sign up 11:59 tomorrow night to ensure that everyone who wants health care coverage by january 1st regardless of time will have did. >> people should not think they can get on with the website for the first time and try to enroll. that's -- that would be a dangerous thing to do. we're trying to encourage everyone to go to the website today. >> the white house is stacked up and says the website is ready to handle the onslaugt of last minute shoppers. it's a record day for sign-ups, thousands are visiting and enrolling now. still, the battle over the law of the land continues on capitol hill. >> the president is working to fix it. we are working in the senate to fix it. we're urging republican colleagues to join us in fixing it. >> what i would say, we need to change health care but what they've done, you can't fix this mess.

>> meanwhile, the white house is touting 1 million enrollments meaning twice as many people have enrolled in december than the previous two months combined. and just moments ago the obama administration confirming that president obama symbolically signed up for the bronze plan on the federal exchange over the weekend and the white house correspondent peter alexander is traveling with the president and what is the white house saying about this latest tweet? how are they explaining this? >> craig, i think he explained it pretty well. let's try to put it in more clean terms. a white house official describes this is a lot like election day, the point being in you're in line at the end of election day, you can still get your vote cast it somehow it goes after midnight. the point is you have not just through midnight tonight but through tomorrow to enroll in health care, through the affordable care act to get coverage by january 1st. they don't want you to initiate the process beginning tomorrow,

tuesday, but ultimately it doesn't appear there's anything that would stop you from doing that. obviously this is an effort by this administration to try to avoid damaging headlines on january 1st from people who might say, hey, i couldn't sign up, there were too many people -- this is something they are trying to head off by extending giving this sort of one day grace period as well. on the topic of the president's enrollment, we're getting new information within the last five minutes as well, white house official telling us that the president's staff signed him up in person through the washington, d.c. exchange, the president was not there in person when it took place. he of course was here in hawaii at the time but the white house said he was actively involved in making the decision of which plan he and his family would have. they selected a bronze plan as well. ultimately he's going to be paying from the administration officials under $400 a month, i believe that's for coverage for he and his family. craig? >> pete, we should note that this new poll that's out, this new cnn poll, it finds that

popularity for the health care law now at the new low, 35% according to the cnn poll, 35% of those questioned in the poll say they support the health care law. that's a five-point drop in less than a month. 62% oppose the law, up four points from november. how is the white house -- is the white house even reacting to those numbers? >> well, the white house as the president may vouch in the final news conference of the year, he says -- to use his language, screwed up. recognize this didn't go the way they intended it to. they are hoping to shift the conversation into the start of the new year with the people who have been able to get plans. many of the people with preexisting conditions and focus on positive headlines, not the negative. that's the people who potentially are newly uninsured but ultimately the verdict of the jury is still out on this one, craig. even as we were hearing your introduction, i was finishing the conversation with the health industry consultant who tells me

from his conversations with insurance executives that they are reporting that the error rate on the back end, the information that they are receiving in terms of people's enrollments is still between 5 and 10%. as he described it, january could be in his words, a very difficult month. >> peter alexander, that is not a green screen. he is traveling with the president in hawaii. thanks so much. >> reporter: give me some time, i'll hustle down to the beach. >> thanks, buddy. joining me now, usa today health policy contributor, carrie kennedy. this deadline move to tomorrow, before this of course, there were a number of adjustments and tweaks to varying agrees made on the law. what kind of message does this now send to consumers? >> i think the administration certainly runs the risk of confusing consumers by doing this, of course they are getting

an extra day so that could only work in the favor of consumers and the white house administration to get those numbers up and for consumers to get their health care. but there's been a lot of changes over the last couple of weeks, last month. as the administration has worked through the problems with the syst system. this shows me the march 31st deadline, the administration runs the risk with consumers putting things off to the end in terms of march and having to extend it once again. >> that's the big deadline. of the deadlines we've seen so far -- kelly, you've got an article in usa today, among other things, that confusion, confusion may now be a bigger hurdle to enrollment than technology. there's still fear that the word may not be getting out to the people who most need to enroll. what's behind this confusion?

>> well, the issue is that if you live in a state where they are not promoting the site, you can go to the state insurance commissioner's website and it won't say anything about the affordable care act. i talked to people in indiana and they say there's no such thing as obama care in indiana. they don't understand this is something that's taking place and no matter where you live you can sign up for the insurance or exchanges. i say that they also think the law has been repeeled. i talked to a woman in ohio who told me people are coming in and saying, why are you trying to get the word out about enrolling if this law isn't going to go through? it's been reappealed by the house but also have to be repealed by the senate and the president would have to sign off of it. >> that misinformation campaign seems to be working. >> right, exactly. >> carrie, we heard a few moments ago the president signed up on the exchange.

largely a symbolic move since he'll continue to enjoy the military insurance that he has. the administration meanwhile has hired 12,000 supporters to answer questions online or over the phone. 80,000 navigators out there nationwide. in fact, their going everywhere to get the word out apparently, including as the politico article points out the club. but the brochures about d.c. health link as the exchange is called, not snapped up as quickly as the free condoms provided by a local clinic. is this the best way to go about getting folks to sign up? >> i don't think putting pamphlets out at a club takes away efforts from something else. a couple people pick it up, i'm sure they'll view that as a win. on saturday night i'm not thinking about health insurance so -- i don't blame -- >> if you're not at the club thinking about health insurance at that time. >> i have a 19-month-old, i was not at the club, i can tell you that. what i think is that the story

that the white house is going to be really excited about to tell in these last 48 hours, is the fact they -- a little bit, chastenned by the bad rollout, some legitimate concern that people wouldn't come back and wouldn't give up on it. this is really the surge at the end, the product is still wanted and even if they are struggling to get to sign up for it. i think the white house wants those numbers very big when they release those numbers in january. and to show republicans that if they try to take it away, they have to take it away from a lot of people. >> real quickly, i know we can't get a great amount of demographic information from the federal exchanges but we have gotten a little information from some of the exchanges that the states are running, california comes to mind. what do we know about the kind of consumer so far?

what do we know about the kind of person who signed up so far for health care insurance? >> you know, it's really interesting because the states are saying the people they have signing up aren't necessarily the ones that were targeted. those people are also signing up but it seems like a lot of people who don't qualify for subsidies are actually signing up for health insurance through the exchanges and they were expecting mostly people young and uninsured and it looks like people who have the money to pay for affordable insurance and maybe had a preexisting condition or some other reason why they didn't have insurance in the past. they are also finding that their numbers for young and healthy, the young invincible seem high as well. >> thank you. >> thank you, craig. >> developing right now, a federal judge in utah has refused to block his own order making same-sex marriage legal in that state. he issued the order on friday and the state was asking him to

halt same sex weddings while it appeared. nbc news justice correspondent pete williams joins me. where does this stand and where does it go from here? >> where it stands now under the law same-sex marriage s are legl in utah. about 100 in salt lake city on friday, more today, lots of people in lines waiting for marriage licenses in utah, although there have been some reports that at least one county clerk will not issue them and has locked the doors. we don't know how widespread that denial is in utah. where it goes next, now the state will go to the next level up, to the tenth circuit court of appeals in denver and ask them to put the judge's ruling on hold while the state pursues an appeal. now, the judge actually has denied this three times in utah, the district court judge who issued this ruling on friday declaring the state's ban on same-sex marriage

unconstitutional and judge shellably declined when he wrote his own order. secondly, there was a telephone conference call that asked him for a stay over the phone. not going to do that. if you want me to consider it, give me written motions and i'll have a hearing today. that's number three. he did that today and denied a stay. so now it's out of his hands and the state goes to try to get a stay from the next level up, the tenth circuit court of appeals. >> pete willwilliams, thank you. hundreds and thousands of americans from michigan to maine are without power after a massive winter storm. it has hit 35 states, being blamed for at least nine deaths over the weekend. in kentucky, five people drowned trying to drive down flooded out roads. in oklahoma city, huge pieces of ice came crashing down on shoppers at one outlet mall. tough to watch. no one was hurt there. in detroit, a delta jet slid off

a taxi way, a spokesperson saying it may have hit black ice. all of the passengers got off safely. let's get to mark elliott. over the next 48 hours, who should be most concerned? >> well, anyone without power across the northern tier into the great lakes, there's another weak system heading in that direction and it's plenty cold and that's all due to this past storm. in fact, behind me, here's the radar loop of what happened over the past weekend as it resets you'll see heavy snows across kansas, lots of places with over 15 inches of snow. in wisconsin it's still snowing there, over 25 inches of snow. and we have the freezing rain concerns near the burlington area, over an 1 1/4 inch of rain. it's plain old rain for 95 into maine. here's the thing, we've got another weak system moving through the same areas. tomorrow light snow, christmas day over the hard hit wisconsin into michigan areas where so

many people are out of power and there's still going to be more snow. this is not going to be a gar gant u an storm system but it is insult on top of injury. 3 to 5 inches of snow in the darker blue, 1 to 3 elsewhere through christmas morning. if you have power, it's really just kind of setting the scene for christmas day. if you don't have power, this is what you have to be more concerned about, lingering cold temperatures and low to mid teens and 20s by christmas day. those are high temperatures for the middle of the week here. there's plenty of cold air there. some of that will be going through the northeast as well. if you're in the burlington area where you may have lost power because of the heavy freezing rain event, these temperatures are going to be quite chilly as well. by wednesday into thursday, it moderates much faster for the northeast corridor. back to you. >> still ahead, target facing the first lawsuits over the massive data breach. how sales are being affected. we'll get a live report from the new york stock exchange. all systems go. nasa confirming that space walk

when astronaut returned to the space station's air lock, he discovered that water had entered his space suit. nasa says he inadvertently turned on a water switch and in any event they were given an extra day to compile a spare space suit -- say that three times. allen boyle. good to see you. we should start with making clear that there was really no problem with the space suit, correct? >> that's correct. during the space walk everything worked just fine. people had been worried that water would pool up in the helmet. that's what happened in july and that's why they gave the space walkers these makeshift snorkels and had them wear absorbant pads in case things started to get squishy. there was none of that. but at the end of the space walk, as you said, there was a

switch that make should have been off that was on for a little bit. and that was the problem. >> what's left -- >> not a biggy. >> what's left for the two american astronauts to do on this repair mission? >> okay, so on saturday, they took out this big refrigerator sized module that contains the coolant plumbing and they did that more quickly than was scheduled and so they really got ahead of the game. and so on this space walk, they are going to put in the new refrigerator sized gizmo and hook it up. they think they'll be able to do all of that during the spacewalk tomorrow. they won't have to go out on christmas. they may not have to go out for a while if they get all of their work done and they can enjoy the holidays like the rest of us. >> no christmas space walk? >> that's correct, yeah. >> even if they needed to do more work, they'd have to wait at least a day to give the spacewalkers time to rest up. this is a strenuous task.

nothing weighs anything and it should be easy but it isn't. you still have to move the stuff around. >> i want to ask you about something that came across maybe a week or so ago about the chinese landing on the moon. have we heard more about that? have we seen definitive proof? >> oh, yeah, they are sending pictures. there's pretty neat time lapse photos of the rover coming off the chinese lander and that rover is doing research on the surface of the moon. we're getting little updates about that. it's a pretty cool thing. there are concerns about well, is there going to be a new space race? we have to see how it works out but it energized people to see that sort of thing happening on the moon. by the way, this is the 45th anniversary of the apollo 8 mission, the first one to go around the moon. it's a pretty cool time in space. >> you should know, there are a

left about 40 million americans debit and credit card information at risk. out of precaution, jp morgan chase has placed a limit on affected debit card accounts, limiting cash withdrawals to $250 per day and total purchases to $1,000 a day. kayla, target facing lawsuits from customers in california and oregon, probably going to be facing more lawsuits. also, reportedly seeing the 3 to 4% drop in transactions as well. what are potential long-term effects of this kind of data breach? >> well, craig, consumers hopefully there aren't very many if at all any long-term effects. the bank account had zero liability. if your account is compromised by something outside of your control, third party forces, you have no obligation to pay that. that's going to put banks on the hook and going to put target on the hook and you can imagine there are going to be a lot of

lawsuits going back and forth on that front. we is a similar breach in t.j. max in 2007 that cost the company $265 million. there are some shoppers already saying they are foregoing their stop at target because they are still worried about any fallout. it's the companies hurt by this. the consumers will fare just fine on the other side. >> this is the second largest credit card security breach in history. what is it about our credit card system in this country that makes it vulnerable to this kind of fraud in particular? >> craig, the incidents at t.j. maxx and target, when you go to a store and paying with credit card and swipe it in the card reader, two things happening. number one, you're basically sharing via the magnetic strip, all of the information embedded in your card with whatever system they are using. target had a centralized system if any hacker was able to get into that centralized hq with

that data in there, you could potentially cause massive damage which is happened here. frequent travelers will know when you go to europe and other countries abroad, they have a chip and pin. you stick it in a machine and have to enter a p.i.n. and self-identify and they are not connected centrally to whatever company it is that's issuing it. and that's one way gotten around it. some u.s. companies are starting to use it. it's a slow and steady progress and that will change things for us. >> i want to get to the story out of china, apple reaching a deal to take the iphone to china, china mobile. how big of a deal is this? how significant is it? >> it's massive. you see apple products everywhere you look but the reality is it's actually google and android that has a 72% market share in the world's smartphone, china mobile is the biggest smartphone carrier, 763 million phones under that plan.

more on developing news in the past hour, a federal judge in utah refusing to block his own order making same-sex marriage legal in that state. joining me live now nbc news senior political editor mark murray. mark, as it stands right now, utah is now one of 18 states plus the district of columbia that allow gay marriage. utah though the first not just red state but deeply red state. what might this mean for the debate moving forward? >> this is probably the next battle ground potentially if this is something that future judges and appeals courts end up doing. craig, before this news came out in utah last friday, i was doing some little research, looking at all of the states that had gay marriage now, legal over the past year and looking back and come up with this list. the 17 states before the utah news plus district of columbia,

these are all states that president obama won easily in 2008 and 2012. utah, however is a state mitt romney won 73% of the vote. and so that is really significant and potentially the next battle ground in all of this. >> we know that there was -- the ban on same-sex marriage in utah passed by voters in 2004. was that vote -- was it overwhelming? >> absolutely. >> one of the things not only is utah a state that's dominated by republicans, also a state heavily influenced by the ladder day saints and any kind of referendum that a ban on gay marriage would win overwhelming support in utah as in other red states. i think that what is significant about all of this, you see a federal judge striking down a gay marriage ban in utah, then all of a sudden you start asking, what is going to be the situation in a place like texas.

support the security of u.s. citizens personnel and property, including our embassy in south sudan. "washington post" foreign correspondent joining me live on the phone from the capital juba where the fighting began there. let's start with the embassy, what can you tell us about safety and security there? >> apparently in juba everything is calm right now. earlier last week it was quite a bit of gunfire and people a lot of evacuation happening but today and yesterday actually it's been pretty calm here. while the fighting is going on the rebels have taken over the town, capital of the oil producing state. and we just learned that the

president kiir told parliament that -- and try to retake the town from the rebels. >> we're hearing also this afternoon that ban ki-moon is expected to ask the security council for around 5,000 more troops for the south sudan peacekeeping mission. what more can you tell us about that? >> well, the nation is pretty overwemd. last week there was an attack by a gang of youth who targeted a u.n. peacekeeping base and the two peacekeepers were killed. as the crisis deteriorates, the u.n. will find itself in even more difficult position and they need more manpower to protect the tens and thousands of

civilians who arrive at bases for protection. certainly protecting civilians. >> is humanitarian aid, is that getting in? >> well, this is a very difficult time for the community. it's the end of the year and most of them appear to have run out of money. there has been a new appeal by the u.n. and other agencies but at the same time, you are seeing quite a number of aid groups evacuating their work -- their employees because of the crisis here. so it is -- it's a very difficult humanitarian situation and many here are predicting it's only going to get worse. >> with the "washington post" on the ground in sudan, be safe, sir. thank you. >> we've got a developing story to tell you about right now out of afghanistan where defense

two members of a russian punk band convicted of a profanity laced protest in 2012 were released from separate prisons today, one of them de defiantly shouted russia without putin and said she's not afraid of anything anymore. it is seen as an attempt to quiet criticism ahead of the winter olympics in sochi. more from jim maceda in siberia where he interviewed one of the band members after her release. >> reporter: hi, craig, if vladimir putin thinks he'll improve by freeing prisoners, he may have to rethink that. both of the members came out of prison today swinging maria, who was released first from a prison much closer to moscow than we are, told reporters that putin's amnesty was a hoax and p.r.

stunt. even though they are targeted in russia, she plans to become one and getting the word out in other words. she spent no time going from the prison to a human rights committee that specializes in torture inside russian prisons. she walked through the prison gates defiant. she was flashing victory signs with both hands and yelling out, russia without putin, a famous chant often used by anti-putin protesters. and our exclusive interview with her in this hotel, she said rumors first of all she had tuberculosis were not true but did suffer the effects of a nine-day hunger strike to protest conditions and was hospitalized with severe migraines. when i asked her if her punk days were over, nadya said she's not just an artist but

the colorado floods this past september were among the most heart wrenching of the year. but now we want to bring you new images from the flood zone. an incredible group of people going above and beyond to help one of their own. >> reporter: there are few things more peaceful than the moments after a fresh snowfall. john lived here in colorado for 25 years, it's moments like these he lives for and also moments -- september brought heavy rains to colorado. towns were flooded and homes washed away. then landslides and homes destroyed and lives lost. it was a devastation many coloradons never seen. he knew it too well because john is a rescue worker. for 43 years he's been part of rescue teams around the country. some say it's remarkable how often this father of two has been at the right place at the right time. >> it's just whether you as an

individual choose to get involved. and i just choose to get involved. >> reporter: what happened to john in the early morning hours of september 16th was not a choice he would have ever made. >> prepared for emergencies at every scope for my entire life, never could have pictured a landslide here. >> that evening as soaking rains continued, john went into his backyard to inspect the hillside behind his home and noticed water gathering. >> i was trying to process what was happening and the ground started to rumble. i saw a measured 25-deep wall of black and you could see 80-foot long trees poking out of it and boulders the size of cars. >> reporter: john was swept away and through his home and down the mountain. >> i was in panic to actually meet your end and know it's coming. >> reporter: holding on to branches for hours as flood

waters roored below him and barely conscious, john remembered his police radio. >> does somebody copy? my name is john. i live in left hand canyon. i'm in a tree over the river and the tree is giving way. >> reporter: then one last barely audible recording. >> this will be my last transmission, will you please tell my children i love them. >> reporter: within moments the tree snapped but miraculously he survived. his home and belongings did not. buried under several feet of mud, john needed help. and then that help literally walked into his life. >> i heard a racket coming up the canyon as they got closer, they were -- there's no sol m y solemnness, there were healthy people. >> organized through word of mouth, a sing you lar task, bring help to whomever, where ever and however. >> we didn't know what we were

doing. none much us do this for a live. but didn't stop to worry about the how. we figured it out as we went. >> the mudslingers gave him something he never thought he would find again, hope. on this day we wanted too give something back to the mudslingers too. >> big hand, first of all for the mudslingers. [ applause ] and tis the season to recognize extraordinary groups doing extraordinary things. >> we're giving you $10,000 in walmart gift cards to help you continue helping others. >> that's -- [ applause ] >> reporter: what john didn't know, we had a surprise for him too. here's the thing, you're an amazing guy and you have spent the better part of your life doing the same thing that these guys did. so we wanted to help you get back in the business of helping others as well. pull back the curtain.

walmart put together much of what john lost. >> i'm overwhelmed. this is amazing. i don't know how to say thank you. >> you just said it. >> but it's so much more than a thank you. these volunteers changed my life and they are volunteers. and they risk their live to save me and i'll be thankful forever for you guys. thank you so very much. thank you. [ applause ] >> so after we reveal those walmart surprises, john asked if it would be okay if he donated most of those items to people in even greater need. that's going to do it for this edition of "news nation."
