roswell, there's a possible third child, completely unconfi unconfirmed. as of right now i'm waiting to hear from the police and get information on the specific injuries. >> what do we know about the circumstances surrounding the shooting and was that suspect who was taken into custody, was that person a student? >> actually i am not sure yet, i don't believe so. as of right now there's very little information. i've gotten to the scene and it's one of those chaotic scenes where parents -- panicked parents are trying to show up. they are not allowed to get -- you have to show their identity to get their kids. and the cops are surrounding the area. it's on lockdown right now to ensure it doesn't spread panic anywhere else. this is kind of new for roswell, we're not used to things like this. >> how large of a school are we talking about on lockdown there?

>> i'm sorry, what. >> how large is a school we're talking about here? >> not very big by city standards, probably about 400 kids. >> okay. amy voglesang, you're on the ground there, do keep us up to date and let us know what's happening. >> i definitely well, thanks. >> here's the other big political story. in a few hours governor chris christie will appear before the new jersey legislature to deliver his annual state of the state address. despite the bold new education reforms he's expected to outline, that is certainly not what's going to be on the minds of most people watching or likely on the mind of the governor himself. instead, this is the headline that continues to dominate the conversation. two new jersey legislative panels to probe christie bridge scandal. the latest and most significant news being that the newly formed investigative committees are expected to hand out further subpoenas this week.

christie is also dealing with headlines like this one. federal auditors probe use of disaster funds for new jersey ad campaign that featured christie. this story is focused on a $25 million tourism campaign including ads featuring the governor and his family. ads that critics say cost $2 million more than a production offer from the next highest bidder. >> i don't think there's any question that this was an effort to promote him. but the problem is it was at the expense of money from the taxpayers that could have been used for other sandy purposes. >> the christie administration denies any wrong doing saying that the ads were quote, a key part in helping new jersey get back on its feet. local columnist bong ingle co-authored the book "chris christie" the inside of his rise to power. let's start with the state of the state address. we know the governor will talk

about the scandal. what do you expect he's going to say? >> i think that he will say something up front about the recent news and how he's not going to let that get in the way of his agenda or education reform. he also will be talking about tax initiatives in making streets safer. i think he will mention it but i don't think he's going to take up a lot of time with it. >> jersey city mayor has now come forward saying that he had a strong relationship with the governor's administration but that relationship completely disappeared when he decided not to endorse christie for governor as the "new york times" reports, throughout his four years as governor and particularly in his re-election campaign last year, mr. christie has worked his powers of government as an arm of his political operation rewarding favors to those who rewarded his political ambitions and punishing those who got in his way.

>> do we expect more stories like this from other mayors around the garden state to continue to pop up over the next few days? >> i think we expect more stories like this. as people go back thinking about things and about what may have happened back in the summer, they may think, that could have been the reason for that. maybe it was, maybe it wasn't. but the story has legs. it's going to be with us for a while. >> in a press conference on thursday, christie portrayed himself as not a bully or micromanager. again, you literally wrote the book on the guy. how accurate of an assessment of himself was that? >> he certainly delegates and he does dell gate. the thing about him, i have never known him not to be on top of what was going on in his office. he also likes to be informed but that would be up to the people who work for him to keep him informed. as of yet we don't have anything other than what he told us about

what he knew. that we may find out in the next few days or weeks. >> really quickly, let's get to this other investigation the governor is facing the audit of the $25 million in federal relief money, the asbury park press release reporting that christie's administration is hiding details about that money. what more can you tell us about that investigation and what they have found? >> that is one of our papers and my colleague bob gordon is the one who did the story. we asked for bids having to do with what was going to handle the campaign. state dragged its feet. we're supposed to get it in 7 business days. we asked for them in august and we got them in december. we're going through all of that. what we found out is that the organization, the agency, that got it actually charged more and is politically connected and makes contributions to political candidates, that sort of thing. the losing campaign does not.

that the top of what we found out so far. >> bob ingle, i'm sure we'll talk to you again soon. thank you very much. let's get straight to the power panel. alice stewart and jimmy williams and senior white house reporter carrie brown. the speech will happen at 3:00, the state of the state, we're hearing that he's going to spend sometime at least talking about the bridge scandal. obviously it's not going to be the bulk of that speech, probably just a nod. should we see a different tone than we saw in that marathon on thursday press conference, carrie? >> it's quite possible. i think that chris christie sort of put himself out there in terms of taking all of the hits and taking the questions and going through it. that was really his one shot to be reflective and just let the media have at him. at a certain point we may see this today with the speeches

he's going to perhaps turn more defiant and say i'm not going to let this get in the way of doing my job. i spent almost two hours answering questions. i'm happy to participate in any kind of investigation but i'm not going to be hamstrung by this. i imagine that's the tone we'll see from christie going forward. that seems to fit with his personality, which doesn't seem to back down from things. >> jimmy, we're hearing he's going to talk about education, specifically calling to extend the school day in new jersey and also apparently going to talk about lowering property taxes in the garden state. is he going to be able to still achieve this or is the speech going to be entirely overshadowed by the bridge scandal, by the other scandal that's starting to brew as well with regard to the tourism money? >> well, i think to be brutally honest, i think he can get things through his state legislature. it's simply a matter of how much more stuff will come out with regard to the scandal. you've got a federal

investigation. you have multiple state legislative committees that are going to be investigating this. if more turns up and if more heads fall within his office, i.e. staff, that's going to debill tate his legislative agenda to a degree. but don't think for a second that chris christie is not going to reach out to democrats. he's got a posse of democrats in the state senate and house that he's been working with for four years. >> are they still on his side, jimmy? this bipartisan posse that you speak of, are they still backing him? >> well, i think they'll back him until they don't have to. the bottom line, they'll be reup for re-election as well. if it looks like -- the last thing the new jersey house and senate want to do is have a 9% approval rate. they want to produce legislation to get things done. new jersey voters will not tolerate having that stalemate trend, they won't allow it. >> alice, here's the thing, we're talking about it, folks writing about it. but in terms of its popularity

in new jersey, according to a recent poll, it has not taken much of a hit. his approval rating hovers around 60%, that's despite the fact according to this asbury park press poll, 80% said they believe more members of christie's administration will be implicated. how do you reconcile those numbers? 80% of the folks saying we think there's going to be more dirt dished but we still like the guy? >> given the fact that how he won his re-election by a landslide in a state that typically wouldn't have that for a republican goes to show you he is a popular guy and able to work across the aisle. the fact he took quick and decisive action, apologizing and holding people accountable, and heads did roll, they believe if there is anyone else responsible they will be shown the door. he is holding people accountable. we're not seeing the same type

of holding people accountable for problems we see in washington, d.c. but that's what the people of new jersey appreciate at least to this point -- >> alice, what did you mean by that last comment there? >> well, obviously, if you want to look at comparisons between what's happened here and this quote, scandal with what we had with benghazi -- >> why quote -- are you saying this is not a legitimate scandal? >> i'm saying that there's certainly cause for concern given that one person or a small handful of people certainly did call for these lane closures but no one died in the situation. we have benghazi and irs and nsa -- president obama is promoting people -- there hasn't been anyone held bltable in major scandal going on in washington, d.c. >> jimmy williams, 20 seconds, i'll end with you. >> staffers from chris

20 weeks. reproductive action right league, who decides the status of reproductive rights report just came out a few minutes ago and gives america an overall grade of d. let's start there, elise, what's happening in this country according to your findings? >> what we're seeing is a political trajectory, particularly at the states that's just completely out of whack with the american -- where the american people are. we live in an overwhelming pro-choice country, 70% of americans actually believe that roe was the right decision for america and that they support women's reproductive freedom. yet increasingly we're seeing an uptick in statehouses passing regressive laws that restrict women's right to choose, makes it harder on them. and it's -- we're going to see a

tide churning and we're already seeing the tide turning because it's too far outside of the mainstream of where america is. >> what's behind this uptick you just mentioned? >> you know, it's really interesting. i think a lot of it is that we're seeing statehouses actually having been seized by tea party extremists who are sort of obsessed with the idea that women's reproductive freedom needs to be taken back to the 1960s. and what we're seeing is that when that's put to the test, when they are forced to own the decisions they are making legislatively, they lose at the ballot box. we saw that in the virginia governor's election, which is really important when we have 36 governors up for election in 2014. we certainly saw it in albuquerque where they resoundly defeated an abortion ban. >> not taken up a case since 2007, i believe. is that a good thing or bad thing for your organization as

far as its concerned? >> you know what, we think the law as it stands is critically important to protect women and doctors. it is not such distant history where we have seen doctors killed in the case of dr. tiller in kansas in the pews of his church. the anti-choice movement has a very long history of extreme violence and harassment towards women. and this buffer zone has been critically important to keeping women and doctors safe. so we seriously hope that the court is going to decide in favor of women and doctors and not with the anti-choice extremist on this one. >> elise hoague, thank you so much. >> cruise ship safety. a new report exposes why many crimes at sea go unreported to the public. plus the new wrinkle in the disappearance of madeleine mccann. and drop offs begins with arthritis pain... and a choice.

when it comes to crimes against passengers ats sea, a new report says the public is not getting the full story. kerry sanders is at the port of miami this afternoon. >> reporter: if i were attacked stabbedi standing on land this would be in the fbi crime reports, but if i was attacked on a ship at sea, that assault may know show up in the fbi statistics for years. a just released gao report says that's what makes it difficult for passengers to understand the crime rate on high seas. two years on the carnival cruise ship victory, janet powers was assaulted by another passenger. >> a man came and grabbed me by the hair and beat my head against the wall until i became unconscious. >> reporter: because it was on international waters fbi agents investigated. there are seven other categories

of cruise ship crime under the bureau's jurisdiction. while almost 11 million americans cruise each year, the government accountability office investigation revealed 78% of the crimes examined by the fbi were never listed in govern crime reports. the gao disclosed there were 287 alleged crimes ats sea in a four-year period, yet only 81 were publicly acknowledged. why the discrepancy? a 2010 law passed after the fatal costa concordia accident clearly says the only cases that will be reported are those the fbi closes. it was a law supported by the cruise ship industry. >> they take advantage of their situation and control the turf and gang. they are all of the umpires. >> the association that represents the industry issued a statement that says in part, cruising is one of the most enjoyable affordable and safe holiday vacation experiences

available today. but it's the safety claim that they question and public crime statistics have little value. >> i don't even look at the report anymore, because clearly it's inaccurate, misleading and it's not -- there's no transparency to it. >> reporter: janet powers has cruised against since that incident but she's more cautious. >> safeguards aren't there. there's no law enforcement at all, the security guards on the cruise ship are not policemen. we're not anti-cruise, we just want to make it safe for everyone. >> in janet's case, carnival says the system worked as it was supposed to. the fbi investigated and the fbi told her that there was not enough evidence to prosecute, meantime, in an effort to be more transparent last year, the cruise lines began voluntarily reporting all of their own crime statistics and the gao report notes that the cruise industry

meta data program, that we can use a month traditional approach of going to the telephone companies when we have reasons to believe a number is connected with a terrorist plot. similarly i think he'll layout steps to bolster confidence both at home and around the world that the eavesdropping we're doing is focused on the bad guys, the people that mean to do us harm. those involved in terrorist plots and there is no desire nor intent to gather the communications of innocent people. so i want to hear him layout the case of how we're going to build that confidence. very important for the cooperation we need around the world as well as important for our industries to maintain their position of leadership in a technology world. >> let's dive into your telephone metadata reform act as you have dubbed it. very sexy title there, by the way. >> yes. >> it specifically removes call records from the types of information that the government can obtain under section 215 of the patriot act. explain how this is going to, a, how it's going to change the

system that we have now, and, b, prevent future controversies like the one exposed -- like the ones exposed by mr. snowden? >> the current practices for the government to apply the fisa court and get all of this domestic call records in bulk. mind you, it's not the content of the calls but the numbers connected to other numbers, what number has been calling other number, rather than do that we would go to more traditional model when we had return to believe that a particular number was connected with a plot, we would go to providers and say, give us the numbers that these number have been in touch with. i think tech logically i think we can reduce the response times. the biggest argument made by the intelligence community by gathering the bulk data is to do it more quickly. i think we can get the response times down very short. >> congressman, you know that phone companies have said they are against this. what makes you think you're

going to be able to change their minds? >> this is certainly an image problem for the phone companies. they would rather not be involved at all. but the reality is they maintain these records anyway, they need to bill customers and need them for disputes. fcc requires them to keep records for a year and a half. they are already doing it. they could carry those records in a form that would make it more easily useable in a terrorism investigation, that's something we should ask them to do. but it's not something they are going to volunteer to do, but nonetheless i think they can be persuaded. >> before i let you go, i want to talk about the budget, house negotiators struck this trillion dollar deal to finance the government through september. among other things, it takes $25 million away from wall street regulators who are essentially supposed to be protecting the little guy from big banks. as a democrat how can you accept a concession like that one? >> it's hard. it's a bitter pill. on the other hand there are a

lot of things i can accept and do like in the bill. the restoration of funding forehead start and early head start, for example, so democrats got a lot of their priorities and republicans that wanted to water down or render that new cf d.c. ineffective, they got part of what they wanted and that's the nature of any big compromise. but what we all got is the avoidance of another shutdown, the avoidance of autopilot financing where we don't get to prioritize changing needs for the country. so on some, i think it's a victory and congress with very few it can claim. >> congressman adam schiff, thank you. >> two panels will investigate the september lane closures on the george washington bridge. >> our concern is that there was apparently a very massive abusive power and attempt to conceal that abuse of power. >> loyal team player, not rogue operative. >> this is the way the

administration does business, you're with them or you're not. >> so few republicans came to his defense. you talk about an acid test. >> there's something here that does not connect fully. >> for more on the chris christie bridge scandal joining me now from trenton, new jersey, michael isikoff. good day to you. let's start with these investigations, tell me about the two simultaneous investigations that the state legislature is conducting. and anymore subpoenas forthcoming? >> reporter: exactly, we've got the formation of a super committee by the general assembly that's going to be chaired by john wisniewski been heading the investigation so far. its scope has been broadened to include what -- to go right into the governor's office and what did the govern's people know and when did they know it. my understanding is when the new legislature is formally sworn in

on thursday, there will be new subpoenas coming and that could -- we would have subpoenas and first two will be bridget kelly, the former deputy chief of staff who got fired who sent that e-mail that sort of started the whole thing, time for some traffic problems in ft. lee. and also, bill stepien, the campaign manager. so two top christie aides who will be subpoenaed on thursday. separately the state senate has its own investigation going and we know the u.s. attorney in newark, paul fishman is reviewing to see whether any federal laws have been broken. multiple investigations right now. >> what do the people at the center of this controversy, david wildstein who went to school with christie and served at the port authority until his resignation and pleaded the fifth on the same day of the marathon news conference. this is how governor christie described their relationship at the news conference.

>> i have had no contact with david wildstein in a long time. a long time, well before the election. >> michael, you've probably seen this by now. the wall street journal today unearthed this picture from september 11th, the third day of the lane closures. it shows christie and center there wearing red tie, that is david wildstein. any explanation at this point? >> reporter: right, well i guess it all depends on the definition of well before the election, that was two months before the election. or less than two months actually. wildstein is the key player so far. he took the fifth amendment last week when he was called to testify. as far as anybody can tell, from the -- based on the testimony from the port authority, it was wildstein who directed these bridge closures. he was the one that ordered them, without even informing the executive director of the port authority. now, all we know is that prior

to his ordering those bridge closures, he had that one e-mail exchange with bridget kelly in the governor's office. so his testimony is crucial to getting to the bottom of what happened here. right now he's taking the fifth. he has indicated that if he gets immunity, he will talk, that could be interpreted in various ways, including that he's got a story to tell that may not be totally supportive of what hash said so far by the governor's office. we just don't know until we hear it. >> and the story goes on. michael isikoff. another congressman is retiring from politics. let's hit the political playground, congressman bill owens, democrat from new york now announced that he is retiring and will not seek a fourth term. he says he wants to undertake new endeavors and spend more time with family. more than a dozen other members of congress have announced their retirement so far in the 113th

congress. some house republicans may not be too happy with senator ted cruz today after he announced his new deputy chief of staff. cruz has hired paul teller, fired last month from the republican study committee, accused of leaking information to outside groups. a wyoming lawmaker is pushing to bring back the firing squad as a means for killing death row inmates. republican state senator bruce burns says if lethal injection is not available, a firing squad is practical because he says building a gas chamber would cost too much and he considers that a crueler method. mitt romney looking like a guy with nothing to lose. there he is letting it all hang out. that was mitt romney gangham style at the conference for young mormons in arizona. you might recognize the moves from the viral video, maybe not.

we want to update you on breaking news, a shooting in a middle school in roswell mm new mexico, four students have been taken to the hospital and two of the students in critical condition. it was a 14-year-old boy who was shot and 13-year-old girl, both of them have been airlifted to a nearby hospital. the other two patients are also minors and being treated in roswell, new mexico, at the eastern new mexico medical center. we've got a crew en route but parents are being told to pick up their students at the nearby mall. the kids were bussed to a nearby mall. the school, we're told at the top of the hour, about 400 students go to berrendo middle school. four kids shot. two of them are in critical condition. middle schoolers, berrendo
