to see him keep his pets. you spoke from your heart when you said you saw a change in j.j. after the pets. what was his condition like before he got snow and his other pets? >> before he got snow and other pets he was made minimal -- bad social skills and he was pulling out his hair and would pinch himself. he was in intense therapy with joint compression brushing just -- he needed a lot of help

and his therapist did a great job of that but the chickens are something we could do at home. it really helped bring him out of his shell. got him running around. got him active, sitting and crouching and standing and jumping. his sounds they would mimic, i snow that sounds crazy but it encouraged him with his speech. and his first word was duck for duck. >> joe, how did you find out that chickens would help? were you looking for a pet and stumbled across this idea? >> well, i'll let joe answer that. >> there was a website i found and it said something about chickens and at the time he was going through a sensory therapy. and they would sit there and scrub him with brushes and stuff because he didn't like anything touching his skin. he didn't even like a blanket at night because he was sensitive

to his skin being touched. still to this day, he doesn't like his shoes and socks on. i was hoping that we could just get a chicken and see how he reacted to it. and i heard that there was advantages to it. we got a chicken and he took to it. >> how did this turn into an issue for city council? were there neighbors who complained? >> it came from one complaint -- actually it was two complaints? >> may have been two. it wasn't neighbors because we've got petitions signed by all of the neighbors who are very supportive of j.j. >> the only thing it said was chickens, it didn't say loud or noisy, just chickens. >> we show the video, a clean contained area, they are not running around loose. and it looks very secure. >> that's right. >> go ahead. >> we live on an acre and

there's a thin closure and sleep in a coop they are locked in every night. >> you believe this was only after the threat of lawsuit. why did it have to get to this point, when you point out there was a petition from neighbors in the community and obviously the family has been open about j.j. having autism and the change this is making in his life. >> i can't answer wipe the city chose to make the decision that they did, but what we presented to them was a lot of information. you can imagine when i first got the case i didn't know anything about chicken therapy for autism. but it's a great treatment. we hired a world renoned specialist with medical information and videos and book on this therapy for children. it's a great therapy and it's

worked and the federal fair housing act requires municipalities to grant an exemption to people with special needs if it's needed and in this case it's needed. we're encouraged by the resolution. i don't think they would have put it up for a vote this coming week if they didn't have the votes and didn't know they had the votes. >> we're confident they have the votes to allow ashley and joe and j.j. to keep the chicken? >> they would not have put it up for vote if they didn't have them i don't think. if it doesn't pass, we always have the alternative suit and that is exactly what we do. >> ashley, you're sitting here and this wonderfully adorable child. everyone in here, j.j.'s face on screen, aw and how impressed how disciplined in chicken is. come on. is j.j. the chicken whisperer? how did you get this animal to sit so calmly with him? >> it comes from being handled on a daily basis and j.j.'s
