obama administration to delay some of the law's most important provisions and to extend some deadlines has caused uncertainty among insurers and confusion among consumers. peter alexander is traveling with the president. he's in hawaii now. so peter, is the white house at least acknowledging that maybe some of these changes could be confusing and causing uncertainty for the consumer? >> reporter: i think pretty simply again on friday during will his fill press conference of the year, we saw the president again fall on the sword, recognizing the problems that have existed in the rolling out of the affordable care act. and the enrollment process in particular. tomorrow at midnight is the deadline to sign up for coverage, but there are still 99 more days administration officials insist before you can get the sign up done going forward. suffice to say, though, the white house has been trying to push and encourage innesurers t

son divide. you have pressure from the left on the president to shore up this program. and to make it more transparent and to curb it back. and also less talked about but also important is that the obama administration behind the scenes as they deal with health care and the bunl and other priorities have spent a lot of time having to deal with foreign leaders and other countries that are very upset about this leader of g germany, france, brazil, putting pressure on the administration, they have canceled some bilateral meetings. and the white house has said this a big distraction and they don't know what is next with the guardian "washington post" publishing these kind of stories. what else is out there. so the president is expected to read very carefully this thing even on vacation, get advice from his top advisers. he will give an address to the nation we believe early next year. and i think lynn is right, is this is one of the big things, communications company will hold a lot of the metadata.

but he is standing by some of the programs because it has protected our security. >> you were nodding. you're here on the set with me so i can see you nodding as we were going through some of this. and we put up what the association press wrote talking about an unusual coalition of conservative republicans and democrats have taken up the issue. so we don't see this bipartisanship. it sounds you have weird bedfello bedfellows. >> this is exactly the thing that brings strange bedfellows together. libertarian, democrats, a federal judge who is aped by former president george bush was the of the metadata collection was unconstitutional. members of the panel thought there was overreach, there was no need for the nsa it to be

holding as much metadata, as much phone call record data as it is holding. so i think that the president signals that is he going to make changes. the question is are they enough for that coalition. remember there was a real move in congress, they were eight votes shy for completely changing what the nsa can do and there was a new push to roll back some provisions of the patriot act that have given the intelligence service so much leeway for the last decade. >> and lynn, i'll bring you back in and piggybank off something about the signals the president has sent. another signal he has sent, with this week or last week hearing that i was going to commute the sentences of at least eight drug offenders, he says i'm commuting the prison terms of eight men and women who were sentenced under an unfair system, each has served more than 15 years, and

sentencing judges expressed frustration that the law at the time did not allow them to issue punishments that more appropriately fit the crime. what are we to make of this? this was certainly a strong sign signal. o what can the president do, what more can he do moving forward besides continuing to commute sentences? because it did send a strong signal. >> it did. and as you noted, it's because president obama thought those people were victims of unfair sentencing guidelines that federal judges were forced to put down. and i know she knows a lot more about this as the expert, but i think he showed his hand that when there are cases that he can give clemency to to people who have served time for some crime,

they had clean records, they weren't career criminal, we may see more of this in a future. >> a young man, clarence, you wrote sensitively about it and some are saying you had a hand in getting his story out there. and she's right. it doesn't send a signal. he played his hand. he's telling everybody what he thinks about some of these laws. >> and there is more than 3,000 people who are serving life sentences for first time nonviolent drug offenses. that's a lot of people locked up for a very, very long time. and i do think the president made it clear where he stands. it was pornd for him to push back on congress to do more changes on unfair sentencing. there are a lot of people who are stuck in what people call the kind of crack cocaine pipeline, it means they were sentenced before the changes and there is no retroactivity to their sentences even though they

are still serving sentences that everyone in congress agrees are now unfair. the thing is the president could still use his power to commute many more people. it's up to him. >> what more can the president do and will congress do anything? >> the president asked the justice department for eight recommendations. there may be more coming. one of the bigger goals is also to reduce crowding in prison. it's taking up a big chunk of the federal corrections budget and longer term going forward as congress matt change it is to the laws, hopefully that will clear out some of what the president and others believe are unnecessary long sentences that crowd the prisons and have other benefit once the crowding goes down. >> all right. thank you all so much for being here. enjoy your holiday. >> thank you. >> actually, i'll see you all in about 45 minutes. they're not done yet, folks. we'll continue with the brain trust in just a little bit.

topping our sunday headlines, an awful update here. after eight days on life support, 17-year-old claire davis has died. this is a young lady shot in the head by 18-year-old karl pierson earlier this month after he entered arapahoe high school armed with a shotgun and molotov cocktail bombs. she died yesterday with her family by her side. also, three people confirmed dead due to yesterday's severe weather. two in mississippi. officials say one was related to damage to a mobile home while the other was due to an accident involving a downed tree. meanwhile in oklahoma, a man was killed when his van flipped off an icy hoorp. yesterday's ice storms caused over 100,000 power outages from oklahoma to maine. also the united nations says they are trying to rush more

so is bush back? jason stanford is a democratic strategist based in texas who has helped run campaigns against george w. bush and keith dawson worked for president obama bush in his 2004 re-election campaign. gentlemen, thank you both for being here. so why now, why are we seeing so much of him? >> well, the president certainly is an amiable, honest good guy. and he made the decision on the way out and told us that he was going to let history write his political obituary. so i think that is what is going on. i wish he would do what bill clinton did, which is rebuild a political legacy, but that's going to be up to the president. we certainly as a party could use him, but toes will be his choices. and he's a good-bye and i think the american public remembers him, you said stood exactly what he was about and who he was. might not have agreed with him,

state officials say the changes are necessary to preserve that program. and nationwide, tomorrow is the deadline to sign up for health coverage under the new health care law. it takes effect this january 1st. so if you sign up, you got to do it by midnight tomorrow night and that coverage would start january 1. republicans and democrats alike are worried about how successful it will be right out of the gate. this morning joe manchin continued his push for a one year delay in the individual mandate so the markets have more breathing room to respond to the program. >> if it's so much more expensive than what we anticipated and if the coverage is not as good as what we've had, you have a complete meltdown at that time. if basically the cost become more than we can absorb, absolutely. >> how is this playing out out side the belt way?

we have ron ralston with us onset. and mark and joe didn't want to come to new york, but that's all right. let's me start with you here onset with me. nevada, a state been hit hard. very high unemployment as we're seeing there and second highest uninsured in the country. if there is any where there could use the health care law the way the president described it, it sounds like nevada. how are things going through? >> we have the only republican can governor in the country who has both expanded medicaidnd set up an exchange. now, they are bragging about you how well the state health exchange is work. he said let's do this, let's not let the feds do it, but they still have fewer than 9,000 people signed up as of last week. and then friday, real late in the day, they put out an emergency notice saying you don't have to pay until next friday. just make sure you sign up by monday. so they have had some glitches, too, but you're right, we still

have the highest unemployment rate in the country. sa sandoval has portrayed medicaid as a way to boost the economy. he portrays it as you get more money into the economy, if these folks can spend hormone. >> mark, how are things playing out in florida? always an important state. and health care down there, this is one state where we're hearing people getting those notices saying you've been kicked off your plan so that promise i'm sure if you like your plan, you can keep it, did at any time play well in florida. how are things looking? >> sure, the president did get the lie of the year for saying that, influence are about 300,000 cancellation notices sent out by florida blue alone. they are rescinded at the moment, but we are the the number two insured rate in the nation and our legislature here, our governor is republican. and together they have either refused or bulked at or spent very little time trying to can abo x. band medicaid.

people are not necessarily seeing cancellation notices, but we're hearing a good numb people saying, hey, look, i thought this would be more affordable. some of these only lasting four times the pofrly level and that's not a lot of money for some people here. so there is a little bit of anger, but i think it will take a number of years for this to work ultimate and we'll have to see what plays out. but the website keeps getting botch and they keep changing the rules, so we never know when it will be fully implemented. >> chad, we heard in california of some early success. >> yeah, it's been a different story in california. i'd say this they have had the head start. they had the time to build a website that actually has been working for the most part. and if you look at the numbers, the preliminary data by tomorrow, monday, they could have more than 300,000 people signed up in private health plans. >> i had some numbers up there, but you tell me that number one

more time is this by tomorrow we could see about 300,000 there in the state of california? >> yeah, they have reported more than 156,000 have signed up and then they have given these smaller snapshots. so for example over tree dahree more than 53,000 people signed up in just three days. to contrast, the whole month of october, they had 30,000. so you've seen a surge ahead of the deadline. people have been made aware that monday is the day. if you want january 1st coverage. and the past few days, people are actually waiting in line for more than an hour showing up at stores before 8:00 a.m. in the cold waiting to sign up. and certainly there are still many people opposed to the health care law. the website doesn't work and the call center, nobody will answer the phones. so there has been plenty of problems in california, but certainly the numbers have been very positive so far. >> senator reid, we watch him on

a national level. but this is your guy in your state. what is his popularity like? it seems like he's in the middle of every fight of course and naturally by his position he would be in washington. but how does that play with his popularity in nevada? >> he's a very polarizing figure in nevada. he has like a 50% disapproval rating. in fact he did when he ran for re-election in 2010. everyone said he was dead. likely he got the opponent he wanted. but essentially he has a lotess invested in obamacare. he's the guy who essentially dragged this through the u.s. senate, some would say by bribing some of his colleagues with perks to get through the louisiana purchase, the cornhusker kickback. he has a lot invested. he continues to be very, very supportive. he says all the things democratic leaders say. all the rollout has been terrible but be patient. everything is going to be fine. he may well be right. that's not what it looks like to most people right now. >> mark, let me wrap with you here. you will have a governor's race

in florida a lot of people will be keeping a close eye on. you mentioned governor rick scott. in other races around the state how big will the affordable care act play in politics next year? >> we do know both republicans and democrats have decided this is going to be a hill they're going to fight over and maybe die on. let's admit, i don't know if in november of 2014 if that's going to make a huge difference one way or the other. obviously if it remains a disaster it's probably bad for democrats. democrats right now are playing offen offense. we have a congressional race in the miami and florida keys area. the incumbent joe garcia. they're attacking his republican opponent by saying he's not backing obamacare and he wants pre-existing positions banned again. he wants the bad stuff before the insurance system was fixed so to speak through obamacare to come back. you're not really seeing democrats run away from this. charlie cris is proudly embracing obamacare. he used to be a republican. used to trash obamacare. people could expect he'd back away from it.

not just in space. yeah. there's psych support stuff on the station. we have a keyboard. we're just people up there, too, t.j. >> who knew. most of our -- i assume most people saw the movie "gravity" in theaters than actually watched this whole spacewalk yesterday. how important is it for people to see these spacewalks. it looked so easy. to really understand just what's at stake and how difficult it is and some of the work that's going on up there. >> yeah. we only go out on spacewalks for absolute necessities. the level of danger is much, much higher, of course, than being inside the spaceship. in this case, on the international space station, one of the main cooling loops has sort of failed where we can't use it. so we need to swap out a thing about the size of a refrigerator. they did a great job on the spacewalk yesterday. they got way ahead of the game. hopefully we'll be able to get everything done in just one more spacewalk. but it is physical. it's like working out steadily

for the whole seven hours that you're outside. it's not something we take lightly. they did a great job yesterday. >> i was fascinated. i watched just about the whole spacewalk. to hear them do some of the things that sounds like i do around my house when i'm fixing. i'm like, just put some duct tape on it. just tear that piece off. it sounds like things would be so meticulous and so exact. but it sounds like they have to do things on the fly up there. is that the case? >> yeah. it's just -- it's just people fixing things. and the space station is a big ship. it weighs almost a million pounds. it's going five miles a second around the world. it's like having to repair your car while you're driving down the highway. beautif a lot of things just have to make sense. rick and mike did a great job yesterday. >> one important question. we will follow the spacewalk new

scheduled for tuesday. we have to take the opportunity to ask you, we see this spacewalk. people get fascinated and interested in it. at the same time funding is being cut from space programs in canada and this country. how does this affect science programs and how can something big like this spacewalk really help somebody like you trying to get more funding for programs? >> you know, there's a lot more stuff going on than people notice in the daily news. the rover on mars just found that in every cubic foot of water on mars there's a liter of water. we have probes to every planet in the solar system. i mean, the why chinese just landed a rover on the moon. the indian space agency just sent a probe to mars. there's a lot of stuff going on. and we have six people living off of earth that are running about 200 experiments up on the space station. we left earth 13 years ago on

2013 will go down in history as the most unproductive year in congress. with the fewest bills passed. it was not such a great year for the white house either. we're back with our brain trust. dafna windsor from msnbc.com. david nakamura from the "washington post." lynn sweet. let me start you. the president on gun reform. this was a big push. nothing got done. does the president have any push on gun control? >> as big a push as he had, sorry to say, he has the new year coming in p p i don't see any momentum for him to get anything done this year. if the newtown massacre couldn't move people, there's nothing out there that will that i see anything developing on that front. >> dafna, that's unfortunate. if 20 babies getting killed in their own classroom doesn't push washington to do something, i don't know what it will take. also as we know there's this

urban/rural divide. how much is that always in play when we talk about gun control? >> i think that that is one of the biggest things that has impacted congress. its sort of inability to do anything. i think this is the great tragedy of this presidency. he has talked about standing at me moimorials reading names of people shot in theater, people killed at a religious temple. this has really been so much about this presidency. >> immigration reform. there's still time, i suppose. but a lot of people say we've been waiting, mr. president. waiting on the next year. waiting on the next year. the immigration -- the administration reported the number of undocumented immigrants -- you wrote just the other day about the importance of that fact. saying, quote, the annual number of deportations have been closely watched by both immigration proponents and those opposed to relaxing rules for people who have come across the border illegally.

so where do we go in 2014? >> i think this has a better shot than gun control, that's for sure. it's still a high hurdle. the house is not going to move the senate bill that's already been passed. john boehner has sent some st signals. very recently again reiterated signals he wants to do something. where it's a compromise deal that won't be full citizenship for all illegal immigrants. maybe younger ones who have no say in coming here. that might by the strategy for republicans. it would be a question of whether democrats would be able to compromise with that. i think there's going to be pressure from the white house to continue to do stuff on immigration, put this in the spotlight. all eyes are on john boehner. he's criticized some of the outside groups that have opposed a lot of these policies including immigration, that we're not going to not do anything anymore. we're going to be a party of solutions. rye we're going to move something forward. >> david, we asked you for a headline. alternate headline. everybody knows the stories that get major play.

what's your alternate headline right now. >> alternate headline, if this indeed goes through and passes i think you got to look at somebody like paul ryan coming off a budget deal where he sort of was a key leader in the house republicans to make some sort of compromise deal, however wrong it was on the budget, paul ryan supported immigration reform. he could be a major player in moving this. >> on this topic, dafna, the alternate line? >> john boehner, immigration hero. the question before boehner -- >> say that one more time. we put it up. just make sure people heard you right. >> he's got a decision to make. is he going to save his speakership or save his party? i think that's where immigration comes into play for him. >> he can't save both? >> no. >> lynn, let me bring you in. that's the topic. immigration. >> i was a little predictive in this one. i predicted that dreamers, those younger people who are in the country illegally through no fault of their own will be put on a path to legalization by the

congress. because -- and this will hope before the 2014 elections. >> how soon we talking about the holidays here, lynn? >> well, i would think -- this congress needs to show something on immigration before the elections. helping these young -- the younger people here, you know, they're called dreamers after the dream act, that is one of the least controversial measures. and then i would think if i could just jump ahead, after the november election, you have a lame duck congress. i would think if nothing more substantial gets done on immigration before then, look to the lame duck -- i'm jumping ahead a whole year now -- to see something done. because you might have republicans with nothing to lose anymore. >> all right. lynn sweet from the chicago time. david nakamura from the "washington post." dafna linzer here with me in studio. thank you for being here on this holiday weekend. >> thank you. again, folks, i'm t.j. holmes sitting in this week for craig melvin. he'll be back with you next
