71-year-old curtis reeves jr. is in custody and charged with second-degree murder. police say he was irked when a man and his wife seated in front of him were texting monday at the theater. it sparked an argument which ended with the 43-year-old man being fatally shot in the chest. his wife was shot in the hand. she's expected to be okay. about 25 horrified movie goers saw it happen. >> their voices start going up. there seems to be almost a confrontation. somebody throws popcorn. i'm not sure who threw the popco popcorn. and then bang, he was shot. he staggered two seats over, fell on my son and i. >> witnesses say the man told the shooter he was texting his 3-year-old daughter. police say it all likely happened during the previews. >> i don't know what he was thinking at the time, but i can tell you that anybody over a cell phone, over somebody texting, to take their life, it's ridiculous. >> it's really hard to believe.

stories of hair row richl, though, are emerging. with an off duty sheriff's deputy detaining the suspect and two nurses who rushed to help the victims. now to some weather news where a big thaw is causing big problems. in illinois, three people plunge into the chicago river after falling through thin ice. a 26-year-old man died after being pulled from the water. authorities say the trio walked on to the ice after one of them dropped their cell phone. divers have been unable to find a 21-year-old woman. a 23-year-old man is in stable condition at a local maryland, thing. three children were playing on a frozen pond when the ice gave way. a 10-year-old boy died. the other two remain hospitalized. and in western pennsylvania, residents are on flood watch. so next to new jersey where there is fresh trouble for governor chris christie, first it was that george washington bridge traffic jam, but this

morning there are new questions about his response to hurricane sandy. and this just hours before his state of the state address. nbc's tracie potts is live in washington. the governor is now dealing with, what, two federal investigations? >> reporter: right. first the u.s. attorney looking into what happened at the bridge. and now the governor's office has to convince washington the department of housing and urban development that an ad that ran featuring the governor and his family after super storm sandy wasn't political. >> the jersey shore is open. >> you bet it is. we're stronger than a storm. >> reporter: this ad after super storm sandy cost $2 million more than ads without governor christie. now federal auditors are looking into whether it was designed to boost tourism or christie's re-election campaign. >> it was at the expense of money from the taxpayers that could have been used for other sandy purposes. >> reporter: this as the bridge traffic scandal widens. state lawmakers are creating a super committee to investigate whether the governor's office

created this four day traffic jam as political payback for a democrat who did not support christie. >> it was apparently a very massive abuse of power. and an attempt to conceal an abuse of power. >> reporter: subpoenas are expected as soon as thursday for former campaign manager bill steppian and bridget anne kelly, deputy chief of staff christie fired. their e-mails are linked to the bridge backup, but there has been no direct link to governor christie. supporters suggest it's a witch hunt. >> of course backlash will be substantial. >> reporter: a new monday mouth university press poll taken after christie's news conference shows 59% of new jersey residents still think he's doing a good job. but in that same poll, the governor's favorability rating, in other words how people in new jersey like the governor personally, that number is down 26 points over the last year, raising questions about whether or not he's weathering this political storm. >> yeah, there are a whole lot

of questions. thank you, tracie. we appreciate it. from one crisis to another, but this one is easing. for the first time in nearly a week, some people in west virginia are waking up to clean tap water. state officials giving the all clear to about 45,000 residents. but that still means some 255,000 people are going a sixth day without clean water. the governor is urging patience. >> we've made a lot of progress, but i ask all west virginiians to continue to be patient as we work to safely restore service to the affected areas. the water will be coming back on, but it will be done in a systemic way. >> last thursday, a chemical leaked into a river polluting the water supply. the national guard is testing samples, but it could be days before everyone gets the okay. a huge three-alarm fire lit up the night sky in northern massachusetts on monday. it engulfed a paper myself and september dark smoke into the
