100,000 computers across the world. "the new york times" reports that cohortly planted software allows the u.s. to conduct remote surveillance and create a digital highway for launching cyber attacks, but right now there is no evidence the nsa does this inside the united states. most of the software is implanted by gaining access to computer networks, but the "times" reports the ns sais increasingly using a secret technology that relies on radio waves. the paper adds that they have used it to monitor china's army, the russian military, drug cartels, trade institutions inside the european union, and sometimes u.s. partners against terrorism, like saudi arabia, india and pakistan. the "times" reports the nsa calls the effort an active defense and has been using the technology for several years now. okay, so, to a scary story of a school shooting in new mexico, where two students were shot, including a young boy who is fighting for his life at this

hour. police say a 12-year-old boy opened fire tuesday at berrendo middle school in roswell. he surrendered to school officials, who coaxed him into dropping his gun. right now he's in an albuquerque psychiatric hospital following a judge's order. the 13-year-old girl who was shot is in stable condition. >> i ask that all new mexicoans please join us in praying for the families, praying for the kids, making sure that they reach out and talk to people. >> police have issued three search warrants for the boy's home, his bag and his locker. officials would not speculate on any potential charges at this time. this morning an eighth grade teacher is hailed as a hero for talking the shooter into putting his gun down before he shot anyone else. nearly 1,500 people prayed for the victims at a memorial service. ♪ classes are canceled today. a judge denies bail to a retired police captain accused of fatally shooting a man who was texting during a movie.

71-year-old curtis reeves jr. is charged with second-degree murder. his lawyer said he had every right to defend himself during an argument over texting. now, officials say he fired a single round from a .38-caliber handgun, striking 43-year-old chad oulson in the chest and his wife, nicole, in the hand. reeves says the victim struck him in the face with an unknown object, but there are no reports that the victim or his wife were armed. in new jersey, it was governor chris christie's fourth state of the state address, but his first surrounded in scandal. he talked about the growing bridge scandal, issuing another public apology, and nbc's kelly o'donnell was there. >> reporter: on his way to the assembly chamber, governor chris christie prepared himself for another public display of regret. [ applause ] while tradition welcomes the governor with applause, controversy is where christie began. >> mistakes were clearly made.

we let down the people we're entrusted to serve. i know our citizens deserve better, much better. >> reporter: the unfolding scandal has brought ridicule and withering criticism. christie faced the state lawmakers who have launched investigations. >> without a doubt, we will cooperate with all appropriate inquiries to insure that this breach of trust does not happen again. let me tell you, everybody, i was blindsided yesterday morning. >> reporter: governor christie denied any prior knowledge of an intentional plan to snarl bridge traffic last september, but how close to christie were the people who did know? an examination of hundreds of pages of documents shows at least six people in governor christie's inner circle and three more christie allies at the port authority were actively messaging or mentioned in communications last fall about the traffic jam, but not necessarily what had caused it. four of the key players are now gone. the others are still on the job. >> what has occurred does not

define us or our state. >> reporter: christie's personal credibility has taken a hit. a monmouth university poll asked "do you believe chris christie has been completely honest?" 40% said yes, but 51% said no. >> and that was nbc's kelly o'donnell reporting. now to oklahoma and what could be the next showdown over gay rights. late tuesday, a federal judge struck down the state's voter-approved ban on same-sex marriage, but couples weren't given an all-out victory. the judge refused to immediately enforce the ruling, so instead, appeals are now making their way through the courts. abortion clinic buffer zones, they are on the docket for the supreme court today. challengers say the 35-foot areas will criminalize people who are peacefully protesting. nbc's tracie potts is live in washington with more on this. tracie, the justices will be looking at this as a free speech issue, i assume. >> reporter: right, and it's actually the second time that they've looked at this particular case, betty, but they

rejected it before it came in a different format. this time, the plaintiffs argue that free speech isn't really free if it's restricted such that people really can't even hear what you're saying, the people that you're talking to. on the other hand, those who work at these clinics say that it's a public safety issue, that many of these demonstrators have either been physical with or have intimidated doctors and nurses and other workers and patients, of course, headed into these clinics. massachusetts has a long history with this. that's where that law is coming from. back in 1994, a couple of abortion clinic workers were killed. and now, as of this morning, a few hours from now, the case is being argued here before the u.s. supreme court. betty? >> we'll be watching. tracie, thank you very much for that. we want to shift gears now and go to my friend, richard lui, with the latest in sports. they're heating things up down under, in australia, that is. let's not get that confused. >> that's right.

some stories making news this morning. new information from the christmas shopping carjacking death in new jersey. questions are being raised after 911 calls reveal it took close to 30 minutes for an ambulance to arrive at last month's fatal carjacking outside a short hills

mall. on the 911 recording, the victim's wife said they called for help over half an hour ago. the operator responds, saying the ambulance had arrived at the mall and was trying to locate them. police say the ambulance arrived in 18 minutes but had trouble fitting below the ceiling in the parking garage. four men have been charged with the murder. a multimillion dollar settlement between the nfl and thousands of former players was put on hold tuesday. a federal judge says -- she was very worried that the $765 million deal was not enough to cover the 65-year plan covering some 20,000 men. and a raid of justin bieber's california mansion led to the arrest of live-in friend xavier smith on drug charges. police were at the home searching for evidence that actually could connect bieber to the egging of a next door neighbor's home. $20,000 worth of damage, in fact, has the police calling this a felony. >> i get that the eggs don't seem that significant, but it does rise to the level of a

here's your "first look" at this morning's dish of "scrambled politics." the scandal surrounding governor chris christie apparently aren't hurting his clout with fellow republicans. he heading to florida this weekend to fundraise for governor rick scott. and if you want to hang out the governor, it will cost you 1,000 bucks. but if you want to splurge, the vip reception beforehand is going for $2,500. wendy davis is off to an impressive start trying to become the first democrat elected as governor of texas since 1990. she raised more than $12 million in the last six months of last year. her likely republican opponent, state attorney general greg abbott brought in $11 million. meanwhile, in iowa, 67-year-old governor terry branstad is expected to announce his re-election bid for a sixth term and many expect him to win in a cake walk. today president obama heads to north carolina, where he'll talk up the economy. one person who won't be there is the state's junior senator, kay hagan.

was how to pay for it, then it was how long should we extend it, then there were amendments, then it needed 60 votes to pass. what's next? when does this end? >> well, betty, looks like we're not quite past that partisan bickering that people hoped after they had a big budget deal. that was the good news. the bad news is that they have not agreed on this. as you said, republicans and democrats keep fighting over mainly how to pay for it as well as the length, but this three-month proposal that had some bipartisan support just hasn't gotten enough overall support because republicans are saying we want to have immediate savings in other areas, and democrats are saying we want to put those savings out to the out years, as far along as 2024, and republicans are saying that's just not good enough. so, both sides really want to find out where those savings are. there's still some hope for this, but it's sort of losing steam right now. >> minority leader mitch mcconnell says a proposal is fundamentally unfair, but majority leader harry reid seems to believe republicans are filibustering unemployment benefits. so, any idea who's right here? >> well, i think what the

republicans are concerned, not only about where to find the savings, but also that democrats are leading them down a road so if it doesn't pass, it can be used politically going forward and taking, you know, attention away from the issues that republicans want to hammer home, like obamacare and that kind of thing. i think on the other side, though, democrats and the white house are saying we're going to keep hitting on this because it's so important, not just to the long-term unemployed, but to the overall economy. the president's saying, hey, we have some momentum on the economy, not enough. taking out, you know, $25 billion this year in potential, you know, spending from this group of people would be a problem for not just them but for the overall economy and most americans. >> but david, is there a real fear that all of this partisan bickering has really all but killed the prospects of reviving jobless aid for now? >> i think so. there's a little hope. i think they're going to come back, you know, in a couple weeks to talk a little bit more about this and there's still some people working on it. i think there's a hope that when the president's out talking about this -- he'll talk about it probably during his state of
